1.11 EVALUATION CRITERIA

Basis for Award: This procurement is being conducted pursuant to FAR Part 15. It’s the Government’s intent to award a Firm- Fixed Price contract under this solicitation; however, the Government also reserves the right to make no award. Each offeror’s proposal will be evaluated utilizing the Best Value Trade-off process. The Government may award a contract to a higher priced offeror if the higher priced proposal offers a better value to the Government than a lower-priced proposal. If a higher rated proposal is lower priced than any other proposals, or if proposals are equal regarding non-price factors but one offers a lower price, then a trade-off analysis will not be conducted. As part of the best value determination, the relative strengths, weaknesses, and deficiencies of each proposal shall be considered in selecting the offer that is most advantageous and represents the best overall value to the Government.

EVALUATION FACTORS: There are three (3) evaluation factors listed in descending order of importance.

Specialized Experience Factor (1) is the most important factor and is more important than Past Performance. The Past Performance Factor (2) is more important than Price and Price Related Factor. The Price and Price Related Factor (3) is the least important factor. When combined all non-price factors are more important than Price.

To receive consideration for award, a rating of no less than 'Acceptable' must be achieved for Factor 1 Specialized Experience. A rating of no less than ‘Satisfactory Confidence’ must be achieved for Factor 2 Past Performance. A ‘Neutral Confidence’ rating is also acceptable if no recent, or relevant past performance record is available. The proposed price will be evaluated for fairness, reasonableness and balanced pricing.

Factor 1 – Specialized Experience: The prime contractor shall demonstrate recent, relevant experience on similar projects, using Construction – Specialized Experience form – (Attachment 1) at the end of the section. Recent experience is within 5 years from the date of the solicitation. Offerors shall demonstrate the experience described in the Technical Element Criteria listed below. Experience with each element shall be demonstrated in at least one of the submitted projects. Offerors may identify state and local government and private contracts that are similar to the Government’s requirements. If the offeror is a joint venture, each firm shall provide information, demonstrating experience relevant to their role on this project. Submit projects that are currently well underway (designed and at least 50% construction progress completed) or completed and turned over no longer than five (5) years preceding the date of the PWS. If any firm has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer or by the team member. Prime contractor must submit at least two modular construction projects executed in a secure facility in accordance with Intelligence Community Directive (ICD) 705, Technical Specifications for Construction and Management of Sensitive Compartmented Information Facilities.

These projects must include a combination of architectural, mechanical, electrical, and plumbing, with a value of $3 million or greater.

Element 1: Offeror shall demonstrate experience with modular/prefabricated construction projects using IC TECH SPEC-FOR ICD/ICS 705 (SCIF) Standards. in secure facilities.

Element 2: Offeror shall demonstrate experience with modular/prefabricated construction projects using Element 2: Offeror shall demonstrate experience with projects constructed on Military installations.

Element 3: Offeror shall demonstrate experience with Projects with a value of $3 million or greater.

Based on the evaluation, the Government will assign a technical rating in accordance with the Table below:

Combined Technical/Risk Ratings

Rating Description Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies. Proposal is un-awardable.

Factor 2 – Past Performance: This factor is more important than Factor 3 Price and Price Related. The Government reserves the right to consider any past performance in its possession including but not limited to the Contractor Performance Assessment Reporting System (CPARS). The Government will evaluate this factor based on the quality of recent and relevant past performance. To be recent, projects must be currently well underway (designed and at least 50% construction progress completed) or completed and turned over no longer than five (5) years preceding the date of this Solicitation.

To be relevant, projects must be for similar size, scope, and complexity. The Government will perform a performance confidence assessment of the offeror’s probability of successfully meeting the contract requirements, considering the degree of success of the offeror’s recent and relevant experience. Note: Offeror shall submit a minimum of three (3) but no more than five (5) recent/relevant projects for evaluation. The offeror shall submit copies of Federal/DoD/Navy/Army performance reviews (i.e. Contractor’s copy of CPARS evaluation) for each project. If the project does not have a CPARS evaluation, the offeror shall provide a Past Performance Questionnaire (PPQ) form (attached) to a representative of the owner/client that can provide the owner’s opinion of the offeror’s past performance for the project.

Offerors shall submit the PPQ to clients to complete for their proposal submission to the Contracting Office.

Questionnaires shall be submitted directly from the client to the Government’s point of contact, Samuel Curry via email samuel.l.curry@usace.army.mil prior to proposal closing date. The offeror is responsible for ensuring that the completed questionnaires are submitted by the closing date. Offerors should followup with clients/references to ensure timely submittal of questionnaires. If the offeror is unable to ensure a completed PPQ from a client for a project(s) is submitted before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s).

