SOLICITATION NUMBER: W912EP25R0005

PROJECT TITLE: Comprehensive Everglades Restoration Program (CERP), Broward County, Water Preserve Areas (BCWPA) Project, Contract 2, C-11 Impoundment and Mitigation Area A, Broward County, Florida

DESCRIPTION OF WORK: This new requirement is an unrestricted, full and open solicitation, best value trade-off approach for the procurement of a firm-fixed price (FFP) competitive, design-bid-build (DBB), construction project for the CERP, BCWPA Project, Contract 2, C-11 Impoundment and Mitigation Area A, Broward County, Florida.

USACE-Jacksonville District is procuring a construction requirement for BCWPA. Work includes storing direct stormwater runoff events from the western C-11 drainage basin in the impoundment instead of pumping the untreated runoff into an adjacent water conservation area (WCA 3A). The impoundment pool will also assist in reducing seepage from WCA 3A and the future WCA 3A/3B Seepage Management Area, thereby increasing groundwater recharge in the vicinity of the impoundment and providing an additional source of water for meeting municipal and agricultural water supply demands, and for preventing saltwater intrusion into drinking water aquifers.

See Volume II, DESCRIPTION OF WORK: REFER TO SECTION 01 11 00 FOR COMPLETE PROJECT DESCRIPTION.

MAGNITUDE OF CONSTRUCTION: Over $500,000,000.00

TYPE OF SOLICITATION & NAICS CODE: Unrestricted. The NAICS Code for this Project is 237990, Other Heavy and Civil Engineering Construction. The Small Business Size Standard is $45 Million

STRUCTURE LEGEND:

Pre-proposal conference: PROJECT INFORMATION The completed C-11 Impoundment will include an above-ground earthen reservoir targeted to have a total storage of 4,600 acre-feet with an effective interior area of approximately 1,053 acres and a normal pool water storage depth of approximately 4.7 ft.

Contract 2 dam embankment (D-511) will have an approximate height of 15ft (crest elevation of 18.8 ft NAVD88). The Contract 2 project includes construction of a slurry wall within the D-511 embankment footprint. It will include an approximately 29,700 ft of embankment and slurry wall.

The slurry wall will have a typical width of 2.5 ft and will be up to 41 ft tall, extending from EL 6 ft NAVD88 to variable depths ranging from EL -10 to -35 ft NAVD88. Temporary slurry wall transitions are required between Contract 2 and Contract limits. Contract 2’s limits end near stations 145+00 and station 205+00; east and west respectively

The proposed Mitigation Area 'A' is approximately 488-acres and located north of the impoundment. Work includes approximately 3.5 miles of perimeter levee, clearing, grubbing, selective removal of invasive plant species and replanting of native vegetation. It provides 89.7 acres of restored wetland, with 81.5 acres of marsh zone habitat and 8.2 acres of littoral zone habitat. Water levels within the mitigation area will fluctuate approximately 1.0 ft above average ground elevation (5.3 ft NAVD88). The levees surrounding the mitigation area will have an approximate height of 3 ft (crest elevation of 7.3 ft NAVD88).

Contract 2 includes 12 total Water Control Structures:

- Gated Culverts S-506A, S-508B, S-508D, and S-511

- Ungated Culverts S-500A, S-505E, S-506B, S-508A, and S-509

- Fixed, Broad-crested Weirs S-505B, S-505C, and S-505F

Pre-proposal conference– PROJECT INFORMATION There are two environmentally sensitive areas (ESAs) which are to be protected during construction and will be ultimately excluded from the project by means of embankment alignment. The ESAs will be protected from disturbance during construction and will be avoided by completed project features.

Contact 2 includes a requirement to backfill the existing Central Lake and an existing borrow area. These features are existing quarry pits estimated to be up to 55 feet deep and filled with water. Backfill of the Central Lake and Borrow Area will primarily consist of onsite muck material. However, the Contractor will be provided approximately 10,800 cubic yards of stockpiled limerick aggregate, located adjacent to SW 26th street and the proposed construction staging area, which is approved to be placed in Central Lake.

Contract 2 will require continuous stormwater management and conveyance of an approximate two square-mile drainage area north of the project site, which flows southward through the project site, plus any stormwater generated within the Contract 2 limits for the duration of the contract. Since stormwater flows will ultimately need to pass south through the future Contract 3 project limits for discharge into the C-11 Canal, stormwater management will include the requirements and restrictions for Contract 2, provided for in the specifications. Surface and subsurface water management will be required to control surface and groundwater levels and conduct work in the dry at various locations within the construction limits in accordance with applicable contract specifications.

