Questions and answers are issued to the Offerors “for information only” and do not revise the solicitation, plans or specifications.)
Question No.1: Can the excavations for the walls, pipes, etc. be used for levee material?
Response: Excavated material may be used for levee material if it meets the specifications in Section 31 00 00 and is free of any HTRW contamination.
Question No. 2: Please provide the earthwork summary for the project. This summary will help us in estimating the correct resources required for each earthwork activity on the project.
Response: All necessary information needed for this project is included in the plans and specifications.
Question No. 3: Ref. Doc. Sect. 00 90 06: Is NJ American Water providing material?
Is it correct to assume that reference to payments, schedules and submission does not apply as stated in this NJ American Water Spec?
Response: No, NJ American Water is not supplying material. Payments, schedules, and submission as stated in NJAW spec are not applicable to this contract. See revised Section 00 90 06 included in this amendment.
Question No.4: The bid documents have the following included: Fair Play & Safe Work Places Executive Order. We understand Trump has signed an executive order to cancel this. Please advise if this will still be included on this project or not.
Response: All current laws applicable to this project will be used in this contract. As stated in the solicitation, FAR Clause 52.222-57 pertaining to Executive Order 13673 is enjoined indefinitely as of the date of court order issued on October 24, 2016.
Question No. 5: Section 33 30 00 of the Technical Specifications refers to the Township of Middletown Sewerage Authority by-pass specification section 15060. It states that this specification is provided at the end of section 33 30 00. It does not appear that anything is included. Please make the sanitary sewer bypass specification available.
Response: See TOMSA Section 15060 at the end of revised Specification Section 33 30 00 included in this amendment.
Question No. 6: Please provide a plan sheet with all the soil boring locations with the proposed floodwall.
Response: The soil boring locations are shown on sheets C-100 to C-106.
Question No. 6: If available, please provide the geotechnical report for the project.
Response: All geotechnical soil and lab data is now provided in the specifications. See revised Specification Section 00 90 03, Geotechnical Data, included in this amendment.
Question No. 8: Please clarify why test piles and reaction piles cannot be left in place.
Response: This is to restore the area to original conditions and to avoid any pile conflicts with the job piles.
Question No. 9: Please provide a list of all approved contractors for JCP+L and NJAW.
Response: See revised Specifications Section 00 90 05 included in this amendment for list of JCP&L approved contractors and revised Section 00 90 06 for a list of NJAW approved contractors.
Question No. 10: How is pile cutoff footage compensated for, i.e. if ACOE orders say an 80’ pile but only 60’ is driven, how is the 20’ cutoff paid for?
Response: If a pile is cutoff at the direction of the Contracting Officer, then the Contractor will be paid for the entire length of the pile. Otherwise, expect pile length to be used.
Question No. 11: Specs say to perform dynamic pile testing on initial driving and on the restrike which is 21 days after the initial driving.
a. How is the restrike paid for?
Response: The restrike of the test piles will be included in Bid Item 0013 (including sub-items) in the bid schedule. The restrike for the job piles will be paid under Bid Item 0012.
b. Will two units of dynamic tests be paid on a pile with initial driving and restrike?
Response: No. The initial driving and restrike of the same pile are tied together and will count as one unit.
Question No. 12: Will the H piles require coating? The specification refers to the sheet pile coating but no reference to the H pile coating if any.
Response: H-piles do not require coating.
Question No. 13: Sheets 113 thru 117 show footing rebar (in both directions) going thru the h-piles and the sheetpile cutoff wall. Is it ACOE’s intent to burn holes in both of these items so that rebar can pass thru (which may not be possible)? Or can the rebar spacing be adjusted to avoid them?
Response: Rebars passing through the H-Piles may be adjusted to avoid H-Piles.
Maximum 1 inch offset on both sides of H piles is allowed for the rebars See revised sheets S-301 to S-304 included in this amendment. For the sheet pile cutoff wall, cut 1- 1/2” holes to pass reinforcement bars through the cutoff wall.
Question No. 14: Will a line stop be required to replace the existing 8” water main? Or will the contractor be allowed to shut the main off at the nearest valve to remove and replace the existing main?
Response: It is expected that a shut-down will be allowed for removal and replacement of the pipe, but the contractor will be required to coordinate with New Jersey American Water (NJAW). NJAW personnel will operate the valves to control the main.
Question No. 15: Please clarify what material the existing 8” water main is comprised of.
Response: The existing 8” water main is asbestos cement (Transite).
Question No. 16: There appears to be a conflict with both note #4’s on sheet 105 & 107 of the plans. Do both job piles and test piles get driven to 300% of test load or just test piles? If not, what load do the job piles get driven to?
Response: There is no test load for the job piles. Job Piles are to be driven to the lengths determined by the pile load test. Pile lengths for estimating purposes are shown on Sheet S-001 and the ranges of pile lengths are shown on the bid schedule items for steel H-piles. See revised sheets S-001 and S-101 included in this amendment.
