Comment: General Requirements - Page 10 of the Solicitation Contract Form includes a description of the project. The written description does not align with the scope of work for this project. Please advise.
Reply: Please disregard the description on page 10 of the Solicitation Contract Form and refer only to the Statement of Work for project description.
Comment: B300 AC Replacement - Regarding B300 AC Replacement project. The installation of split-unit AC units are both shown as Bid Option #1 on drawing M101 but are referenced as separate bid options #1 & #2 within the Statement of Work and within the Solicitation Contract Form. Please confirm that the Statement of work and the Solicitation forms are correct.
Reply: Two bid options are correct. Please refer to the Solicitation Contract Form and Statement of Work for correct description of Bid Options #1 and #2.
Comment: B310 Water Damage Restoration - The Solicitation Contract Form includes Item 1001 (option #1). This bid option is not included within the Statement of Work. Provide complete description of work for this option if option is required.
Reply: Per Sheet A2, Bid Option #1 – Paint walls up to 44” high wooden trim in the area designated on the plan and also shown in photo #3. Paint submittal shall be approved by project
COR.
Comment: B310 Water Damage Restoration - Note #2 shows rooms where new cove base is required. Note #3 on drawings A1 & A2 require steam cleaning of carpeting in rooms where new cove base is installed. There are rooms shown with note #2 that do not have note #3. Please advise which rooms with carpet are to be steam cleaned.
Reply: Please steam clean rooms that include note 3. Rooms that include only note 2 do not have carpet or do not need to be steam cleaned. Note 2 was not intended to include the actions of note 3.
Comment: B310 Water Damage Restoration - Photos provided appear to be numbered incorrectly. Photo 5 is missing, there are two #9 photos. Photo numbers do not align with identifiers on floor plans.
Reply: Please see attached revised photos for B310 Water Damage Restoration.
Comment: Do “Buy American” requirements apply to this project.
Reply: Yes, reference Federal Acquisition Clause (FAR) 52.212-10 listed in the solicitation
Comment: The project completion duration is listed on Form 1442 as 180 calendar days while section 52.211-10 references 90 calendar days. Which is correct?
Reply: The contract duration is 180 calendar days.
Comment: There are three different wage rate classifications included (Building, Heavy and Highway). Which wage rate classification applies to which project?
Reply: Wage Rate for Building applies to Projects: B300AC / B310 Water Damage Restoration and Repair Lift Station Pumps and Controls. Wage Rate for Heavy applies to Project: Security Gate Improvements. Wage Rate for Highway applies to Project: Base Pavement Repairs
Comment: Regarding temporary utilities for construction, will use of power, water and toilets be provided for use by construction personnel at no additional cost to the General Contractor?
Reply: Port-o-lets should be used on work sites where accessible buildings are not in close proximity. For work in or near buildings, the contractor will be granted access for use of the bathrooms.
Comment: Regarding replacement of air handling units and condensers at Building 300. The air handler specified is a 15 ton units and the condensers spec’d are 12.5 tons. Is this correct?
Reply: Yes. This is the current setup for the building and with the same tonnage replacement.
Comment: The painting requirements for Building 310 are to match existing. The existing wall paint below the chair rail trim appears to be a special finish that is textured.
A. Do you have as built submittals that could be provided that describe this existing paint system?
B. Is this paint system still available? If not, what should we use?
Reply: As-built information is not available on the existing wall paint. We ask that the contractor uses a solid color paint in the areas called for painting. Please submit a paint proposal and color samples for walls called out to be repainted. Color samples should be similar to the purple background color on existing walls to be repainted.
VTANG comments per 7-18-19 pre bid site walkthrough: Sheet A2, Legend notes.
Salvaged 1” x 8” wood base trim is no longer available for reinstallation. Contractor shall install new 1” x 8” wood base trim where indicated on plans A1 and A2. New wood trim shall be finished with a clear protectant finish similar to existing wood trim. The quantity of new 1” x 8” wood trim needed for this project is approximately 220 LF +/-.