Other project features and activities include clearing, grubbing, planting, borrow, material processing, boat ramps, soil cement embankment armoring, emergency stockpiles, instrumentation and monitoring stations, wetland preservation/protection, erosion control, and debris disposal.

PRE-PROPOSAL CONFERENCE: EVALUATION CRITERIA

BASIS FOR AWARD: In accordance with USACE Alert 25-HQ-029: USACE Guidance on Rescission of Class Deviation 2025-O0002 and its Revision 1, Waiver of Project Labor Agreement Requirements in FAR 22.5, for large-scale construction projects already solicited, and proposals have been received, an amendment to add a PLA requirement must be available to all of industry (not limited to current offerors) and the proposal due date must be extended by at least 30 days. Award will be made to the offeror whose proposal represents the best value to the Government, taking into consideration both non-price factors and price. The Source Selection Authority (SSA) will use a Best Value Tradeoff (BVTO) process to determine which proposal represents the best value to the Government. The Tradeoff process will consider three non-price factors that are listed in descending order of importance: (1) Technical; (2) Past Performance; and (3) Small Business Participation. Additionally, any other than small business offeror must have an acceptable Small Business Subcontracting Plan to receive an award in accordance with FAR 19.702(a). Offerors will be cautioned that the award may not necessarily be made to the lowest priced offer. Non-priced factors (1), (2), and (3), when combined are approximately equal to price. Factor 5, Project Labor Agreement (PLA) will also be assessed by the Government: namely, the submission of a PLA. This PLA factor will be evaluated on an acceptable/unacceptable basis. The PLA Factor will not play a role in the tradeoff analysis discussed above, but an offeror’s PLA must be rated acceptable in order for the offeror to be eligible for award. Award will be made based on the best overall proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the five evaluation factors:

STAGE 3: due 24 November 2025 FACTOR 1 – Technical Merit FACTOR 2 – Past Performance FACTOR 3 – Small Business Participation FACTOR 4 – Price FACTOR 5 – Project Labor Agreement (PLA)

The Technical, Past Performance and the Small Business Participation Factors, when combined, are approximately equal to Price. The first three factors are listed in order of importance.

Please refer to Section 00100A for complete instructions and details

FACTOR 1 – Technical Merit

Submission Requirements

Technical Merit includes the following: Technical Approach Plan, and Management Plan

Technical Approach Plan - at a minimum, the Technical Approach Plan shall address items (a)-(e) below. Offerors shall address all sub-elements in order to receive an acceptable rating:

Dam and Levee Embankment Construction Surface and Subsurface Water Management Cutoff Wall Construction Canal Excavation Soil-Cement Construction

Refer to the Technical Approach Plan sections for a complete description of what is required under this factor.

CONT. FACTOR 1 – Technical Merit, Submission Requirements

Management Plan - at a minimum, the Management Plan shall address the three items listed below:

Provide an organization chart of the key positions.

Provide a detailed chart/plan for how the offeror proposes to coordinate and communicate with major subcontractors identified as part of the technical factor and with other contractors working in and around the project site.

Provide a detailed plan for how the contractor will ensure timely submission of acceptable-quality submittals meeting the submittal requirements in the specifications.

Refer to the Management Plan section for a complete description of what is required under this factor.

CONT. FACTOR 1 – Technical Merit

Evaluation Method

The Government will evaluate how well a proposal demonstrates both a logical and a practical approach, sequence, execution plan and means and methods used to accomplish the required work for all required items under Factors to be Evaluated, Submission Requirements, Factor 1 Technical Merit/Technical Approach Plan. To be considered acceptable, the Technical Approach Plan will include information necessary to give the Government confidence that the offeror understands the requirements and can execute the construction project as detailed in the plans and specifications. The Government will also evaluate the offeror’s proposed ability to mitigate and manage risk.

Refer to the Technical Approach Plan sections for a complete description of what is required under this factor.

CONT. FACTOR 1 – Technical Merit

Management Plan

The Government will evaluate how well the proposal demonstrates key positions identified meet or exceed the qualifications required to perform the work under this solicitation. Additional consideration may be given for management plans that clearly exceed the minimum qualifications required or that effectively describe application of lessons learned related to change management and key positions replacement or that demonstrate significant team depth or backup plans may be rated more favorably.

The Government will evaluate the offeror’s understanding and ability to coordinate and communicate with major subcontractors while making sure all requirements are met, and schedule impacts are avoided.

Finally, the Government will evaluate adequate knowledge of submittal processes in accordance with USACE requirements using Resident Management System (RMS) and the offeror ability to timely manage all required submittals.

Refer to the Management Plan section for a complete description of what is required under this factor.

FACTOR 2 – Past Performance

The offeror shall provide recent and relevant construction projects. There are two submission requirements for Factor 2: the Company Specialized Experience Form and the NAVFAC/USACE Past Performance Questionnaire.