Question No.17: Sheet Page 7 of the JCP&L Specifications refers to 4- 6’x17’x6’ manholes. These manholes are not shown on the electrical plans. Please confirm they are not required.
Response: Concur. JCP&L manholes are not required as part of Contract #4.
Question No.18: Please provide flow rates for the existing 8” and 30” sanitary sewers which is needed for the temporary bypassing
Response: By-pass pumping shall follow the requirements set forth in the specifications provided by the Township of Middleton Sewerage Authority (TOMSA); see TOMSA Section 15060 at the end of revised Specification Section 33 30 00 included in this amendment. It is expected that for the 8” sanitary sewer at Willow St. & State Route #36, pumps shall be able to handle 2.5cfs; for the 8” sanitary sewer at Campbell Avenue Closure Gate, pumps shall be able to handle 5cfs, and for the 30” sanitary sewer at Broadway Closure Gate, pumps shall be able to handle 20cfs. Contractor shall verify pipe inverts in the field, and should contact TOMSA to confirm the required bypass flow rate, and for additional information such as drainage areas, records on flow volumes, etc.
Question No.19: Subsection 1.4.3 of the earthwork specification section states that topsoil is “materials suitable for topsoil obtained from offsite areas excavations”. Is topsoil required to be imported topsoil? Or will the contractor be allowed to use topsoil that is stripped from the site?
Response: The Contractor can reuse topsoil on-site as long as it meets all applicable specifications.
Question No.20: Plan sheets 134 thru 140, please provide a thickness for each of the wall sleeves and details of the apparent tab around each one.
Response: Steel wall pipe sleeves and waterstop dimensions are based on manufacturer.
Question No.21: The Bid Proposal does not provide a separate pay item for Mobilization and General Conditions costs, which are significant costs and should be paid for separately since these costs are not incidental to the work. Therefore, we request that the Bid Proposal be revised to include a separate CLIN for these costs.
Response: Consideration has been given to your request. However, no change will be made to the bid schedule for this. Note that, typically, costs for mobilization and demobilization are accepted as a pay activity.
Question No.22: With regard to the Vibration Monitoring requirements in Section 02 01 51, please address, revise and clarify the following:
a. The submittal requirement time frames stipulated in Paragraph 1.1 for the Qualifications of the Vibration Control Personnel, the Pre-Construction Structural Survey, and the Vibration Control Plan will be impossible to achieve due to the amount of effort that will be required to prepare all of the information that is required. Therefore, we request that all of this information be submitted within 90 calendar days after Notice of Award and prior to the mobilization of equipment.
Response: The submittal timeframes have been changed as follows:
Qualifications of the Vibration Control Personnel -14 calendar days after Notice of Award; the Pre-Construction Structural Survey- 45 calendar days after Notice of Award;
and the Vibration Control Plan -90 calendar days after Notice of Award. See revised Specification Section 02 01 51 included in this amendment.
b. The title of this Section is Vibration Monitoring, yet there are many references in this Section to “Noise” and “Noise Monitors”. Therefore, please clarify the scope of the intended Noise Monitoring that is expected for this project, since the work zones are very close to many existing residential properties, and a Permissible Noise Exposure Chart is found in Paragraph 3.11 of Section 01 57 19 of the General Requirements.
Response: This term noise in this section refers to any noises that cause vibrations. Non-vibration noises shall adhere to the Permissible Noise Exposure Chart found in Paragraph 3.11 of Section 01 57 19.
c. The title for CLIN Item #0019 only makes reference to the performance of
Vibration Monitoring of Structures, and there is no CLIN Item for Noise Monitoring.
Therefore, if Noise Monitoring is to be performed on this project then we request a specific Pay Item be provided in the Bid Proposal for the Noise Monitoring work.
Response: Noise monitoring (not including vibration monitoring) and noise control are up to the discretion of the Contractor to ensure the requirements of Paragraph 3.11 of Section 01 57 19 are met.
Question No.23: The Monday through Friday, 8 AM to 4 PM Pile Driving Work-Hour Restrictions, that are stipulated in Paragraph 3.11 of Section 01 57 19 – Temporary Environmental Controls, do not provide the Contractor with a minimum of a full 8-Hours of Pile Driving work, and this work hour restriction will significantly impact the cost and duration of the project unless modified. Also, the 8 AM to 4 PM Work Hour Restriction is not consistent with the Normal 8-Hour Work Days (8:00 AM to 4:30 PM) that are specified in Article #31 of the Special Contract Requirements. Therefore, we request that the Contractor be provided with a minimum of Eight Working Hours per day, and the Contractor should be allowed to work longer hours if Noise Monitoring demonstrates that the Pile Diving work is not exceeding the maximum Decibels that are identified in the Permissible Noise Exposure Chart found in Paragraph 3.11 of Section 01 57 19.