The following Relevancy levels and Confidence ratings will be used in the evaluation of the contractor’s past performance. The Relevancy is not a separate proposal rating but is only used in developing overall past performance confidence assessment rating assigned to the Past Performance Factor.

Past Performance Relevancy Levels

Rating Definition

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

Performance Confidence Assessments Rating Description

Substantial Confidence

Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence

Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence

Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.

Unknown Confidence (Neutral)

No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

Factor 3 – Price and Price Related: This is the least important factor. The Contractor shall provide a firm fixed price proposal submitted in a separate file/document. The Contractor shall provide itemized cost for all labor, travel, insurance, equipment, and any additional costs required to perform the work specified in the PWS. The price proposal should be in sufficient detail to allow the Government to verify the pricing to be fair and reasonable. The proposed price will be evaluated for fairness and reasonableness and balanced pricing. The Government reserves the right to award without discussions. CLINs shall be priced separately and rounded to the Nearest Dollar. To facilitate evaluation, provide an itemized price breakdown, to include prime and subcontractor prices separated with direct and indirect costs.

a. Labor Costs: All prime and subcontractor pricing must clearly identify labor categories, rates, and hours for each task, and all subcontractor mark-ups.

b. Subcontracting: Offerors shall provide detailed subcontractors proposals, or no-bids provided by the sub-contractor. Lump sum pricing is not acceptable. If the proposal utilizes subcontractors, the subcontract format shall also be in Microsoft Excel for the breakout of pricing and quantities. The proposal shall also include the scope of the project with the subcontractor’s proposal. Competition in subcontracting is required to the maximum practical extent.

c. Travel: All travel and related expenses associated with the execution of work shall be IAW the Per

Diem, Travel, and Transportation Allowance Committee ‘Travel for a Government or Contractor Employee’ https://www.defensetravel.dod.mil/Docs/AP-CTR-01.pdf. No markups are allowed on travel cost, except for G&A.

d. The Offeror shall provide a FFP proposal for the CLINs identified in Section 00 10 00. Failure to propose this CLIN structure may deem your proposal unacceptable.

Document and Section Page Question Response

Statement of Work / Paragraph 1.1.1 3 The statement of work uses the term "plug and play" and specifies that all electrical and data ports must be entirely pre-wired, ready to use. From our experience with ICD/ICS 705 standards and compliance, this is not possible.

Can the Government clarify what they require with the pre-wired requirement to ensure that are proposed solution remains ICD/ICS 705 compliant?

The Government understands that this project can be completed by several methods. Means and Methods of construction shall be determined by the contractor but what ever method the contractor uses, the construction methodology must be of a faster construction than that of traditional building methods and allow for pre-engineered features . If your past buildings were IC TECH SPEC-FOR ICD/ICS 705 (SCIF) compliant then your methods of construction will be acceptable. The statement of work was revised to remove the term " plug and play".

Statement of Work / Paragraph 4.6, Request+for+Proposal

(RFP)+W912DY21R0063 / Section 00 10 00 - Solicitation

15, 4 Paragraph 4.6 states that the period of performance duration is limited to 270 calendar days. The CLIN structure laid out in Section 00 10 00 - Solicitation of the RFP document states that the contract duration shall be limited to 240 calendar days after notice to proceed. Will the Government please clarify whether of the period of performance is 240 days or 270 days?

The period of performance is 240 calendar days after the NTP is issued. The work to be completed post award and prior to NTP should take approximately 30 days so the total duration will be 270 days. SOW paragraph 4.6 will be revised to match the 240 days after NTP as listed in appendix 1.

Statement of Work / Paragraph 1.1.1, Paragraph 2.b., and Paragraph 4

3, 5, 6 Paragraph 1.1 and paragraph 2.b. state that the system must have a ballistic rating. Paragraph 4 states that the Blast Load is minimum 8 psi - maximum

11.5 102 MS overpressure. Will the Government please define the ballistic rating requirement and how does that align with the structural requirements laid out in paragraph 4?

A ballistic rating is an explosion test that typically yields 11.5 psi / 102ms at a 10 foot standoff. These results are also listed in structural , Paragraph 4, Blast Load. These values can be more or less depending on the manufacturer . IC TECH SPEC-FOR ICD/ICS 705 (SCIF) doesn't state a minimum blast rating but contractors are encouraged to provide this information if available.

Proposal Submittals

10 What volume(s) would the Government like us to use to present the information laid out in paragraphs 2.c. and 2.d?

Volume 1. This information will be excluded from the page count.

