About this file

This justification document supports a limited sources solicitation for the construction of an AFSOC three-bay aircraft hangar and aircraft maintenance unit at Yokota Air Base in Japan. The solicitation requires the use of Det-Tronics Corporation's Model X3301 Multispectrum Infrared Flame Detectors and Model EQ30XX Eagle Quantum Premier Fire Detection and Releasing Service Fire Alarm Control Unit due to their immunity to electromagnetic frequency interference from aircraft, as required by design criteria. The estimated cost of these restricted items is redacted and the total project cost is between 2.5 and 10 billion Japanese yen. The document provides background on testing of these and other products, details unsuccessful efforts to obtain additional qualified sources, and certifies the contracting officer's determination that competition is not feasible and the anticipated project costs will be fair and reasonable. The U.S. Army Corps of Engineers Engineering District Japan will issue the solicitation, seeking a firm-fixed-price construction contract to be awarded using Military Construction funds.

Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: U.S. Army Corps of Engineers, Japan Engineer District, , Contracting Division, Camp Zama, Japan, Unit 45010, APO, AP 96343-5010

2. Description of Action: The Japan Engineer District intends to include restrictive brand name specifications for Det-Tronics Corporation’s Model X3301 Multispectrum Infared (IR) Flame Detectors and Model EQ30XX Eagle Quantum Premier Fire Detection/Releasing Service Fire Alarm Control Unit (RSFACU) for the Solicitation No - W912HV-21-B-0009, AFSOC Hangar project at Yokota Air Base, Japan. The solicitation will be a competitive full and open solicitation with the restrictive specifications resulting in a new firm-fixed price construction contract to be awarded with MILCON funds.

3. Description of Supplies/Services: The Japan Engineer District intends to include restrictive brand name specifications for Det-Tronics Corporation’s Model X3301 Multispectrum IR Flame Detectors and Model EQ30XX Eagle Quantum Premier Fire Detection/RSFACU for the AFSOC Hangar project at Yokota Air Base, Japan. These construction materials are required in order to interface with existing systems used at Yokota Air Base. The estimated cost of the restricted construction material is The estimated project cost is . Approval authority is the Procuring Contracting Officer.

4. Authority Cited: Other than Full and Open Competition is authorized pursuant to 10 U.S.C.

2304(c)(1) as implemented by FAR 6.302-1(c) when there is only one brand name, product, or feature of a product, peculiar to one manufacturer that will satisfy agency requirements.

5. Reason for Authority Cited:

(a) Background: DoD United Facilities Criteria (UFC) related to design and installation of aircraft maintenance hangar fire suppression systems (UFC 4-211-01, Aircraft Maintenance Hangars, Change 3 dated 20 Apr 2021) requires the use of an infrared optical flame detection process to activate the suppression system in the event of a fire. Specifically, the UFC requires “Provide triple infrared optical flame detectors that are listed/approved for the expected fuel hazards in the hangar bay. Provide detectors that are immune to radar and radio frequency emissions from hand held equipment or equipment on-board the aircraft. Provide shielded circuiting for both the SLC (signaling line circuit) and power from the optical detectors to the RSFACU and ground shielding in accordance with the optical flame detector manufacturer.”

Until recently, the Government had identified two different manufacturers who met the Government’s performance requirements for optical flame detection using triple spectrum infrared technology; these requirements are intended to reduce false alarms and accidental discharge of the foam fire suppression system in aircraft hangars. One of the two products was associated with over 20 false activations and inadvertent discharges of foam at a Navy hangar, disrupting flight operations and damaging government property. Each of the false activations cost the Government approximately $40,000 in cleanup and disposal costs plus 40 man-hours of military labor. Costs of associated facility or aircraft damage is unknown; it is also unknown how many inadvertent foam discharges occurred at other facilities & Installations.

