AMENDMENT PARTICULARS

CONTRACTOR INQUIRIES

By this Amendment 0004, the Chicago District, USACE provides its responses to contractor inquiries, continued from Amendment 0003:

Q31. Per the Prime contractor on PH1 of this project and per my site visit, they will not be complete before mid-summer of 2021 and utilizing the entire staging area they built. How is the PH2 work to start in spring of 2021 if that is the case?

USACE Answer to 31: The potential bidder shall refer to the commencement clause, wherein stating a 2-part notice to proceed (NTP), the second to be issued sometime between mid-Spring 2021 and 31 December 2021. Accordingly, in consideration of the clause provisions, the start of physical work and/or staging area concerns are non-issues for this contract. Provided below is the full text of the relevant clause:

“52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to commence work under this contract within 10 calendar days following its acknowledgement of the first Notice to Proceed letter and execute the work as stipulated in the following paragraph.

Upon the Contractor’s acknowledgement of the second Notice to Proceed letter, the Contractor shall be required to proceed with the entire contract work, prosecute the work diligently, and complete the entire work ready for use not later than 30 November 2023, which shall include final cleanup of the premises.

“The Contractor will be issued two separate Notice to Proceed Letters for this project.

“a. Notice to Proceed Letter #1 will be issued following the government’s approval of the Contractor’s Bonds and Insurance. Under this particular Notice, the Contractor will be authorized to initiate work that is considered to be administrative in nature, e.g., this Notice will not authorize any onsite PHYSICAL work.

“b. Notice to Proceed Letter #2 is anticipated for issuance by mid-Spring 2021 and at the latest 31 December 2021.

By way of the second Notice to Proceed Letter, the Contractor will be authorized to perform the entire work of the contract, prosecute the work diligently, and complete the entire work ready for use not later than 30 November 2023, which considers the award of the contract by 30 September 2020. The time stated for completion shall include final cleanup of the premises.

“(End of Clause)”

Q32. Per the Prime contractor on PH1 of this project and per my site visit, it is obvious that they have invested +- $100,000 in creating a large/stabilized staging area. The Prime on PH1 indicated this staging area will be removed when they demobilize from the site in mid-summer of 2021. Can the government pay the Prime contractor of PH1 to keep the large stabilized staging area in place? If not, this will require the government to essentially pay twice or +$200,000 to stabilize the same large staging area used for both phases of work.

USACE Answer to 32: The specifications at in Section 01 10 10 cover the staging area. For this phase II contract, the prime contractor may not require the same size area.

Q33. The answer for Q27 on Amendment 3 is incorrect. We are the contractor that installed the improvements to the laydown area for PH1, and we will be taking it out and restoring the site to preconstruction condition (grass/topsoil) in mid-summer (pending actual completion date). Please advise.

USACE Answer to 33: The response to question 27 should be this: “The Phase 1 laydown area will be restored and vacated by the Phase 1 Contractor prior to the construction of the Phase 2 Work.”
