SECTION 00 21 00 - INSTRUCTIONS
The following have been modified:
OFFEROR Q&A
(Continued from Amendment 01 questions, #1 - #19)
20. Which are the forecasts of how much construction work will actually take place under this MATOC?
Which kind of tasks are forecasted? What kind of construction works are expected to happen and in which countries of the area?
Government response: This is an indefinite delivery/indefinite quantity contract. In Solicitation
Section 00 10 00 Contract Line Item Number (CLIN) schedule, in the description under each CLIN, the countries are listed and the type of work is listed. As an indefinite delivery/indefinite quantity contract, the type and location of work required will be determined and solicited at the task order level.
21. Is there any forecast about which are the Government Agencies that are expected to give USACE the inputs to issue the Task Orders? If yes: In which countries are they operating and when will this agencies unveil their needs and budgets?
Government response: No. Europe District U.S. Army Corps of Engineers is issuing this indefinite delivery/indefinite quantity contract, and is the construction agent for Department of Defense (DOD) and other U.S. Agencies operating in Africa. Requirements will be publicized at the task order level, to those firms which are awarded a contract under this MATOC.
22. Is there any forecast about the value of the Task Orders that will originate under this MATOC? Will the table shown in section 01 11 00 “Summary of Works” be completely fulfilled and therefore is the 10% of the tasks issued going to be above USD 1’000’000 value? In the contrary, what’s the exact meaning of the percentages shown there?
Government response: The table shown in Solicitation section 01 11 00 lists the expected magnitude of projects under this MATOC. The meaning is stated…the listed percentages of projects are expected to be valued between certain U.S. dollar amounts. Therefore, yes, it is expected that 10% of projects on this
MATOC will be above $1 Million.
23. Will the Task Orders originated within the MATOC include a deadline for the short-listed contractors to reply? For how many times can a contractor not be interest in the RFPs issued under this MATOC?
Government response: Solicitation Section 01 30 00 Administrative Requirements explains the task order request for proposal process. Yes, this process will include a request for proposal due date for each task order. Solicitation Section 00 70 00 Conditions of the Contract, contains on ramp/off ramp procedures. The contracting officer will determine when it is in the best interest of the Government to off-ramp a MATOC contractor. The following statement has been added to these procedures: “A
MATOC contractor, which does not propose on any task order requests for proposal (RFPs) issued within a one calendar year period, may be off-ramped using the methods listed.”
24. Will the task orders have to be performed within the time-frame of MATOC's validity? Will the start date and end date of a task order be based on an agreed project schedule?
Government response: All task orders will be awarded during the MATOC period of performance.
And the period of performance and schedule for each individual task order will be determined at task order award. However, if a task order is awarded near the end of the MATOC period of performance, that task order period of performance may go beyond the MATOC period of performance, per the task order schedule determined at award.
25. Being the fees for the pricing (phase 2) in man-day, and having the template only a subdivision by year, how does the pricing template take into account the differences in workforce costs between the different countries in the indicated areas? How should a contractor selected in phase 1, manage such differences?
Government response: The Solicitation Attachment 4 Pricing Schedule is already separated into five
(5) one-year periods. And each one-year period is further broken down into two (2) different groups of countries. The Government will not break down this pricing schedule further. Therefore, the method of determining the price is entirely the Offeror’s decision from a business perspective.
26. Can you please specify the range of design services needed and therefore the expected requirements of the designer team? Will the Task Orders take designing time and costs into account?
Government response: Solicitation Factor 4 Design Capability is a Phase II requirement. This
Solicitation is currently at Phase I. This is a design build indefinite delivery/indefinite quantity contract.
Design requirements for the MATOC solicitation are listed in the Factor 4 submission requirements.
Design requirements will be stated for each individual project at the task order level.
27. Can an interested contractor show, in his submission, projects bigger than the values indicated in the solicitations documents? How are bigger projects being evaluated in comparison with projects that fits in the required range of value?
Government response: Solicitation Section 00 22 00 Supplementary Instructions Evaluation Criteria states the U.S. dollar range that is considered relevant for this solicitation. Therefore, projects that are not within that range will be considered less relevant than those within that range. To be clear, projects outside the listed range will not be disqualified, but will be considered less relevant that projects within the listed range.
SECTION 00 70 00 - CONDITIONS OF THE CONTRACT
The following have been modified:
ON RAMP OFF RAMP PROCEDURES
a. On-Ramp Procedures:
(1) The Government reserves the right to re-open competition at any time during the term of the contract. The KO intends to periodically review the need for additional Contractors during the contract period of performance (PoP). If it is determined to be in the Government’s best interest to add Contractors, an on-ramp may be executed. When an on-ramp is used, the
Government will advertise the reopening of the competition on FedBizOpps. All new awardees shall meet the criteria established in the initial solicitation. The evaluation and selection of awardees for any on-ramp will be the same as the evaluation and award criteria used for the initial basic contract awards. The anticipated number of awards will be announced in the reopening announcement posted to FedBizOpps; however the PCO has the discretion to award more or fewer contracts than the number anticipated in the solicitation depending upon the quality of the offers received.
(2) Any Contractor that received a basic contract award shall not re-compete. The new awardee(s) will compete with any existing or remaining Contractors for all task orders. Any additions due to on-ramps will not impact the contract ceiling. The ordering period for new awardees will not extend the overall maximum term of the original contract, nor shall it re-establish the contract base period. The new awardee(s) will be eligible to compete for future task order requests for proposals issued against the basic IDIQ contract. The Government will not consider unsolicited requests for additional Contractors.
b. Off-Ramp Procedures:
The Government reserves the right to utilize off-ramps when it is determined in the best interest of the Government. The Government may off-ramp a Contractor by permitting a Contractor’s contract to expire instead of exercising an option, implementing a termination for convenience, implementing a termination for default or taking any other action permitted by the contract terms and conditions.
A Contractor, which does not propose on any task order requests for proposal (RFPs) issued within a one calendar year period, may be off-ramped using the methods listed.
