(7) Quoters shall provide the following:

(i) A signed copy of the SF 1449 with pricing input in price schedule. A commercial vendor quote may be submitted but is not a substitute for the completed SF 1449. Failure to include the completed SF 1449 will result in your quote not being considered for award.

(ii) To be considered, quoters must submit a formal Letter of Bonding Capacity from an approved surety company listed in the Department of the Treasury Circular 570. The letter must explicitly state that the surety possesses the bonding capacity to provide both Performance and Payment Bonds in an amount equal to 100% of the quoters' total proposed price, should the quote be selected for award.

(b) Period for acceptance of quotes. The quoter agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the solicitation.

(c) Late submissions, modifications, revisions, and withdrawals of quotations.

(1) Quoters are responsible for submitting quotes and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.

(2) Any quote, modification, or revision received after the time specified for receipt of quotes is "late" and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition. However, a late modification of an otherwise successful quote that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

(3) If an emergency or unanticipated event interrupts normal Government processes so that quotes cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(4) Reserved.

(d) Award of Purchase Order.

(1) The Government intends to review quotes and award a firm-fixed-price (FFP) purchase order. The quoter's initial quote should contain the quoter's best terms.

(2) The Government reserves the right to seek clarifications on the contents of the quote if determined necessary by the Contracting Officer.

(3) The Government may reject any or all quotes if such action is in the public interest and waive informalities and minor irregularities in quotes received.

(4) The Government will require the selected quoter to provide written acceptance of the Government's offer by returning a signed SF 1449 purchase order within five (5) calendar days after notice of selection. Upon acceptance, the purchase order will form a binding contract (see RFO 12.201-1(b)(2)). If the selected quoter does not timely accept the purchase order, the Government may withdraw or cancel its offer.

(5) A bid guarantee ("bid bond") WILL NOT be required to accompany your quotation, however, the contractor will be required to provide Payment and Performance Bonds (see Section C-1, par 1).

(e) Debriefings. If a post award debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

(1) The agency's evaluation of the significant weak or deficient factors in the debriefed Offeror's offer.

(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award.

(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.

(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.

Note: This solicitation is a Request for Quotations (RFQ). A quotation is not an offer (see 12.201-1(b), Legal effect of quotations), and this is not a request for proposals. While the debriefing procedures described above are required by statute, the Government may provide a brief explanation to unsuccessful quoters upon request, consistent with RFO Part 12.301(b).

(End of tailored provision)

National Guard Agency Protest Program

NG Agency Protest Program is intended to encourage interested parties to seek resolution of their concerns with the National Guard (NG) as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum.

Contract award or performance is suspended during the protest to the same extent, and within the same time periods as if filed at the GAO. The NG protest decision goal is to resolve protests within 35 calendar days from filing. An agency protest may be filed with either the Contracting Officer or the NG Agency's Protest Decision Authority, but not both, in accordance with NG protest procedures.

To be timely, protests must be filed within the time periods specified in RFO 33.103. To file a protest under the NG Agency Protest Program, the protest must request resolution under that program and be sent to the address below:

52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation 2026-O0038) (Tailored) Jan 2026 hereby reads as follows:

Provision under 52.212-2 is replaced in its entirety as follows and tailored in accordance with 12.205(b):

(a) Evaluation.

(1) The Government will evaluate quotations and issue a firm-fixed-price purchase order to the responsible quoter submitting the lowest-priced quotation that conforms to the solicitation requirements. Price is the only evaluation factor.

(2) To be eligible for consideration, the quoter shall submit:

(i) A signed SF 1449 with complete pricing entered in the solicitation price schedule. The quoter shall acknowledge all solicitation amendments. Failure to submit a signed SF 1449 with complete pricing and acknowledgment of all solicitation amendments may result in non-consideration for award.

(ii) A Letter of Bonding Capacity meeting the requirements of the solicitation from a surety company listed in the Department of the Treasury Circular 570. Failure to submit the required Letter of Bonding Capacity with the quotation may result in non-consideration for award.

(3) Total Evaluated Price. The Government will evaluate the total price quoted for the complete requirement, inclusive of all transportation, delivery, labor, materials, equipment, and other associated costs to the destination stated in the solicitation. The Government will determine price reasonableness using one or more techniques authorized by RFO 12.203(c)(2), including comparison of quotations received, comparison with the Independent Government Estimate, or other appropriate techniques.

(b) Notice of Purchase Order. The purchase order issued in response to a quotation is the Government's offer to purchase the specified products or services on the stated terms and conditions. A binding contract is formed when the supplier accepts the Government's offer, either by written acceptance of the purchase order or by substantial performance. The Contracting Officer will request written acceptance from the apparent successful quoter. See RFO 12.201-1(b).

(c) Responsibility Determination. Before issuing a purchase order, the Contracting Officer must determine that the apparent successful quoter is responsible. If the Contracting Officer identifies an apparent performance risk, including a quoted price that raises a reasonable concern regarding the quoter's ability to perform, the Contracting Officer may request information necessary to make an affirmative responsibility determination. Such information may include information addressing labor, materials, proposed performance approach, financial resources, bonding capacity, and risk mitigation. The Government will use any information requested under this paragraph solely to assess responsibility and not to conduct a price-realism evaluation. Failure to demonstrate the capacity and competence to perform may result in a nonresponsibility determination. If the apparent successful quoter is a small business concern and is determined nonresponsible, the Contracting Officer will refer the matter to the Small Business Administration for a Certificate of Competency determination, as applicable.
