Section 00 21 00 - INSTRUCTIONS

INSTRUCTIONS

SECTION II - SOLICITATION PROVISIONS

A. Basis for Award

Subject to the provisions contained herein, award will be made to one Offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), conforms to the solicitation requirements and whose proposal is determined to be technically acceptable on all non-price technical evaluation factors and offers the lowest price to the Government. This source selection approach, called Lowest Price Technically Acceptable (LPTA), includes an evaluation of all factors: experience, past performance, key personnel and qualifications, and price.

B. Factors to be Evaluated In accordance with FAR 15.304, the following evaluation factors will be used to evaluate each proposal.

1. Factor One (1) – Experience

2. Factor Two (2) - Past Performance

3. Factor Three (3) – Key Personnel and Qualifications

4. Factor Four (4) – Price

C. Evaluation Approach

All proposals shall be subject to evaluation by the Source Selection Team (SST). All factors are listed below along with the specific evaluation criteria of each factor.

1. Technical Factor One (1) - Experience

a. In order to receive an acceptable rating the offeror must demonstrate on the three projects they submit, at a minimum, the following experience: Tthe offeror’s projects must meet ALL of the criteria established innumbers 1-3. And, the offeror’s projects must demonstrate experience in at least two of evaluation criteria established in numbers 4-7. Offerors must meet these requirements in order to receive an overall acceptable for Experience:

Must Meet ALL of the Following

i. At least one project in Serbia

ii. At least two projects valued at over $100,000.

iii. At least two of the projects were completed within the past five (5) years of the closing date of this solicitation, or at least 50% complete.

Must Meet at Least Two of the Following

iv. A project demonstrating design-build experience.

v. A project demonstrating experience in architectural construction practices.

vi. A project demonstrating experience in mechanical systems and plumbing.

vii. A project demonstrating experience in electrical systems.

c. If more than the maximum of three (3) projects are submitted, only the first three (3) will be evaluated.

d. An Offeror will not receive credit under this factor for the relevant experience of an individual or for key personnel experience proposed for this project. An Offeror should not submit the base indefinite delivery indefinite quantity (IDIQ) contracts and multiple award construction contracts as projects, however, individual task orders under those contracts may be submitted as projects.

e. The Technical Factor Ratings, excerpted below focus on the strengths, deficiencies, weaknesses, risks and uncertainties of the offeror's proposal. The rating depicts how well the offeror’s proposal meets the Technical requirements.

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

2. Factor Two (2) - Past Performance

Past performance shall be evaluated in accordance with FAR 15.305 and DFARS 215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in the table below. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

a. Evaluation of past performance shall be in accordance with this plan utilizing the forms and questionnaires set forth in Appendix D.

b. Aspects of Past Performance Evaluation. The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the solicitation requirements. There are two aspects to the past performance evaluation. The first is to evaluate whether the offeror’s present/past performance is relevant or not relevant to the effort to be acquired.

The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.

a. The Government reserves the right to verify statement the Offeror makes regarding its past performance to determine whether they are substantiated.

b. Additional Past Performance Evaluation Information:

c. Negative comments received from data gathered by the Government will not necessarily result in an adverse rating. However, negative comments from relevant past performance sources may negatively impact the evaluation of an Offeror’s past performance.

c. RELEVANCY: The first aspect of the past performance evaluation is to assess the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. Relevancy is not separately rated; however, the following criteria will be used to establish what is relevant which shall include trend in Offeror’s performance, how recent the project submitted was performed, dollar value, and similarity in scope of work performed.

Past Performance Relevancy Ratings

Rating Definition

Very Relevant Present / past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present / past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present / past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present / past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

1. QUALITY ASSESSMENT: Assess the quality of the offeror’s past performance on those recent efforts that were determined relevant by determining how well the contractor performed on the contracts. Documented results from Past Performance Questionnaires, interviews, CPARS, and other sources form the support and basis for this assessment.

2. PERFORMANCE CONFIDENCE ASSESSMENT: The Offeror's past performance will be evaluated based on the performance on projects submitted under Factor One (1), Experience, and any other past performance information obtained and deemed appropriate by the Government. Past performance shall be evaluated in accordance with the following criteria:

i. Quality: The degree to which the Offeror has complied with the contract requirements;

met quality standards; was timely in regard to problem resolution without extensive customer guidance; and the shown effectiveness of his prior quality control program.

ii. Schedule/Timeliness of Performance: Whether the Offeror met contract completion dates including significant milestones and where schedules were exceeded; and whether the Offeror identified valid justifications for the delays or if liquidated damages were assessed due to late delivery by the Offeror.

iii. Customer Satisfaction: The degree to which end-users were satisfied with the project;

whether the Offeror was reasonable and cooperative in regard to resolving disagreements; whether the Offeror was responsive and businesslike with concern for the customer; and whether the Offeror achieved customer satisfaction.

