MANDATORY FORMAT FOR

PERFORMANCE WORK STATEMENT (PWS)

FOR

PSXE142004, Repair Overhead Doors Basewide

1.0 General:

1.1 Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary, except as specified in Paragraph 3.0 as Government Furnished, to perform construction activities associated with the maintenance, repair, and replacement of overhead doors basewide, to include all Services, as defined in this PWS.

1.2 Background: Multiple Facilities on Base require adequately maintained and secure overhead doors in various functional areas to provide for proper access of supplies, cargo, and mobility equipment. Doors are required to accommodate and access mechanical, utility, maintenance, supply distribution, and mission support vehicle access within the facilities.

1.3 Period of Performance (PoP): The Period of Performance shall be 180 days

1.4 General Information:

1.4.1 Quality Control (QC): The contractor shall develop and maintain an effective QC Plan (QCP) to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s QCP is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the contractor shall develop QC procedures that address the areas identified in Technical Exhibit 1, Performance Requirements Summary.

1.4.2 Quality Assurance (QA): The Government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) (defect rate(s)).

1.4.3 Recognized Holidays: The following are recognized US holidays. The contractor shall perform services on these days:

1.4.4 Place and Performance of Services: The contractor shall provide services between the hours of _0700 - 1700_ on _Monday through Friday_, except on recognized US holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings. Performance shall be performed _base wide_. The contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility/installation is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the work force are essential.

1.4.4.1 Unscheduled gate closures by the Security Police may occur at any time causing all personnel entering or exiting a closed installation to experience a delay. This cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the contractor employee’s installation driving privileges.

1.4.4.2 The contractor’s employees shall become familiar with and obey the regulations of the installation; including fire, traffic, safety and security regulations while on the installation. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All contractor employees shall carry proper identification with them at all times. The contractor shall ensure compliance with all regulations and orders of the installation which may affect performance.

1.4.5 Security Requirements. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the Contracting Officer’s Representative (COR). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by DOD, HQDA and/or local policy.

Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.

1.4.5.1 COMSEC/IT Security. All communications with DOD organizations are subject to communications security (COMSEC) review. All telephone communications networks are continually subject to intercept by unfriendly intelligence organizations. DOD has authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from, or terminating at, DOD organizations. Therefore, the contractor is advised that any time contractor place or receive a call they are subject to COMSEC procedures. The contractor shall ensure wide and frequent dissemination of the above information to all employees dealing with DOD information. The contractor shall abide by all Government regulations concerning the authorized use of the Government's computer network, including the restriction against using the network to recruit Government personnel or advertise job openings.

1.4.5.2 AT Level 1 Awareness Training (AT): All contractor employees requiring access to Army Installations, facilities, and controlled access areas shall complete Level 1 AT within 30 calendar days after contract start date and within 30 calendar days of new employees commencing performance. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee, to the COR, or to the KO if a COR is not assigned, within 15 calendar days after completion of training.

1.4.6 Physical Security. The contractor shall safeguard all Government property provided for contractor use. At the close of each work period, Government facilities, equipment and materials shall be secured. The contractor is responsible for the safe and secure storage of all materials and equipment used in the performance of this project. A bed-down area will be provided, upon request, for equipment and materials onsite or in the adjacent parking areas.

1.4.6.1 Personnel Badging / Visitor Passes: All employees must have a valid badge or visitors pass throughout operations unless a government escort is provided. Badges will be obtained through MTAB Security Forces. A 134th Air Refueling Wing Form #5 shall be completed by each applicant and submitted to the Contracting Officer’s Representative (COR) for approval prior to submittal to Security Forces for final approval & badging.

1.4.7 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the KO in accordance with Federal Acquisition Regulations Subpart 42.5. The KO, Contracting Officer’s Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contactor’s performance. At these meetings, the Contacting Officer will apprise the contractor of how the Government views the contractor’s performance and the contractor shall apprise the Government of problems, if any, being experienced The contractor shall resolve outstanding issues raised by the Government.

Contractor attendance at these meetings shall be at no additional cost to the Government.

1.4.9 Contract Manager (CM): The contactor shall designate a CM who shall ensure performance under this contract. The name of this person, and an alternate who shall act for the contractor when the CM is absent, shall be designated in writing to the KO. The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The CM shall work through the COR, (or the KO if a COR is not assigned), to resolve issues, receive technical instructions, and ensure https://atlevel1.dtic.mil/at/ adequate performance of services. The CM shall ensure that contractor employees do not perform any services outside the scope of the contract without an official modification issued by the KO. The CM shall ensure contractor employees understand that services performed outside the scope of the contract are performed wholly at the expense of the contractor.

