BIDDER’S QUESTIONS AND GOVERNMENT REPLY

(Questions that may be of general interest to all Bidders and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the bidders “For Information Only” and do not revise the solicitation, plans or specifications.)

Question 1: Please see paragraph 1.1 of Spec 33 46 16 SUBDRAINAGE PIPING clauses pertaining to UNIT PRICES, Measurement and Payment for Pipe Subdrains, Manholes, and Flushing and Observation Risers. Please advise where on the Bid Form are the Unit Prices for this work to be entered.

Response 1: Unit prices are not required for subdrainage piping. References to unit pricing have been removed from Specification 33 46 16.

Question 2: We have found the Borings and Boring Logs for Borings A-1, A-3, A-4, A-5, A-6 & A-7. There are no Borings nor subsurface information shown anywhere for the vicinity of the PROPOSED 12” HDPE UNDERDRAIN OUTLET PIPE shown on Dwg C-019. Dwg C-004 designates this pipe to be “INSTALLED BY DIRECTIONAL BORE.” As such we need some subsurface and/or Boring information to anticipate the ground conditions at the line of the Directional Bore. Please provide same.

Response 2: See report titled “Delafield Pond Dam Leakage Assessment” for boring information that was issued as an appendix within the specifications.

Question 3: Dwg C-004 shows the Proposed Underdrain Pipe “OUTLET PIPE INVERT 290.00” and the end of the pipe is shown graphically at existing contour line 209. Dwg C-019 at “B1 DRAINAGE PIPE OUTFALL SECTION” shows a notation at the end of the pipe “PIPE OUTLET INVERT EL.. 290…” and also shows graphically that the end of the pipe is at Elev 290. However the EXISTING GRADE at the end of the pipe is shown graphically as El. 298.0.

This information is inconsistent and confusing. Please advise which is correct and provide corrected drawing.

Response 3: Drawing C-004 correctly shows pipe invert and grade at 290. Existing grade lines on C-019 have been revised to show 290. See Addendum 3 for revised drawing.

Question 4: Dwg C-004 at “A3 STORMWATER PLAN” the scale is written as “ 1” = 50’ “, but is drawn as 1” = 20’.

No need to correct this, we figured it out.

Response 4: The written scale on drawing C-003 has been corrected to 1”=20’. See Addendum 3 for revised drawing.

Question 5: Section 02 61 13 Excavation & Handling of Contaminated Material states that ‘the sampling results indicate the sediment materials should be excavated from the dam impoundment area and disposed offsite at a Resource Conservation and Recovery Act (RCRA) subtitle D nonhazardous waste disposal facility.’ The limited analysis available in the bid package indicated levels that could be acceptable at beneficial reuse/recycling facilities through New Jersey and Pennsylvania. If future waste characterization results indicate acceptable levels, would we be able to utilize a beneficial reuse facility (at a significantly lower cost) as opposed to a Subtitle D Landfill?

Response 5: The question is hypothetical. The Government cannot speculate on the hypothetical situation. If future waste characterization results indicate the material meets criteria for disposal at alternate locations, specific observed conditions can be presented to the Government as an RFI after NTP.

Question 6: Spec Section 02 61 13-1.2 States “sampling results indicate sediment materials should be excavated from the dam impoundment area and disposed offsite at a RCR subtitle D nonhazardous waste disposal facility – Please advise why this material needs to be dispose at a subtitle D facility?

Response 6: Based on the analysis, the sediments subject to removal do not constitute characteristic hazardous waste subject to regulation under RCRA. However, waste characterization sampling using USEPA Method 1312, Synthetic Precipitation Leaching Procedure, may be necessary if required by the selected off-site disposal facility.

Question 7: Dwgs C-006 shows “A3 POND PROFILE AT BASELINE.” At the bottom Left hand end of the Profile there is a note “COMPACTED FILL (IF REQUIRED) TO RAISE GRADE FOR INSTALLATION OF DRAINAGE LAYER. SEE SHEET C-018.” Sheet C-018 mentions nothing at all about Compacted Fill to Raise Grade. Please advise.

Response 7: Call note on C-006 has been revised to “COMPACTED FILL (IF REQUIRED) TO RAISE GRADE FOR INSTALLATION OF DRAINAGE LAYER. SEE CROSS SECTIONS ON SHEETS C-010 THROUGH C-015.” See Addendum 3 for revised drawing.

Question 8: Dwgs C-007 shows “B2 TYPICAL POND SECTION (DELAFIELD POND C/L).” at the bottom Right hand side of the Section is a note ” At the bottom Left hand end of the Profile there is a note “COMPACTED FILL (IF REQUIRED) TO RAISE GRADE FOR INSTALLATION OF DRAINAGE LAYER. SEE SHEET C-018…..” Sheet C-018 mentions nothing at all about Compacted Fill to Raise Grade. Please advise.

