General Information

1. General: This is a non-personal service(s) contract under which the personnel rendering the service(s) are not subject, either by the contract's terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.

1.1 Description of Services/Introduction: This is a non-personal service(s) contract to provide a blanket purchase agreement providing services for water quality analysis of water samples in Poland.

1.2 Background: The U.S. Army Garrison Poland, established in 2023, supports service members and civilians stationed at its headquarters at Camp Kosciuszko in Poznan, Poland and is responsible for 11 installations, including the military communities of Poznan, Powidz, and Swietoszow. The USACE ERDC Environmental Laboratory (EL), Environmental Engineering Branch (EPE) is currently assisting with assessing the water quality at three sites that are part of USAG Poland (Camp Kosciuszko (Poznan), Camp Konotop, and Bolesawiec) and requires water quality analysis of various constituents to ensure that required water quality standards are being met. ERDC does not currently have the capacity to complete all the analysis in Poland, and therefore is seeking to establish a BPA to obtain the necessary water quality data.

1.3 Scope: The Contractor shall provide non-personal service(s). This contractor(s) must be able to provide all labor associated with sample management and analysis after samples are delivered to them, provide all required sampling supplies and shipping supplies prior to sampling, analyze the samples within the required holding times, and have the capabilities to adequately dispose of water.

1.4 Objectives:

Contractor capable of receiving and analyzing multiple water samples collected in Poland on a monthly frequency. The number of samples delivered might vary between 3-27 samples monthly.

Contractor capable of screening samples for multiple constituents including but not limited to biological, inorganics, pesticides, volatile organics, PFAS and radiological constituents.

Contractor capable of processing samples within the required holding times that each required constituent requires.

Contractor capable of providing all necessary supplies and materials to the Government to adequately collect, store, and deliver (either by hand or by shipment) the water samples to the contractor for processing.

Contractor capable of providing data results within 60 days of receiving water samples.

1.5 General Information:

1.5.1 The Contractor shall inform the COR and USACE ERDC of issues or potential issues that might affect the performance within 5 business days of identifying those issues. Verbal reports shall be followed up by written reports within 10 business days.

1.5.2 Quality Assurance: The Government will evaluate the Contractor's performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the acceptable quality levels (performance thresholds).

1.5.3 Recognized Holidays: The following provides information on recognized holidays for the purpose of the PWS. If submittal of any documentation (e.g. deliverables, submittals, etc.) deadlines fall on a holiday, the closest work day prior to the holiday will apply as the deadline for submittal.

1.5.3.1 U.S. Holidays: Work may be performed on U.S. federally recognized holidays occurring during the normal workweek unless otherwise directed by the Contracting Officer. When a U.S. holiday occurs on a Saturday or a Sunday, the holiday is observed on the preceding Friday or following Monday, respectively.

Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as "RAMs"), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.

Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.

1.6.3 Security requirement for contract performance outside of the US: For contract performance requirements that involve services or delivery in a foreign country, the Contractor shall comply with the requirement of DFARS clause 252.225-7043. For performance requirements that involve contract personnel accompanying or supporting US Armed Forces deployed outside the US, the Contractor shall comply with the requirements of DFARS clause 252.225-7040. 1.6.4 Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.

1.6.5 Escorting in Classified and/or Sensitive Areas: In accordance with applicable regulations, all contract personnel who do not possess the appropriate security clearance or access privileges will be escorted in areas where they may be exposed to classified information or operations, sensitive information or activities, or restricted areas.

1.7 Post Award Conference/Periodic Progress Meetings: The Contractor shall virtually attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The Contracting Officer, COR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

The COR is not authorized to change any of the terms and conditions of the resulting order. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is not authorized to obligate the Government. If the work is not written in the contract, the COR is not authorized to request new work. 4.1 General: The Contractor shall provide materials and labor for analysis of multiple water samples, including chemical, biological, and physical quality parameters.

To meet sample holding times, the contract laboratory must be located in Poland. Shipments to other countries incur delays due to customs clearance which will exceed sample holding times

These projects will include water samples from ground, surface, and potable water used in various sites that are part of US Army Garrison Poland.

Due to the nature of the work, these samples will not be considered "clean" drinking water and shall be treated as non-potable water / complex matrices, and therefore will often require extraction clean up or other matrix and interference reduction processing to achieve desired reporting limits.

The primary contractor may subcontract any analyses not performed in-house to meet the needs of the requirement if necessary. The primary contractor will need to notify the Government in advance of analyses not performed in-house. All primary and subcontractors must have NELAC and /or DOD ELAP and/or ISO/IEC 17025 and/or PN-EN ISO/IEC 17025:2018-02 accreditation for all requested analyses.

The contractor shall notify Government personnel within 5 business days if delays in data are expected due to instrument malfunctions, QC failures requiring reanalysis, etc. Reporting limits for each analysis are dependent of the requirement of each project. All required reporting limits will be provided when a quote for services is requested.

Table 1 (Attachment 4 - Technical Exhibit A - List of Contaminants of Interest in Water Samples) shows a list of example analyses to be performed through the duration of the BPA. This list is not all inclusive and additional analyses may be requested as needed over the ordering period of the contract.
