A. BASIS FOR AWARD

The MATOC awards and the first Task Order will be made based on the best value to the Government by using the Best Value Lowest Price Technically Acceptable source selection process in FAR Part 15. The MATOCs will be awarded for a two-year base period with a one-year option period. The total contract capacity shared among firms will not exceed $2,000,000. Any unused capacity in one period may be carried over into the subsequent contract period. The minimum guarantee amount for the entire life of the contract for each IDIQ awardee is $5,000. The minimum Task Order value is $2,000 and the maximum Task Order value is $300,000.00. The Government intends to award up to three IDIQ contracts to the offeror(s) whose proposal, conforming to the RFP, will be the lowest price technically acceptable. Task Orders will be awarded on a firm-fixed price basis with the exception of a necessary emergency contract that may be Time and Materials or Labor Hours.

Tasks include, but are not limited to, survey, testing, containment, sustainment, modernization, removal, treatment, transportation, and disposal of existing hazardous materials on federal facilities within the Northwest Division. In addition, tasks include removal, containment, treatment, transportation, and minor demolition and repair for non-regulated toxic substances. Work will occur on the hydroelectric facilities machinery/equipment throughout the region (Oregon, Washington, Montana and Idaho) covered in the Contract.

MATOC Solicitation Process - This procurement will be conducted as a 100% Small-Business Set-aside using the Best Value Lowest Price Technically Acceptable source selection process in FAR Part 15. The primary NAICS code for work under this procurement is 238910 (Site Preparation Contractors) with a small business size standard of no more than $15 million in average annual receipts. The solicitation will contain the evaluation factors identified below which will be based on the overall MATOC scope of work. Upon the conclusion of evaluations, the first Task Order will be awarded along with the MATOC IDIQ contracts.

Placement of Task Orders - The actual amount of work to be performed and the time of such performance will be determined by a USACE Contracting Officer who will issue written Task Order Proposal Requests (TOPR) to the IDIQ awardees. Prices will be requested and evaluated for each Task Order in accordance with FAR 16.505.

Each TOPR will state the evaluation criteria for the Task Order to be awarded. Individual Task Order awards may be evaluated on price only or price and other non-price evaluation factors as outlined in the TOPR. Whenever possible, award will be made without discussions. All construction submittals that are applicable will be required, offerors may be required to show a valid certification applicable to any aspect of work when required by the contracting officer or required as a construction submittal.

The government will evaluate offerors’ proposals submitted in response to this solicitation. After evaluation, the government may select up to three lowest priced, technically acceptable offerors and the first Task Order (seed project) will be awarded along with the MATOC IDIQ contracts.

Offerors will have a minimum of 30 days to submit their proposals.

The government may award the MATOC contracts and the first Task Order on the basis of initial offers received, without discussions; therefore, an offeror’s proposal should contain the offeror’s best terms from a technical and price standpoint.

The price proposal will not be assigned a rating for evaluation.

The government will evaluate offerors’ proposals based on how well the proposals address each of the

Evaluation Factors provided below.

The award will be made based on the best overall (i.e., best value) proposal that is determined to be technically acceptable with appropriate consideration given to the three (3) evaluation factors: Past Performance, Technical and Price.

To receive a consideration for award, a rating of no less than “Acceptable” must be achieved for the non-price factors. Offerors will be cautioned that the awards will be made to the Lowest Price Technically Acceptable proposals; ensure that your pricing is not unreasonably low.

B. FACTORS TO BE EVALUATED

The following evaluation factors will be used to evaluate each proposal. Award will be made to the offeror with the lowest evaluated price and for which all non-price factors are rated as Acceptable in accordance with established criteria.

Further description of each factor and additional information pertaining to submission requirements are provided in Sections D.1 through Section D.3, below the following outline. The information requested for each of the factors shall be included in the appropriate volume and tab.

• Factor 1 – Past Performance

• Factor 2 – Technical

• Factor 3 – Price

C. EVALUATION APPROACH

All proposals will be evaluated by the Source Selection Evaluation Board (SSEB).

The overarching evaluation approach for all factors is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s response has adequately and completely considered, defined, and satisfied the requirements to an Acceptable level specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP.

Factor 1 - Past Performance

There are three aspects to the past performance evaluation: Recency, Relevancy (including context of data) and Quality (including general trends in contractor performance and source of information).

a. The Government will focus its inquiries on the offeror’s (and major sub-contractors’) record of performance as it relates to all solicitation requirements, including price, schedule, performance and management of sub-contractors. Major sub-contractors are defined as members of an offeror’s overall team who are expected to perform fifteen (15) percent or more of the proposed effort. Therefore, offerors are reminded to include the most current and relevant past performance efforts (within the past six years) in their proposal. The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System NAICS 238910, Site Preparation Contractors. Data submitted by the offeror or gathered from other sources by the government in conducting performance risk assessments shall not extend past six years prior to the issue date of the RFP, but may include performance data generated during the past six years without regard to the contract award date. CPARS data is limited to the past 6 years.