1.4.10. Combating Trafficking in Persons: The United States Government has adopted a zero tolerance policy regarding trafficking in persons. Contractors and contractor employees shall not engage in severe forms of trafficking in persons during the period of performance of the contract; procure commercial sex acts during the period of performance of the contract; or use forced labor in the performance of the contract. The Contractor shall notify its employees of the United States Government’s zero tolerance policy, the actions that will be taken against employees for violations of this policy. Such actions may include, but are not limited to, removal from the contract, reduction in benefits, or termination of employment. The Contractor shall take appropriate action, up to and including termination, against employees or subcontractors that violate the US Government policy as described at FAR 22.17.

1.4.11 Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the KO. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

1.4.12 Organizational Conflicts of Interest (OCI): The contractor and subcontractor personnel performing services under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent OCIs, as defined in FAR Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the contractor from participation in subsequent contracted requirements which may be affected by the OCI.

2.0 Definitions and Acronyms:

2.1.1 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2 CONTRACTING OFFICER (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.

2.1.3 CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S.

Government designated by the KO to monitor contractor performance. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5 DELIVERABLE. Anything that can be physically delivered and includes non-manufactured things such as meeting minutes or reports.

2.1.6 KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7 PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8 QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.9 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10 QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11 SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.12 WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

2.1.13 WORK WEEK. Monday through Friday, unless specified otherwise.

3.0 Government Furnished Property, Material, Equipment and Services (GFP/M/E/S):

The Government will provide the property, material, equipment, and/or services listed below solely for the purpose of performance under this contract:

3.1 Utilities: All utilities in the facility will be available for the contactor’s use in the performance of this contract. The contractor shall instruct employees in utilities conservation practices. The contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.

4.0 Contractor Furnished Property, Materials, and Equipment (CFP/M/E):

4.1 General: Except for those items specifically stated to be Government-Furnished in Paragraph 3.0, the contractor shall furnish everything required to perform these services as indicated in Paragraph 1.1.

5.0 Requirements: The contractor shall provide the following in accordance with this PWS and the associated plans and specifications:

5.1 Progress Schedule, Submittals, & Requests for Information (RFIs):

5.1.1 Contractor will provide Progress Schedule by direction of the Contracting Officer not to exceed ten (10) days after contract award.

5.1.2 Contractor shall submit the manufacturer’s products requested as in accordance with this PWS and the provided plans and specifications. Contractor shall wait for approval before purchasing material. The contractor will supply all equipment and material unless otherwise stated in scope of work. A list of all recovered materials and quantities must be submitted by the contractor following project completion. The contractor must submit a list of hazardous materials required for project completion, if any, to the Base Environmental Manager (EM) before project execution begins. All unused product, if any, must be removed from base upon project completion.

5.1.3 Contractor will immediately notify Contracting Officer when conflicts or delays are identified that require additional information from the Government to proceed. Contractor shall submit Requests for Information (RFIs) to the Contracting Officer within 5 calendar days of identification.

5.2 Site Visits: Contracting will schedule tour of site between 8:00 A.M. and 4 P.M Monday through Friday. Contact Major J. David Barrett at (865) 336-4212 for appointments.

5.3 Coordination: All work will require coordination with the Tennessee Air National Guard Civil Engineering. The contractor shall conduct their work in a manner that will not interfere with or stop the operations being conducted in and around the work area.

Contractors are NOT to connect to the base water distribution system without prior approval from Civil Engineering. Once approval is received, the contractor must provide a functional backflow prevention device to ensure cross contamination is prevented.

5.4 Performance: Submission of a bid by a contractor shall be accepted as evidence that they have read the work scope and have satisfied themselves as to the nature and location of the proposed work and all matters which can in any way affect the work or cost under this contract. Any failure of the contractor to acquaint themselves with all available information from including physical survey of the site of the proposed work will not relieve them from performing all work to be done for a complete and acceptable job. Work shall be completed in compliance with all applicable local, state, and federal codes and regulations.

