10464293 General Section H.8 Award of Task Orders Under Multiple Award Contracts

Paragraph f states that a post-award debriefing for task orders exceeding $6,000,000 will be given to requesting contractors.

Given that this is an 8(a) award and likely the majority of task orders less than $6 million, we request that debriefs be given regardless of the task order size, unless the award is solely made on price. Companies use these debriefs as lessons learned to continually improve our submissions.

On: Oct 02 2023.

Government Response. . FAR 16.505(b)(6) requires the debriefing for orders $6M and above. Companies are allowed to request a debriefing below that amount and the PCO will make a determination. On: Oct 03 2023 Current Request Status: Request Closed

10464297 Contracting Section L, Instructions to Offerors, Section D.2.c, Factor 2 Past Performance Evaluation

10464300 Contracting Section L, Instructions to Offerors, Section D.2.c, Factor 2 Past Performance Evaluation

10464302 Contracting Section L, Instructions to Offerors, Subsection D.2.b, Factor 1 Technical Approach

The RFP states that the "offeror shall submit a detailed technical approach based on the Performance Work Scope (PWS). Is the technical approach only to respond to the Seed Project PWS (Attachment 6), or should it also address all the requirements of the MATOC PWS in Section C?

On: Oct 02 2023.

Government Response. . Use the seed project for developing proposals. On: Oct 03 2023

Current Request Status: Request Closed Information for this report is procurement sensitive.

10464304 Contracting Section L, Instructions to Offerors, Subsection D.1.b, Entry-Gate Screening Criteria

This section requires bidders to submit proof of meeting entry-gate screening criteria. The requirement is to submit evidence in the form of a state regulatory letter of a site it performed within the last 7 years from issuance of this RFP where an HRSC study was accepted AND the project must be greater than $1.5 million. This is very restrictive for an 8(a) procurement and will significantly limit the field of competitors. We request this requirement at least be modified to remove the project dollar value.

On: Oct 02 2023.

Government Response. . Upon receipt of all comments on the draft RFP, USACE will make a determination on the requirement in the final RFP. On: Oct 03 2023 Current Request Status: Request Closed

Information for this report is procurement sensitive.

10464306 Contracting Section B, Contract Line Item Schedule - MATOC Binding Rates, Note 3

Comment Classification: Controlled Unclassified Information (CUI)

Note 3 states that Overhad and G&A is allowable on labor rates only and is not acceptable for Other Direct Costs, Subcontracting Costs, or Travel Costs. Note 7 further states that subcontracting costs shall include profit only. FAR 31.203 expressly states "(d) Once an appropriate base for allocating indirect costs has been accepted, the contractor shall not fragment the base by removing individual elements. All items properly includable in an indirect cost base shall bear a pro rata share of indirect costs irrespective of their acceptance as Government contract costs. For example, when a cost input base is used for the allocation of G&A costs, the contractor shall include in the base all items that would properly be part of the cost input base, whether allowable or unallowable, and these items shall bear their pro rata share of G&A costs." As noted, G&A is an expressly allowable cost under the FAR, and since this is an 8(a) setaside, disallowing these costs could be an undue burden on contractors. As such we request that G&A and profit be allowable per the FAR on ODCs and Subcontracts, and G&A only be allowable on Travel.

10464308 Contracting Section L, Attachment 6 Comment Classification: Controlled Unclassified Information (CUI)

The PWS references several documents that were created (reference Seed Task Section 8.0 References. Will USACE provide these documents as Government-Furnished Information (GFI) to ensure all offerors have the same information?

On: Oct 02 2023.

Please define what is meant by "provide Key Personnel qualifications for designated roles." How will the government evaluate key personnel qualifications?

On: Oct 05 2023.

Government Response. . Key personnel requirements are specific to the seed project. Sections L and M utilize the seed project as the project for proposal development and submission. 10468541 General Section L-D.1b, Volume I – General Requirements

Comment Classification: Controlled Unclassified Information (CUI)

Section L-D.1b, Volume I – General Requirements table Tab 6 on page 76 states that offerors shall submit the past three years' financial statements, annual reports, Dun & Bradstreet Ratings and/or number. After SAM converted to using UEI, many companies no longer pay D&B to keep their ratings current. Can the government please remove the requirement for D&B ratings? Also, can the government modify the request to "annual reports (as applicable)"? For Offerors made up of a JV, are both JV members required to submit Financial Information? Given the proprietary nature of Financial Information, will the government please allow Financial Information from JV partners to be submitted as separate, password protected files directly to the Contracting Officer, instead of as part of the Proposal Submittal?

On: Oct 05 2023.

Government Response. . JV's should submit financial information as the JV. If the JV is so newly chartered that financial data is not available, then financial data should be provided by both or one of the JV partners. This information shall be provided with the proposal. On: Oct 11 2023

10468542 General Section M-C.3b2a Comment Classification: Controlled Unclassified Information (CUI)

Section M-C.3b2a on page 113 states, "Remediation of contaminants of concern (COC) for Polycyclic Aromatic Hydrocarbons (PAHs), Semi-Volatile Organic Compounds (SVOCs) Volatile Organic Compounds (COV), metals, and pesticides. Within surface soils, subsurface soils, surface and groundwater." With the way it is written, this instruction expects an offeror's project to have all of these COCs instead of one or more of them. Could the government please edit this requirement from "and pesticides" to "or pesticides"? Additionally, does the government expect the remediation of these COCs to have been conducted in surface soils, subsurface soils, surface water, and groundwater in a single project as written, or could "and groundwater" be changed to "or groundwater"?

Does the government expect an Offeror's project to include the installation, operation, and maintenance of remediation systems with greater than 3 years of regulatory oversight for all the COCs listed in (a), or one or more of the COCs listed in (a)?

On: Oct 05 2023.

10468550 General Section M-C.3c on page 113

Section M-C.3c on page 113 states, "If a firm has multiple functions or divisions, the Government will only evaluate the past performance and experience of the unit or division submitting the offer." As currently written, this solicitation would prohibit the use of past performance from an affiliated firm (i.e., a sister company within a tribally owned firm). Generally, an Offeror is allowed to rely upon affiliates for its experience and past performance information as long as the solicitation (1) does not explicitly forbid it, and the Offeror's proposal represents that affiliates' resources will be involved in a meaningful manner [see Hot Shot Express, Inc., B-290482 (Aug. 2, 2002)]. Given that "(1)solicitations which restrict the ability of an offeror to provide the experience and past performance of its affiliates, even for proposals that demonstrate that affiliates will participate meaningfully in contract performance, are unduly restrictive of competition when the agency fails to provide an explanation that sets forth a reasonable basis for the restriction, Iyabak Construction, LLC, B-409196 (Feb. 6, 2014)", could the government please allow for tribally owned companies to use the past performance of affiliates (sister companies) in this solicitation as long as Offeror's proposal represents that affiliates' resources will be involved in a meaningful manner?