These failures were attributed to electromagnetic frequency (EMF) interference from aircraft surveillance and weapons platforms; the proposed aircraft maintenance hangar will be exposed to similar frequencies. UFC 4-211-01 specifically requires that these optical detectors be immune to such interference. After further operational use of this product and a continued number of unacceptable incidents of false activation, the Government reinvestigated both previously acceptable products with full scale testing using an operational aircraft. The Government found the product that had been experiencing false activations was not immune to EMF interference from aircraft and was definitively proven to be susceptible to aircraft radar emissions.

The Government testing and continued operational experience with both products confirmed that only the Det-Tronics products worked as intended and met the Government's performance requirements as set forth in UFC 4-211-01. In 2016 and 2017, the Air Force conducted additional tests of radiant energy (optical) detectors open to any interested manufacturers. These tests confirmed the previous testing results and indicated the manufacturers had not modified or improved the basic detection device technology. The Air Force did develop a generic test protocol which would allow manufacturers to propose new products and technologies capable of performing in the unique DoD electromagnetic environment. Although the Government has gone through great efforts to develop a simple system using off-the-shelf components to the greatest extent possible, the optical detector and associated control panel are the only remaining components of this system for which there is now only one qualified manufacturer. The optical detector and associated control panel from this manufacturer are essential to the Government’s requirements and no other known products meets this requirement.

(b) Justification: UFC 4-211-01 related to design and installation of hangar fire suppression systems requires the use of optical flame detection using triple spectrum infrared technology to reduce false alarms and accidental discharge of foam fire suppression systems. The UFC specifically requires that these optical detectors be immune to EMF interference from aircraft frequencies to prevent false alarms and inadvertent foam discharges. The RSFACU must similarly be immune to EMF interference and must be the same manufacturer as the flame detectors in order to avoid compatibility issues.

(c) Impact: Failure to incorporate the Det-Tronics model X3301 Multispectrum IR Flame Detectors and Det-Tronics EQ30XX Eagle Quantum Premier RSFACU into the project will result in use of a system that will cause false alarms and accidental discharges of the foam fire suppression system in the aircraft hangar. A false alarm creates mission delays by pausing operations to vacate the hangar, identify alarm sources and attempt to troubleshoot and resolve.

Inadvertent foam discharges are potentially life-threatening, delay operations, incur costs for cleanup and possibly for facility and aircraft repairs. The unit cost of aircraft to be maintained in the proposed 3-bay Hangar/AMU are approximately $90M each.

(d) Alternatives: None. Specification of Det-Tronics model X3301 Multispectrum IR Flame Detectors and Det-Tronics model EQ30XX Eagle Quantum Premier RSFACU are essential to the Government's requirements, precluding consideration of products manufactured by other companies.

6. Efforts to Obtain Competition:

Based on the information in paragraph 5, above, competition for the sole source items to be included in the solicitation is not feasible as the brand name products identified are essential to the Government’s requirements.

In accordance with FAR 5.102(a)(6), this J&A will be included with the solicitation when the solicitation is made available through the Government Point of Entry (SAM.gov). Any sources that indicate interest as a result of the publication of the solicitation will be evaluated.

Subcontracting Competition: Subcontracting opportunities exist for suppliers, distributors, and/or installers. This is a restrictive specification that only precludes consideration of a product manufactured by another company. Subcontracting competition will be the responsibility of the Prime contractor awarded the resulting contract.

7. Actions to Increase Competition: To ascertain whether existing manufacturers or new manufacturers entering the market have developed products or programming which will be compatible, interchangeable, and competitive with the items identified in this document and currently in use, a sources sough notice was published on 20 May 2021on BetaSAM. The notice contained the Government’s intent to acquire the materials/systems included in this J&A on a sole source basis for aircraft maintenance hangar facilities in Japan. . No responses were received. No similar products meeting UFC 4-211-01were found.

8. Market Research: Market research was conducted to determine if there are other manufacturers who can fully meet the Government’s requirements. No firms responded to the sources sought notice that was posted to BetaSAM. No similar products meeting UFC 4-211- 01were found.

9. Interested Sources: To date, no other sources have submitted a written response to express an interest in the subject requirement.