First, using the Company Specialized Experience Form (Attachment 1), offerors shall provide a minimum of two, not to exceed five, examples of completed projects. In order to be considered relevant, the projects must demonstrate that the offeror and/or their major subcontractors (if applicable) have experience accomplishing the following and submitted projects must demonstrate:

a.Constructing a new dam or levee construction with a minimum height of 10 feet.
b.Managing surface and subsurface water within a construction site where the subsurface is highly permeable (defined as hydraulic conductivity of 500 feet per day or higher, and groundwater level is at or near ground surface (within 5 feet of ground surface).
c.Constructing steel sheet pile water exclusion cofferdams to facilitate excavation dewatering. The difference in water level across the cofferdam must be a minimum of eight feet. Project submitted must include dewatering design and placement of a tremie concrete seal slab as part of the water exclusion cofferdam design.
d.Constructing reinforced, cast-in-place, concrete water control structures with operable gates.

Refer to the Past Performance section for a complete description of what is required under this factor.

FACTOR 2 – Past Performance CONT

In order to be RECENT, a project will be considered recent if it is at least 80% physically complete within the last 10 years from the date of this solicitation. If the project is less than 100% physically complete, the offeror must explain which elements of the work are completed and provide supporting documentation.

In order to be RELEVANT, the criteria listed in “Table 2-Past Performance Relevancy Ratings” will be used to establish what is relevant which shall include similarity of scope, complexity, dollar value, contract type, and degree of subcontract/teaming.

Second, the offeror shall submit one NAVFAC/USACE Past Performance Questionnaire (PPQ) (Attachment 3) for each project submitted.

Refer to the Past Performance section for a complete description of what is required under this factor.

Cont. FACTOR 2 – Past Performance

The past performance evaluation factor assesses the degree of confidence the Government has in an offeror’s ability to meet the solicitation requirements, based on the offeror’s record of performance. The assessment considers each offeror's demonstrated recent, relevant, and overall quality for each of the performance reference in supplying services that meet the solicitation requirements.

Refer to the Past Performance section for a complete description of what is required under this factor.

CONT. FACTOR 2 – Past Performance, Evaluation Method

The first aspect is to evaluate the recency of the offeror’s past performance. Recency is generally the time period during which past performance references are considered relevant and is critical to establishing the relevancy of past performance information. A project will be considered recent if it is at least 80% physically complete within the last 10 years from the date of this solicitation. If the project is less than 100% physically complete, the offeror must explain which elements of the work are completed and provide supporting documentation.

The second aspect is to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. Relevancy is not separately rated; however, the following criteria (see Table 2) will be used to establish what is relevant which shall include similarity of scope, complexity, dollar value, contract type, and degree of subcontract/teaming.

3. The third aspect is to assess the quality of the offeror's past performance. USACE may do this by multiple methods, including validating the quality ratings on the past performance questionnaires, reviewing CPARs and other Government databases, and interviews with people familiar with the offeror's past performance. Quality assessments do not receive a separate rating apart from the Performance Confidence Rating.

Performance Confidence Assessment: The Government will utilize the Performance Confidence Assessment below to select the most appropriate confidence level for each Offeror.

NOTE: In the case of an offeror without a record of recent/relevant past performance, or for whom information on past performance is not available, or so sparse that no meaningful past performance rating can be assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown (or “Neutral Confidence”) past performance, having no favorable or unfavorable impact on the evaluation.

FACTOR 3 - Small Business Participation

Submission Requirements

This Factor consists of two elements:

Small Business Participation Commitment Document (SBPCD), and Commitment to Small Business

All offerors, regardless of size status, shall address their planned small business usage for this requirement and will be evaluated on the level of proposed participation of U.S. small businesses (as a small business prime, joint venture, teaming arrangement, and/or small business subcontractors) in the performance of this acquisition relative to the objectives, requirements and goals established herein.

Minimum Small Business Participation Goals:

For SB, the minimum goal is 10%.

For SDB, the minimum goal is 5%.

For WOSB, the minimum goal is 3%.

For SDVOSB, the minimum goal is 3%.

For HUBZone, the minimum goal is 2%.

Cont. FACTOR 3 - Small Business Participation, Submission Requirements

Small business prime offerors may achieve small business participation (meet or exceed MQR) through their own performance/participation as a prime and through a joint venture, teaming arrangement, and subcontracting to other small businesses. Small business Participation Commitments will become requirements and be incorporated into the resulting contract. Small Business Concerns identified in the SBPCD must be used on the contract. No deviations or substitutions will be permitted after award unless approved in writing by the Contracting Officer.

