SECTION 00 21 00 - INSTRUCTIONS

The following have been added by full text:

OFFEROR Q&A

1. The text of the Bank Letter of Assurance has no time limitation. Please advise if the banks would be allowed to add a validity period to the BLA text.

Government response: No. Per the BLA sample, and per the BLA clause 52.000-4059, the BLA is an assurance that the contractor’s bank shall furnish a bank letter of guarantee if the contractor is awarded a contract. The BLA will be returned to the contractor when that contractor is awarded a project task order under the MATOC. The BLA will also be returned to each Offeror not awarded a base MATOC contract under this solicitation.

2. Please clarify at which phase the bank letter of assurance should be submitted. Please advise if the Bank Letter of Assurance is required to be submitted in phase I or II?

Government response: The BLA is due at Phase II with the Volume II proposal. Solicitation section 00 21 00 Submission Requirements, Paragraph 3, has been updated to clarify this requirement. Also, Paragraph 6 already states this.

3. Please inform us, whether the proposal due date (25.01.2017) is valid only for Phase 1 or is also valid for Phase 2.

Government response: The 25 January 2017 proposal due date is for Phase I only. See section 00 21 00 Instructions, Overview, Paragraph 3. Only those among the most highly qualified as outlined in Phase I of this solicitation will be required to submit additional information for Phase II for evaluation.

4. For experience on projects located in other African countries and elsewhere such as Asia/Europe, but not located in the specified Southern Africa countries…would these be a fail element in our technical evaluation, or will they be rated as less relevant? If yes, can we submit the performance of our key subcontractor for stated countries in the solicitation for 5 projects?

Government response: Please note, Section 00 22 00 Supplementary Instructions, Evaluation Criteria, Factor 1 Experience has been clarified and updated as follows:

“Offerors demonstrating experience with multiple projects in multiple trades are considered more relevant. Projects older than 6 years, projects not performed in the listed countries, or projects valued outside the listed range, may be considered but will be considered less relevant.”

Therefore, not meeting any of these criteria will make that Offer less relevant, but will not disqualify an Offer nor cause an Offer to fail. However, please see “NOTE” section, in which the Offeror must have performed at least 3 of 5 projects.

5. Do we need to submit a Letter of Commitment(s) for DOR in Phase II Volume I, Factor 4 (Design Capability)?

Government response: Yes. This is for Phase II.

6. Can you confirm that the solicitation requires a 30% Bank Letter of Guarantee for each awarded Task Order?

Government response: Yes. See Clause 52.000-4062 BANK LETTER OF GUARANTY. For each project task order, the awarded contractor shall provide a BLG valued at 30% of the total task order value.

7. SF1442, Block 13: Requires two copies of the offeror's proposal be submitted to a USACE postal address in Germany. It is noted that electronic submittals via ARMDEC are also required (AMRDEC SAFE). Is the offer still required to submit two "hard" copies of its proposal to the stated German postal address?

Government response: Offeror proposals shall be submitted via the AMRDEC SAFE site only. Hard copies are not required.

8. SF1442, Block 13: States that an Offer Guarantee is required. Please confirm that this is / is-not a submittal requirement. We can find no elaborating information in the Solicitation Document (1442) regarding an "Offer Guarantee.

Government response: The BLA is the Offer Guarantee. See response to question #2 which clarifies the requirement for the BLA at Phase II.

STATEMENT:

Pages 13 and 23 of the Solicitation document state that this is a two-phase procurement and that only those offerors found technically responsible in phase I will be invited to submit a Cost / Price proposal in a Phase II phase of the Solicitation.

However, pages 21 and 22 of the Solicitation state under Submission Requirements, that Offerors must submit our Electronic Price Schedule and "failure to submit the Electronic Price Schedule and failure to complete all Line Items on the Electronic Price Schedule, including the base year and all options years may result in the Offeror’s proposal package being rejected by the Government after initial evaluation without further consideration.

9. Is this really a two-step procurement as authorized under 10 U.S.C. 2305a? Must a completed Electronic Price Schedule and a completed SF-1442 be submitted with our initial response to the Solicitation? OR, will a Price / Cost proposal be solicited at a later time for specific Task Orders from those offerors found technically qualified?