5.5 Drawings: The drawings show and the specifications describe the work intended, but the Contractor shall be solely responsible for taking his own measurements and installing the work to fit the conditions encountered everything necessary for a complete and satisfactory installation shall be furnished and installed by this Contractor performing work under this contract, whether or not specifically shown or specified. This is not intended to cover major items of equipment not shown or specified but is intended and will be interpreted to cover all miscellaneous parts, devices, accessories, controls, and appurtenances which are required by any applicable code, ordinance, regulation or law required to complete and place the system in satisfactory operation and required for a first class job which is complete in every respect.

5.6 Deviations: No deviations from the plans and specifications shall be made without the full knowledge and consent of the Base Contracting Officer. Should this Contractor find at any time during the progress of the work that, in his judgment, existing conditions made desirable a modification in requirements covering any item he shall report such items to the Base Contracting Officer for his decision and instructions. No changes shall be made until written request has been made by the Contractor to the Base Contracting Officer and written approval of said change has been given by the Base Contracting Officer.

5.7 Omissions: The drawings and specifications shall both be considered as part of the contract. Any work or material shown in one and omitted in the other shall be furnished and performed as though shown in both to give a complete job approvable by the Base Contracting Officer. The awarding of the contract shall be construed to mean that this Contractor will install a complete and satisfactory system, furnishing all items of materials and labor to accomplish this result whether or not such items are particularly specified or shown on plans. Should any discrepancy or omission be discovered in the plans or specifications, such must be reported to the Base Contracting Officer immediately in order that any necessary addenda may be issued before the bids are received.

5.8 Interpretation: The meaning and intent of the plans and specifications shall be subject to the interpretations of the Base Contracting Officer whose decision on all questions pertaining thereto shall be binding upon the Contractor.

5.9 Permits, Licenses and Insurance: The Contractor shall obtain and pay for all permits, licenses, fees, etc., required for his work.

5.10 Guarantee: The Contractor shall furnish a guarantee covering all labor and materials for a period of one year from date of acceptance of his work which shall include an agreement to repair replace and make good at his expense, any and all defects which may appear in his work or materials during that time, which in the judgment of the Base Contracting Officer arise from defective workmanship or imperfect or inferior materials.

5.11 Cleanup: Contractor will repair all surfaces that may have been damaged during work to acceptable conditions as determined by Civil Engineering. Prior to final acceptance, the Contractor shall remove all waste materials and debris arising from construction and shall present all maintenance areas in a broom clean condition.

Construction debris will be removed on a daily basis. Contractor will dispose of removed material and maintenance excess as determined by Civil Engineering.

5.12 Contractor shall complete all required tasks in accordance with the plans and specifications to include but not limited to the following tasks:

5.12.1 Replace 27 overhead doors as specified per Appendix A on the attached specifications, to include all associated electrical requirements as defined in the project specifications Appendix C.

5.12.1.1. All existing doors and associated appurtenances shall be removed. Unless otherwise noted on Table 1 Appendix A in the attached specifications*. This is an “or equal” item, basis of design is 625 Stormtite series rolling door as manufactured by Overhead Door Corporation with a RHX operator. All doors shall be powder coated with a Standard RAL color except as noted, colors to be selected by COR.

5.12.1.2. All overhead doors on the Base shall be labeled as indicated Table 1 Appendix A in the attached specifications and on provided floorplans** with an anodized aluminum 3"x5" label. The labels shall be mechanically fastened to the bottom center of the outside face of the door. Confirm door label, numbering and location with COR. **The floor plans are provided as a courtesy, Appendix D, and it is the contractor's responsibility to field verify locations and dimensions.

5.12.1.3. Contractor shall provide a complete inventory of all overhead doors on Base upon completion of the project. The inventory shall include building number, building name, overhead door label, date of service/replacement and operator type.

5.12.1.4. Contractor shall provide door frame, jamb and infill shop drawings as required with overhead door submittals.

5.12.2 Repair 53 overhead doors as specified per Appendix B on the attached specifications. Contractor shall service* all doors and repair door(s) as noted, to include all associated electrical requirements as defined in the project specifications Appendix C.

*Service = Inspect the door, oil/lube working parts, make normal adjustments for door to comply with original manufacturer's specifications and evaluate for additional repairs and labor.

5.12.3 ABI #1: Replace one existing (22’ 2” x 12’) overhead door in Bldg 323 with a smaller overhead door (12'x14') as specified per Appendix A on the attached specifications. Install additional building framing/siding for smaller door opening.

5.13 Contractor Manpower Reporting Application (CMRA):

5.14 The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the National Guard Bureau via a secure data collection site.

5.15 The contractor shall completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs shall be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013.