Attachment 7 Factor 1 Element 1

Specialized Experience 1 Would the Government be willing to provide a Microsoft Word Version of this document for the purposes of editing/expanding various sections?

Yes, included with amendment 01.

Request+for+Proposal (RFP)+W912DY21R0063 / Section

1.11 Evaluation Criteria

11 The Element 2: sentence under the Factor 1 - Specialized Experience section is not complete. Can the Government please provide a completed version of this sentence?

Factor 1 was revised to address this. See RFP Amendment 01.

Request+for+Proposal (RFP)+W912DY21R0063 / Block 10 of the SF 1442, Section 1.11 Evaluation Criteria

1, 11 Block 10 of the SF 1442 states the magnitude for this project is between $1,000,000.00 and $5,000,000.00. Factor 1 Element 4 states that the offeror shall demonstrate experience with projects with a value of $3 million or greater. Would the Government consider adjusting Element 4 to state, Offeror shall demonstrate experience with Projects with a value of $1 million or greater?

Factor 1 Element has been updated. However, the requirement to demonstrate experience with projects with a value of $3 million or greater remains unchanged.

Statement of Work / Paragraph 2.b. 5 Paragraph b. under Section 2 Modular/Prefabricated Building states that the minimum wall construction requirements are made using two 16-gauge steel skins (one inside skin and one outside skin) and a 14-gauge frame. Is the Government intending to use the iFortress offering exclusively? If not, will solutions that meet the Fire, STC, and ICD/ICS 705 compliance be favorably considered?

Yes, solutions that meet the Fire, STC, and ICD/ICS 705 compliance will be favorably considered. The Government cannot sole source a product - we mentioned I Fortress as only one solution that will satisfy Fire, STC, and ICD/ICS 705 Standards/ Requirements.

Statement of Work / Paragraph 1.1 Scope of Work

3 Paragraph 1.1 states that it will be the full responsibility of the contractor to provide the required documents that INSCOM has to submit/coordinate with the Accreditation Officer (AO) to achieve SCIF accreditation. Can the Government clarify what documents INSCOM would like us to produce to assist with the SCIF accreditation process?

Accreditation of a SCIF will be based upon a review by the Accreditation Officer of all required SCIF construction documentation to ensure all ICD 705 requirements were met in the construction, maintenance, and operation of the SCIF. See UFC 4_010_05, paragraph 1-16.1 and 1-16.2

Statement of Work, Paragraph 2, Task

1. Paragraph 10. Protection/Life Safety.

7 The Third bullet states "Wet or Dry pipe sprinkler system will not be required.

Can the Government confirm that no fire suppression is required to include chemical (FM 200, etc.)?

Sprinkler pipes are metallic penetrations thru a SCIF and considered carriers of compromising emanations(CE) and Pose. UFC 4_010_05, Par 3-5.802 (Not required for this contract but may be used on others with special additional requirements). May want to refer to Life Safety regulations (NFPA) that require fire supression systems for buidings of a certain size and occupancy thresholds. Believe a one story building less than 5,000SF and less than 50 PN max occupancy does not require a fire supression system.

Can we conduct a site survey the week of 13 September? This will allow us to properly solve for stand off, bridging the IT duct bank, etc.

That is not possible at this time.

Statement of Work, Paragraph 2, Task 1, Paragraph 3-Site Construction

6 2nd Bullet says "Relocation of an existing stormwater pipe is required. This was completed under previous project provides acceptable pipe relocation strategy and specification." The wording makes it sound like the relocation is complete and it is acceptable where it is. Please clarify if it still must be relocated under this contract?

The stormwater pipe has NOT been relocated. The design for relocation was completed under a previous project. Relocation of the stormwater pipe MAY be necessary based on the final footprint / Limit of Disturbance of the facility. If required, the existing relocation design is an acceptable strategy and spec.

Request for Proposals (RFP) W912DY21R0063

RFP W912DY21R0063, Section 1.11 Evaluation Criteria

11-12 The Solicitation is silent regarding the extent to which offerors may use the experience and past performance of affiliated entities. The GAO has found solicitations that restrict the ability of an offeror to provide the experience and past performance of its affiliates, even where those affiliates will participate meaningfully in contract performance, to be unduly restrictive of competition.

Accordingly, we respectfully request that the Government amend the solicitation to expressly permit the submission of experience and past performance projects completed by parent companies, affiliated entities, and subsidiaries? in support of the Experience and Past Performance requirements.

Past performance from affiliates will be considered. If affiliate past performance is proposed, the offeror must clearly demonstrate the factual basis for how the affiliate will be involved in performance, how the affiliate will share resources with the offeror and the percentage to which they will be responsible for contract performance.
