The offeror shall confine submissions to essential matters, sufficient to define the proposal in a concise manner, to permit a complete and accurate evaluation of each proposal. The Summary Section shall contain a brief abstract of the file. Proprietary information shall be clearly marked.
B. BASIS FOR AWARD
1. Award will be made to the offeror whose proposal represents the best value to the Government, taking into consideration both non-price factors and price. The Source Selection Authority (SSA) will use a Best Value Tradeoff (BVTO) process, using a bifurcated-solicitation approach, to determine which proposal represents the best value to the Government. The Tradeoff process will consider three non-price factors that are listed in descending order of importance: (1) Technical; (2) Past Performance; and (3) Small Business Participation.
Additionally, any other than small business offeror must have an acceptable Small Business Subcontracting Plan to receive an award in accordance with FAR 19.702(a). Offerors will be cautioned that the award may not necessarily be made to the lowest priced offer. Non-priced factors (1), (2), and (3), when combined are approximately equal to price.
2. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for Factor 1, Technical (to include all elements) and Factor 3, Small Business Participation. Factor 2, Past Performance will receive a confidence assessment. The Government reserves the right to make award based upon the Cost/Price factor if the Technical, Past Performance, and Small Business Participation evaluation results of all the offerors’ proposals are substantially the same. In order to be eligible for award, a rating of no less than Acceptable is required on factors (1) and (3), and a rating of no less than Neutral Confidence is required on factor (2).
3. Factor 5 – Project Labor Agreement (PLA) - PLA will ensure the offeror has negotiated and entered into a Project Labor Agreement with one or more labor organizations and that it establishes the terms and conditions of employment this project. This PLA factor will be evaluated on an acceptable/unacceptable basis. The PLA Factor will not play a role in the tradeoff analysis discussed above, but an offeror’s PLA must be rated acceptable in order for the offeror to be eligible for award.
C. FACTORS TO BE EVALUATED
The following factors will be used to evaluate each proposal. Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors described below. The submissions will be bifurcated into 2 Volumes. Each of the two Stages of the solicitation shall include the requirements for the corresponding Volume of the proposal. Finally, an Amendment to the Solicitation will include the requirements for a third Volume of the proposal.
SUBMISSION REQUIREMENTS: STAGE 1
Stage 1 of the solicitation shall include the requirements for submission of Volume I of the proposal. Volume I of the proposal shall include five Tabs, A-E, as described below:
Offerors are responsible for including sufficient details in their Stage 1 proposals, in a concise manner, to permit a complete and accurate evaluation of Volume I proposals.
TAB A STANDARD FORM (SF1442), SOLICITATIONS, OFFER, AND ACKNOWLEDGEMENT OF

TAB D FACTOR 1 – TECHNICAL MERIT
Technical Merit is divided into the following elements:
1. Technical Approach Plan
2. Management Plan
Element 1 – Technical Approach Plan
At a minimum, offerors shall adequately address all items (a)-(e) below.
a. Dam and Levee Embankment Construction
Describe approach for sourcing, processing (crushing-screening), testing, storage, and handling of embankment materials.
Describe approach for constructing embankment, including internal drainage features such as the chimney and blanket drain. Include specific means and methods to keep different materials separated and uncontaminated.

e. Soil-Cement Construction Describe approach for production and installation of soil-cement, including sourcing, processing, handling, and testing of materials for soil cement slope protection.
Describe quality control measures to be implemented beginning with preparation of the embankment surface and extending to final placement and testing of soil cement.
Note: The areas of work identified in paragraph (1)(a)-(e) above represent areas of particular concern to the Government. Therefore, for each such area of work, the offeror must affirmatively explain whether it intends to self-perform the work or whether it intends to subcontract the work. If the offeror intends to subcontract the work, the offeror must identify the subcontractor proposed and submit a letter of commitment from that contractor using the template in Attachment 2.
