Section 00 22 16 (Revised)
SECTION 00 22 16 - SUPPLEMENTARY INSTRUCTIONS TO PROPOSERS
The following have been modified:
EVALUATION FACTORS FOR AWARD
1.0 BASIS OF AWARD
Award of this Contract will be made to the technically acceptable responsible Offeror submitting the lowest priced offer – Lowest Priced Technically Acceptable Offer (LPTA). This acquisition will result in the award of a firm-fixed price, construction contract.
The technical evaluation of each proposal will be solely on the basis of Technical Evaluation Factors found in this section.
The Government will evaluate each proposal on a technically acceptable/unacceptable basis only with respect to the technical evaluation factors (criteria) described herein. Award will be to the Offeror who presents the technically acceptable proposal with the overall total lowest price. It is the intent of the Government to award off initial offers without discussions.
2.1 PROPOSAL EVALUATION
2.2 Technical Evaluation:
Acceptability will be based on all factors receiving an acceptable rating. The proposal will be evaluated according to the CRITERIA for Non-Price Evaluation Factors of this section.
Proposals will receive either an ACCEPTABLE or an UNACCEPTABLE rating for each of the evaluation factors. Find the description of these ratings in Table 1.
TABLE 1: TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS
Rating: Description:
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
2.3 Pricing Evaluation:
In accordance with FAR provision 52.217-5, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Additionally, the prices for the base and option line items will be evaluated for fairness and reasonableness through the use of a price analysis. The prices for the base and option items will also be checked for unbalancing of line items.
The low offeror shall be determined as follows—
1) Those offerors whose non-priced proposals were determined to be technically acceptable and their offered prices determined fair and reasonable will be eligible for award consideration.
2) The Government will award to the technically acceptable lowest priced offeror and lowest price is determined by totaling the base items and option items.
3.1 EVALUATION PROCESS:
The evaluation process consists of three parts:
1) Proposal Compliance Review. This is an initial review to ensure that all required forms and certifications are complete and that a complete proposal is received. An initial review of each of the proposals will be conducted to check for apparent errors, omissions and areas that require clarification. The purpose of this preliminary review session is to eliminate minor irregularities or apparent clerical mistakes. This preliminary evaluation will ensure that each proposal contains the Price Volume II and the correct number of copies.
2) Relevant Experience and Past Performance. Relevant Experience and Past Performance will be evaluated according to the CRITERIA for Non-Price Evaluation Factors found in this section.
3) Price Evaluation. The Government will evaluate price for fairness and reasonableness through the use of price analysis. Price will also be verified for unbalancing of line items.
3.2 Definitions:
a) Clarification is a limited exchange with an Offeror for the sole purpose of eliminating minor irregularities, informalities, or apparent clerical mistakes in the proposal or to address adverse past performance not previously addressed with the Offeror. Clarifications do not give an Offeror the opportunity to revise or modify its proposal and are used, as necessary, when not opening discussions.
b) Communications are a limited exchange with an Offeror used to assist in determinations of the competitive range. Communications are limited to enhancing Government understanding of proposals and addressing adverse past performance information not previously addressed if said information is the determining factor preventing an Offeror from being included in the competitive range. Such communications shall not be used to cure proposal deficiencies or material omissions, or otherwise revise the proposal.
c) Discussions offer the opportunity to resolve deficiencies or weaknesses in the proposals, based on the requirement and the evaluations factors set forth in the solicitation. If the Contracting Officer determines it is necessary to open discussions, they must discuss with all Offerors in the competitive range. Offerors have the opportunity to revise their proposals at the conclusion of discussions.
d) Relevant: “Relevant” is defined as having a logical connection with the requirements in this request for technical proposals; that is, featuring work that is similar in nature, magnitude, and complexity to the current requirement. To be acceptable, there must be an explanation of how the provided project information is relevant to the proposed work.
e) Year: A “year” is 365 consecutive days.
3.3 Bid Guarantee:
The Offeror is required to submit a bid guarantee along with its proposal. The bid guarantee shall be included in Volume II of the proposal. Any proposal received without a bid guarantee will be rejected and is ineligible for review by the Government. The amount of the Bid Guarantee shall be twenty (20) percent of the Offeror’s proposed price or $3,000,000.00, whichever is less.
