BL.004 AMENDMENTS TO SOLICITATIONS(NOV 2004)

BL. 007 SUBMISSION OF OFFERORS (NOV 2004)

BL. 021 INSTRUCTIONS TO OFFERORS

BI.073 EXTRAS (NOV 2004)

The following clauses are hereby incorporated into solicitation W912DS20B0001.

BF.009 F.O.B. DESTINATION (NOV 2004)

(a) The term "f.o.b. destination," as used in this clause, means-

(1) Free of expense to the NAFI, on board the carrier's conveyance, at a specified delivery point where the consignee's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and

(2) Supplies shall be delivered to the destination consignee's wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The NAFI shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the NAFI acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, the consignee shall perform unloading (including movement to the tailgate), with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(b) The Contractor shall-

(1) Pack and mark the shipment to comply with contract specifications; or in the absence of specifications, prepare the shipment in conformance with carrier requirements;

(2) Prepare and distribute commercial bills of lading;

(3) Deliver the shipment in good order and condition to the point of delivery specified in the contract;

(4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract;

(5) Furnish a delivery schedule and designate the mode of delivering carrier; and

(6) Pay and bear all charges to the specified point of delivery.

BI.013 ORDER OF PRECEDENCE (NOV 2004)

Any inconsistency in this solicitation or contract shall be resolved by giving precedence in the following order:

(a) The Schedule (excluding the specifications);

(b) Representations and other instructions;

(c) Contract clauses;

(d) Other documents, exhibits, and attachments; and

(e) The specifications.

(End of clause)

BI.023 NOTICE TO THE NAFI OF LABOR DISPUTES (NOV 2004)

(a) If the Contractor has knowledge that any actual or potential labor dispute is delaying or threatens to delay the timely performance of this contract, the Contractor shall immediately give notice, including all relevant information, to the Contracting Officer.

(b) The Contractor agrees to insert the substance of this clause, including this paragraph (b), in any subcontract to which a labor dispute may delay the timely performance of this contract; except that each such subcontract shall provide that in the event its timely performance is delayed or threatened by delay by an actual or potential labor dispute, the subcontractor shall immediately notify the next higher tier subcontractor or the prime Contractor, as the case may be, of all relevant information with respect to such dispute.

(End of clause)

BI.024 CONTRACT WORK HOURS AND SAFETY STANDARDS ACT-OVERTIME

COMPENSATION (MAY 2014)

(a) Overtime requirements. No Contractor or subcontractor employing laborers or mechanics shall require or permit them to work over 40 hours in any workweek unless they are paid at least 1 and 1/2 times the basic rate of pay for each hour worked over 40 hours.

(b) Violation; liability for unpaid wages; liquidated damages. The responsible Contractor and subcontractor are liable for unpaid wages if they violate the terms in paragraph (a) of this clause. In addition, the Contractor and subcontractor are liable for liquidated damages payable to the Government. The Contracting Officer will assess liquidated damages at the rate of $10 per affected employee for each calendar day on which the employer required or permitted the employee to work in excess of the standard workweek of 40 hours without paying overtime wages required by the Contract Work Hours and Safety Standards statute (found at 40 U.S.C. chapter 37).

(c) Withholding for unpaid wages and liquidated damages. The Contracting Officer will withhold from payments due under the contract sufficient funds required to satisfy any Contractor or subcontractor liabilities for unpaid wages and liquidated damages. If amounts withheld under the contract are insufficient to satisfy Contractor or subcontractor liabilities, the Contracting Officer will withhold payments from other Federal or federally assisted contracts held by the same Contractor that are subject to the Contract Work Hours and Safety Standards statute

(d) Payrolls and basic records.

(1) The Contractor and its subcontractors shall maintain payrolls and basic payroll records for all laborers and mechanics working on the contract during the contract and shall make them available to the Government until 3 years after contract completion. The records shall contain the name and address of each employee, social security number, labor classifications, hourly rates of wages paid, daily and weekly number of hours worked, deductions made, and actual wages paid. The records need not duplicate those required for construction work by Department of Labor regulations at 29 CFR 5.5(a)(3) implementing the Construction Wage Rate Requirements statute.

