Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) Physical Conditions. The physical conditions indicated on the drawings and in the specifications are the result of the site investigations by surveys and soundings. Contractors are strongly encouraged to visit the work site and determine for themselves the characteristics of the material and the extent of the work performed.

(b) Weather Conditions.

(1) The annual normal rainfall (1950-90) at Savannah, Georgia, Municipal Airport, 5 miles west of the site, is 49.70 inches. (Average Annual 1961-90: 48.30 inches.)

(B) Record (40 years) Minimum Monthly -- 0.02 inch October 1963

(C) Record (40 years) Maximum 24 Hour – 7.04 inches August 1971

Normally about 25 inches of rain falls during the thunderstorm season of 15 June through 15 September. The remainder of the annual rainfall, produced principally by squall-line and frontal showers, is spread over 9 months with a minor peak in March. Considerable periods of fair, mild weather are experienced in October, November, April, and to a less extent, in May. Snow is a rarity and even a trace does not occur on an average of once a year. The greatest recorded fall was

3.6 inches in February 1968. Severe tropical storms affect this area about once in 10 years. Rainfall from these storms constitutes our heaviest sustained precipitation. Instances of this are the 22.79 inches in August 1898, and 22.88 inches in September 1924, most of which was from tropical storms, (1950-85) 20.10 inches in July 1964.

(2) The average normal monthly temperature at Savannah, Georgia, (1950-90) is 66.8 degrees F. with seasonal averages as follows:

(c) Transportation Facilities. Railway facilities are available at Savannah, Georgia. Areas of work are accessible by barge through the Atlantic Intracoastal Waterway and the Savannah Harbor.

(d) Location. The location of the work is within the limits of disposal areas 2A in Chatham County, Georgia, and 12 A&B, 13 A&B, 14 A&B, and Jones/Oysterbed Island in Jasper County, SC. Maintenance of all bird islands, including the offshore bird island 2 miles east of Jones/Oysterbed Island, is also included in the scope of this work.

(e) Subsurface Investigations: No subsurface investigations (drilling or core boring) have been performed for this work.

(A) The Contractor shall promptly, and before the conditions are disturbed, give a written notice, within 3 days, to the Contracting Officer of (1) subsurface or latent physical conditions at the site which differ materially from those indicated in this contract, or (2) unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inherent in work of the character provided for in the contract.

(B) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the conditions do materially so differ and cause an increase or decrease in the Contractor’s cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.

(C) No request by the Contractor for an equitable adjustment to the contract under this clause shall be allowed, unless the Contractor has given the written notice required; provided, that the time prescribed in (i)(A) above for giving written notice may be extended by the Contracting Officer.

(D) No request by the Contractor for an equitable adjustment to the contract for differing site conditions shall be allowed if made after final payment under this contract. (FAR 52.236-2 DIFFERING SITE CONDITIONS.)

(E) The Contractor acknowledges that he has taken steps reasonably necessary to ascertain the nature and location of the work, and that he has investigated and satisfied himself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertainties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during work performance. The Contractor also acknowledges that he has satisfied himself as to the character, quality, and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including all exploratory work done by the Government, as well as from the drawings and specifications made a part of this contract.

Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.

(F) The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of its officers or agents before the execution of this contract, unless that understanding or representation is expressly stated in this contract

(FAR 52.236-3 – SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK).

3.1 MOWING

3.1.1 General

a. The dike system consists of approximately 42 miles of dikes at Savannah Harbor and 5 miles of dike at Andrews Island, with additional frontage roads. The areas to be mowed have both variable widths and slopes. In order to fulfill the requirement of this contract, specialized equipment must be used. Mowing the tops of the dikes shall be accomplished using a mowing machine pulled behind a tractor. Mowing all other areas, dike slopes and wet areas, shall be accomplished using a boom mower and/or batwing mower. The Contractor will furnish all labor and special equipment as required to accomplish this. All equipment used in the operation of mowing shall be adequate to produce the desired results.

b. Areas of mowing are to be cut a maximum of 5 inches above the ground except in areas where Love grass is dominant, where mowing shall be cut to a maximum of 10 inches above the ground. The Contractor shall keep the mowers in proper adjustment at all times in order to eliminate destroying the turf and/or leaving the vegetation above 5 inches. The Contractor shall ensure that mower blades are kept sharp at all times and all mowing equipment is in top running order. The vegetation shall be left in a cleanly cut condition. If the areas are not mowed satisfactorily on the first pass as a result of failure by the Contractor to maintain sharp blades, the Contractor will be directed to re-mow the area at no additional cost to the Government.

c. The Contractor shall perform all mowing operations in a manner which will prevent any spillage or leakage of fuel, oil, or any material that may contaminate the area. The Contractor shall clean up any

SECTION 02 01 40 Page 11 contamination of the area caused during mowing.

d. At all weir locations, a 16-foot width access path shall be mowed or cut to the outlet end of the weir pipe. The access path to each weir catwalk shall be mowed the same as the dike. The cost for this will be included in the mowing of the containment area.

3.1.2 Equipment

The Contractor shall use equipment that will not destroy the integrity of the dike. Equipment used shall not be permitted to operate on slopes that are too steep or sandy and that will cause rutting of slopes. The Contractor shall restore all damage to the top of dikes, slopes, shoulders, or roads caused by the Contractor, to their original condition. On slopes that are too steep for equipment, a boom mower will be required. Also, there are areas within the limits of mowing that are wet and/or pond water for extended periods of time which will require use of a boom mower.

3.1.3 Order of Work

Order of work shall be determined by the Contracting Officer. Mowing of the top of dikes, slopes, underdrain ramps, access ramps, access shoulders, etc. shall be completed and accepted per containment area unless otherwise directed by the Contracting Officer.

3.1.4 Extent of Mowing

a. Mowing shall consist of mowing of all dikes, dike slopes, access ramps, under drain station ramps, weir access ramps, weir outfall accessories, etc. In accordance with the August 1996 U.S. Corps of Engineers Environmental Impact Study, the dike roads and 5' down the inside and outside slopes may be mowed during the non-mowing season defined as April 1 to July 15. Mowing season is defined as July 16 to March 31. Grass will be taller after this period of time and will require more time to be mowed. Avoid all bird nests at all times.

b. In addition to the dikes, the Contractor shall be required to mow the access road along the front of Areas 12A and 14A and an open area adjacent to the tide gate structure on the South Carolina side of the Back River. This mowing will consist of mowing the shoulders and back slope approximately 10 feet on each side of the road. Inside of curves will be 15 feet.

c. Area 2A, located on Hutchinson Island, may be accessed by water or land. To access Area 2A by land requires crossing property owned by International Paper Company. Permission to cross International Paper Company's property will be the responsibility of the Contractor. The Government will assume no responsibility nor arrange for the Contractor to have access to this disposal area across the property owned by International Paper Company. The Contractor may use a barge at his own expense.

d. The Contractor may be required to mow an area at the outside toe of the dike and/or all or portions of the interior of any of the disposal areas. Estimated quantities are shown in Table 1.