A letter of commitment is defined as a letter from a subcontractor on official company letterhead addressed to the offeror as prime contractor, identifying the work the subcontractor intends to perform, and stating that the subcontractor is willing to be bound to perform the identified work if the offeror is awarded a contract. A letter of commitment simply stating that a subcontractor commits to submit pricing to the offeror does not satisfy this requirement.
Element 2 – Management Plan
At a minimum the Management Plan shall address the three items below:
1. Provide an organization chart of the key positions. The following positions shall be included in the organization chart: Project Manager, Superintendent, Lead Geotechnical Engineer, Quality Control Manager, Site Safety and Health Officer, Data Manager, Design Engineer, and Slurry Wall Specialist in accordance with the Specifications. Offeror shall NOT submit employee resumes. The organization chart shall also include the Quality Control and Safety Teams including their relationship and reporting within the overall organization. Offeror shall provide qualifications the company proposes for each key position included. This includes required education, specialized experience, and certifications. If the offeror proposes qualifications that exceed the specifications, the offeror must clearly call out this fact in its proposal. If the offeror is awarded a contract under this solicitation, the offeror’s proposed qualifications for key positions will be incorporated into the contract.
2. Provide a detailed chart/plan for how the offeror proposes to coordinate and communicate with major subcontractors (that is, subcontractors doing work identified above in paragraphs (1)(a)-(e)) of the technical factor and with other contractors working in and around the project site.
3. Provide a detailed plan for how the contractor will ensure timely submission of acceptable-quality submittals meeting the submittal requirements in the specifications. Include procedures that will ensure quality submittals on the first submission, and a correction plan for any submittal that requires more than one round of corrections before it can be approved
TAB E FACTOR 2 - PAST PERFORMANCE
The offeror shall provide recent and relevant construction projects. There are two submission requirements for Factor 2: the Company Specialized Experience Form, and the NAVFAC/USACE Past Performance Questionnaire.
Offerors are encouraged to submit a combination of projects demonstrating experience with as many relevant characteristics as possible. Projects submitted can be performed by the Offeror’s major subcontractors that will be utilized on this contract.
First, using the Company Specialized Experience Form (Attachment 1), offerors shall provide a minimum of two, not to exceed five, examples of completed projects. In order to be considered relevant, the projects must demonstrate that the offeror and/or their major subcontractors (if applicable) have experience accomplishing the following and submitted projects must demonstrate:
a. Constructing a new dam or levee construction with a minimum height of 10 feet.
b. Managing surface and subsurface water within a construction site where the subsurface is highly permeable (defined as hydraulic conductivity of 500 feet per day or higher, and groundwater level is at or near ground surface (within 5 feet of ground surface).
c. Constructing steel sheet pile water exclusion cofferdams to facilitate excavation dewatering. The difference in water level across the cofferdam must be a minimum of eight feet. Project submitted must include dewatering design and placement of a tremie concrete seal slab as part of the water exclusion cofferdam design.
d. Constructing reinforced, cast-in-place, concrete water control structures with operable gates.
Offerors shall submit a past performance portfolio that collectively satisfies at least one example of all four key scope characteristics above. Offerors do not have to include all 4 characteristics on one project but must demonstrate at least one example of each scope characteristic (Items a to d above) on the totality of the projects submitted.
A “project” is defined as work performed at a single site under a single contract or task order. An IDIQ contract or other similar ordering vehicle is not considered a “project”; however, a single task order issued under that IDIQ or ordering vehicle may be considered a “project” under this evaluation factor.
If any offeror provides more than five projects, only the first five projects submitted in order of submission will be evaluated. No additional consideration or evaluation will be given for the remaining submissions.
