5.1.2.3 Accident Prevention Plan / Site Safety and Health Plan / Chronic Beryllium Disease Prevention Program / Radiation Protection Plan

The CONTRACTOR shall utilize the services of a Certified Industrial Hygienist (CIH) with at least ten (10) years experience in the development and/or management and implementation of safety programs for HTRW cleanup, facility D&D or other projects with hazards similar to the Luckey Site, preferably involving beryllium and radionuclides, to develop a site-specific APP/SSHP in accordance with

5-5 requirements located in USACE EM 385-1-1, 15 September 2008, “Safety and Health Requirements Manual” and any specific requirements of this SOW. The APP/SSHP shall be developed and submitted in the format provided in Appendix A of USACE EM 385-1-1 and include all applicable plans using the APP/SSHP Checklist as a guide. The CONTRACTOR shall use the site specific UFGS 01 35 26 (Governmental Safety Requirements) and UFGS 01 35 29.13 (Health, Safety and Emergency Response Procedures for Contaminated Sites), both located in Appendix B of this SOW, to complete the APP/SSHP.

The CONTRACTOR shall complete the APP/SSHP Checklist and submit this as an attachment to the APP/SSHP. The CONTRACTOR shall complete an Activity Hazard Analysis (AHA) per EM 385-1-1, 01.A.13 for each work activity, and submit these as attachments to the APP/SSHP. The CONTRACTOR shall fill out a Monthly Man Hour Report and submit this to the COR by the fifth work day of the following month. The CONTRACTOR will complete an Accident Reporting Form 3394, when needed, and submit this to the KO or COR. The APP/SSHP Checklist, AHA template, Monthly Man Hour Report, Accident Reporting Form 3394, and Crane Certificate of Compliance can all be found in Attachment 5. The CONTRACTOR will submit all other relevant safety plans as attachments to the APP/SSHP (see EM 385-1- 1 Appendix A).

The CONTRACTOR shall utilize the services of a Certified Industrial Hygienist (CIH) with experience in beryllium health and safety to prepare a Luckey Site-Specific Chronic Beryllium Disease Prevention Program (CBDPP) as an attachment to the APP/SSHP. Included in the CBDPP will be a Baseline Inventory and Hazard Assessment (BIHA) of beryllium contamination on site.

The CBDPP will contain all necessary elements to allow the CONTRACTOR to minimize the number of beryllium-exposed staff, including official visitors and visiting specialists (e.g., mechanics, specialty craftsmen for short term duties, etc), minimize the amount of the beryllium exposure, and minimize the duration of the beryllium exposure. The minimum required topics to be addressed in the CONTRACTOR CBDPP are presented in Appendix B. The CONTRACTOR is not limited to these topics but the CBDPP submittal will be a deliverable subject to KO acceptance prior to the Notice to Proceed with any site work.

The BIHA will result in the establishment of anticipated work zone boundaries, including the Exclusion Zone (EZ), Contamination Reduction Zone (CRZ), and Support Zone (SZ). All access points and decontamination areas are to be clearly delineated on the site drawings, which will also indicate where the “potential exposure to beryllium” exists. The CBDPP-required signage will be in place before Notice to Proceed with any site work is granted. PPE requirements, including training for use (donning & doffing), care, and inspection, will be clearly defined for each area and will be based on the potential exposure to beryllium. The SHM will continually assess the potential exposure to beryllium on site and may modify the work zone boundaries based on additional sampling results and changing activity in each work zone. See UFGS 01 35 29.13 Section 1.16 (SITE CONTROL MEASURES) for additional information. The CONTRACTOR must adhere to the USACE Occupational Exposure Limit of 0.2 micrograms per cubic meter (µg/m3) and Action Level of 0.1 µg/m3 as indicated in the attached Beryllium Exposure Standard Variance Letter for Luckey (Appendix B), to ensure employee protection.

Exposure monitoring and air sampling shall be performed by a competent person to evaluate

5-6 effectiveness of prescribed PPE and to evaluate worker exposure to site related contaminants and hazardous substances used in the cleanup process.

Per EM 385-1-1, 15 Sep 08, Section 01.A.17, the Site Safety and Health Officer (SSHO), as a minimum, must have completed the 30-hour OSHA Construction Safety Training, and must be on-site at all times when work is being performed. See UFGS 01 35 26 and UFGS 01 35 29.13 (Appendix B), for additional requirements of the SHM and SSHO.

The CONTRACTOR shall utilize the services of a Certified Health Physicist (CHP) with at least ten (10) years’ experience in radioactive waste handling and disposal operations, to develop a RPP that is commensurate with the scope and extent of the activities, and is sufficient to ensure compliance with the provisions of the applicable standards. The RPP will be signed by the CHP and be an attachment to the APP/SSHP. The CONTRACTOR shall develop a RPP to address the radioactive materials encountered at the project site.

If a crane will be used, the CONTRACTOR is required to comply with requirements of OSHA and EM 385- 1-1, Chapter 16, and complete the Crane Certificate of Compliance. The completed certificate shall be attached to the APP/SSHP as well as posted in the cab of the crane.

ALL Contractor accidents, involving injuries (including First Aid), illnesses or property damage, occurring during the execution of this contract shall be reported to USACE within 4 hours of the contractor becoming aware of its occurrence. Reporting injuries, illness or property damage to the COR may be sufficient. Based upon the severity of the injury, illness or property damage, more detailed reporting (i.e. ENG Form 3394) may be required. More detailed notification will include contractor name; contract title; type of contract; name of activity, installation or location where accident occurred; date and time of accident; names of personnel injured; extent of property damage, if any; extent of injury, if known, and brief description of accident (to include type of construction equipment used, PPE used, etc.). The USACE initial contact shall be made personally (telephone or email messages only are not acceptable) to one of the following:

1. COR - To be determined

2. KO - Jeff Ernest: Office (716) 879-4173; Blackberry (716) 803-5405; Email

Jeffrey.G.Ernest@usace.army.mil

3. Project Manager - Stephen Buechi: Office (716) 879-4287; Email

Stephen.P.Buechi@usace.army.mil

Site work shall not proceed until the APP/SSHP has been submitted to and accepted by USACE.