(2) The Contractor and its subcontractors shall allow authorized representatives of the Contracting Officer or the Department of Labor to inspect, copy, or transcribe records maintained under paragraph (d)(1) of this clause. The Contractor or subcontractor also shall allow authorized representatives of the Contracting Officer or Department of Labor to interview employees in the workplace during working hours.

(e) Subcontracts. The Contractor shall insert the provisions set forth in paragraphs (a) through (d) of this clause in subcontracts that may require or involve the employment of laborers and mechanics and require subcontractors to include these provisions in any such lower tier subcontracts. The Contractor shall be responsible for compliance by any subcontractor or lower-tier subcontractor with the provisions set forth in paragraphs (a) through (d) of this clause.

(End of clause)

BL.003 AMENDMENTS TO INVITATIONS FOR BIDS (NOV 2004)

(a) If this solicitation is amended, then all terms and conditions that are not modified remain unchanged.

(b) Bidders shall acknowledge receipt of any amendment to this solicitation (1) by signing and returning the amendment, (2) by identifying the amendment number and date in the space provided for this purpose on the form for submitting a bid, (3) by letter or telegram, or (4) by facsimile, if facsimile bids are authorized in the solicitation. The NAFI must receive the acknowledgement by the time and at the place specified for receipt of bids.

(End of provision)

BL.005 FALSE STATEMENTS IN BIDS (DEC 2005)

Bidders must provide full, accurate, and complete information as required by this solicitation and its attachments. The penalty for making false statements in bids is prescribed in 18 U.S.C. 1001.

(End of provision)

BL.008 EXPLANATION TO PROSPECTIVE OFFERORS (NOV 2004)

Any prospective offeror desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing soon enough to allow a reply to reach all prospective offerors before the submission of their offers. Oral explanations or instructions given before the award of the contract will not be binding. Any information given to a prospective offeror concerning a solicitation will be furnished promptly to all other prospective offerors as an amendment of the solicitation, if that information is necessary in submitting offers or if the lack of it would be prejudicial to any other prospective offerors.

(End of provision)

BL.009 LATE SUBMISSIONS, MODIFICATIONS, AND WITHDRAWALS OF BIDS (NOV

2004)

(a) Bidders are responsible for submitting bids, and any modifications or withdrawals, so as to reach the office designated in the invitation for bids (IFB) by the time specified in the IFB. If no time is specified in the IFB, the time for receipt is 4:30 p.m., local time, for the designated office on the date that bids are due.

(b)(1) Any bid, modification, or withdrawal received at the office designated in the IFB after the exact time specified for receipt of bids is "late" and will not be considered unless it is received before award is made; and-

(i) If it was transmitted through an electronic commerce method authorized by the IFB, it was received at the initial point of entry to the Government/NAFI infrastructure not later than 5:00 p.m.

one working day prior to the date specified for receipt of bids; or

(ii) There is acceptable evidence to establish that it was received at the installation designated for receipt of bids and was under the Government/NAFI control prior to the time set for receipt of bids.

(2) However, a late modification of an otherwise successful bid that makes its terms more favorable to the NAFI, will be considered at any time it is received and may be accepted.

(c) Acceptable evidence to establish the time of receipt at the installation includes the time/date stamp of that installation on the bid wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of NAFI or Government personnel.

(d) If an emergency or unanticipated event interrupts normal processes so that bids cannot be received at the office designated for receipt of bids by the exact time specified in the IFB and urgent NAFI requirements preclude amendment of the IFB, the time specified for receipt of bids will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal processes resume.

(e) Bids may be withdrawn by written notice received at any time before the exact time set for receipt of bids. If the IFB authorizes facsimile bids, bids may be withdrawn via facsimile received at any time before the exact time set for receipt of bids. A bid may be withdrawn in person by a bidder or its authorized representative if, before the exact time set for receipt of bids, the identity of the person requesting withdrawal is established and the person signs a receipt for the bid.

