ATTENTION TO BIDDERS
1. Responsibility Criteria IAW FAR Subpart 9.1: To ensure award is made to the responsible bidder, a determination of responsibility will be conducted. As part of this responsibility determination, the Contracting Officer will utilize the guidance contained in FAR Subpart 9.1, Responsible Prospective Contractors. In accordance with FAR 9.104-1, to be determined responsible, a prospective contractor must:
(a) Have adequate financial resources to perform the contract, or the ability to obtain them (see form below);
(b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
(c) Have a satisfactory performance record, similar in scope and magnitude of that stated in the contract requirements;
(d) Have a satisfactory record of integrity and business ethics;
(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them;
(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and
(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
2. ATTENTION: Definitive Responsibility Criteria (DRC): In addition to examining the criteria in FAR
9.104-1 as listed above, the Contracting Officer will also examine whether the low bidder can meet the requirements of the definitive responsibility criteria mentioned in section 1) below. THIS INFORMATION WILL BE REQUESTED AFTER BID OPENING. The apparent low bidder will be required to meet the following experience requirements:
Definitive Responsibility Criteria (DRC):
1) Provide a minimum of (2) projects completed* within the last (6) years** that include experience in electrical industrial installation and commissioning similar to the scope and complexity required in the solicitation. ***
a) Offerors shall submit the following:
i) Completed equipment upgrade of 5kVA-5000kVA power distribution system that collectively include the following:
(1) Medium voltage (1kV-69kV) and low voltage (below 1kV) switchgear/switchboard, low voltage motor control center, panelboards and motors.
(2) Medium voltage oil filled/dry type transformer installation.
(3) Medium voltage (2.4kV-35kV) conductors and conduits/trays.
(4) Low voltage (Below 1kV) conductors and conduits/trays.
ii) Completed equipment upgrade of 24VDC, 480/120VAC industrial control systems that collectively include the following:
(1) Fiber & Ethernet Industrial network
(2) Instrumentation, Programmable Logic Controller (PLC) & Human-Machine Interface (HMI)
(3) Variable frequency drive (VFD) motion control
(4) Close-circuit television (CCTV) system
FOR THE DRC ABOVE:
* All project examples must include documentation that show a minimum of 75% complete in order to be considered.
** Define “6 years” as 6 years from the date solicitation is posted.
*** If submitting experience of a subcontractor, a letter of commitment must be included for their experience to be considered.
2) The Contracting Officer will verify the submitted projects meet the definitive responsibility criteria as part of the responsibility determination.
3) Along with the Definitive Responsibility Criteria above, the apparent low bidder will be required to provide the following information for the Government’s use in the determination of Bidder(s) responsibility (See 1
(a) above).
a) Current Balance Sheet and latest Profit and Loss Statement prepared from the most recent fiscal/calendar year and certified by an officer of the company.

Bidders are advised that only bids submitted on a firm price basis will be considered, and that bids submitted on any other than firm price basis will be rejected. Bids received after the date and time stated within Block 13 of the SF1442, or Block 14 of the most recently issued SF 30 as applicable, will be considered late and will not be considered for award. To avoid rejection of a bid, the bidder must make every effort to ensure the bid is delivered by the date and time specified.
The following additional restrictions apply in the event an electronic form of bid is submitted:
a. File Packaging. All the bid files shall be compressed (zipped) into one file entitled bid zip using WinZip version
6.2 or later, or as separate uploads in their native format, i.e., doc, xls, ppt, etc., and provided on CDs or DVDs. Zip disks are not permitted. Files shall be in read-only format, using PDF files. All price breakdown information to aid in the Price evaluation shall be submitted in Microsoft Office Excel Read/Write format. Each disc shall be externally labeled with the volume number, date, and the bidder’s name. **Please note – Self extracting exe files are not acceptable. **
b. Content Requirement. All information shall be confined to the appropriate file. The bidder shall confine submissions to essential matters, sufficient to define the proposal in a concise manner, to permit a complete and accurate evaluation of each proposal.
BID QUANTITIES
Bids for less than specified quantities of each item in Section 00 10 00 of the Schedule will not be considered.
Failure to submit a unit price for each item where required in the Schedule will be considered as a material deviation from the requirements of the solicitation, and the bid will be rejected. (FAR 14.201-5)
BID OPENING
Bidders are advised there will be a physical bid opening held for this invitation for bids. The bid opening will be held in the Bid Opening Room at 201 N 3rd Ave, Walla Walla WA, 99362, at 1:00 pm on the date bids are due.
Bidders wishing to participate in the bid opening must email a list of participants to both Contracting Officer (Jani.C.Long@usace.army.mil) and Contract Specialist (chandra.d.crow@usace.army.mil) no later than the close of business 24 hours prior to the bid due date and time so a list of names can be provided to security.
ARITHMETIC DISCREPENCIES
(a) The following will be used in resolving arithmetic discrepancies found on the face of the bidding schedule as submitted by the bidder:
(1) In a discrepancy between unit price and extended price, the unit price stated on the bid schedule will govern;
(2) Apparent errors in the extension of unit prices will be corrected;
(3) Apparent errors in the addition of lump-sum and extended prices will be corrected.
(b) For the purpose of bid evaluation, the government will proceed on the assumption that the bidder intends his bid to be evaluated on the basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above and the bid will be so reflected on the abstract of bids.
(c) These correction procedures shall not be used to resolve any ambiguity concerning which bid is low.
SPECIAL INSTRUCTIONS
INVOICES/PAYMENT REQUESTS: Invoices/payment requests must be submitted to Corps of Engineers, Walla Walla District, Attention: Construction Branch, 201 N. Third Ave., Walla Walla, WA 99362.
BONDS: If the successful offeror, upon acceptance of its offer by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed payments bonds or alternate payment protection within 10 Calendar days after receipt of the contract award forms by the offeror, the Contracting Officer may terminate the contract for default/cause.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or
""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour National Office because National Office has responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