Response 8: Call out note on C-007 has been revised to “COMPACTED FILL (IF REQUIRED) TO RAISE GRADE FOR INSTALLATION OF DRAINAGE LAYER. SEE CROSS SECTION ON SHEETS C-010 THROUGH C-015.” See Addendum 3 for revised drawing.

Question 9: Dwg C-007 shows “B2 TYPICAL POND SECTION (DELAFIELD POND C/L).” This C/L is obviously different from the Baseline 10+00 to 14+94. Please describe and show on drawing where is the POND C/L.

Response 9: C/L call out has been removed from drawing C-007. This is a typical section not tied to a specific station. It is a generic depiction of the proposed conditions and was required for use in permit applications. See Addendum 3 for revised drawing.

Question 10: Dwg C-018 shows “E2 ACCESS RAMP SECTION.” At the approx center of the section shows “COMPACTED SOIL.” Is this material the same as the “COMPACTED FILL Specification?

Response 10: Drawing has been revised to say, “COMPACTED FILL”. See Addendum 3 for revised drawing.

Question 11: Dwg C-018 shows “E2 ACCESS RAMP SECTION.” Near the top Left hand side of the Section is a callout saying “GEOTEXTILE FILTER FABRIC BETWEEN COMPACTED SOIL AND 6” COMPACTED SOIL.” Please clarify this note.

Response 11: Call out has been revised to say, “GEOTEXTILE FILTER FABRIC BETWEEN COMPACTED FILL AND 6” COMPACTED SAND.” See Addendum 3 for revised drawing.

Question 12: Dwg C-018 shows “E2 ACCESS RAMP SECTION.” On the extreme Right hand side shows an area which appears to require fill material, however it is not indicated as such. There is no way to quantify the Fill volume with the information given, however is there a reason that fill does not show as being required?

Response 12: Drawing C-018 has been revised to show compacted fill on the right hand side. See Addendum 3 for revised drawing.

Question 13: Spec section 31 23 00.00 20-3.5-Subgrade Filter Fabric calls out to place filter fabric as needed on the prepared subgrade, details in the drawings only show fabric below and above the 2 FT drainage stone layer and not directly over the subgrade. Please advise if filter fabric is required to be placed over the prepared subgrade prior to backfilling the undercut?

Response 13: Filter fabric is not required to be placed over the prepared subgrade.

Question 14: Is the contractor allowed to blast on-site?

Response 14: Blasting is not permitted. Explosives must not be used nor brought to the project site.

Question 15: Regarding key personnel – are the following positions required to be on-site at all times - Two (2) Assistant Superintendents, Contractor's Assistant Quality Control System Manager, and Assistant Site Safety and Health Officer? Or may they serve as alternates as necessary when the lead positions are unavailable?

Response 15: Two (2) Assistant Superintendents are not required to be on site at all times; they serve as alternates in the event the Superintendent is absent. Contractor's Assistant Quality Control System Manager is not required to be on site at all times; she serves as alternate in the event the Contractor's Quality Control System Manager is absent. Assistant Site Safety and Health Officer is not required to be on site at all times; she serves as alternate in the event the Site Safety and Health Officer is absent.

Question 16: Dwgs C-010 through C-015 show Cross Sections of the Pond at various Stations. Why are some Cross Sections labelled “E3 POND SECTION” while others are labelled “B3 POND SECTION” and one is labelled “D3 POND SECTION”? What does E3 and B3 and E3 intend to indicate.

Response 16: Sections are placed in the drawing area according to the Army Corps of Engineers Best Practices for drawing area title placement. This grid is designated with numbers 1-10 at the top of the drawing sheet and letters G-A on the left side of the drawing sheet. E3 indicates that the placement of the section is row E, column 3. B3 indicates row B, column 3. D3 indicates row D, column 3.

Question 17: Dwg C-002 at the bottom Right hand side of the A3 DEMOLITION PLAN shows a callout “REMOVE EXISTING FENCE AND FENCE FOUNDATION.” From the field inspection meeting, the fence appears to be a conventional Chain Link Fence 4’ high with conventional chain link fence and conventional posts. Please describe the size, material and extent of the “FENCE FOUNDATION.”

Response 17: The fence is chain link with an approximate height of 4ft, a fence topper, and a typical concrete foundation, with posts placed approximately every 10ft. It is assumed that there is a post hole filled with concrete at each fence post 1ft-2ft deep and 8in-12in in diameter.

