For a commercial item exception, the Offeror shall submit, at a minimum, information on prices at which the same item or/similar items have previously been sold in the commercial market that is adequate for evaluating the reasonableness of the price for this acquisition. Such information may include—
(A) For catalog items, a copy of or identification of the catalog and its date, or the appropriate pages for the offered items, or a statement that the catalog is on file in the buying office to which the proposal is being submitted. Provide a copy or describe current discount policies and price lists (published or unpublished), e.g., wholesale, original equipment manufacturer, or reseller. Also explain the basis of each offered price and its relationship to the established catalog price, including how the proposed price relates to the price of recent sales in quantities similar to the proposed quantities;
(B) For market-priced items, the source and date or period of the market quotation or other basis for market price, the base amount, and applicable discounts. In addition, describe the nature of the market; or
(C) For items included on an active Federal Supply Service Multiple Award Schedule contract, proof that an exception has been granted for the schedule item.
(3) The Offeror grants the Contracting Officer or an authorized representative the right to examine, at any time before award, books, records, documents, or other directly pertinent records to verify any request for an exception under this provision, and the reasonableness of price. For items priced using catalog or market prices, or law or regulation, access does not extend to cost or profit information or other data relevant solely to the Offeror's determination of the prices to be offered in the catalog or marketplace.
(4) Requirements for certified cost or pricing data. If the Offeror is not granted an exception from the requirement to submit certified cost or pricing data, the following applies:
(i) The Offeror shall prepare and submit certified cost or pricing data and supporting attachments in accordance with the instructions contained in Table 15-2 of FAR 15.408, which is incorporated by reference with the same force and effect as though it were inserted here in full text. The instructions in Table 15-2 are incorporated as a mandatory format to be used, unless the Contracting Officer and the Offeror agree to a different format.
(ii) As soon as practicable after agreement on price, but before contract award (except for unpriced actions such as letter contracts), the offeror shall submit a Certificate of Current Cost or Pricing Data, as prescribed by FAR 15.406- 2.
(c) If the Offeror is the Canadian Commercial Corporation, certified cost or pricing data are not required. If the Contracting Officer notifies the Canadian Commercial Corporation that additional data other than certified cost or pricing data are required in accordance with 225.870-4(c), the Canadian Commercial Corporation shall obtain and provide the following:
(1) Profit rate or fee (as applicable).
(2) Analysis provided by Public Works and Government Services Canada to the Canadian Commercial Corporation to determine a fair and reasonable price (comparable to the analysis required at FAR 15.404-1).
(3) Data other than certified cost or pricing data necessary to permit a determination by the U.S. Contracting Officer that the proposed price is fair and reasonable [U.S. Contracting Officer to provide description of the data required in accordance with FAR 15.403-3(a)(1) with the notification].
(4) As specified in FAR 15.403-3(a)(4), an offeror who does not comply with a requirement to submit data that the U.S. Contracting Officer has deemed necessary to determine price reasonableness or cost realism is ineligible for award unless the head of the contracting activity determines that it is in the best interest of the Government to make the award to that offeror.
(d) If negotiations are conducted, the negotiated price should not exceed the offered price.

NOTE: Pages that exceed the required page limitation will not be evaluated. Additional pages will be removed from the back to the front of the proposal, and will not be evaluated by the Government.
The purpose of the management/technical approach narrative is to determine if the offeror has a clear understanding of the scope of work for the solicitation as well as a viable approach for executing the projects.
The offeror shall provide a detailed narrative that identifies the offeror’s understanding of the overall scope for a project or projects similar to those described in Phase One’s Factor 2 and its approach to completing the work. The narrative will identify all the major scope components of a project. Offerors will provide a discussion of the technical approach to the project that demonstrates not only an understanding of the geographic constraints, local labor market, laws, culture, and other anticipated challenges but also mitigation strategies for identified challenges.
Offerors will demonstrate a clear understanding of the following: use of local consultants and labor, potential material shortage, assembly of the administrative and technical staff, shipping and logistics, subcontractor markets, site security, local storage of materials, lay-down area(s), weather factors, and/or other unique requirements of the project.
The narrative shall specifically address the following elements:
Element 1 – Licensing: Offerors shall provide a copy of current licensure in Saudi Arabia including relevant construction licenses, Saudi Arabian General Investment Authority (SAGIA) documents, and design firm registration.
Element 2 – Base Access: Describe in detail a current base access pass process and procedures and/or provide a detailed plan with examples from the past five years. Provide copies of Iqamas (residency permits for Saudi Arabia) for planned key personnel.
Element 3 – Permit Requirements: Describe in detail your understanding of the Saudi permit requirements as they apply to performing Design-Build or Design-Bid-Build construction providing: (1) a list of necessary permits applicable to a construction project that you performed, (2) a detailed plan to obtain the necessary permits, and (3) if possible, evidence of obtaining applicable permits for projects performed on Saudi military bases.
Element 4 – Subcontractor Management: Submit a Subcontractor Management Plan which describes by name and position all key subcontractors (anticipated to perform 30% or more of the work) identified for potential projects in accordance with the Statement of Work, and how you plan to integrate those subcontractors into the overall contract effort. Provide a copy of each key subcontract binding agreement or letter of commitment that obligates the parties if no subcontract is in place. Provide a name, address, telephone number, and email point of contact for each of the subcontractors you identify. Describe plans for implementing and maintaining oversight and management of subcontractors to ensure performance is consistent with contract requirements.