Response: Paragraph 3.11 of Section 01 57 19 has been revised to be consistent with the work hours of 8:00 AM to 4:30 PM specified in Paragraph 31 of Section 00 73 00.
No work is permitted outside of these hours except when specifically authorized by the
COR.
Question No.24: With regard to the Electrical Work that is shown on the ES-Drawings, please address and clarify the following:
a. Please clarify why an Outage is required for the JCP&L Work, and how the
Outage will impact the JCP&L Utility Work and how the Outage will impact the construction of the Floodwall.
Response: The outage is not required for the JCP&L work. The outage was determined to be required for safe pile driving and excavation operations.
b. Please indicate on the ES-Drawings the Demarcation Limits between
JCP&L Utility Work and the Electrical Contract work that is not JCP&L work.
Response: See Specifications Section 00 73 00, paragraph 50 and Section
00 90 05 for requirements associated with JCP&L utility work.
c. Please clarify the Note on Dwg ES-104 that states that “All Items Included in Legend [are] Not in Contract #4”. It is not clear from this Note what is being excluded from Contract #4. The Legend includes two “symbols”: one is “USE”, which is an abbreviation for an Underground Service Entrance, and the other symbol is for a Pole Mounted Transformer Bank. However, we do not see “USE” called-out on any of the ES-Drawings, and it is not clear if all Pole Mounted Transformer Banks are to be excluded from Contract 4 or just the Pole-Mounted Transformer Bank that is shown on Dwg. ES-104. Please clarify.
Response: The pole mounted transformer bank on Sheet ES-104 is part of
Contract 4. See revised sheet ES-104 included in this amendment.
d. A 4” Schedule 80 Conduit is called-out on the ES Drawings for the Top of the Floodwall. Is this 4” Conduit part of the JCP&L work?
Response: The conduits shown on top of the levees and floodwall are NOT part of the JCP&L work. These conduits are to be used to provide power for sluice gates along the floodway and levee.
Question No.25: With regard to the Environmental Soil Samples provided in Section 00 90 04, please clarify the following:
a. Apparently, the Environmental Soil Samples were taken at the Soil Boring locations, but the depths (below ground surface) of the Environmental Soil Samples are not indicated on the Analytical Reports or on the Soil Boring Logs. Since it would be useful for the bidders to be provided with the depths of the Environmental Soil Samples, we request that this information be provided.
Response: Environmental Soil samples were collected from depths of 10 to 15 feet below ground surface.
b. The test results for the Metals do not identify the type of Chromium that was detected. Please clarify if the Chromium was Trivalent Chromium or Hexavalent Chromium since the two types of Chromium are different.
Response: Chromium analysis was for Trivalent Chromium.
Question No.26: With regard to the proposed Resurfacing Work on Route 36 that requires the Traffic Controls shown on Drawings G-104 to G-107 please clarify the following:
a. Why is this work being performed?
Response: Route 36 work is being performed to achieve the necessary elevation to ensure a continuous line of protection for the project.
b. A note on Dwg C-111 makes reference to Sheet C-208 for Route 36
Roadway Shoulder Profiles, but there is no Dwg C-208 provided in the bid set of drawings.
Please provide the missing information.
Response: See revised sheet C-111 included in Amendment 0001 which now references Sheet C-201 for Route 36 Roadway Shoulder Profiles.
c. Please confirm that the USACE is responsible for obtaining the NJDOT Permit for the Route 36 Resurfacing work.
Response: Yes, the Corps will obtain the permit for this work.
d. Is the work shown on Dwg C-111 at the private property located at #203 Wilson Avenue also to be included in CLIN #0021 for the Route 36 work.
Response: No, this work is included in CLIN 0006, Appurtenant Items.
Question No.27: With regard to the Temporary Construction Easements that are shown on Site Plan Dwg’s C-101 TO DWG C-107, please address and clarify the following questions and concerns.
a. From what we can tell there is an operating Heliport next to the project limits that could have an adverse impact on the Contractor’s operations. Please clarify what the Government is doing to make sure that the Werner Heliport on Route 36 does not have any adverse impact on the Contractor’s operations.
Response: The Contractor will need to address the proximity of the construction operations to the heliport as part of the Accident Prevention Plan.
b. Where the Floodwall is close to the Easement Lines, please clarify if any
Temporary Shoring will be required. If so, please indicate these requirements and where Temporary Shoring may be needed.
Response: It is the contractor’s responsibility to determine their temporary means and methods to construct the permanent structure within the established contract limits and easements.
c. The large number of adjoining property owners and the amount of disruption to the adjoining property owners that the work will generate is going to create a constant public relations problem that should not be the responsibility of the Contractor to manage and to address. Therefore, please confirm that the Government will assign a full-time person on its field office staff to handle all public relations issues and complaints and provide informational meetings with the affected property owners, local politicians, etc.
for the duration of the project.