The offeror’s small business participation factor will be assessed an adjectival rating of either Outstanding, Good, Acceptable, Marginal, or Unacceptable. The relevant definitions are noted in the Table Below.

Refer to the Small Business Participation section for a complete description of what is required under this factor.

Cont. FACTOR 3 - Small Business Participation, Evaluation Method

FACTOR 4 – PRICE AND PRICE RELATED INFORMATION

Submission Requirements

Offeror shall submit a Pricing Schedule in accordance with the Standard Form 1442, Section 00010A, Line Items and Pricing Schedule. The total price for the construction will be considered for evaluation.

FACTOR 4 – PRICE (continued)

Evaluation Method

Price is not rated. It is evaluated to ensure that the price is fair and reasonable in accordance with FAR 15.404. The Price proposal will be evaluated for the following:

Compliance Unbalanced Pricing Errors In accordance with 33 U.S.C. 624, no Civil Works construction will be awarded by private contract if the contract price exceeds the Government estimate by more than 25%.

As discussed in the Basis for Award Section, non-price factors 1, 2 and 3, when combined, are approximately equal to price.

In accordance with FAR 19.1307, if applicable, the price evaluation preference for HUBZone small business concerns will be used for this acquisition.

FACTOR 5 – Project Labor Agreement

Submission Requirements

In accordance with FAR Provision 52.222-33, Notice of Project Labor Agreement, which is incorporated into this solicitation, all offerors are required to 1) negotiate or become party to a project labor agreement with one or more labor organizations for the term of the resulting construction contract, (2) require its subcontractors to become a party to the resulting project labor agreement, and (3) submit said project labor agreement with their offer. At a minimum, the PLA must address the following six requirements:

i. Bind the Offeror and Subcontractors engaged in construction on the construction project to comply with the project labor agreement;

ii. Allow the Offeror and all Subcontractors to compete for contracts and subcontracts without regard to whether they are otherwise parties to collective bargaining agreements;

iii. Contain guarantees against strikes, lockouts, and similar job disruptions;

iv. Set forth effective, prompt, and mutually binding procedures for resolving labor disputes arising during the term of the project labor agreement;

v. Provide other mechanisms for labor-management cooperation on matters of mutual interest and concern, including productivity, quality of work, safety, and health.

vi. Fully conform to all statutes, regulations, Executive orders, and agency requirements.

FACTOR 5 – Project Labor Agreement CONT

Evaluation Approach

This factor will be evaluated on an “Acceptable” or “Unacceptable’ basis. In order for an Offeror to be considered eligible for award, the PLA must receive an “Acceptable” rating. To receive an Acceptable rating for this factor, the PLA must address satisfactorily all six submission requirements listed above. This factor is not included within the tradeoff analysis discussed in the Basis for Award section.

Important Reminders: Read the solicitation in its entirety

Joint Ventures: Proposals from joint ventures must include a copy of the joint venture agreement, signed by authorized representatives of all participants. Offerors are reminded that if it is an 8(a) or HUBZone joint venture, it shall ensure that it complies with the applicable requirements of 13 CFR Part 124 and 13 CFR Part 126, respectively. In addition, the joint venture must be registered and active in the System for Award Management website (SAM.gov) as a joint venture in order for an award to be made.

Commitment Letters: A letter of commitment is defined as a letter from a subcontractor on official company letterhead addressed to the offeror as prime contractor, identifying the work the subcontractor intends to perform, and stating that the subcontractor is willing to be bound to perform the identified work if the offeror is awarded a contract. A letter of commitment simply stating that a subcontractor commits to submit pricing to the offeror does not satisfy this requirement.

Important Reminders: Read the solicitation in its entirety Subcontracting Plans: For other than small business offerors, a Small Business Subcontracting Plan shall be submitted that contains all the elements required by FAR 52.219-9 ALT II, in Section 00700. This plan shall be submitted separately from the Small Business Participation information required in Factor 3. The Small Business Subcontracting Plan is not a requirement for evaluation in source selection, but rather a requirement for award to other than small business.

The Small Business Subcontracting Plan shall be thorough and complete. The Subcontracting Plan will be incorporated into the contract upon award of the contract to the offeror, if acceptable and upon final approval of the Contracting Officer.

SAM Registration: Failure to have an active and completed registration in SAM will determine an Offeror ineligible for ward and removed from competition.

Bid Guarantee: An electronic copy of the bid guarantee shall be submitted with the offer. The electronic copy must be signed and legible. The Bid Guarantee will be reviewed for acceptability. Any offeror whose bid guarantee is unacceptable will be eliminated without further consideration unless the Source Selection Authority/Contracting Officer later determines that discussions are necessary and decides that the offeror’s proposal should be included in the competitive range.