Comment: In the State of Work it describes replacing AHU-1 and Condensing Unit #1 and #2. I believe AHU-2 is needing to be replaced as well as these are both R-22 systems. We do not have a specification on AHU-2 if this is in fact going to get replaced as well. Please let me know what you can provide for clarification on the equipment being replaced in Section F of the SOW.
Reply: AHU-2 only contains a heating coil that supplies the shops and maintenance side of Building 300. AHU-2 is not to be replaced or altered in any way. AHU-1 has a heating coil as well as dual cooling coils fed by condensing units #1 and #2. AHU-1 and condensing units #1 and #2 shall be replaced per the SOW.

SUBJECT: Addendum #2 2019 Consolidated Projects
This memorandum summarized comments and clarifications to questions received by VTANG CES regarding 2019 Consolidated projects.
The Bid Opening has been changed as Follows:

Comment: B300 AC Replacement – Do the power requirements for the AHU and condensers need to be the same as existing?
Reply: No. Voltage available in the mechanical room is 480v and 120/208v. There is breaker space and capacity available for both options.
Comment: B300 AC Replacement – Where can the condensate for the Comm Room split units go?
Reply: Provide a proposed condensate line path as indicated in the submittal requirements.
The closest existing plumbing for Room 6 is located in the group of bathrooms/kitchen in rooms 15, 16, and 17. The closest existing plumbing for Room 32 is room 34 (elec/mech room). All ceilings are accessible drop ceilings. The contractor will be responsible for condensate pumps or any other additional equipment needed for their proposed condensate line path.
Comment: B300 AC Replacement – There is an existing government owned genie lift in the mechanical room. Is this available for contractor use?
Reply: No. The contractor is responsible for all equipment and tools to execute the work unless specifically stated in the Statement of Work.
Comment: B300 AC Replacement – Is there existing Glycol in the hot water coil in AHU #1?
Reply: No, the existing mixture is water and a chemical inhibitor for corrosion.
Comment: B300 AC Replacement – What does the existing ductwork below AHU #1 feed?
It may need to be removed to access it.
Reply: The ductwork below AHU #1 is the return duct to that unit. Any piping, ductwork, supports, or any other equipment moved or damaged to gain access to AHU #1 will be reinstalled or replaced by the contractor.
Comment: B300 AC Replacement – Can we see a wall section of the back wall of the mechanical room?
Reply: Please see attached. Refer to detail 2, A2.5 and detail 8, A4.3.
Comment: Repair Lift Station Pumps and Controls – Is there a curb stop or another method of isolating the pump station down stream?
Reply: No, there are existing valves located in the pump station to isolate each pump individually.
Comment: Repair Lift Station Pumps and Controls – The existing sump pump in the pump station was removed by maintenance personnel. The pump model is Zoeller M57-0001.
Nameplate power information is as follows: 3hp, 1ph, 115v, 9.7a. Replace as indicated in the Statement of Work.
Comment: The specification call for the replacement of both Condenser Units, but when going through my configuration tool, the AHU Specified only requires the one condensing unit for the design. Please clarify on the need for two condensing units with the new package.
Reply: The government has changed requirements for the condenser replacement. The new model number to match equivalency is YD360C00A2BAA2. This is a single 30 Ton, York Millennium Split System R-410A Air conditioner, 4 Pipe, 4 stage cooling, 208/230-3-60 Smart Equipment Controller and includes a HACR circuit breaker/disconnect sized for 208 volts.
Field and factory installed accessories include Low Ambient Kit (208/230V 30T, model # 2LA04713925), and a Hot Gas Bypass Kit (model # 2HG04700824). Bidders may submit alternative models/manufacturers that meet the performance (cfm, heating/cooling capacities) of this unit, and that have equivalent accessories. As stated in the SOW, the contractor will be responsible for modifying the existing condenser supports for the replacement condenser.
