SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS
The following have been modified:
SOURCE SELECTION PLAN
A. BASIS FOR AWARD
This acquisition is a full and open, competitive procurement utilizing Lowest Price Technically Acceptable (LPTA) best value continuum source selection procedures in accordance with FAR 15.101-2.
A single award will be made to the Offeror who provides a technically acceptable proposal with the lowest evaluated price.
Proposed prices will be evaluated but not scored or otherwise combined with the other aspects of the proposal evaluation.
B. FACTORS TO BE EVALUATED
Factor 1: Price Factor 2: Technical Factor 3: Past Performance
C. EVALUATION APPROACH
All proposals will be evaluated by the Source Selection Team (SST). In order for any offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price factor. The two non-price factors are Technical and Past Performance.
Factor 1: Price
Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. An award will be made to the lowest priced, technically acceptable proposal. The lowest price will be determined by adding up all listed line items. Offerors shall complete and submit the Schedule of Prices with its proposal and include a price for each line item. Failure to submit a price for any of the required line items on the Schedule of Prices will render the Offeror’s proposal as ineligible for award. Offerors will be allowed one proposal submission.
The Source Selection Evaluation Board will evaluate each Offeror’s price and verify that unbalanced pricing is not present. The Contracting Officer will evaluate each Offeror’s price in accordance with FAR 15.404-1 to determine price reasonableness. Price reasonableness will be determined by comparing all proposed prices, the Independent Government Estimate, and pricing of previous work that is same or similar to the requirement.
The otherwise technically acceptable lowest priced Offeror may be required to confirm/validate their offered price. Certified cost and pricing data are not currently required; however, the Government reserves the right to request such data prior to award.
Factor 2: Technical The Government will evaluate the Technical Proposal on an Acceptable/Unacceptable basis.
This factor identifies the minimum requirements that are imperative to successful contract performance.
The Source Selection Team will evaluate the Offeror’s proposal against the factors listed below to determine whether the technical proposal is Acceptable or Unacceptable. To be considered acceptable, all factors under the technical proposal must receive an acceptable rating. The adjectival rating depicts whether or not the offeror’s proposal meets the Technical Proposal factor requirements.
Table C-1
Technical Proposal Acceptable/Unacceptable Ratings
Rating Description
ACCEPTABLE Proposal meets the minimum requirements of the solicitation.
UNACCEPTABLE Proposal does not meet the minimum requirements of the solicitation.
Subfactor 1: Schedule
Technical Subfactor 1 evaluates the Offeror’s proposed schedule for the lock closure period.
The Government will evaluate the Offeror’s proposed schedule to determine understanding of and compliance with the Government’s requirements.
Minimum requirements for this factor include a preliminary bar chart schedule showing the following activities as outlined in Specification Section 01 14 00, WORK RESTRICTIONS
a. Survey of existing lock components
b. Receipt of Government Furnished Equipment (GFE)
c. Precast concrete segment procurement and delivery
d. Installation of dewatering systems and dewatering/rewatering/dewatering/rewatering of lock chamber.
e. Government miter gate removal/installation activities
f. Installation of miter gate anchorage, quoin, pintle
g. Adjustment of the miter gates
h. Miter gate machinery installation at each corner
i. Valve recess construction at each corner
j. Control stand construction at each corner
k. Switchboard building construction
l. Construction of the electrical crossover ductbank
m. Utility trench construction on each wall
n. Electrical installation
o. Bubbler system installation
p. Commissioning
n. Curing of concrete
The Government will evaluate the schedule based on demonstration of all activities listed above being complete by the end of the lock closure period, and the sequences provided are logical and activity durations are reasonable.
The Government will evaluate Subfactor 1: Schedule on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-2. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-2. Subfactor 1: Schedule Evaluation Ratings
ACCEPTABLE The proposed Schedule includes all required activities and sequences provide are logical and activity durations are reasonable. Based on the Schedule proposed by the Offeror, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.
UNACCEPTABLE The proposed Schedule does not include all required activities and/or sequences provide are not logical and activity durations are reasonable. Based on the Schedule proposed by the Offeror, the Government does not have a reasonable expectation that the Offeror will successfully perform the required effort.
Subfactor 2: Experience
The Government will evaluate relevant experience of the Offeror, and/or committed sub-contractor as described in the following.
