Questions
Question: This scope of work does not require the contractor to take government property into our possession. As this contract is for inspection and testing services only, and the systems we are working on are permanently affixed to the structures they are installed, can this requirement be removed?
Answer: (a) When GP (GFP or CAP) is required to be on contract, the contractor is required to submit a Property Management Plan (PMP) with their proposal. FAR 45.201(c)(4): A description of the offeror's property management system, plan, and any customary commercial practices, voluntary consensus standards, or industry-leading practices and standards to be used by the offeror in managing Government property.
The repair parts are considered: Contractor Acquired Property (CAP) CAP is property purchased or fabricated by a contractor for use on a contract. Property will not be recorded on DoD financial statements or in accountability systems until property is delivered to DoD. CAP that is subsequently delivered and accepted by the Government for use on the same or another contract is considered GFP.
Therefore you are correct the government property of the Fire suppression systems are affixed to the facility however the repair parts are considered CAP.