10 Comment: Three different equipment vendors concur, that the combination of tonnage between the AHU, and the condensers is not a combination, which will work. The AHU is 15 ton, and the two ACCUs are a combined 25 tons. Vendors will not quote, based on the current schedule, despite the statement in Addendum 1. If the air handling equipment is 15 tons, then the ACCUs should be no more than a combined 15 tons. Please advise.
Reply: The government has changed requirements for the air handler replacement. The new model number to match equivalency is ND360C00N6AAA1. This is a single 30 Ton, York Millenium split System R-410A Air Handler 208/230/460-3-60, 4 Pipe air handler with drain pan. Field and factory accessories include Standard Static Drive (model # 1LD0407, contains sheave and belt), Motor Overlad Relay Kit (model # 2MP04708700), and a 2 row deep hot water coil (model # 1HW0406). Bidders may submit alternative models/manufacturers that meet the performance (cfm, heating/cooling capacities) of this unit, and that have equivalent accessories. As stated in the SOW, the contractor will be responsible for modifying the existing condenser supports for the replacement condenser.
Comment: B300 AC Replacement - Although AHU #1 does not currently supply cooling, it is still operational, supplying heat and ventilation to half of the building. It is the government’s desire to minimize the downtime between demolition of this unit and the installation of the replacement.
Comment: B310 Water Damage Restoration – Who is responsible for moving furniture in occupied areas where carpet cleaning/restoration is to occur?
Reply: The Contractor shall be responsible for moving any furniture to facilitate work included in the project contract documents.When work has been satisfactorily completed the Contractor shall move the furniture back into the rooms in the original location. Computers, phone lines, Ethernet cables and any other equipment that is unplugged in order to be moved for the cleaning shall be plugged back in by the Government and not the General Contractor or subcontractor.
The Government requests that the contractor develops and submits a cleaning schedule that takes advantage of the building being minimally occupied each Monday.
Comment: B300 AC Replacement – Replace both split unit AC for comm rooms with Mitsubishi PKA-A12HA6 (indoor) and PUY-A12NHA6 (outdoor), or equivalent. Outdoor units must contain Wind Baffles for low temperature (0ºF) operation. Wall mount units as indicated in project drawings.
Comment: B300 AC Replacement – See attached for as-builts for the DDC temperature controls for B300 (from 1992).
15 Comment: B300 AC Replacement – Included in the installation of the new Air Handling Unit is the balancing of the HVAC system. Several existing VAV controllers are inoperable in the building. Work with the COR on balancing airflow in these areas.
16 Comment: Can the air handling unit/existing condensers be replaced with an outdoor packaged unit?
Reply: Yes. Bidders may submit an alternative proposal. A proposed outdoor package unit would need to meet all of the heating, cooling and airflow requirements intended in the statement of work and within the addendums. The contractor shall be responsible for any and all system requirements (gas, hot water, refrigerant etc.) for a complete and functional unit.
IMPORTANT – Final bids will not be evaluated based on an alternative proposal. Bids will be awarded based on the cumulatative CLIN prices (all base bids and bid options together).
SUBJECT: Addendum #3 2019 Consolidated Projects
This memorandum summarized comments and clarifications to questions received by VTANG CES regarding 2019 Consolidated projects.
Comment: B300 AC Replacement – Our subcontractor looked at the unit air handler and stated that it will not fit in the existing air handler space. How do we proceed?
Reply: Modification to the existing space may be required to install the York unit YD360C00A2BAA2 specified in addendum #2. This is intended as a design capacity for the contractor to meet. The bidder may submit a different unit that with similar cfm, cooling and heating capacities as this model.
Comment: The air handler spec’d in addendum #2 seems oversized. How do we proceed?
Reply: The unit specified in addendum #2 has the correct capacities. See drawing B300_asbuilts_M5.1_1992_Schedule, Notes, Legends.pdf. The original specified unit for the building was 259MBH.
