SUMMARY OF CHANGES
SECTION 00 11 00 - STANDARD FORM (SF) 1442 AND CLIN SCHEDULE
The required response date/time has changed from 04-Apr-2016 12:00 PM to 11-Apr-2016 12:00 PM.
The following have been modified:
BLOCK 10 CONTINUATION PAGE
EXECUTIVE SUMMARY
1. Objective: To award indefinite-delivery, indefinite-quantity (IDIQ) design-build (D-B) Multiple Award Task Order Contracts (MATOCs) in support of the Medical Repair & Renewal (MRR) Program for the provision of repair and renewal services under NAICS Code 236220 “Commercial and Institutional Building Construction” for medical facilities, systems, and equipment located throughout the Contiguous United States (CONUS), Alaska, Hawaii, and U.S. Territories. MRR contracts provide quick response for medical facility repair, renovation, conversion, alteration, additions, construction, and equipment procurement / installation at Government installations and facilities. The contractor may be required to survey the problem areas, evaluate and recommend solutions, develop and implement work plans in a timely manner within negotiated costs, and provide the repair/renewal/construction efforts to support the design solution. At times, the contractor may be required to provide stand-alone construction efforts without the provision of the associated services (i.e. site investigation, work plan, etc.).
2. Selection of the Multiple Award Task Order Contract (MATOC) Awardees: Under this solicitation, the Government intends to award a target of eight indefinite-delivery, indefinite-quantity contracts (with four reserved for 8(a) firms). The Government reserves the right to select more, less, or none at all. Criteria such as project scope, complexity, magnitude, location, and expected duration will be used to determine whether task orders will be reserved for competition amongst 8(a) firms.
3. On-Ramp / Off-Ramp: The Government may evaluate the market 18 months into the life of the MATOCs to determine if it is in the Government’s best interest to open a contract “on-ramp” or “off-ramp”. During a contract “on-ramp” the Government will accept and evaluate new proposals with the intention of adding additional contracts to the MATOC pool, or modifying existing contracts, to refresh the competition and provide the Government with better buying power. These proposals are subject to the same proposal instructions and evaluation procedures as contained in the original solicitation. During a contract “off-ramp”, the contracting officer may elect to remove firms from the MATOC pool that have poor performance records or have not submitted a proposal for any of the projects for which they were qualified.
4. Ordering: The estimated duration for each contract award will be an initial base ordering period of one year with up to four optional ordering periods of one year each and one six-month optional extension in accordance with FAR Clause 52.217-8, for a total cumulative ordering period not to exceed five and a half years. There is no guarantee that the options will be exercised on any or all of the awarded contracts. Task orders will be awarded against the basic IDIQ contracts using the fair opportunity procedures pursuant to Section 843 of the National Defense Authorization Act for FY 2009, Public Law 110-118 and FAR PART 16.5, in addition to the competitive source selection procedures identified in Section 863 of Public Law 110-417. Each order exceeding $3,000.00 will be awarded on a competitive basis in accordance with FAR 16.505 and DFARS 216.505-70(c), unless an exception described in FAR 16.505 (b)(2)(i) through (iv) or DFARS 216.505-70(b)(1) applies.
Task orders will be negotiated and awarded against the basic IDIQ contract on an as-needed basis once requirements arise. The IDIQ awardees will compete against each other for task order awards after the Government has determined if the task order is appropriate to be reserved for competition amongst 8(a) firms. In making the determination of whether to reserve the task order award, the Government will consider: 1) capability of the contractors to perform at the level of complexity required for successful completion of the task, particularly as related to proven occupied medical facilities renovation capability; 2) past performance of the contractors on earlier orders under the contract, including quality, timeliness, and cost control; 3) potential impact on other orders placed with the contractors; 4) minimum order requirements; and 5) any other factor necessary to determine the appropriateness of selecting a method of competition of the task order (contract capacity, e.g.).
The Government will utilize both project type and dollar value when evaluating complexity. The contracting officer will use their discretion to determine where on the complexity scale an anticipated project falls and whether other Government considerations support reserving the task order for 8(a) firms. The decision matrix for complexity to be used for this determinations is shown below:
Project Type - 70%
Rank Examples
1 Project With Simple Scope/One Design Discipline
2 Minor Construction Projects That Are Minimal Additions to an Existing Facility
3 Project With Moderate Scope and Conceptual Design
Project With Moderate Scope But Requires Phasing of Construction Activities in an Active Medical Environment
Projects With Complex Scope, Multiple Design Disciplines, in an Active Medical
Environment
Projects with Multiple Design Disciplines, Requiring Multiple Phasing of
Construction Activities in an Active Medical Environment
7 Repair or Addition of a Laboratory or Other Highly Specialized Facility
Size - 30%
Rank Examples
1 <$150k
2 <$500k
3 <$3 Million
4 <$5 Million
5 <$10 Million
6 <$50 Million
Process
Project Type (70%) and Size (30%) will be considered.