Question 18: Dwg C-003 at the bottom center shows a callout “TRANSITION BETWEEN SECTION B-B AND SECTION C-C SEE SHEET C-017.” There is no SECTION B-B and no SECTION C-C on Sheet C-017. Where are SECTION B-B and

SECTION C-C?

Response 18: Section callout has been revised. See Addendum 3 for revised drawing.

Question 19: Dwg C-011 shows “B3 POND SECTION STA. 11+50” There is no “6” COMPACTED SAND LAYER” shown. In our opinion this is an oversight and 6” Compacted Sand Layer should be included. Please advise.

Response 19: Drawing has been revised to show 6” compacted sand layer. See Addendum 3 for revised drawing.

Question 20: Please advise if the flooding in early July has drastically changed any of the existing conditions in and around Delafield pond, if so will bidder be allowed another site visit?

Response 20: The existing conditions were not affected. Another bidder site visit will not be scheduled.

Question 21: Please advise if the existing parking lot adjacent to the historic building can be used for contractor staging/laydown/stockpiles?

Response 21: Yes, it can.

Question 22: Based on the recent flood damage to the base we foresee major infrastructure work taking priority on the base and are wondering what coordination will be required with such contracts as well as how this affects the overall project and schedule.

Response 22: The performance of this contract will not be impacted by other work happening on the Installation.

Question 23: Dwg C-002 shows a location for fence removal and gate installation. The height of the fence is not shown and the height of the Gate is not shown. Please advise the heights.

Response 23: Approximate height of fence for removal is 4ft. Per specification 01 50 00, height of security gate is 6ft.

Question 24: Dwg C-009 shows the detail for the Gate. But the height of the gate is not disclosed. Please advise.

Response 24: Per specification 01 50 00, height of security gate is 6ft.

Question 25: There will be broken rock material quantities which develop from the various rock removal locations on site. We are assuming that this material may be placed in the fills. Please confirm.

Response 25: Per specification 32 23 00, 2.1.3 Structural Backfill Material, Reuse excavated materials that meet the specified requirements for the material type required at the intended location. Coordinate with the Contracting Officer’s Representative to identify onsite reuse opportunities.

Question 26: There will be broken concrete material quantities which develop from the various concrete removal locations on site. We are assuming that this material may be placed in the fills. Please confirm.

Response 26: Per specification 32 23 00, 3.3 Excavation, reuse excavated materials that meet the specified requirements for the material type required at the intended location. Coordinate with the Contracting Officer’s Representative to identify onsite reuse opportunities.

Question 27: Dwg C-004 shows the Underdrain Outlet Structure GRATE ELEV as 309.0 Dwg C-019 shows the TOP ELEV at 307.5. Please advise which is correct.

Response 27: Drawing C-019 has been revised to show TOP ELEV at 309.0. See Addendum 3 for revised drawing.

Question 28: Specification 31 23 00.00 20 at Paragraph 2,1,3 says “…The Structural Backfill shall not contain any rock fragments any larger than 4” .“ This limitation is rather narrow considering that the fills vary from 2’ deep to 20’ deep. In the interest of Project Economy would you be able to relax or revise this spec to correspond to NYSDOT Spec 733-08 EMBANKMENT IN PLACE & Spec 733-09 SELECT BORROW?

Response 28: Specification 31 23 00.00 20 cannot be revised at this time.

Question 29: Clarification of Clearing and Grubbing regarding removal of stumps. NYSDOT Spec 201-3.02 Clearing and Grubbing. “No Grubbing will be required beneath the embankment where the finished grade will be 6 feet or more above the original ground surface…Where trees or existing stumps are cleared and grubbing ids not required, the tree trunk or existing stump shall be cut off not more than 6 inches above the original ground surface.” . In the interest of Project Economy would you be able to relax or revise the spec 31 11 00?

Response 29: The question is speculative; this condition is not anticipated. All vegetation in the pond bottom is expected to be adequately removed with the 2ft of required over-excavation. The specification cannot be revised.

Specific observed conditions can be presented to the Government as an RFI after NTP.

Question 30: The Drawing of the “DEVELOPMENT OF DELAFIELD POND AREA” does not represent the existing conditions. It may be that this scheme never materialized. Site inspection and phots did not show any of the proposed improvements.

Response 30: The “as-built” drawing in question was provided For Information Only and is not a part of this contract.

Question 31: Your response to Question 6 (Amendment 3) is “Gray line weights are for existing conditions /reference only.” We notice that you have provided corrected drawings with most of the formerly faint & illegible notations darkened which can now be recognized. There are still some very faint notations which remain as illegible. We will disregard all illegible notations as being “existing conditions/reference only.”