Relevant experience is what an Offeror, and/or committed sub-contractor(s), has done on projects that are the same or similar in size, scope and complexity as the project in this solicitation.
The Offeror shall submit a minimum of three (3) projects which demonstrate experience similar to this requirement and have been substantially completed within the last ten (10) years prior to the issue date of the solicitation. The project information must demonstrate relevancy to the project described in the solicitation and all information submitted must be accurate, current, and complete.
Substantially complete as defined for this solicitation: A project is considered substantially complete when the project is sufficient for the use of which it is intended, as of the closing date of this solicitation.
All project examples shall contain a Point of Contact (POC) as well as one alternate Point of Contact, to include the name, job title of the POC, address, telephone, and e-mail address. The POC and alternate shall be familiar with the construction performance of the contractor and be a representative of the owner/customer/prime contractor, not affiliated with the contractor. The POC and alternate shall be able to verify the experience cited.
Minimum requirements for this factor include:
Offeror or subcontractor must have at least two (2) projects demonstrating experience with Floating Plant on Navigable Waterways.
Offeror or subcontractor must have at least two (2) projects demonstrating experience with working on a lock or dam structure.
Offeror must have at least two (2) projects demonstrating experience with construction of concrete structures involving formwork over 4 feet high.
Offeror or subcontractor must have at least two (2) projects demonstrating experience with the installation and commissioning of industrial electrical or mechanical systems.
If using a subcontractor as team members in demonstrating experience, describe the roles the prime contractor and subcontractors will play in the project and the percentage of any type each will perform. For the purpose of this requirement, subcontractors are defined as members of an Offeror’s overall team who are expected to perform ten (10%) percent or more of the proposed effort.
If using experience for work performed as a joint venture, the experience information must state in detail the nature of the work performed by both of the joint venture partners, the total percentage of the overall contract performed by both of the joint venture partners, and the total amount of work performed by both of the joint venture partners.
The Government will evaluate Subfactor 2: Experience on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-3. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-3. Subfactor 2: Experience Evaluation Ratings
ACCEPTABLE Offerors (in combination with experience of their Joint Venture (JV) partners or committed key subcontractors) who show experience described in the experience subfactor in the past ten (10) years will be determined to meet the minimum requirements of the contract and will be found Acceptable.
UNACCEPTABLE Offerors (in combination with the experience of their JV partners or committed key subcontractors) failing to show experience described for the experience subfactor in the past ten (10) years will be found Unacceptable.
Factor 3: Past Performance
The Government will evaluate the Past Performance factor on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-4. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-4. Past Performance Evaluation Ratings
ACCEPTABLE Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below)
UNACCEPTABLE Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
3.3.2. Evaluations of past performance shall be in accordance with this plan while utilizing the Past Performance Questionnaires (PPQ) and forms in Appendix D, Enclosure 1.
3.3.4. An Offeror’s past performance is a measure of the degree to which an Offeror was successful on projects of similar size. The Government will evaluate the information/performance data provided by Offerors, as well as information from other sources, such as Government databases.
3.3.5. The Offeror shall submit up to five (5) PPQ’s for work performed since 2010 for construction projects with a dollar value equal to, or greater than five million dollars. If more than five (5) are submitted, only the five (5) most recent projects will be considered. The forms shall identify whether the contract is active or complete, whether the contract was with a Government (federal, state, local, etc) or a commercial entity, and whether the Offeror was the prime contractor, a subcontractor, or member of a joint venture. The PPQ respondent must have been a client, or client representative, with whom the Offeror/subcontractor had a contract, or subcontract (if applicable) for one or more projects.
3.3.6. The PPQ respondent must hold, or have held at the time, a senior position in the client organization with responsibilities for either contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The PPQ respondent must have first-hand knowledge of the Offeror’s performance.
3.3.7. In addition to the above, past performance information may be obtained from established systems such as the Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; and may be obtained from other sources available to the Government, such as the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.
3.3.8. The Government reserves the right to evaluate the past performance of any subcontractor identified in the Offeror’s proposal as part of its assessment of the acceptability of that Offeror’s proposal.
3.3.9. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION
NOTE
(E) Exceptional
Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good
Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory
Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal
Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory
Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