3.4 Submission Format: (Please refer to Section 00 21 16 for number of required copies)
All proposal materials shall be submitted in binders with a table of contents and tabbed section dividers. The sections should parallel the submission requirements identified below. In Volume I, Technical Proposal, there shall be a tabbed section for each Non-Price Evaluation factor. Volume II, Price Proposal, shall be submitted in a clearly marked envelope.
3.3.1 Volume I - Offeror’s Technical Proposal shall include the following sections, in the general format specified below:
• Table of Contents for Volume I - (Listing of all sections of the technical proposal)
• Tab A/Factor A – Relevant Experience of OFFEROR/PRIME (Or Affiliate as defined in Paragraph 5.2), Attachment 1 & 2.
• Tab B/Factor B – Relevant Experience of TEAM, Attachment 1 & 3.
• Tab C/Factor C– Past Performance, Attachment 4.
3.3.2 Volume II – Offeror’s Price Proposal shall include the following, in the general format specified below:

• Joint Venture Agreement, if applicable
• Pre-Award Information found at back of Section 00 45 00 (filled out in its entirety)
• Section 00 45 00 Representations and Certifications
NOTE: Offeror’s Price Proposal is due AT THE SAME TIME as Technical Proposal.
4.0 EVALUATION CRITERIA
4.1 CRITERIA for Non-Price Evaluation Factors:
Proposals shall concisely, accurately, and completely provide the information required for each of the following non-price evaluation factors. NOTE: Absence of complete information will be deemed as if no support information was provided for that factor. Proposals that do not meet the minimum requirements of all of the non-price evaluation factors shall be determined to be UNACCEPTABLE and are not eligible for award consideration. NO assumptions may be made by the Government. Your proposal must CLEARLY demonstrate the requisite technical experience and qualifications to receive an ACCEPTABLE rating for each of the following criteria:
TABLE 2: EVALUATION
FACTORS: LOCATION: DESCRIPTION:
FACTOR A VOLUME 1, TAB A RELEVANT EXPERIENCE OF
OFFEROR/PRIME.
FACTOR B VOLUME 1, TAB B RELEVANT EXPERIENCE OF TEAM.
FACTOR C VOLUME 1, TAB C PAST PERFORMANCE.
5.0 FACTOR A– Relevant Experience of Offeror/Prime (Or Affiliate as defined in Paragraph 5.2):
5.1 Definitions for Factor A (Definitions for the purposes of this factor):
Complexity means new construction with many varied elements of work or sequencing of the work required for a project of this nature (not pre-engineered or pre-fabricated).
Function means construction of a fire station or a commercial building that has at least two functions contained in this proposed project, i.e., administrative offices, classrooms/training rooms, commercial kitchen, apparatus bay, locker room with showers, and sleeping quarters. For information only, examples of a commercial building include: administration building, airport terminal, cinema, medical clinic, dormitory, dry cleaning plant, educational building, commercial garage and service station, , health and athletic club, hospital, hotel, laboratory, library, motel, museum, radio and television broadcast studio, recreational facility building, religious building (church, synagogue, mosque or temple), school building, shopping mall, and theater.
Magnitude/Cost means projects equal to or greater than Contract amount of $5,000,000.
Relevant means the present or past performance effort involved with construction projects similar in function, scope, magnitude, and complexity.
Scope means containing many of the elements of work and of physical size of a vertical construction building, with the minimum of 16,500 square feet.
Similar means not identical but showing a resemblance in qualities or characteristics of the proposed project.
5.2 Submission Requirements for Factor A:
For this Factor, the Offeror shall submit examples of construction projects which illustrate the relevant experience on projects of similar function, scope, magnitude, and complexity as defined in paragraph 5.1, demonstrating its own experience as a prime contractor. The Offeror may submit construction projects performed by parent companies, affiliates, separate divisions, or other entities associated with the Offeror (hereinafter collectively referred to as Affiliate(s)). If the Affiliate(s) have the relevant experience, and the Offeror can show that this association will continue through the execution of this contract, then that experience may be deemed relevant, and will be considered for this Factor.
