About this file
This document is a Request for Information (RFI) responses file for the Military Ocean Terminal Concord (MOTCO) Berms Construction and Dredging Project (Solicitation Number W912P725BA013). The project involves dredging MOTCO Wharves 2 and 3 to -35 feet (MLLW) plus 1-foot of over-depth, MEC screening of dredged material to 3 inches, MEC clearing of detention basins, constructing new berms, installing reinforced polyethylene liners in detention basin cells 1 and 2, and discharging effluent water to the local wastewater system. The bid due date is 24 July 2025 at 01:00 PM PDT, with a public bid opening on 24 July 2025 at 02:00 PM PDT. The estimated cost range is between $10,000,000 - $25,000,000, and the project has a 146-day period of performance, with Notice to Proceed (NTP) expected around 19 August 2025.
The RFI responses address various technical, logistical, and procedural questions from potential bidders, including details about site access, MEC clearance, working hours, pipeline routing, water discharge permits, environmental considerations, and specific project requirements. Key clarifications include: MOTCO will own the railroad tracks between Wharves and detention basins, there is no designated hydraulic offloading site, material will be disposed of in detention basin cells 1 and 2, and a biologist is required to map jurisdictional wetlands and monitor specific protected species. The government maintained the liquidated damages clause and will not extend the period of performance, emphasizing the need for contractors to carefully plan their approach to meet the project's tight timeline and specific requirements.

11399198 Section 01 35 26
1.7 Special Qualifications
40-hour HAZWOPER training per OSHA 1910.120(e)(3) and 1926.65(e)(3), is necessary for all workers within the MRS, even for non-intrusive activities such as surveying activities (e.g. quality, biological, archaeological monitors) and general workers per OSHA letter of interpretation 996-03-26-2.
Q: Please confirm that every person working onsite must have 40-hour HAZWOPER training, and that this includes all field management staff.
This breaks down to 3 categories - 1. General site workers, (workers that have repeated daily MEC exposure within the MRS that come into contact with soil, soil handling, or participate in intrusive activities to include surveyors (geo, environmental, land survey)) must receive a minimum of 40 hours of instruction, off-site, and a minimum of three days actual field experience under the direct supervision of a trained experienced supervisor prior to being assigned to perform their duties. - 2. Other site workers (workers within the MRS, but not directly exposed to soil or soil handling equipment (potentially site manager, archeologist, biologist) must receive a minimum of 24 hours of instruction, off-site, and a minimum of one day of actual field experience under the direct supervision of a trained, experienced supervisor. -3. Visitors, or anyone who is not assigned to work at the site, either permanently or temporarily, that comes to the work site for short-term observation are required to have: a. Safety brief from a person knowledgeable of the hazards expected on site and the SOH controls required. b. Escorted by appropriate site personnel.
11399200 Section 01 35 26
1.7 TRAINING REQUIREMENTS FOR HAZARDOUS WASTE OPERATIONS AND
EMERGENCY
RESPONSE SITES
Follow training requirements listed in EM 385-1-1 for Environmental Cleanup and Investigation Project sites and activities specified in 29 CFR
1910.120 or 29 CFR 1926.65 and involve operations where hazardous substances are investigated, removed, contained, incinerated, treated, neutralized, cleaned-up, or in any other manner processed or handled with the goal of making the site safer for people or the environment.
1.7.1 Initial Training Requirements
General site workers must receive a minimum of 40 hours of instruction off the project site and a minimum of three days actual field experience under the direct supervision of a trained experienced supervisor prior to being assigned to perform their duties.
Other site workers must receive a minimum of 24 hours of instruction off the project site, and a minimum of one day of actual field experience under the direct supervision of a trained, experienced supervisor.
Q: Are field management staff, or workers conducting non-intrusive activities such as surveying activities (e.g. quality, biological, archaeological monitors) considered "other site workers."
see Answer to RFI 11399198
11399201 Section 35 20 23
1.3 MATERIAL TO BE REMOVED
Q: Please confirm the material to be removed is considered maintenance material?