For example, a project with moderate scope and conceptual design (Project Type Rating of 3) that is valued at $10 Million (Size Rating of 5) would yield a combined rating of 3.6.
The calculation is (3.0 x 0.7) + (5.0 x 0.3) = (2.1) + (1.5) = 3.6
Each factor will receive a rating as designated above.
Any requirement that receives a combined rating of 3.8 or below will be considered for competition as Restricted.
After the first year, the decision point may be adjusted either up or down
The Government will consider unrestricted competition of a task order among all MATOC awardees if it is determined that reserving competition among the 8(a) contractors is inappropriate, or that the contractors are unwilling to propose on the work, or that the initial proposals from contractors are technically unacceptable. FAR 52.219-14, Limitations on Subcontracting, is only applicable for task orders that are reserved for competition amongst 8(a) contractors.
The only authorized ordering office is the U.S. Army Engineering and Support Center, Huntsville, Alabama. Other agencies may be delegated this authority, in which case, an advance written notice will be given to the contractor. In addition to, or in lieu of mailing an order, the contracting officer may issue an order orally, by facsimile, or by electronic commerce methods, at his/her discretion.
The minimum guarantee for each contract will be $3,000. The estimated capacity for the contract is $990 Million.
The contract capacity will be shared among all awardees and shared between CLINs and ordering periods as necessary. Capacity that remains unused at the end of each ordering period will roll forward to the next optional ordering period (if exercised).
5. Wage Determinations: Davis Bacon Act Wage Decisions/Determinations for the geographic area where the awarded work is to be performed will be incorporated in individual task orders. A copy of the determination is available at www.wdol.gov. The labor rates in effect at the time a task order is awarded will remain in effect through completion of the project, unless modified due to an increase in the Department of Labor wage rates.
6. Minimum Obligation Quantity: The Government is under no obligation to issue any orders against this contract in excess of the minimum contract obligation of $3,000.00.
7. Key Personnel Changes: Any proposed changes to key personnel proposed in the offeror’s proposal shall be submitted to the Contracting Officer’s Representative (COR) and the contracting officer for review and approval.
8. Award Process. This solicitation will be evaluated under the Two Phase Design Build Process of FAR subpart 36.3. In Phase 1, interested firms or joint venture entities (referred to as “offerors”) may submit proposals describing specific performance capability and experience relative to successful renovation of occupied medical facilities, demonstrating its capability to successfully execute the design-build construction IDIQ contract resulting from this solicitation. The Government will evaluate the performance capability proposals in accordance with the criteria described in the solicitation, and intends to select a target of twelve offerors to compete for the contract in Phase 2 of the process. However, the Government reserves the right to select more, less, or none at all.
In Phase 2, the selected offerors will submit technical design proposals for a sample task order, a schedule and a price proposal. The scope of the sample project will be in the general arena of the MRR effort. More information regarding the types of requirements that the sample may involve can be found in the Division 01 Specifications.
The typical MRR task order is valued at $5,000,000.00, with orders historically ranging from $35,000.00 to $45,000,000.00. The sample task order is estimated to be approximately $5 Million, but may be higher or lower.
The Government will evaluate the Phase 2 proposals, in accordance with the criteria described for Phase 2 in the solicitation, and award the contract to the responsible offerors, whose proposal conforms with all the material terms and conditions of the solicitation and whose proposal is determined to represent the overall best value to the Government, considering the evaluation criteria identified in this solicitation. The Government anticipates awarding each contract with the minimum guarantee.
The Government reserves the right to make staggered awards. Later awarded contracts will have a base period of performance that will be less than the full year in duration and will end on the same date as all other contractors which receive a basic MATOC award. Optional ordering periods will be the same for all awardees. If determined to be in the Government’s interest to hold discussions, discussions may be held with offerors remaining in the competitive range after initial awards have been made to some offerors.
9. System for Award Management: Offerors must be registered in System for Award Management (SAM) to be eligible for award. See FAR 52.204-7.
10. Blocks 11 and 12: The date on which performance will start for each task order will be determined with each task order. Offerors will be required to obtain performance and payment bonds in accordance with FAR
28.102 on a task order basis.
11. For the purpose of this solicitation, the term ‘offeror’ is defined as the prime contractor, key design firm(s), and all key subcontractors. Key design firms are defined as any design firm that will perform a major portion of the project. At least one design firm must be identified or the offeror must identify the use of in-house design capability.
Key subcontractors are defined as any subcontractor that will perform a major portion (more than 15% of the total job) of the project. Offeror must provide letters of commitment for key subcontractors and key designers.

In Phase One, the Government will evaluate the qualifications in accordance with the criteria described in Section, 00 22 10 and will allow a target of twelve offerors (to include six 8(a) firms) from Phase 1 to compete for the base IDIQ contract award. The Government reserves the right to include less, more, or no offerors at all to move to Phase 2.

The Government reserves the right to award more, less, or none at all.
The Government reserves the right to make staggered awards. Later awarded contracts will have a base period of performance that will be less than the full year in duration and will end on the same date as all other contractors which receive a basic MATOC award.
