3. UPDATE TO VOLUME I: FACTOR 1 – TECHNICAL MERIT
The following have been modified:
FACTOR 1 – TECHNICAL MERIT
In responding to this factor, the objective should be to instill confidence that the offeror thoroughly understands the requirements of the solicitation, has the expertise and experience required to successfully satisfy or exceed the solicitation requirements within the required period of performance (See Section 00700, FAR Clause 52.211-10).
In accordance with the Limitations on Substitutions For Certain Items of Work, Positions and/or Subcontractors paragraph in Section 00800 of this solicitation, a letter of commitment must be provided for any proposed major subcontractor for the following positions or items of work: (1) rock blasting and (2) temporary sheet pile installation.
A major subcontractor is defined as any subcontractor whose experience is submitted as part of this proposal and is also identified in the non-substitution clause in Section 00800 of the Solicitation.
A letter of commitment is defined as a letter from the major subcontractor on official company letterhead (1) addressed to the offeror (prime contractor), (2) identifying the work they intend to perform, and (3) stating that they are willing to be bound to perform the identified work if the offeror is awarded a contract. A letter of commitment simply stating that a major subcontractor commits to submit pricing to the offeror does not satisfy this requirement. Submission requirement; Letter of Commitment for Key Subcontractor or Key Personnel (Attachment 2).
Failure to provide a letter of commitment from a proposed major subcontractor or key personnel will be noted as a deficiency.
Elements are not rated separately. An overall rating will be assigned for Factor 1 – Technical Merit. See “Technical Merit Ratings” below.

(End of paragraph)
CONSTRUCTION CONTRACTOR PERFORMANCE EVALUATIONS
In accordance with the provisions of Subpart 36.201 (Evaluation of Contractor Performance) of the Federal
Acquisition Regulation (FAR), construction contractors’ performance shall be evaluated throughout the performance of the contract. The United States Army Corps of Engineers (USACE) follows the procedures outlined in Engineering and Construction Bulletin 2014- 13 to fulfill this FAR requirement. For construction contracts awarded at $750,000 $650,000.00 or more, the USACE will evaluate contractor's performance and prepare a performance report using the Contractor Performance Assessment Reporting System (CPARS), which is a web-based system.
After an evaluation (interim or final) is written up by the USACE, the contractor will have the ability to access, review and comment on the evaluation for a period of 60 days. The evaluation will be transferred to the Past Performance Information Retrieval System (PPIRS) within 15 calendar days after issuance. However, it will remain with “Pending” status in PPIRS until the government official closes the form in CPARS. Contractors may access their own evaluations in PPIRS by registering as a user and obtaining specific software, called PKI certification, which is installed on the user's computer. The certification is a Department of Defense requirement and was implemented to provide security in electronic transactions. The average cost per certificate is about $100 - $120 per year and is purchased from an External Certificate Authorities (ECA) vendor. Current information about CPARS, PKI certification process and for contacting vendors can be found on the web site: http://www.cpars.gov. If the Contractor wishes to participate in the performance evaluation process, access to CPARS and PKI certification is the sole responsibility of the Contractor.
LIMITATIONS ON SUBSTITUTIONS FOR CERTAIN POSITIONS AND/OR SUBCONTRACTORS
The award decision for this contract was based, in part, on an evaluation of the personnel and/or subcontractors the Contractor included in its proposal for the positions and/or items of subcontracted work identified at the end of this paragraph. The Contractor agrees these personnel and/or subcontractors will be employed as described in its proposal and no substitutes will be employed without prior written approval of the Contracting Officer or Administrative Contracting Officer. The Contractor further agrees that any proposed substitutes shall meet or exceed the qualifications of the original personnel and/or subcontractors. If the Contractor’s proposal did not name a subcontractor for an identified item of work, the Contractor will not be allowed to subcontract that item of work without prior approval of the Contracting Officer or Administrative Contracting Officer.
Personnel subject to Limitations On Substitutions For Certain Positions And/Or Subcontractors:
• Contractor's Project Manager
• Quality Control Manager
• Site Superintendent
Subcontract work subject to Limitations On Substitutions For Certain Positions And/Or Subcontractors:

Measurement procedures for payment, required quantity survey or procurement documentation and payment restrictions are described in applicable specification sections.
Allocate costs for work not specifically mentioned to the Line Item most closely associated with work involved. Unless there is a specific Line Item for administrative costs, such as Quality Control and Safety, allocate such costs proportionally across all Line Items.
1.2 RESIDENT MANAGEMENT SYSTEM (RMS)
1.2.1 Definition
The terms Contract Line Item Number (CLIN) and Line Item are interchangeable herein (e.g.: CLIN 0001 is Line Item 0001). The term CLIN is a contracting term used in the Resident Management System (RMS) payment data base.
1.2.2 Instructions
See Section 01 45 00 RESIDENT MANAGEMENT SYSTEM CONTRACTOR MODE (RMS CM) for more information on CLINs, schedule of values of pay activities and construction schedule, and payment procedures. 1.4 JOB PAYMENT ITEMS
Payment items for the work of this contract for which contract lump sum payments will be made are listed in the LINE ITEMS AND PRICING SCHEDULE with the unit JOB and described below. All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, shall be included in the listed job item most closely associated with the work involved. The job price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.
Progress payments for job CLINs will be made in accordance with the Payments Under Fixed-Price Construction Contracts clause of Section 00700 CONTRACT CLAUSES in Volume 1. Submit Schedule of Values for Government approval with the baseline schedule submittal (see Section 01 32 01 PROJECT SCHEDULE). Include a list of pay activities to breakdown bid for each job CLIN as part of the RMS Schedule. Schedule of Values will become basis for CLIN and Pay Activity data in the RMS payment data base. An unbalanced Schedule of Values and Pay Activity Schedule will be returned for revision. If this contract contains either the Continuing Contracts clause or the Continuing Contracts (Alternate) clause, take into account the amount reserved for contract payments when preparing the construction schedule.
1.4.1 Project Initiation Activities (Line Item 0001)

The Government will perform initial and final surveys in accordance with the clause QUANTITY SURVEYS of Section 00700 CONTRACT CLAUSES in Volume 1. The initial and final DTM surfaces used for calculation of final quantities will be determined from the original (initial surface) survey performed by the Government after clearing, SECTION 01 22 00 Page 5 grubbing, and demucking and before excavation, and the finished grades (final surface) as shown on the drawings. The final survey performed by the Government will be used to verify that excavation is complete to the required finished grades, and that tolerances have not been exceeded.
