SECTION 00 21 00 - INSTRUCTIONS

The following have been added by full text:

QUESTION AND ANSWERS

K25 Observation Building - Questions and Answers Q. Per Section 1.8 (page 4 of the released solicitation), this project appears to require the use of a project labor agreement (PLA). USACE should not mandate use of a PLA on this project. Any government mandate or prohibit ion of contractors' use of PLAs may be unduly restrictive of competition. In the Government's commitment to free and open competition for publicly funded work, the lawful labor relation s policies and practice s of private construction contractors should not be a factor in a Government agency's selection process. Neither a public project owner nor its representative should compel any firm to change its lawful labor policies or practice s to compete for or perform public work, as PLAs effectively do. This government mandate for PLAs can restrain competition, drive up costs, cause delays, and lead to jobsite disputes. If a PLA would benefit the construction of a particular project, the contractors otherwise qualified to perform the work would be the first to recognize that fact, and they would be the most qualified to negotiate such an agreement. Please refrain and reconsider imposing any PLA mandates on any contractors and defer to the contractor’s judgment as to whether a PLA is appropriate for a given project. This requirement is below the $35M threshold for mandator y PLAs and, as such, we request that the PLA requirement be removed from this solicitation.

A. PLA is not waived for this project. Executed PLA Agreement is required prior to award.

Q. With respect to the liquidated damage clause, does the stated project duration take into consideration issues with material procurement given the current state of the supply chain and long lead times that the industry is experiencing?

A. There is time allotted for material procurement in the PoP duration. The contractor should bid the job to complete all scope within the specified contract duration.

Q. What are the wage rates and benefits to be based on, Davis Bacon or the current CLA agreement associated with the Oak Ridge Reservation (ORO)? Wage rates need to be known prior to providing a bid. Who does the PLA have to be executed with, Knoxville Construction Building Trades Council.

A. The required wage rates are included with the solicitation. Yes, the PLA agreement will be executed with the Knoxville Construction Building Trades Council.

Q. Are any permits from the City of Oak Ridge required for this project?

A. Yes, the Contractor shall obtain construction permits from the City of Oak Ridge.

Q. Does all waste including construction debris go to the Y12 landfill site?

A. Soil generated from excavation activities suitable for use as backfill or contouring fill can be spread in/around the Viewing Platform construction site. Spoil materials not suitable for use as backfill or contouring fill as well as debris from excavations will be disposed at the Oak Ridge Reservation Landfill at Y-12. All municipal type wastes (new construction materials, packaging materials, office trash, food debris, etc.) shall be commercially disposed off-site by the Contractor

Q. Can you post an amendment detailing the required labor rate (If any).

A. Labor Rates are attached to the solicitation. No additional information will be provided, please bid, or propose as shown.

Q. Are any badges required for access to ETTP and/or access to Y-12 Landfill? Is GET training required as the site is on D.O.E. property?

A. Badges are not required for access to the Viewing Platform construction site at the ETTP or to the Y-12 Landfill.

GET training is not required for the Viewing Platform construction project at ETTP. The Contractor shall follow U.S. Army Corps of Engineers training requirements.

Q. Can you please clarify the intent for All utility tie-ins?

A. The Contractor is responsible for all utility tie-ins, as well as connecting and disconnecting temporary utilities.

ETTP is not an operating plant with formal "plant systems" any longer. Any outages required for connections/disconnections must be coordinated with the utility owner – City of Oak Ridge Electrical District for electricity; Oak Ridge Utility District for natural gas; City of Oak Ridge Public Works for water and sewer; and UCOR for storm drain. Drawing H765 was revised to assign responsibility for underground run of power (from new end-of-line pole to be installed by CORED) from UCOR to Contractor.

Q. Does the Gov. provide RADCON radiation survey include existing asphalt, concrete, underground utility piping and/or soils excavated as part of the Viewing Platform Bldg. and Site improvements construction efforts? Will this Gov. provided RADCON support be on a continuous basis while excavation is being performed or only periodically? Also, will the RADCON support also perform radiation surveys of incoming and outgoing equipment?

A. UCOR will provide a Radiological Protection Technician (RPT) to scan excavated material, including asphalt, concrete, underground utility piping and/or soils, for radiological contamination during excavation activities.