Response 31: Existing conditions and reference items continue to be shown in gray scale.

Question 32: Your response to Question 12 (Amendment 3) regarding the incorrect scale for Drawing C-007 states that the “Drawing will be revised and noted as N.T.S.” What is the purpose of this sketch if it is Not To Scale?

Response 32: Drawing C-007 is a typical section and not intended to be used to layout excavation or materials. It is a generic depiction of the proposed conditions and was required for use in permit applications.

Question 33: The Scale on C-020 seem to be close to correct, however the given length of 122’ remov is either incorrect or the drawing is not to scale. The Scaled length of Silt fence is 140’. This is beyond the margin of error for scaling on 1”= 20’. Please verify the scale or the dimension of 122’ so we can be confident in using this drawing.

Response 33: Callout note on C-020 has been corrected to “140 L.F. SILT FENCE”. The scale on C-020 is correct at 1”=20’.

Question 34: Three of our prospective Horizontal Directional Drilling Subcontractors have declined quoting us for the drilling on this project due to the rigid and sophisticated HDD Spec. 33 05 23.13 pages 7-8. They have walk over locator systems and do not have any way of recording all the pressures and drill bit locations every 2’’through their drilling rigs . If these requirements change or are not required, please let us know so we can so advise our potential subcontractors.

Response 34: The requirements are not being altered at this time.

Question 35: We noticed some multi colored electrical conductors along the top and down the face of the dam (see the attached photo). These are not noted on the drawings and , as such, we will disregard them.

Response 35: Remove and dispose of those pursuant to 02 41 00 paragraph 3.1 EXISTING FACILITIES TO BE

REMOVED.

Question 36: Please advise what is the purpose of demolishing the existing retaining wall if it is to be buried in the compacted fill? We will assume that, if demolition is insisted upon, that the debris may be distributed into the compacted fill areas. Please confirm.

Response 36: Debris may be distributed into the compact fill areas. See specification 02 41 00, 2.1 Fill Material, “Comply with excavating, backfilling, and compacting procedures for soils used as backfill material to fill basements, voids, depressions or excavations resulting from demolition or deconstruction of structures.”

Question 37: Please confirm compacted fill deliveries can enter the base through the Thayer gate similar to rock deliveries/removals?

Response 37: No; passing through Thayer Gate will not be allowed. Follow the route shown on G-005 Haul Route Plan.

Question 38: Refer to Dwg C-011 from Amend No 0003 Add No 2. At B3 POND SECTION STA 11+50 showing the notation “OVER EXCAVATE BOTTOM 2’ OF POND”. We recognize that this 2’ excavation will be replaced and backfilled with “COMPACTED FILL.” Also, please note the legend “24” STONE DRAINAGE LAYER”. Please confirm that the “24” STONE DRAINAGE LAYER” will also require the “OVER EXCAVATION of the BOTTOM 2’ OF POND, prior to the placement of “24” STONE DRAINAGE LAYER.” B3 POND SECTION STA 12+00 presents the same situation.

Response 38: It is the intent that the pond bottom be over excavated by 2FT regardless if it is backfilled with compacted fill or stone layer. In the condition where the stone layer is placed on the pond bottom, no additional excavation beyond the initial 2ft is required.

Question 39: The TABLE OF CONTENTS listings for Appendix B, Appendix F, Appendix G, and Appendix H each contain the note “Available Upon Request.” Please make these documents available in the most convenient format.

Response 39: The information already provided in the Specifications is all that we are able to provide at this time.

Question 40: With respect to the over-excavation in the pond, the 4200 CY estimate provided reflects the 2’ depth of the contaminated soil to be removed. However, this does not appear to account for the volume of vegetation growing on top of the contaminated soil that has to get cleared/grubbed. Can we assume this vegetation will be discarded the same way the contaminated soil will be? If so, does your team have an estimate for the vegetation getting removed to support our cost calculations (as this is not a traditional clearing)?

Response 40: The vegetation can be disposed of normally as discarded material at a landfill. There is no estimate for the exact vegetation in the pond area as flora conditions have changed since the time of the land surveying.

Question 41: Can you provide a profile/dimensions and material of the retaining wall to be removed on the southwest portion of DWG C-002?

Response 41: See as-built drawing titled, "Development for Delafield Pond Area Plan, Elevations, Section & Details of Wading Pool, Wall, Railing & Seat" for approximate dimensions and material type of retaining wall to be removed.

Question 42: What are the dimensions of the drainage inlet marked for removal on C-002?

Response 42: The drainage inlet is currently obscured but assumed to be the scale of a small drainage inlet corresponding to a 12inch outlet.