Comment: The existing air handler is oriented with return air and outdoor air mixed with a single return to the air handler. This is oriented on the rear (facing away from the entrance to mech room) of the unit. The unit is draw-thru, with the supply air located on the other side of the unit.

While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013.

52.202-1 DEFINITIONS (NOV 2013)
When a solicitation provision or contract clause uses a word or term that is defined in the Federal Acquisition Regulation (FAR), the word or term has the same meaning as the definition in FAR 2.101 in effect at the time the solicitation was issued, unless--
(a) The solicitation, or amended solicitation, provides a different definition;
(b) The contracting parties agree to a different definition;
(c) The part, subpart, or section of the FAR where the provision or clause is prescribed provides a different meaning;
or
(d) The word or term is defined in FAR Part 31, for use in the cost principles and procedures.

52.203-10 PRICE OR FEE ADJUSTMENT FOR ILLEGAL OR IMPROPER ACTIVITY (MAY 2014)
(a) The Government, at its election, may reduce the price of a fixed-price type contract and the total cost and fee under a cost-type contract by the amount of profit or fee determined as set forth in paragraph (b) of this clause if the head of the contracting activity or designee determines that there was a violation of 41 U.S.C. 2102 or 2103, as implemented in section 3.104 of the Federal Acquisition Regulation.
(b) The price or fee reduction referred to in paragraph (a) of this clause shall be--
(1) For cost-plus-fixed-fee contracts, the amount of the fee specified in the contract at the time of award;
(2) For cost-plus-incentive-fee contracts, the target fee specified in the contract at the time of award, notwithstanding any minimum fee or "fee floor" specified in the contract;
(3) For cost-plus-award-fee contracts--
(i) The base fee established in the contract at the time of contract award;
(ii) If no base fee is specified in the contract, 30 percent of the amount of each award fee otherwise payable to the Contractor for each award fee evaluation period or at each award fee determination point.
(4) For fixed-price-incentive contracts, the Government may--
(i) Reduce the contract target price and contract target profit both by an amount equal to the initial target profit specified in the contract at the time of contract award; or
(ii) If an immediate adjustment to the contract target price and contract target profit would have a significant adverse impact on the incentive price revision relationship under the contract, or adversely affect the contract financing provisions, the Contracting Officer may defer such adjustment until establishment of the total final price of the contract. The total final price established in accordance with the incentive price revision provisions of the contract shall be reduced by an amount equal to the initial target profit specified in the contract at the time of contract award and such reduced price shall be the total final contract price.
(5) For firm-fixed-price contracts, by 10 percent of the initial contract price or a profit amount determined by the Contracting Officer from records or documents in existence prior to the date of the contract award.
(c) The Government may, at its election, reduce a prime contractor's price or fee in accordance with the procedures of paragraph (b) of this clause for violations of the statute by its subcontractors by an amount not to exceed the amount of profit or fee reflected in the subcontract at the time the subcontract was first definitively priced.
(d) In addition to the remedies in paragraphs (a) and (c) of this clause, the Government may terminate this contract for default. The rights and remedies of the Government specified herein are not exclusive, and are in addition to any other rights and remedies provided by law or under this contract.
52.203-13 CONTRACTOR CODE OF BUSINESS ETHICS AND CONDUCT (OCT 2015)
(a) Definitions. As used in this clause--
Agent means any individual, including a director, an officer, an employee, or an independent Contractor, authorized to act on behalf of the organization.
Full cooperation—
(1) Means disclosure to the Government of the information sufficient for law enforcement to identify the nature and extent of the offense and the individuals responsible for the conduct. It includes providing timely and complete response to Government auditors' and investigators' request for documents and access to employees with information;
(2) Does not foreclose any Contractor rights arising in law, the FAR, or the terms of the contract. It does not require-
(i) A Contractor to waive its attorney-client privilege or the protections afforded by the attorney work product doctrine; or
(ii) Any officer, director, owner, or employee of the Contractor, including a sole proprietor, to waive his or her attorney client privilege or Fifth Amendment rights; and
(3) Does not restrict a Contractor from--
(i) Conducting an internal investigation; or
(ii) Defending a proceeding or dispute arising under the contract or related to a potential or disclosed violation.
Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
Subcontract means any contract entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract.
Subcontractor means any supplier, distributor, vendor, or firm that furnished supplies or services to or for a prime contractor or another subcontractor.
United States means the 50 States, the District of Columbia, and outlying areas.
(b) Code of business ethics and conduct. (1) Within 30 days after contract award, unless the Contracting Officer establishes a longer time period, the Contractor shall--
(i) Have a written code of business ethics and conduct;
(ii) Make a copy of the code available to each employee engaged in performance of the contract.
(2) The Contractor shall--
(i) Exercise due diligence to prevent and detect criminal conduct; and
(ii) Otherwise promote an organizational culture that encourages ethical conduct and a commitment to compliance with the law.
(3)(i) The Contractor shall timely disclose, in writing, to the agency Office of the Inspector General (OIG), with a copy to the Contracting Officer, whenever, in connection with the award, performance, or closeout of this contract or any subcontract thereunder, the Contractor has credible evidence that a principal, employee, agent, or subcontractor of the Contractor has committed--
(A) A violation of Federal criminal law involving fraud, conflict of interest, bribery, or gratuity violations found in Title 18 of the United States Code; or
(B) A violation of the civil False Claims Act (31 U.S.C. 3729-3733).
(ii) The Government, to the extent permitted by law and regulation, will safeguard and treat information obtained pursuant to the Contractor's disclosure as confidential where the information has been marked “confidential” or “proprietary” by the company. To the extent permitted by law and regulation, such information will not be released by the Government to the public pursuant to a Freedom of Information Act request, 5 U.S.C. Section 552, without prior notification to the Contractor. The Government may transfer documents provided by the Contractor to any department or agency within the Executive Branch if the information relates to matters within the organization's jurisdiction.
(iii) If the violation relates to an order against a Governmentwide acquisition contract, a multi-agency contract, a multiple-award schedule contract such as the Federal Supply Schedule, or any other procurement instrument intended for use by multiple agencies, the Contractor shall notify the OIG of the ordering agency and the IG of the agency responsible for the basic contract.
(c) Business ethics awareness and compliance program and internal control system. This paragraph (c) does not apply if the Contractor has represented itself as a small business concern pursuant to the award of this contract or if this contract is for the acquisition of a commercial item as defined at FAR 2.101. The Contractor shall establish the following within 90 days after contract award, unless the Contracting Officer establishes a longer time period:
(1) An ongoing business ethics awareness and compliance program.
(i) This program shall include reasonable steps to communicate periodically and in a practical manner the Contractor's standards and procedures and other aspects of the Contractor's business ethics awareness and compliance program and internal control system, by conducting effective training programs and otherwise disseminating information appropriate to an individual's respective roles and responsibilities.
(ii) The training conducted under this program shall be provided to the Contractor's principals and employees, and as appropriate, the Contractor's agents and subcontractors.
(2) An internal control system.
(i) The Contractor's internal control system shall--
(A) Establish standards and procedures to facilitate timely discovery of improper conduct in connection with Government contracts; and
(B) Ensure corrective measures are promptly instituted and carried out.
(ii) At a minimum, the Contractor's internal control system shall provide for the following:
(A) Assignment of responsibility at a sufficiently high level and adequate resources to ensure effectiveness of the business ethics awareness and compliance program and internal control system.
(B) Reasonable efforts not to include an individual as a principal, whom due diligence would have exposed as having engaged in conduct that is in conflict with the Contractor's code of business ethics and conduct.