Element 5 – Organization: Describe the management process that will be used to manage multiple projects in widely separated areas in Saudi Arabia. Provide a narrative on project organization, defining the roles, responsibilities, and authority to be delegated to the staff in each position. Discuss how work flows through the organization. Identify all of the major components of the team for the project and explain how their work will be integrated into the overall scope. Identify how the offeror will integrate the design team into the organization for potential projects. Explain the role the design team will be allotted in the decision-making process. Provide an organizational chart showing the relationship between the offeror, sub-contractors, Quality Control (QC) personnel, safety personnel, and USACE.
Element 6 – Quality Control: Each offeror shall describe its capabilities to assure quality control by describing its quality control approach, corporate systems, and capabilities to maintain quality control of the construction.
Each offeror shall provide specific information on how it will manage quality control and changes during design to meet the schedule and to facilitate quicker Government review, as well as how it will handle internal and external requests for information, shop drawings, submittal reviews, progress meetings, site visits, contract completion, closeout, as-built, and completion documentation. Offerors will be required to describe their experience with the USACE three-phase inspection system and their experience using the QCS system. (Note, after contract award, the selected contractor(s) will submit their Quality Control Plan for Government approval.)
EVALUATION APPROACH FOR FACTOR 1
The overarching evaluation approach for Factor 1 elements are as follows:
Element 1 – Licensing: The offeror will show that they have the necessary construction and design licenses and documentations to prove that they have worked and can currently work in Saudi Arabia. Offerors must submit a copy of their current licenses to perform construction projects in Saudi Arabia as part of their proposal. Greater weight will be given to offerors with design registration in Saudi Arabia.
Element 2 – Base Access: The offeror will show that they have worked on construction projects in Saudi Arabia or the Middle East countries of Kuwait, Qatar, UAE, Oman and/or Bahrain. Base access in Saudi Arabia will be more advantageous to the Government than base access work in the Middle East countries identified above or the CENTCOM AOR (i.e. Afghanistan, Iraq, Egypt, Jordan, Kyrgyzstan, Kuwait, Qatar, United Arab Emirates, Kazakhstan, Lebanon, Oman, Pakistan, Turkmenistan, Syria, Bahrain, Uzbekistan, Tajikistan, etc.).
The Government will evaluate each offeror’s understanding of current base access/pass procedures, requirements and potential constraints. The completeness, reasonableness, feasibility, and timeline of the offeror’s plan to gain a sufficient number of base passes to meet the offeror’s staffing plan will be considered. Greater weight will be given to offerors that demonstrate they currently perform work in Saudi Arabia, with the greatest weight given to offerors that are currently working on a Saudi military base and have current access.
Element 3 – Permit Requirements: The Government will evaluate the offeror’s understanding of current Saudi permitting requirements, the completeness of the offeror’s list of necessary permits applicable to performing construction in Saudi, and the offeror’s timeline and detailed plan to obtain the necessary permits. Greater weight will be given to offerors that demonstrate their experience in obtaining recent (i.e. in the past 5 years) applicable permits for projects on a Saudi military base.
Element 4 – Subcontractor Management: The Government will evaluate the clarity and strength of the overall Subcontract Management Plan to manage subcontractors’ performance and to integrate subcontractors into the project team to successfully execute the entire scope of work. The Government will evaluate how well the offeror will implement and maintain surveillance over subcontractors to ensure performance is in compliance with requirements. The offeror is required to identify whether they will use an in-house design team or an independent design firm as part of their response under this element. Greater weight will be given to offerors that demonstrate previous experience with subcontractors on relevant projects included in experience/past performance factors.
Element 5 – Organization: The Government will evaluate the extent to which an offeror’s Organization Plan includes well defined organization and lines of authority, responsibility, communication, integration of design team, and tracking of schedules. The offeror shall clearly describe its organization structure including lines of authority and the relationship between its home office, site office (office which is directly responsible for performing work as described in this solicitation), and USACE. An organization chart including titles and explanations of the major responsibilities and authorities for key personnel in the home office, support office, and site offices shall be provided. The Organization Plan shall clearly explain the proposed project staffing and how the work effort can be effectively managed. The organization chart should clearly identify where positions/personnel are located and whether filled by the Prime Contractor or their subcontractor’s personnel. The roles of any Joint Venture partners and/or major subcontractors (i.e. subcontractors anticipated to perform 30% or more of the work) must be clearly stated in this section. A subcontract or binding agreement must be included in the proposal for all major subcontractors. If a Joint Venture, the offeror should address the respective roles of the Joint Venture partners.
Greater weight will be given to offerors who can effectively demonstrate organizational structure, process, and procedures that minimize the risk to the Government.
The Government will more heavily weight proposals that demonstrates an understanding of: (1) how the Task Order will be accomplished under the proposed organizational structure; (2) how supervision will be accomplished during all phases of work; and (3) how various types of problems will be effectively and efficiently resolved within the organization.
Element 6 – Quality Control: The Government will evaluate each offeror’s capabilities and understanding of the contractually required quality control processes for both design and construction. The Government will evaluate the adequacy of the staffing plan to cover all required tasks and responsibilities. The Government places a high value upon early integrated participation by construction personnel during the design phase and continued participation by the designers of record during the construction quality control process. Greater weight will be given for quality control experience on a USACE design-build project. Greater weight will also be given for USACE QC experience on a project in the CENTCOM AOR.