Question 43: Which scaling should we be utilizing for the drawings? When setting the scale in our software, the graphic scale bar on the bottom right of the drawing does not match the specified scale on the bottom left. We get two very different dimensions as a result.

Response 43: Written scale on C-004 has been corrected to 1”=20’. See addendum 3 for revised drawing.

Question 44: The plans specify a 3” gap between the fence fabric and the ground. UFC 4-022-03 specifies that the fence fabric must be within 2” of the ground. Additionally, the specifications state 6-foot fencing fabric, but UFC specifies 7-foot fabric. Which specification should be followed?

Response 44: UFC 4-022-03 2013 is related to security fences. It is stated that the guidelines may be used for perimeter fences but is not a requirement. Please use the contract drawings and disregard any differences with the referenced UFC.

Question 45: Can an allowance be provided for rock removal. There is no way to properly quantify the amount of rock at the mounds at ledges.

Response 45: No, an allowance will not be provided. The notes on sheet C-004 indicate the anticipated extent of rock removal.

Question 46: Specification 01 20 00 PRICE AND PAYMENT PROCEDURES ends abruptly on the second page. There is no advisement of ---End of Section---. Are there additional pages?

Response 46: 01 20 00 is two pages.

Question 47: For the “Unsuitable” or “Muck” the statement says "Payment will be made for costs associated with work included in this line item consists of but is not limited to excavation, temporary storage, and offsite transportation of approximately 4,200 cubic yards of contaminated material within the existing pond side slopes and bottom…” One of our questions on one our RFIs was “How is payment made for the DISPOSAL COST of the Material?” The Disposal is not mentioned at all. The Disposal or Tipping Fee is usually the largest component of unsuitable material handling. How is Disposal paid?

Response 47: Include disposal costs in the unit-priced CLIN 1.

Question 48: Can the designer identify areas that require temporary shoring during excavation since these will likely require expensive rock sockets and piles.

Response 48: It is not anticipated that temporary shoring will be required. Language, from the specifications, is included in the unexpected event that the encountered conditions differ from the expected conditions.

Question 49: Will the contaminated soil material need to receive thermal treatment for disposal to reduce future liability as recommended by Arcadis in the environmental report?

Response 49: Per specification 02 61 13, 3.5 Disposal Requirements: Offsite disposal of contaminated material shall be in accordance with the requirements of the disposal facility including a waste characterization sample, USEPA METHOD 1312, SYNTHETIC PRECIPITATION LEACHING PROCEDURE (SPLP)if required by the facility.

Question 50: Will water access to the Hudson be available for deliveries?

Response 50: No.

Question 51: Section 252.2367004 (a), of the contract (W912DS23B0016) states, "The Government will pay all costs for the mobilization and demobilization of all of the Contractor's plant and equipment at the contract lump sum price for this item". Referencing Section 00 10 00, "Solicitation" of the contract (W912DS23B0016), no item was designated specifically for mobilization and demobilization. Please clarify which item the contractor's mobilization and demobilization is to be paid under or provide an appropriate pay item.

Response 51: CLIN 3.

Question 52: Sheet C-004 of the plans identifies an existing valve adjacent to the existing slide and proposed rip-rap swale. Please confirm if this is an in-service water line and advise whether the contractor would be able to use it as water supply.

Response 52: Assume that water line is not in service. Once the contract is awarded, the contractor may request temporary water supply from the privatized utility company, American Water. Typically, those temporary water supply requests are for connection to a fire hydrant near the construction site.

Question 53: Can historical photos at rain events be provided so the bidders can visualize the site during a rain event.

Response 53: Yes, photos taken in July 2023 are being provided.

Question 54: Demolition and disposal of slides, play equipment and water park features.

Response 54: Remove and dispose of those pursuant to 02 41 00 paragraph 3.1 EXISTING FACILITIES TO BE

REMOVED.

Question 55: Is there a as built of the existing dam showing concrete thickness and steel layout?

Response 55: See photos/sketch in report titled “Delafield Pond Dam Leakage Assessment” that was issued as an appendix within the specifications.

Question 56: We have been searching in the Specifications for the Insurance requirements. In our review of the Contract specs we found one page that referred to insurance requirements. That page was Section 01 30 00 Page 5, at paragraph 1.6 wherein it referenced.

Response 56: The amounts listed in Section 01 30 00 Page 5, at paragraph 1.6 is what is required. Certificate should be on current Accord Insurance Form.

Question 57: Please confirm there are no minority or DBE goals for this project?

Response 57: Goals for minority participation for each trade is 17.0%. Goals for female participation for each trade is 6.9%