(C) Periodic reviews of company business practices, procedures, policies, and internal controls for compliance with the Contractor's code of business ethics and conduct and the special requirements of Government contracting, including--
(1) Monitoring and auditing to detect criminal conduct;
(2) Periodic evaluation of the effectiveness of the business ethics awareness and compliance program and internal control system, especially if criminal conduct has been detected; and
(3) Periodic assessment of the risk of criminal conduct, with appropriate steps to design, implement, or modify the business ethics awareness and compliance program and the internal control system as necessary to reduce the risk of criminal conduct identified through this process.
(D) An internal reporting mechanism, such as a hotline, which allows for anonymity or confidentiality, by which employees may report suspected instances of improper conduct, and instructions that encourage employees to make such reports.
(E) Disciplinary action for improper conduct or for failing to take reasonable steps to prevent or detect improper conduct.
(F) Timely disclosure, in writing, to the agency OIG, with a copy to the Contracting Officer, whenever, in connection with the award, performance, or closeout of any Government contract performed by the Contractor or a subcontractor thereunder, the Contractor has credible evidence that a principal, employee, agent, or subcontractor of the Contractor has committed a violation of Federal criminal law involving fraud, conflict of interest, bribery, or gratuity violations found in Title 18 U.S.C. or a violation of the civil False Claims Act (31 U.S.C. 3729-3733).
(1) If a violation relates to more than one Government contract, the Contractor may make the disclosure to the agency OIG and Contracting Officer responsible for the largest dollar value contract impacted by the violation.
(2) If the violation relates to an order against a Governmentwide acquisition contract, a multi-agency contract, a multiple-award schedule contract such as the Federal Supply Schedule, or any other procurement instrument intended for use by multiple agencies, the contractor shall notify the OIG of the ordering agency and the IG of the agency responsible for the basic contract, and the respective agencies' contracting officers.
(3) The disclosure requirement for an individual contract continues until at least 3 years after final payment on the contract.
(4) The Government will safeguard such disclosures in accordance with paragraph (b)(3)(ii) of this clause.
(G) Full cooperation with any Government agencies responsible for audits, investigations, or corrective actions.
(d) Subcontracts.
(1) The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts that have a value in excess of $5.5 million and a performance period of more than 120 days.
(2) In altering this clause to identify the appropriate parties, all disclosures of violation of the civil False Claims Act or of Federal criminal law shall be directed to the agency Office of the Inspector General, with a copy to the Contracting Officer.
52.204-1 APPROVAL OF CONTRACT (DEC 1989)
This contract is subject to the written approval of Office of the Senior Contracting Official and shall not be binding until so approved.
52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 30 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 90 days after the date the contractor receives the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.
*The Contracting Officer shall specify either a number of days after the date the contractor receives the notice to proceed, or a calendar date.
52.222-35 EQUAL OPPORTUNITY FOR VETERANS (OCT 2015)
(a) Definitions. As used in this clause--
``Active duty wartime or campaign badge veteran,'' ``Armed Forces service medal veteran,'' ``disabled veteran,'' ``protected veteran,'' ``qualified disabled veteran,'' and ``recently separated veteran'' have the meanings given at FAR 22.1301.
(b) Equal opportunity clause. The Contractor shall abide by the requirements of the equal opportunity clause at 41 CFR 60-300.5(a), as of March 24, 2014. This clause prohibits discrimination against qualified protected veterans, and requires affirmative action by the Contractor to employ and advance in employment qualified protected veterans.
(c) Subcontracts. The Contractor shall insert the terms of this clause in subcontracts of $150,000 or more unless exempted by rules, regulations, or orders of the Secretary of Labor. The Contractor shall act as specified by the Director, Office of Federal Contract Compliance Programs, to enforce the terms, including action for noncompliance. Such necessary changes in language may be made as shall be appropriate to identify properly the parties and their undertakings.

Postconsumer material means a material or finished product that has served its intended use and has been discarded for disposal or recovery, having completed its life as a consumer item. Postconsumer material is a part of the broader category of “recovered material.”
Recovered material means waste materials and by-products recovered or diverted from solid waste, but the term does not include those materials and by-products generated from, and commonly reused within, an original manufacturing process.