(End of provision)

BL.012 PREPARATION OF BIDS-CONSTRUCTION (DEC 2005)

(1) Lump sum bidding;

(2) Alternate prices;

(3) Units of construction; or

(4) Any combination of paragraphs (b)(1) through (b)(3) of this provision.

(c) If the solicitation requires bidding on all items, failure to do so will disqualify the bid. If bidding on all items is not required, bidders should insert the words "no bid" in the space provided for any item on which no price is submitted.

(d) Alternate bids will not be considered unless this solicitation authorizes their submission.

(End of provision)

BL.026 SITE VISIT (CONSTRUCTION) (NOV 2004) -- Alternate I (NOV 2004)

The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. Full text is available online at www.armymwr.org (NAF Contracting).

(End of provision)

BL.030 CONTRACT AWARD-SEALED BIDDING-CONSTRUCTION (DEC 2005)

(a) The NAFI will evaluate bids in response to this solicitation without discussions and will award a contract to the responsible bidder whose bid, conforming to the solicitation, will be most advantageous to the NAFI, considering only price and the price-related factors specified elsewhere in the solicitation.

(b) The NAFI may reject any or all bids, and waive informalities or minor irregularities in bids received.

(c) The NAFI may accept any item or combination of items, unless doing so is precluded by a restrictive limitation in the solicitation or the bid.

(d) The NAFI may reject a bid as nonresponsive if the prices bid are materially unbalanced between line items or subline items. A bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the NAFI even though it may be the low evaluated bid, or if it is so unbalanced as to be tantamount to allowing an advance payment.

BIDDER’S QUESTIONS AND GOVERNMENT REPLY

(Questions that may be of general interest to all Offerors and/or the Government and that are not readily answered by the proceeding changes will appear below. These questions may have been paraphrased or altered to represent several questions regarding the same subject and/or simply revised to clarify and simplify the question(s). Questions and answers are issued to the Offerors “for information only ”and do not revise the solicitation, plans or specifications.).

1. Spec Section 01 30 00 is in the Spec, but not listed on the TOC. Will a revised TOC be issued?

Response: The revised/updated front end specifications have been issued under this amendment 0001.

2. In the Specifications, there appears to be a glitch in the pdf process as several chunks of sections are in an unusual font that is extremely difficult to read (for reference please see 04 20 00). Will a revised pdf of the Spec be issued? Response: The revised/updated front end specifications have been issued under this amendment 0001.

3. Specification Section 01 23 00 (Alternates) Para. 3.1.4 Alternate No. 4 - REVISE HVAC SYSTEM TO INCLUDE HYPER HEAT TECHNOLOGY is listed as an alternate. However on the Bid Form this is listed as a base bid item (Item 0003). Also on drawings M1.01A and E-300A they both say alternate. Please clarify. Response: It is not relevant whether the item is noted as an alternate on the drawings, the government intends to award this work as part of the base bid. Please provide pricing as noted on the bid schedule.

4. What is the cutoff date for RFI's? Response: The Government would like to receive all RFI at least 2 weeks before the bids due date to allow for response and contractor

5. Please advise if project is Tax Exempt. Response: Determination of the applicability of taxes is the bidder's responsibility, and bidders are responsible for including all applicable taxes in their bid.

After award, the Contracting Officer may be able to assist with obtaining tax exempt certificates, however, assistance with provision of a form is not an assurance that the contractor will be able to purchase materials that are tax exempt.

6. In Factor 3- Offeror's Team Qualifications it states a resume is needed for the Project Manager & Site Superintendent. Please advise how many resumes are required.

Response: Please re-read the requirements of Factor 3, (paragraph 3.1.3) those are clearly stated in the solicitation, also review par 2.8 for requirements.

7. Will the government approve GSA pricing to buy 1 thru 142 items for Option#5? Response:

There may nay be any GSA pricing for the items selected in the package. The contractors are free to procure items from suggested sources within the document or any other location.