Restated, only those projects for which the Offeror or its Affiliate(s) (as long as it is demonstrated that said Affiliate(s) will affect the performance of the Offeror) were the prime contractor shall be submitted. If the experience of an Affiliate is submitted for evaluation, it shall be accompanied by a letter of commitment signed by the Affiliate and the Offeror binding affiliate resources to the performance of the project. This letter must be signed by a person authorized to bind the Affiliate to dedicate its resources—its workforce, management, facilities, or other resources—to the performance of the work under this solicitation.
The Offeror shall document the teaming arrangement with the Affiliate by utilizing the Letter of Commitment for Affiliate, Parent Company, Separate Division, or Other Entity (Attachment 2) found at the end of this Section 00 22 16, or of similar document.
Offeror shall submit at least one (1) project example, but no more than four (4) project examples which demonstrate Offeror’s (or that of an Affiliate specifically for the execution of this contract) relevant experience as the Prime Contractor, with a construction value of at least $5,000,000. Each submitted project shall be 100% complete within six (6) years from the date of issuance of this solicitation. If the Offeror submits more than four (4) project examples, only the first four will be evaluated, starting with the most recent and working backwards in time. The submitted project(s) shall also have elements matching the following:
5.2.1 At least one (1) project shall be new construction or renovation of a facility having achieved a U.S. Green Building Council’s LEED Silver certification or better.
5.2.2 At least one (1) project shall be new construction or renovation of a facility on a U.S. military installation.
Note: Project experience for Factor A must be submitted using Attachment 1.
The total of one (1) and up to four (4) submitted projects combined, must meet the two elements of the especially relevant construction experience areas listed above, although both elements do not necessarily need to be present in any one project. However, each project submitted must demonstrate at least one of the two elements indicated above and in the matrix below.
Using a Relevant Experience Matrix similar to that shown below, clearly identify to which experience area(s) each project example pertains (i.e. Project 1 demonstrates new construction on a U.S. military installation):

5.3 Evaluation Method for Factor A:
Factor A will be evaluated to determine whether it meets the requirements of this factor. If any of the required information is not provided in the Offeror’s proposal, the Offeror will be evaluated as “Unacceptable.” The Government reserves the right to verify the experience record of cited projects or other recent projects by reviewing the Past Performance Information Retrieval system (PPIRS) which includes the CCASS/ACASS ratings, other DOD or Government appraisal systems. The Government may check any or all cited references to verify supplied information.
TABLE 3: FACTOR A - RELEVANT EXPERIENCE OF OFFEROR/PRIME
Acceptable The proposal clearly demonstrates how at least one of the project examples submitted meets the requirements of paragraph 5.2.
Unacceptable The proposal does not clearly demonstrate how at least one of the project examples submitted meets the requirements of paragraph 5.2.
6.0 FACTOR B – Relevant Experience of Team
6.1 Definitions for Factor B (Definitions for the purposes of this factor):
Electrical Systems means a network of electrical components deployed to supply, transfer, store, and use electrical power.
Magnitude/Cost means projects equal to or greater than Contract amount of $3,000,000.
Mechanical Systems means heating, ventilating, air-conditioning, refrigeration (HVAC-R), plumbing, fire protection, and noise reduction for the buildings.
Long span means 40 feet unsupported span in length.
Relevant means present or past performance effort involved with construction projects similar in scope and magnitude (note: different than Factor A).
Scope means containing many of the elements of work and of physical size in terms of square feet of the vertical construction building, with a minimum of 25,000 square feet (note: different than Factor A).
Similar means not identical but showing a resemblance in qualities or characteristics of the proposed project.
Team means the Prime Contractor/Offeror (including any Affiliates as defined in Paragraph 5.2, above) and/or its major/key subcontractors, taken as a whole.
6.2 Submission Requirements for Factor B:
For this Factor, the Offeror shall submit at least one (1) relevant project, but no more than four (4) relevant project examples with a construction value of at least $3,000,000, demonstrating its own experience as a prime or as a key subcontractor. The experience of a proposed team may be submitted as an example, subject to the additional submission of the Letter of Commitment of Key Subcontractor found at Attachment 3 to this Section. If the Offeror submits more than four (4) project examples, only the first four will be evaluated, starting with the most recent and working backwards in time. The project examples submitted for Factor A may also be submitted under this Factor B to meet the minimum requirements of this Section 6.0.