Because the work area has previously been remediated and/or determined to meet or exceed public health and safety standards, continuous radiological protection coverage is NOT required. A RPT will scan the area to be excavated prior to the start of work. After the Contractor marks the area to be excavated, the Contractor shall give 24-hr advance notice to allow the area to be surveyed prior to starting excavation. During excavation activities, a RPT will periodically perform spot-check surveys of excavated material and equipment to verify the absence of radiological contamination. Excess dirt or spoils that cannot be used as backfill or contouring fill for construction of the Viewing Platform will be stockpiled on site while UCOR completes the documentation for acceptance of the materials at the Y-12 Landfill. Excavated materials to be disposed at the landfill will generally fall into two categories: spoil materials (soil co-mingled with gravel, rock, asphalt, etc.) containing items less than 2-ft x 2-ft in size) and construction/demolition waste (excavated larger items sized to be less than 8 feet in length). Subsurface items/debris (concrete, utility lines, etc.) that are excavated shall be set aside by the Contractor to allow access to the items for surveying, surveyed by an RPT, and released by Radiological Protection prior to disposal at the Y-12 Landfill. The Radiation Contamination sign referred to is a boundary posting for a remediation project to the north of the Viewing Platform construction area and does not apply to the Viewing Platform area. These signs will be moved north to the entrance of the remediation project area. An RPT will perform radiological surveys of incoming and outgoing equipment used for excavation purposes only. Radiological surveys of other equipment such as forklifts, dump trucks, delivery trucks, etc., are not required.

Q. Is it the Govt intent for the contractor to prepare the site specific SWPPP and submit to the state along with application fees as stated in the project specifications?

A. The UCOR SWPPP is provided as a reference for the contractor to assist them in preparing their SWPPP and submitting to the state for permit.

Q. Will the Gov. provide radiological surveys and green tags for these efforts?

A. The Government will provide radiological surveys and green tags if they are required. However, the only excess material and equipment that require radiological survey before removal from the facility are excavated materials to be shipped to the Y-12 Landfill for disposal.

Q. Can you please provide the DOE K-25 sites MS4 permit?

A. There is no MS4 permit at the DOE K-25 Site. The contractor will need to comply with the SWPPP which the Contractor will submit to TDEC with the NOI for coverage under the Construction General Permit.

Q. Who will perform the building inspections; USACE or the TN local government inspectors?

A. USACE will perform contract compliance inspections and the TN local government will perform occupancy compliance inspections.

Q. Is a state of TN General Contractor license required, or is a GC license from another state acceptable since this is a Federal project?

A. There is no requirement or mention of a General Contractor permit in this solicitation. No additional information will be provided, please bid, or propose as shown.

Q. Will the sign-in sheet from the site visit be posted?

A. This will be addressed via Amendment

Q. Is there a specified HVAC control or BAS system for the building?

A. No BAS system; controls to be local.

Q. Are there data/comm, low voltage, sitework, and demolition specifications for the project?

A. Please see Specification Section SECTION 00 01 10 Site Improvement specifications.

Q. Regarding specification section 083613 Sectional Doors, please indicate the warranty period and requirements for 1.7-A. Special General Warranty?

A. See Specification section 083613 Sectional Doors. Paragraph 1.7-A was appended with the following sentence:

Special General Warranty is provided by the General Contractor and is for a period of one year following date of Substantial Completion.

Q. Specification section 083613 Sectional Doors paragraph 1.7 B.2 indicates a warranty of 5-years from substantial completion for the manufacturer’s warranty. Our sectional door subcontractor has indicated that there isn’t a manufacturer that can meet this duration. Is this an acceptable alternative?

A. See Specification section 083613 Sectional Doors. Paragraph 1.7 B.2 was revised to specify a Warranty period of 2 years from date of Substantial Completion.

Q. Specification section 083613 Sectional Doors paragraph 1.7 C. indicates a 10-year Finish Warranty. Our sectional door subcontractor has indicated that there isn’t a manufacturer that can meet this duration. Is there an acceptable alternative?

A. See Specification section 083613 Sectional Doors. Paragraph 1.7 C was revised to specify a Warranty period of 3 years from date of Substantial Completion.

Q. Specification section 083613 Sectional Doors paragraph 2.3 C. & D. The product specified will not meet these requirements. The .149 U value, 7 R- value cannot be met with this type of product. In order meet these requirements the Glass sections would have to be eliminated and different door specified. We have attached product data for Overhead Door Series 596 which we believe would be a good example of a product that could meet these requirements. Is this an acceptable alternative?

A. An R-Value of 4.1 which is available with the Overhead Door aluminum and glass door, model 521, is acceptable in lieu of the R-7 and U-.149 stated in the specification. See Specification section 083613 Sectional Doors.

Paragraph 2.3. D was revised to specify a U-Value of 0.24 Btu/sq. ft. x h x deg F (same as R- 4.1).

Q. Specification section 083613 Sectional Doors paragraph 2.3 F. 3. Slotted vertical track has been discontinued from all manufacturers. Please advise on an acceptable alternative?

A. See Specifications section 083613 Sectional Doors. Paragraph 2.3 F.3, was revised to delete the slotted vertical track and now reads: Track Reinforcement and Supports: Provide galvanized- steel members to support track without sag, sway, and vibration during opening and closing of doors.