8. Athletic Flooring: Other than supply material and install with heat weld and game lines. Is contractor responsible for any application to finish of the product (Lonseal Loncourt 1). Please advise. Response: Yes, general contractor shall apply finish as part of the installation and shall be in accordance with the approved installation instructions.

9. The Aluminum Storefront and Entrances Specification (084113) should follow the Minimum Anti- Terrorism Performance similar to the Aluminum Windows specification (085113). If so, what is the correct Wind Speed and Risk Category for the Aluminum Storefront and Entrances specification (084113)? Response: The Wind Loads are referenced on sheet S0.01, under section “Structural Design Loads”.

10. Section 22 00 00 Domestic Water Service page 22: Will this building be connected to the base wide energy and utility monitoring control system? Response: The water meter shall be an advanced water meter that complies with the Specifications. The water meter shall be capable of being connected to the base wide monitoring system.

11. It looks like the interior frames are shown to have 2” x 6” storefront material for impact resistance.

What are the blast mitigation/impact resistant/antiterrorism requirements for the exterior storefront, if there are any? Plans & specs seem to just list typical 2” x 4 ½” storefront on exterior.

Response: Exterior storefront and windows shall follow UFC-04-010-01 DoD Minimum Antiterrorism Standards for Buildings for strength design for storefronts and windows, paragraph B-3.1 Standard 10. Windows and Skylights. Include calculations as part of the submittals.

12. Door 104A calls for door type FG, but the elevation on A5.01 shows an SF type door. Please confirm this door type. Response: Door 104A is door type FG as shown on A9.01.

13. Please confirm that the equipment on QF101 and QF102 are GFGI unless noted. Response:

Contractors are responsible to procure items identified on A8.02 and FF&E package only.

14. There is a footing Mark on Plan for an F6A. This is not included in the Footing Schedule. There is a footing included in Footing Schedule for F7. Not found on plan. Response: Refer to Drawing S1.00, Footing Schedule for information on all the footings, including footing F6A. There is no F7 footing in the Footing Schedule. There is a Footing F7A.

15. Drawing A1.01 states to add (5) EX6 site lights for Alt #1, drawing E1.00 shows (8) EX6 site lights as Alt #1, please clarify. Response: Please see drawing L1.01 for designation of Alt #1

16. Does the grade beam rebar shown in detail 1 and 1a / S301 continue thru pier footing detail 2 / S301? This appears to be the detail for exterior wall grade beam pier ftgs. Please clarify.

Response: Yes, details 1 and 1A are on the exterior wall, and the grade beam rebar is continuous as indicated, similar to detail 5 on S3.01.

17. Specification 08 51 13 Aluminum Windows states to submit design calculations for Min Anti-terrorism Performance. Please provide specification of System Series and Glazing required to meet Anti-terrorism Performance. Response: An example, basis of design, of acceptable windows providing blast mitigation is Kawneer Trifab 421UT or equal.

18. Specification 08 51 13 Aluminum Windows calls out glass/glazing to be triple glazed. This contradicts glazing specification. Response: No triple glazing is used on the project.

Specification section 08 51 13 has been revised.

19. Specification 08 81 00 Glazing calls out Insulated Glass units using annealed glass. Drawing A5.01 (Glass type legend) calls out laminated. Which is it? Neither type will pass ASTM El 886 Impact. Response: Use specified glass PPG Solarban 70XL Solarbronze with interlayer or equal. Refer to revised section 08 81 00.

20. Drawing E3.00 shows panel LCP, but there is no panel schedule for LCP on E5.03 or E5.04.

Please provide schedule for this panel. Response: Typically the designation LCP stands for lighting control panel. There are no lights being wired through the panel. Typically a LCP panel does not have breakers within it, just relays and a time clock. All exterior lights are on time clock.