All project(s) submitted shall be 100% complete within the past six (6) years from the date of issuance of this solicitation. The submitted project(s) shall also have elements matching the following:

1 X 2 X 3 X
If the experience involving the types of construction areas listed above was not self-performed by the Prime, the Offeror shall submit relevant experience information for the Key Subcontractor that will be completing work for this project. The Offeror shall document the teaming arrangement with the Key Subcontractor(s) utilizing the Letter of Commitment of Key Subcontractor (Attachment 3) found at the end of this Section 00 22 16.)
Note: Project experience for Factor B must be submitted using Attachment 1.
6.3 Evaluation Method for Factor B:
Factor B will be evaluated to determine whether it meets the requirements of this factor.
TABLE 4: FACTOR B - RELEVANT EXPERIENCE OF TEAM
Acceptable The proposal clearly demonstrates how at least one of the project examples submitted meets the requirements of paragraph 6.2.
Unacceptable The proposal does not clearly demonstrate how at least one of the project examples submitted meets the requirements of paragraph 6.2.
7.0 FACTOR C – Past Performance
7.1 Submission Requirements for Factor C:
The project examples submitted for Paragraph 5.2 and Paragraph 6.2 will be used for evaluation of Past Performance. DO NOT provide Past Performance references for projects other than those project examples provided for Factor A and Factor B.
If a completed interim and/or final Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal. Offeror shall not submit a Past Performance Questionnaire (PPQ) when a completed CPARS evaluation is available. If both are submitted, only the CPARS will be evaluated.
Completed PPQs should be submitted with your proposal ONLY if a CPARS evaluation is not available. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ (Attachment 4), which will provide contract and client information for the respective project(s). Offeror should follow-up with clients/references to ensure timely submittal of questionnaires.
If the client requests, PPQs may be submitted directly to the Government's point of contact, Shawna West, via email at shawna.west@usace.army.mil prior to the proposal closing date. The Offeror shall instruct the clients to refer to the solicitation number in the subject line. The PPQs are Source Selection materials. All successfully submitted PPQs will receive an e-mail confirmation upon receipt. If the Offeror does not receive the confirmation, it is their responsibility to follow up to ensure the Government has received the information.
Offeror shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other solicitations. However, this does not preclude the Government from utilizing previously submitted past performance information in the past performance evaluation.
Offeror may provide explanation on problems encountered on past projects and the corrective actions taken by the Offeror.
7.2 Evaluation Method for Factor C: The method of rating for Factor C shall be as follows:
The Government will evaluate past performance based on a demonstrated record of performance. Past performance information is an indicator of an Offeror’s ability to perform the contract successfully. The Government will evaluate the successful completion of all project examples submitted in the proposal for Factor A and Factor B. The Government reserves the right to check any or all cited references to verify supplied information and to assess owner satisfaction.
The Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System
(CPARS).
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
TABLE 5: FACTOR C – PAST PERFORMANCE EVALUATION RATING
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
NOTE: In the case of an Offeror without a record of past performance or for whom information on past performance is not available, the Offeror’s past performance may not be evaluated as favorable or unfavorable.
[Ref: FAR 15.305(a)(2)(iv)]. Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
8.0 REPRESENTATIONS AND CERTIFICATIONS:
mailto:shawna.west@usace.army.mil
The following representations and certifications apply to this solicitation. The Offeror submitting a proposal in response to this solicitation shall fill in the appropriate information and/or check the appropriate boxes for each provision listed below and complete the Pre-Award Information which can be found in Section 00 45 00. This information shall be submitted with the Offerors Proposal.
Contractors are required to be registered in the System for Awards Management (SAM) for awards resulting from solicitations.
This rule more efficiently implements the Debt Collection Improvement Act of 1996, as it requires contractors to be registered in SAM for consideration of future solicitations, awards, and payment. Registration is required prior to award of any contract, basic agreement, basic ordering agreement, or blanket purchase agreement from a solicitation issued after May 31, 1998.
LACK OF REGISTRATION IN THE SAM DATABASE WILL MAKE AN OFFER INELIGIBLE FOR
AWARD.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT EVALUATION
(E) Exceptional:
Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good:
Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory:
Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal:
Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory:
Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable: No information or did not apply to your contract. Rating will be neither positive nor negative.