If the offeror proposes to use the past performance of a major subcontractor, the proposal must clearly demonstrate that the same subcontractor will be utilized and will have meaningful involvement in the performance of the contract. Similarly, if any offeror has multiple functions or divisions, limit the project examples to those performed by the division, unit, or team member submitting the offer. If the offeror proposes to use the experience of an affiliate, the proposal must clearly demonstrate that the affiliate will have meaningful involvement in the performance of the contract. A major subcontractor is a subcontractor doing work identified above in Element 1, paragraphs (a)-(e) of the Technical Approach Plan.
NOTE: For purposes of evaluating Past Performance, the Prime Contractor is defined as the contractor identified in Block 14 of the Standard Form (SF) 1442. If more than one contractor is listed in Block 14, then a signed joint venture agreement must be submitted with the proposal and the joint venture shall be registered as such in the System for Award Management (SAM). However, each party of the joint venture must submit their own UEI number with the JV proposal.
The Government will consider a proposal that includes with its completed projects the past performance of a major subcontractor, as long as the proposal demonstrates that the subcontractor will have meaningful involvement in the performance of the contract. The subcontractor shall not be listed in Block 14 of the SF 1442.
If submitting a proposal as a joint venture, the experience of each joint venture partners can be submitted separately but may not exceed the maximum of five examples of completed projects. The experience of each joint venture partners can be submitted for the joint venture entity. These projects will be evaluated separately;
however, the overall evaluation for the demonstrated experience will be combined to form one overall evaluation rating for the joint venture.
Second, the offeror shall submit one NAVFAC/USACE Past Performance Questionnaire (PPQ) (Attachment 3) for each project submitted.
If the offeror is unable to obtain a completed NAVFAC/USACE PPQ from the point of contact before the proposal due date, the offeror shall complete and submit with the proposal the first page of the questionnaire (Blocks 1 –
7) that contains contract and client information for the submitted project. It is the offeror’s responsibility to ensure that the client’s point of contact information is current and correct. The client point of contact reflected in Blocks 1 – 7 should also be familiar with the past performance they are being asked to verify and informed that they will be contacted by the Government to verify past performance. If a Contractor Performance Assessment Reporting System (CPARS) record or official performance evaluation form from a non-federal entity is available for any of the projects submitted, the CPARS record or official performance evaluation form from a non-Federal entity may be submitted in lieu of the completed NAVFAC/USACE PPQ.
The Government reserves the right to review all recent past performance records available to make a confidence determination, to include other projects not submitted by the Offeror. The Government also reserves the right to review past performance of any Subcontractors or JV partners the Offeror may have submitted. Key focus areas will include the following (see PPQ Form):
• Quality
• Schedule/Timeliness of Performance
• Customer Satisfaction
• Management/Personnel/Labor
• Cost/Financial Management
• Safety/Security
In order to be RECENT, a project must have been completed, or be at least (80% or more) physically complete within the last ten (10) years from the solicitation issue date as of the date of this solicitation. If the project is less than 100% physically complete, the offeror must explain which elements of the work are completed and provide supporting documentation. Also note that the offeror may utilize different projects to demonstrate experience in each of the areas required above.
A letter of commitment (Attachment 2) shall be provided for any proposed major subcontractor for this solicitation as explained in Factor 1 and Factor 2 sections above. If any of that work is intended to be self-performed, it should be stated in the proposal.
SUBMISSION REQUIREMENTS: VOLUME 2
Volume II will be requested for submission separate from Volume I, via an amendment issued after receipt of Volume I proposals. The amendment will be issued via email only to contractors that submitted proposals for Stage
1. A Price Schedule will be included in the amendment for submission of Volume II and will be due approximately 14 days after issuance of the referenced amendment. This volume shall consist of all information required to support proposed prices. Certified cost and pricing data are not currently required; however, the Government reserves the right to request such data prior to award.
TAB A STANDARD FORM (SF1442), SOLICITATIONS, OFFER, AND ACKNOWLEDGEMENT OF
AMENDMENTS.
The SF1442 shall be completed by the offeror and duly executed with an original signature by an official authorized to bind the company in accordance with instructions at FAR 4.102.