21. Do the storefront doors, windows, and glazing have to be blast resistant? Response: Yes, an example (basis of desing) is Kawneer Trifab 421UT (or equal) windows provide blast mitigation

22. The interior aluminum frame spec 08 12 16 calls for a 2" x 6" center glazed screw spline system.

Are they actually looking for a system that wraps the sheetrock, like a Raco or Frameworks system? I know of no 2" x 6" screw spline interior storefront system for ¼" glass. Please advise.

Response: Spec description is based on Kawneer InFrame interior windows:

https://www.kawneer.com/kawneer/north_america/en/product.asp?prod_id=4454&desc=ce nter-glazed-interior-framing-system

23. Is there a source for the HVAC control system on JB MDL? There is a note on the mechanical drawings that the HVAC Controls are supposed to report to a central EMCS. All systems need to be compatible if tying into each other. Response: Control system shall be Niagara BACnet compatible. The Contractor shall provide a complete system (all hardware and software) to enable the new Youth Center control system to interface with the base EMCS. During construction, the Contractor shall coordinate with JBMDL (ICS) personnel for connecting the building to the Niagara supervisor.

24. There is a conflict on the glass makeup from schedule on sheet A5.01 and the written spec.

Section 08 81 00 Page 5. Drawings say Type G-1 is laminated insulated glass but spec doesn't mention laminated in the G-1 makeup. Please advise. Response: Use specified glass PPG Solarban 70XL Solarbronze with interlayer or equal. Refer to revised section 08 81 00, as revised in this amendment.

25. Drawing M400 Control System General Notes - This would require additional controls hardware and monitoring points. Response: Please provide as indicated, also refer to added sections.

26. Drawing M400 Control System General Notes - This building appears to be one story with no stair tower, does this note apply? Response: These are general notes, not all apply.

27. ERV Units M4.04 Sequence of Operation - Does this relate to VAV boxes? There do not appear to be VAV boxes on the project. Are window switches required? Who will provide the switches and how many are there? If this relates to the ERV's do you want the ERV turning off if it serves multiple spaces when conditions are only met in one space served? Response: It does not relate to VAV boxes, none are included. Window switches are not required.

28. The finish specified for the exterior aluminum storefronts is 70% Fluoropolymer (Kynar painted) to match Kawneer #28 Medium Bronze (an anodized finish). Do they want painted or anodized?

Response: As the note indicates the finish is to be Kynar, (painted) that matches as close as possible to Kawneer #28.

29. Sheet M2.00 Mechanical Schedules lists Mitsubishi as the basis of design for VRF and ERV equipment. This equipment will not meet the Buy American Act and there are no other manufactures providing similar equipment made in America. Will Mitsubishi equipment be acceptable as there is no other alternative? Response: A federal law that generally requires that only domestic end products may be procured in purchasing supplies for public use, unless the items (1) are for use outside the United States, (2) would be unreasonable in cost, or (3) are not mined, produced, or manufactured domestically in sufficient and reasonable available commercial quantities of satisfactory quality. There are separate regulations for the purchase of supplies and construction materials. With regard to supplies, the law provides a preference evaluation system for domestic end products for public use inside the United States over foreign end products. See FAR 25.104 for a list of approximately 100 materials and supplies exempted from the Act. Products are considered to be not of foreign origin if the cost of the foreign products used in them accounts for 50 percent of the total cost..

30. The documents make reference for the security system to be compatible with the existing access control and CCTV systems. What is the current system used at JB MDL? 31. Drawing M4.02 VAV box Sequence of Operation, please confirm VAV boxes are not being used.

In regards to monitoring it states monitoring the flow rate of the supply air. This would require air flow monitoring stations on all ERV units, if this detail is applicable to the ERV's. Response:

Correct, there are no VAV boxes, so control system is not required.

32. Clarification for Option #5: For the Table on revised Drawing A8.02 (as per Amendment No. 2), there are items that do not have any designation under the GFCI column (they are blank). Are we to include these items as well under this option? In summary is Contractor responsible to buy all items on the table as per revised drawing A8.02 whether it is GFCl/GFGI OR BLANK?