iv. Management Personnel/Labor: Whether the Offeror used effective business practices for on-site management for subcontractors, suppliers, materials, and labor force; whether and the extent to which the Offeror displayed an ability to hire and retain a qualified workforce; controlled government/ owner property when applicable; provided a workforce with the required expertise; easily assimilated and incorporated changes in requirements and priorities in response to the owner; and provided an effective overall management and control of projects and programs.

v. Cost/Financial Management: Whether the Offeror met the contract requirements by completing the project at the agreed to price and where not; the extent to which the Offeror was responsible for cost increases; whether the Offeror provided alternative methods that benefited the client; whether the Offeror submitted invoices timely with sufficient documentation to substantiate requested payment; and whether the Offeror avoided significant unexplained variances from the original price.

vi. Safety/Security: The Offeror’s prior record for maintaining an environment of safety, adherence to a safety plan, and compliance with safety requirements, including following safety regulations, housekeeping, and correcting noted deficiencies, as well as the Offeror’s prior compliance with all security requirements and personnel security requirements when applicable.

Performance Confidence Assessments:

Rating Definition

Substantial Confidence Based on the Offeror’s recent / relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence Based on the Offeror’s recent / relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Limited Confidence Based on the Offeror’s recent / relevant performance record, the Government has a low expectation that the Offeror will successfully perform the required effort.

No Confidence Based on the Offeror’s recent / relevant performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.

Unknown Confidence (Neutral)

No recent / relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

3. An offeror must receive a rating of Somewhat Relevant and Satisfactory

Confidence or better to receive an Acceptable rating overall for Past Performance.

A rating of Not Relevant or Limited Confidence or lower will result in an overall rating of Unacceptable for Past Performance.

Past Performance Evaluation Ratings

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

d. Technical Factor Three (3) - Key Personnel and Qualifications

This factor evaluates the offeror’s minimum acceptable experience and qualifications of key personnel on the project. The key personnel are the Project Manager and Designer(s) of Record.

c. The PM shall be responsible for the design and construction of the project indicated in the solicitation. The Designer(s) of Record must be able to certify designs based on local construction laws, or describe how designs will be certified under local construction laws.

d. The project manager must have at, a minimum, one year of experience and/or the designer of record must have at, a minimum, one year of experience .

e. The proposal must address how designs shall be certified under local construction laws.

d. The rating depicts how well the offeror’s proposal meets the Technical requirements.

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

e. Factor Four (4) - Price/Cost

The contract will be a firm fixed price contract. The Government will evaluate price reasonableness for the fixed priced effort.

a. Evaluation

i. The Government will evaluate price, for award purposes, based on the total sum of all base and option items. Evaluation of options shall not obligate the Government to exercise any or all options. In order to be considered acceptable, offers must contain prices for all contract line item number(s) (CLINs) identified in the price schedule. Failure to submit a price and failure to complete all CLINs in Section 00 10 00 of the Solicitation may result in the Offeror’s proposal package being rejected by the Government after initial evaluation without further consideration.

ii. The LPTA procedure is applied to known, firm requirements, where a fair and reasonable price determination is based on adequate price competition. Therefore, price analysis will normally be used to determine the total evaluated price to support the selection of the lowest priced, technically acceptable offeror. Although in exceptional cases when the determination of fair and reasonable price requires additional information, the PCO may conduct a cost analysis to support the determination of whether the proposed price is fair and reasonable. Regardless of the specific evaluation methodology, in order to enable offerors to make informed decisions on how best to propose, every solicitation will provide an adequate description of the cost or price evaluation.

iii. The price evaluation will not be assigned an adjectival rating, yet will be evaluated for completeness and reasonableness as follows:

a. Completeness: To be complete, the Offeror must provide all data that is requested and necessary to evaluate the prices, including completing all CLINs identified on the price schedule. The Government will assess the extent to which the proposed prices comply with the content and format requirements set forth in this solicitation.

b. Reasonableness: The Offeror's proposal will be evaluated through price analysis techniques as described in FAR Part 15. For price to be reasonable, it must represent a price that provides best value to the Government when consideration is given to prices in the market (market conditions may be evidenced by other competitive proposals) and the technical and functional capabilities of the Offeror. The Offeror’s proposed prices will be evaluated to determine if any are unreasonably high in relation to the anticipated work under the contract as well as current industry standards.

Because the evaluation of the price proposal will represent a portion of the total evaluation, it is possible than an Offeror might not be selected for award because of unreasonable, unbalanced, incomplete, inaccurate, non-current price proposal information and/or project pricing data.

D. Proposal Submission

The Government will not make assumptions concerning intent, capabilities, or experiences. Clear identification of proposal details shall be the sole responsibility of the Offeror. The proposal shall meet the following basic requirements:

1. Introduction.

The offeror’s proposal shall be submitted in hard copy, with accompanying digital copies, as set forth below. The RFP shall provide the Government address and receipt date for proposal submittal.