Government response: This is a two-phased procurement. The section referenced (solicitation page 21-22) is the set of submission requirements for Phase II. Therefore the Electronic Price Schedule shall be required at Phase II, and only from invited Offerors. Additionally, for those Offerors awarded a MATOC contract, per Solicitation 01 30 00 Administrative Requirements, the Contractor will provide a price proposal for task orders in response to requests for proposal (RFP).

10. Please provide details of where Defense Base Act insurance can be obtained - name of carrier(s) who will provide such insurance in each of the African countries in which work will be performed.

Government response: See clause 52.228-3 Workers’ Compensation Insurance (Defense Base Act) (July 2014), and click the link to the DOL (Department of Labor) website. On this website, click “LONGSHORE AUTHORIZED CARRIERS AND SELF-INSURED EMPLOYERS” which contains a listing of all insurance carriers currently authorized by the Department of Labor to provide DBA insurance.

11. Will this contract be the follow-on to an on-going, or previous MATOC / JOC. If this is a follow-on contract please provide a). the name(s) of the previous winners; b). the number of TO’s / JO's awarded by year and the total aggregate amount of all TO’s / JO's.

Government response: In Fiscal Year 2012, a MATOC was awarded for Central and Southern Africa.

However, no task orders were awarded in the Southern Africa region. Below are the awarded contractors under the FY12 Central and Southern Africa MATOC:

W912GB-12-D-0002: SKE

W912GB-12-D-0003: Contracting Consulting Engineering LLC W912GB-12-D-0004: Lakeshore Engineering Services Inc.

W912GB-12-D-0005: ERKA Co. Ltd.

W912GB-12-D-0006: CNAF-SET JV

12. What is the anticipated percentage of MATOC work will take place in each of the stated South African countries?

Government response: That information is not available.

13. Is it anticipated that any construction work will take place outside of the stated South African countries?

Government response: The work under this proposed MATOC will ONLY take place in the listed countries.

14. Since the contractor will be paying its bills in local African currencies and the exchange rates between these currencies and the Dollar have been historically subject to large fluctuations, must the Offeror assume all risk associated with exchange rate fluctuations from when their proposal is made and when their good and proper Invoices are submitted for payment? OR, will the Government be amenable to an equitable adjustment if the exchange rates change more than a certain TBD percent?

Government response: As stated in Solicitation Section 00 21 00 Instructions, Proposal Submission Requirements Factor 5 Price, the Government reserves the right to award task orders and make payments in U.S. Dollars. Offerors assume any and all risk associated with currency fluctuations.

15. Will the US Government Task Order RFP contain a specific set of tasks to be performed leaving it up to the contractor to determine the type and amount of labor required to satisfy the RFP requirements? Will the USG issue a Performance Work Statement with each RFP and leave implementing details (labor, travel, materials) to the contractor?

Government response: Yes. See Solicitation Section 01 30 00 Administrative Requirements, which specifies the process for task order requests for proposals.

16. A requirement for a Bank Letter of Assurance in the amount of US$300,000 is stated at page 33 of the Solicitation document. Should this number be US$200,000 considering that the total contract award value for the base and option years will not exceed US$20 million?

Government response: Correct. Solicitation BLA references have been updated to state “$200,000.00”.

17. Is there a Solicitation requirement to provide with its proposal a Bank Letter of Assurance? If so in what amount? If a BLA is required will the winning offeror's bank Letter of Assurance be returned after contract award in exchange for Bank Guarantees in the amount of the Job Orders awarded? Or, must the successful offeror's Bank Letter of Assurance remain in force for the contract period?

Government response: Please see responses to Questions #1 and #2 above.

18. Is there a page limitation applicable to Proposal Attachment 2, Experience Information Sheet?

Government response: No.

19. Will there be additional MATOCs for West and Central and East and North Africa? If so when can industry expect these solicitations to be released?

Government response: Interested parties are invited to continue monitoring FedBizOpps (www.fbo.gov) for any information on future solicitations. Parties may search using the Europe District DOD activity address code “W912GB”.
