Request for Prequalification Information

The following Government responses to questions from interested vendors are provided for informational purposes only.

Q13. To follow up on the USACE requirement of naming the Painter/Intumescent at the (Pre)Qualification stage, and partially clarified in the June 1st response to Question 1: There are a limited number of qualified Intumescent applicators and we have been notified that the qualified painters will be (potentially submitting/)qualifying on multiple competing GC teams. Careful review of the (RFI) documents allows this. The procurement rules also do not prohibit the General Contractor from naming multiple qualified companies. Please confirm that the foregoing is a correct interpretation of the

RFQ.

A13. Yes, the interpretation of those two statements is correct.

Please refer to Para. 3.1.1.4 of the Prequalification RFI: "If the Offeror submits experience for a proposed key subcontractor, the experience must be relevant to the firm’s role on this project. In addition, the Offeror must include documentation of an unequivocal teaming agreement or letter of commitment in this section of the response/proposal, signed by an authorized representative of the proposed subcontractor (Attachment 6)."

That being said, please also refer to the following section of the Request for Prequalification Information document:

FACTORS FOR EVALUATION, BASIS OF AWARD, EVALUATION CRITERIA,

RATING SYSTEM AND DEFINITIONS (SECTION 00 22 11) 1.0 OVERVIEW, Source Selection Phase: "Short-listed Offerors that have submitted an acceptable response in the Prequalification phase will be required to RESUBMIT Factors 1-3 in their proposal as part of this phase, which will be evaluated in the Government’s tradeoff analysis. The Offeror shall identify any items for Factors 1-3 in their Source Selection phase proposal (at that time,) that may have changed since their Prequalification response."

Q14. Earlier today (6/13/18) the USACE clarified that Attachment 8 (of the Prequalification RFI) is required for all Key Subcontractor Personnel and Offerors.

Previously it was understood (by our firm that) the Attachment 8 secure information was not required at this time. Attachment 8 requires sensitive personal information such as the SSN and Driver’s License numbers. It is problematic to submit such information in a Request for Qualification (the Prequalification RFI) on such short notice. Will the Corps accept the Offeror providing the information “Upon Request” after the (Pre)Qualification documents have been reviewed and without a negative impact to the (Pre)qualification (evaluation)?

A14. The Government intends to perform security background checks on all identified employees of the Offeror's Team as part of the Pre-qualification RFI evaluation, as was stated in paragraph 3.1.4.4: "All identified employees of the Offerors’ team involved in the response or proposal process (including those from known subcontractors or suppliers) will be vetted by the government (security background check) prior to moving on to consideration for the Source Selection Phase." This requirement was in the original text posted by the Government on FBO on 23 May 18, therefore no time extension will be granted for completion of this item.

However, the Government understands the unique structure of the requirements for this procurement, and the time constraint the Offerors are subject to, and therefore is clarifying a change to the Source Selection Phase requirements, in advance of release of the Source Selection RFP, w/ the following statement:

"For the Source Selection Phase, the Government will only release the plans and specifications to one (1) point of contact (POC) from the prime/general contractor.

Offerors that successfully pre-qualify will be asked by the Government to identify this individual in advance of the Source Selection Phase. This individual will be the only individual permitted to view or otherwise access the supplied plans and specifications, unless otherwise authorized by the Government after satisfying the following conditions:

1) This POC will notify the Government for every individual that the plans and specifications need to be released to, for the purposes of preparing their Source Selection Proposal. It will be the Offeror's responsibility to ensure that an NDA (Attachment 7) and Security Consent Form (Attachment 8) are provided to the Government in order for the appropriate background checks to be performed for each requested individual. The Government will process all background checks in a timely manner so as not to interfere with the Offeror's ability to prepare their Source Selection Proposal in a timely manner.

2) (For employees/personnel of a subcontractor or other party only): If after receipt and review of the plans and specifications the prime contractor's POC intends to release these documents to a potential subcontractor or other party of the Offeror's team, the prime contractor's POC shall submit a statement in writing to the Government certifying that “to the best of their knowledge the subcontractor or other party is capable of performing the scope associated with that specific feature of work.” Offerors are reminded that only the portions of the plans and specifications absolutely necessary to perform a subcontractor, supplier, or other party's specific scope of work shall be released to that particular party. Offerors will be required to confirm w/ the Government in advance that these portions of the plans and specifications they are requesting be released to these parties are indeed suitable for release.

Upon completion of the above requirements, the Government will make a determination and notify the prime contractor's POC whether or not permission is granted to release the plans and specifications to the requested individuals/parties. The prime contractor's POC shall at no point in time release the plans and specification to any other individual prior to this permission being received. Failure to comply with this requirement will result in removal from consideration for the Source Selection Phase."

The requirements stated in Section 00 22 11 paragraph 3.1.4.6 have been amended. See Amendment – 4 to Request for Prequalification Information.