Q: Please confirm the dredge areas have been previously dredged to -35'?
Q: When was the last time the current dredge footprints were dredged and did the contractor encounter any MEC/UXO?
The material to be removed is considered new work material but the footprint has been dredged previously to -32 feet at Wharves 2 and 3.
Dredging last occurred in 2008 when a MEC item was found utilizing a cutter head dredge. The divers during the 2024 Large Object Debris Relocation project marked the locations of 5 larger MEC items that remain in the Wharf 2 footprint which do not require removal.
11399421 1. PDF Page 27, 52.211-12 Liquidated Damages-Construction – We respectfully request that the liquidated damages of $2,790/day be removed from the contract.
a. This clause may pose challenges because many potential causes for project delay are outside of the contractor's control, including weather, delays in obtaining permit approvals, shipping lane traffic in Suisun Bay, and availability of materials such as the berm liner. We believe a collaborative approach to managing timelines would be beneficial for both parties, allowing us to address potential delays proactively and adapt to unforeseen circumstances.
b. If the liquidated damages clause is left in the contract, it might discourage some qualified contractors from participating, potentially narrowing the field of competitive proposals.
The Government will not be removing this clause
11399422 PDF Page 27, 52.211-12 Liquidated Damages-Construction - How was the specific amount for liquidated damages calculated?
The liquidated damages were calculated based on the USACE construction management labor costs per day.
11399423 Are CLINs 0002 and 0003 to be paid on a firm fixed price basis (i.e., lump sum per CLIN), or a fixed unit rate basis (i.e., payment by cubic yard)?
CLINs 0002 and 0003 are paid on a Firm Fixed Price CY basis. FAR 52.211-18 Variation in Estimated Quantity and 52.236-16 Quantity Surveys apply to the estimated quantity CLINs.
11399424 If CLINs 0002 and 0003 are to be paid on a fixed unit rate basis (payment by cubic yard) how will the volume be measured?
Volume computations will be generated by using the TIN (Triangulated Irregular Network) computation method, as outlined in the Hydrographic Surveying Manual EM 1110-2-1003, dated November 2013, and the subsequent changes/revisions issued by HQUSACE. A 5-foot by 5-foot matrix using the average depth of all depths recorded in a cell will be generated from the edited multi-beam data to perform the TIN volume computations, following the procedures in EM 1110-2-1003.
11399425 The pricing schedule gives dredge quantities to the design depth of -35' MLLW plus 1' of over depth. Will the government please break out the dredge volumes separately for a.) volume to design depth, and b.) volume to 1' over depth?
The government will not break up the dredge volumes separately for a) volume to design depth and b) volume to 1 ft over depth in the pricing schedule.
11399426 While the dredging is being conducted, if the actual volume is projected to be above the volumes specified in the bid schedule, what is the government's expectation for response? Will the government issue change orders to the contract prior to the overage volume being dredged, or should the contractor assume demobilization after the government-specified volumes have been removed?
If the actual volumes vary less than 15% of the bid volumes, then the volume increase will be handled in accordance with FAR clause 51.211-18 "Variation in Estimated Quantity". If the actual volumes vary more than 15% of the bid volumes, then the volume increase will be handled in accordance with FAR clause 52.243-4 "Changes"
11399427 Have there been any additional sediment sampling efforts performed since the 2019 event by DR Reed and Associates that is mentioned in the Water Board permit? If so, please provide them.
The latest sediment sampling and testing was performed in 2019 by DR Reed and Associates. There has been no additional sediment sampling and testing performed since 2019.
11399428 Section 01 57 19 paragraph 3.6.11 states that during construction of the detention basins, "If pickleweed is cut, care will be taken to not disturb the root base of the plant as much as feasible to allow it to re-establish once construction is completed." Please confirm that this is correct. For other projects at MOTCO, the Contractor would be required to move any pickleweed that would be impacted by ground disturbing activities.
The statement in Section 01 57 19 3.6.11 is correct.