Q. Specification section 083613 Sectional Doors paragraph 2.3 I.1. & 2. Our sectional door supplier has indicated that both of these locking systems cannot be installed together. Please indicate which lock shall be required?

A. See Specification section 083613 Sectional Doors. Paragraph 2.3 I.1 was deleted, leaving the assembly identified in 2.3 I.2 as the only locking device.

Q. Specification section 083613 Sectional Doors paragraph 2.3 L 1. A. indicates clear anodized finish however, page -H697 (Exterior Elevations) shows a note that the door is to be painted Type 1. Is it preferred that this element be powder coated to match paint Type 1?

A. Regarding specification section 083613 Sectional Doors, paragraph 2.3. L. 1.a., the finish of the aluminum door is to be the manufacturer's standard clear anodized finish, as stated. This matches the clear anodized finish on the aluminum storefront and entrances. The note on H697 directing the overhead door to be painted was deleted. This same change to an anodized finish required a change to Sheet H706, Door Details, where the door finish is called out as clean anodized aluminum and the trim is called out as break metal rather than paint. On Sheet H709, Door Types, the overhead door, Z101, was changed to aluminum and glass with clear anodized finish and a thickness of 1 3/4".

Q. In regard to material RB-2 (096513-2), there is a minimum order requirement on this material which is well in excess of what the project requires. Would it be acceptable for the RB-2 material to be 6” versus 8”?

A. See Specification section 096513 Resilient Base and Accessories. Paragraph 2.1 B 3.b, was revised to read: RB- 2: 6 inches. The Finish Legend on H711 was revised similarly.

Q. Is there a certain percentage that the prime (small business) must perform to meet project requirements?

A. Yes, Prime Contractor will self-perform at least 15% according to FAR 52.219-14, LIMITATIONS ON

SUBCONTRACTING.

Q. Note on sheet C1E-700NHP-H744 reads “Loop Road From Avenue “M” Ref. Sheet H751” however, we cannot locate this page. Please provide this drawing sheet.

A. Drawing H751 is exclusively for Phase II of the project. The referenced note is west of and outside the Phase I boundary. Neither the drawing nor the note is relevant to this project.

Q. To the east side of the sheet H744 the project limits appear to extend beyond the sheet. Please confirm no work is needed in this location.

A. The overall NHP project limits (Phase I + Phase II) extend to Avenue J (Meritus Avenue), but the limits for the VP Building construction project are defined by the Phase I boundary line that is about 50 feet east of the east wall of the Viewing Platform Building.

Q. Is the contract only to consist of Phase I?

A. Yes.

Q. Please confirm that radiation is not anticipated to be present in this project scope. Additionally confirm the contractor is not to carry pricing for RADCON or other similar abatement.

A. The work area has previously been remediated and/or determined to meet or exceed public health and safety standards. No radiological contamination is anticipated to be present in this project scope. The contractor is not to carry pricing for RADCON or other similar abatement. UCOR will provide a Radiological Protection Technician (RPT) to scan excavated material, including asphalt, concrete, underground utility piping and/or soils, for radiological contamination at no cost to the contractor. During excavation activities, a RPT will periodically perform spot-check surveys of excavated material and equipment to verify the absence of radiological contamination.

Continuous RADCON support is not required.

Q. The drawings call out not to insulate the exhaust, exposed supply, and exposed return duct. The specifications call for insulation of the exhaust, supply, fresh air, and return. Please clarify the insulation requirements for the mechanical scope.

A. Exposed ductwork does not require insulation (per Insulation Note on H726) but needs to be paint grip and painted black. Requirements for networking the fire alarm system with the system in the adjacent building were deleted in Specification section 28 31 00 paragraphs 1.1 A, 2.1, and 3.1 B.

Q. Would the government consider extending the proposal due date?

A. Yes amendment to the solicitation has extended proposal due date to 15 Feb 2023.

Q. If we are submitting SF24, is this all that is needed to cover both items (3) and (4) in RFP Section 2.2?

A. A completed SF24 would be sufficient to cover items (3) and (4) in RFP Section 2.2.

Q. Project specifications indicate the requirement for an executed PLA within 21 days of notice of award. To date, we have officially invited over 500 subcontractors to participate in this project and despite an abundance of initial interest, each has indicated an unwillingness or inability to participate with such requirements. Can the requirement for a PLA be waived for this project with demonstration of good faith efforts? Also, does the PLA requirement apply to all trades or specific trades?

A. PLA requirement is not waived for this solicitation. Labor agreement would define specific trades (if any) that could not be supported by the local union hall. Executed PLA Agreement is required for Award.