b. Offerors should submit all Government and/or commercial contract numbers and descriptions for the prime offeror and each major sub-contractor in performance or awarded during the past six years, from the issue date of this RFP, which are relevant to the efforts required by this RFP. Any past performance evaluations that are unsatisfactory, or any comment about the firm not being hired again in a performance evaluation will receive an unacceptable rating for this factor.

c. RECENCY; The Government will evaluate recency by examining the offerors’ record of past performance and to assess the time period during which the offeror’s past performance is considered relevant.

d. RELEVANCY: The Government will evaluate those aspects of an offeror’s history of contract performance that would provide the most context and give the greatest ability to measure whether the offeror will successfully satisfy the current requirement. This evaluation will include all aspects of the offeror’s execution of schedule, performance, customer support and subcontracting plan for these projects and the offeror’s record of: 1) Conforming to specifications and standards of good workmanship; 2) Maintaining program execution within price; 3) Adherence to contract schedules, including the administrative aspects of performance; 4) Ability to resolve technical and manufacturing problems quickly and effectively; 5) Businesslike concern for the interest of its customers; 6) Establishing and maintaining adequate management of sub-contractors; and 7) Compliance with subcontracting plans submitted on previous projects.

e. QUALITY: The third aspect of the past performance evaluation is to establish the overall quality of the offeror’s past performance. The quality past performance evaluation conducted gathers information from the offeror’s customers to determine how well the offeror performed those past contracts. This quality assessment will be reflected in the overall confidence assessment described below.

f. PERFORMANCE CONFIDENCE ASSESSMENT: The final step is for the team to arrive at a single consensus performance confidence assessment for the offeror. This rating considers the assessed quality of the relevant/current efforts gathered (documented results from Past Performance Questionnaires, interviews, CPARS, and other sources form the support and basis for this assessment).

Past Performance Evaluation Ratings Rating Definition

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Factor 2 - Technical

This factor evaluates the offeror’s proposed certifications and licensing for the first year of the contract.

The offeror shall submit certifications and licensing information for itself, major subcontractor, joint venture partner, the offeror wants the government to consider in the certifications & licensing evaluation. An Acceptable rating will be assigned if the offeror can provide active, current, and in good standing, certifications & licensing documentation for the following key areas:

Certificates & Licenses Requirement Oregon Asbestos License Active and Current State License Oregon Lead License Active and Current State License Washington Asbestos License Active and Current State License Washington Lead License Active and Current State License Testing Laboratory for Asbestos Accredited by American Association for

Laboratory Accreditation (A2LA) or American Industrial Hygiene Association (AIHA)

Testing Laboratory for Lead Accredited by American Association for Laboratory Accreditation (A2LA) or American Industrial Hygiene Association (AIHA)

The Technical Factor Ratings, excerpted below focuses on the acceptability of the offeror’s proposal. The rating depicts whether the offeror’s proposal meets the Technical factor requirements.

Technical Evaluation Ratings Rating Definition

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

After award all MATOC contractors will have to provide current certification for the Task Orders.

Certifications are required to be kept current for the duration of the base period and for the option period.

If a contractor is unable to provide current certification the option period may not be exercised.

Credit for Subcontractor Experience and/or Certification; Letter of Commitment (LOC) If an offeror wishes to be credited with experience and/or certification of a subcontractor or supplier, i.e., a firm that is not the prime contractor or part of the joint venture, a letter of commitment signed by the subcontractor and the prime contractor must be submitted. The letter of commitment must be submitted even if the firm is in some way related to a joint venture partner (for example, the subcontractor is subsidiary of a joint venture partner, or a subsidiary of a firm to which the joint venture partner is also a subsidiary). In regard to experience and/or certification, if an offeror submits projects demonstrating experience and/or certification in one of the factors, and that project was completed by a subcontractor, a subsidiary, or a supplier, as opposed to the prime or one of the joint venture partners, the offeror MUST submit a signed letter of commitment from the contractor who either performed and completed the work or holds the certification. If a letter of commitment is not submitted, the experience and/or certification will not be considered.

Factor 3 - Price The Task Order will be a Firm Fixed-Price Contract. The Government will evaluate offers for award purposes by evaluating the prices proposed in the Bid Schedule. The offeror must provide a price proposal by completing the Bid Schedule for the seed project along with Schedule B for the MATOC. Schedule B rates will be used for T&M contracts, negotiations, modifications and compliance. There are two years within the base period, the appropriate rates and the corresponding year will be used when appropriate. The base award date will be the start of year one.

a. The RFP requires firm fixed-price contract line items. A price reasonableness approach will be utilized by the Government to determine that the proposed prices offered are fair and reasonable and that a “buy-in” or unbalanced pricing between CLINs or Option Periods is not occurring.

b. The Government will examine price proposals for artificially low unit prices. Offers found to be unreasonably high, unrealistically low (an indication of “buy–in”), or unbalanced, may be considered unacceptable and may be rejected on that basis.

52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (JAN 2017)

(a) Definitions. As used in this provision--

“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.

“In writing or written” means any worded or numbered expression which can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.

Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) The first page of the proposal must show--

(i) The solicitation number;

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.

(3) Submission, modification, or revision, of proposals.

(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.