There is not a requirement to relocate Pickleweed for this project.
11399429 Section 01 57 19, subsection 1.10.2.3 states "Ensure the Traffic Control Plan includes recreational traffic such as bicycles and pedestrians." Figure G-003 shows that the haul route is only on MOTCO, which will have no recreational traffic or pedestrians. Is the Traffic Control Plan required to include off-base areas?
A traffic control plan is required but it does not need to include recreational traffic that includes bicycles and pedestrians.
Amendment 0002 deleted "Ensure the Traffic Control Plan includes recreational traffic such as bicycles and pedestrians." from Section 01 57 19, subsection 1.10.2.3
11399430 Has USACE already obtained any necessary permits, conditions, and approvals for the dredging effort beyond the Regional Water Board permit included in the package (BCDC, CDFW, etc.), or will this task be part of the contractor's responsibility?
The permissions USACE will be providing are the Water Board 401 Certification, the BCDC Consistency Concurrence and USFWS and NMFS Biological Opinions. These will be obtained prior to award.
11399431 For effluent water from this project that may be discharged to the local wastewater system in accordance with the Delta Diablo Special Discharge Permit, will permit modifications be required? If so, what are the modification requirements?
The contractor shall apply and obtain a special discharge permit from the Delta Diablo Sanitation District in order to discharge the effluent water to the local wastewater system. The special discharge permit application form is attached at the end of the specifications package. This is not a modification to a permit.
11399432 What is the maximum amount of water allowed to be discharged per day from this project to the local wastewater system?
Water can be discharged at a rate of 72,000/day or 50 gallons/minute. If additional daily capacity is required, the contractor may contact Delta Diablo.
11399433 For MEC clearance at the detention basin and borrow area, what is the failure criterion (i.e., what is the smallest object that must be detected and removed)?
The smallest munition of concern is 20mm Projectile, Mark I High Energy Incendiary
11399434 For the wastewater permit, the specification package is contradictory, as follows:
a. Section 01 57 19, subsection 1.10.11.c states, "If discharge into the MOTCO sewer system is necessary the Contractor must complete and submit the attached Delta Diablo SPECIAL DISCHARGE PERMIT (SDP) APPLICATION BAY POINT and play the applicable fee."
b. Attachments to Section 01 57 19.01 43 (i.e., the 401 permit) state, "If the tested decant water meets the conditions of the Permittee's existing Industrial Wastewater Discharge Permit from Delta Diablo Sanitation District, the decant water will be discharged into the sanitary sewer."
If there is an "existing Industrial Wastewater Discharge Permit," why does the contractor need to prepare a special discharge permit?
If there is an "existing Industrial Wastewater Discharge Permit", please provide a copy of the permit.
There is an existing Industrial Wastewater Discharge permit held by Delta Diablo District (DDSD_MOTCO_Wastewater_Permit_018117-S_Sept2023- April2027.pdf). In order to utilize this permit, the contractor must apply for a special discharge permit from Delta Diablo District.
11399435 PDF page 535, Section A, Project Description, states, "As the slurry is being pumped into the Management Site, it will be screened further to 20 mm for UXO and munitions." We believe this text should read, "As the slurry is being pumped into the Management Site, it will be screened to 3 inches for UXO and munitions." Please confirm.
Correct. The specifications have been modified to state 3 inches. See Amendment 0002

11409348 While an EA appears to be available for this project, that EA (https://ceqanet.lci.ca.gov/2021060547) appears to cover a different version of this project. Has a NEPA assessment been performed for the version of this project that is in the Specifications? If so, can copies of the CATEX/EIS/EA be shared to see the former and current availability and impact of the salt marsh harvest mouse (SMHM)? If not, will it be done? If it will be done, will it be performed by the government or the contractor?
If it will be performed by the government, please specify a delivery date to the contractor.
The Draft EA is available online at https://www.sddc.army.mil/Shared%20Documents/Public_Draft_%20MOTC O%20Dredging%20EA_25APR2025.pdf. The FONSI is scheduled prior to award.
