This document is an Amendment (Amendment 0006) to a federal solicitation for the Troy Lock (AFO) Mooring Pier project issued by the U.S. Army Corps of Engineers, New York District. The amendment extends the bid opening date to March 25, 2025, and provides responses to Request for Information (RFI) questions, including clarifications on painting requirements, geotechnical engineering responsibilities, ladder repairs, composite timber specifications, and joint venture eligibility. The project is a 100% Small Business Set-Aside with a NAICS code of 237990 and a project magnitude range between $1,000,000 and $5,000,000.

The solicitation involves repairing a mooring structure downstream of Troy Lock & Dam on the Hudson River, with work including replacing timber rubbing fenders with composite material, repairing ladders and metal grating, replacing concrete decks, repairing cell wall leaks, and clearing vegetation. All work will be performed via water access only, with careful consideration of the adjacent public boat launch. The contractor must obtain necessary federal, state, and local permits, with a performance period of approximately 365 calendar days. Bids are to be submitted to the U.S. Army Corps of Engineers Contracting Division, with all vendors required to be registered in SAM.gov prior to award.

Questions and Answers:

The following questions and answers are provided for information only. Nothing contained below amends or revises any provision of the solicitation.

This is for bidder’s reference only and is not to be considered as a part of the Contract Documents.

Contract award will be based on what is contained in the printed Plans and Specifications in a hard copy format or Electronic Bid Set if provided and as posted in the FBO.

RFI SET #2:

1. Please confirm that a painting contractor who is SSPC QP 1 certified is required to coat the 9 snubbing posts. This will add significant cost to this project.

a. The painter must be SSPC QP 1 certified.

2. Please confirm that the W12x58 fender support beams are to be galvanized and not painted.

a. Yes, Beams will be galvanized

6. Amendment 4 dated 2/13/25, the answer to question 1 references an attachment “1968 –

Downstream Mooring Wall Reconstruction As Built Drawing”. This drawing was not in the amendment 4 and is not on Sam.Gov. Can this drawing be provided?

a. Drawing uploaded to SAM.gov.

8. Are contractors required to provide a professional geotechnical engineer in accordance with specification section 31 00 00, 1.4? The only scope of work pertaining to this specification section is the backfilling of cell fill voids with crushed stone. Please advise.

a. Government Response: The Contractor is expected to perform the work in accordance with the Contract documents, so yes, a professional geotechnical engineer is required. The professional geotechnical engineer is expected to review the gradation results from the quarry where stone is being received from for conformance to the contract documents. They must also provide sampling of the stone delivered to field and an assessment of whether the stone meets the requirements outlined in the specifications. If dewatering is required, the professional geotechnical engineer would design the proper plan for dewatering as well.

9. Specification section 31 00 00 1.4.2 indicates contractors to provide a qualified technician to inspect, monitor, sample and perform field testing. Please specify the field testing required for earthwork on this project. The table under 3.8 in this section only indicates gradation testing at the stone source for the crushed rock fill. Are other field testing procedures required such as compaction testing?

a. Government Response: Gradation testing is required at the source and onsite during construction to ensure the gradation meets the contract requirements. A qualified technician will be onsite to observe the condition of the subgrade prior to filling the voids with crushed rock. The subgrade will be inspected by the qualified technician who will state whether or not the subgrade is ready to receive crushed stone. Once the crushed stone is placed, the qualified technician will ensure that the compaction procedures are being met (8 inch lifts compacted via plate tamper).

12. If existing sheet piles are coated, please clarify if contractors are to recoat the sheet pile after installing the fender support beams? If recoating is to occur please clarify if an SSPC QP 1 certified painter is required and what painting system is to be utilized on the sheet piles.

a. Government Response: The existing sheet pile coating will be locally removed and the area will be cleaned where the steel channels and support brackets are to be welded on as per AWS D-19.0. After welding is complete, the sheet pile will be coated with zinc-primer and paint as per ASTM A780.

Because of the complex conditions of the work site and the need to maintain the water quality of the Hudson River, the painter must be SSPC QP 1 certified. The contract plans now include a note reflecting this direction.

13. Drawing C-102 indicate turbidity barrier around the majority the mooring structure. Is this required?

This scope of work should not create turbidity as all of the work is above MLW.

a. Yes, it is required.

15. Specification section 05 51 33, 1.3 states to provide fabricator certification for ladder assembly that the ladder and associated components have bene fabricated according the requirements of 29 CFR

1910.23. This seems to indicate that new ladders are being provided, the plans seem to indicate that existing bent ladders are to be repaired and reused. Please advise if ladders are to be repaired or replaced.

a. Government Response: Ladders are to be repaired as shown in the contract plans. Specification Section 05 51 33 paragraph 1.3 will be kept in the documentation just in case the contractor finds in the field that a ladder is beyond repair. The contract plans now include a note reflecting this direction.

16. The composite timber manufacturer reviewed the contract documents including Amendment 0004. Based on what’s been provided, they are unable to determine what composite timber (size and reinforcement) is required for this application. Can the USACE provide some guidance on the recommended size (8”x12”, 10”x10” or 12”x12”) and reinforcement (dia of fiberglass rebar reinforcement) that is needed for this application. Product data can be provided if needed.

a. Government Response: The contract plans will be adjusted, particularly S-102, to provide guidance regarding the composite timber size. There will also be more specific guidance that will be directed only to bidders, but this guidance should not restrict the contractor when choosing a fendering system.

17. Would your office allow for a Joint Venture with a larger company to help perform this scope of work? I have found one that is able to conduct this work and has a history of such in the area.

a. Yes, a small business can form a joint venture with a large business and still be eligible for a small business set‐aside contract—but the joint venture must be structured so that it qualifies as a small business concern under FAR 19.001 and FAR 19.301 1. This means that either all partners must individually meet the applicable size standards or, in a mentor–protégé arrangement, the small business (protégé) must qualify as small even if its mentor is large. USACE will evaluate the combined capabilities by reviewing the past performance and experience of each joint venture member, and the joint venture entity must be properly registered (e.g., in SAM), as emphasized in recent GAO decisions and supported by AFARS guidance.