Response: The Contractor is responsible to coordinate directly with the impacted property owners on a daily basis to address access and disruption issues. The Government will hold public meetings as necessary to provide updates and a forum for the local community to express any concerns and/or comments during the execution of the contract. The Prime Contractor should expect to attend monthly public meetings which may occur in the evening after normal work hours.
d. Please clarify why the Temporary Staging Areas are depicted with dashed lines in a grid pattern. Is this just a symbol for the Staging Areas, or do the dashed grid patterns have any other meaning for the bidders?
Response: This is the symbol used for the Staging Areas.
Question No.28: Considering that the work zones are located in areas where the ground conditions are expected to be soft and wet, please provide the bidders with all soils testing data performed by the Government for this project so that the bidders can better understand the nature of the ground conditions and the expected soil bearing capacity.
The bidders need this information to determine how to construct the temporary access roads that will be required to provide access for the construction equipment, construction vehicles, delivery trucks, concrete trucks, quarry trucks, etc.
Response: All geotechnical soil and lab data is now provided in the specifications. See revised Specification Section 00 90 03, Geotechnical Data, included in this amendment.
Question No. 29: Does this project have a PLA?
Response: No.
Question No. 30: In Specification 31 62 16.16 for Steel H Piles, Sections 3.3.1 and
3.3.4.2 both state that primary and secondary test piles and reaction piles must be removed. Removal may be impractical or impossible. Please clarify if it would be permissible to abandon the piles and, if permitted, what the requirements would be to abandon the piles in lieu of removal.
Response: Test piles are to be removed per the specification.
Question No. 31: Section 3.3.4.3 of Specification 31 62 16.16 for Steel H Piles requires restrikes on 5% of the job piles after a 21 day wait. 21 days is much longer than test piles are typically required to sit before restrikes and the 5% value would suggest a pile is tested in roughly every other section of wall. Given the relatively short time frame to complete this very linear project, can a correlation be done using a designated primary and/or secondary test pile to restrike in a shorter period of time to allow the job production piles to be tested sooner?
Response: This is the current time frame that should be used for bidding purposes.
Adjustments may be made based on the results of the pile load tests but until the tests are performed, the 21 day requirement shall be used.
Question No. 32: The specifications "SECTION 00 72 00 CONTRACT CLUSES" states "(to be provided by Contracting Division)" when will they be provided?
Response: This is included in the front end solicitation document.
Question No. 33: Section 00 73 00 SPECIAL CONTRACT REQUIREMENTS starts at page 00 73 00 - 29 and ends at 00 73 00 - 32. Are there any SPECIAL CONTRACT
REQUIREMENTS?
Response: Yes, the remainder of Section 00 73 00- Special Contract Requirements is included in the front end solicitation document.
Question No. 34: The specifications "SECTION 00 90 01 WAGE RATES" states "(to be provided by Contracting Division)" when will they be provided?
Response: The Wage Rates are included in in the front end solicitation document as Section 01 00 00- General Requirements.
Question No. 35: For levee the levee construction, can the material removed for the inspection trench be placed back into the trench after inspection?
Response: The material may be placed back into the trench only if it meets the embankment specifications.
Question No. 36: The solicitation (Page 64) mentions the required 2 vehicles for government use. Do these vehicles need to be capable of opening and closing flood gates with the block and tackle systems?
Response: No.
Question No. 37: Due to the large number of unknowns, logistical issues, design issues and complexities involving this project, and considering the difficult issues that have been presented for pre-bid clarification, we request a minimum 4-week postponement to the bid date for Contract 4, which is currently scheduled for October 17th, 2017.
Response: Bid opening has been extended to 31 Jan 2018.
Question No.38: Detail 1A on Dwg E-100 provides a detail for an Electrical Access Point at the top of the new concrete Floodwall that is to receive a 4” Electrical Conduit. This Electrical Access Point is also detailed on Structural Dwg S-507. With regard to these details, please address and clarify the following.
a. The two referenced details were not drawn the same, which causes confusion. Please clarify which detail correctly shows the way the Electrical Access Points are to be constructed.
Response: See revised details on Plan Sheets E-100 and S-507 included in this amendment.
b. Neither of the two details provide sufficient information to instruct the bidders as to what needs to be purchased. Therefore, please provide the suggested manufacturer, make and model number of the proposed Electrical Access Points.
Response: The access point on the floodwall must either be cast in place with the conduit or a standard box placed within the form. The lower box is a standard waterproof cast box (dimensions as shown on the plan).
Question No.39: Please clarify the purpose and need for specifying Schedule 80 PVC Electrical Conduit for embedment in the new Floodwalls, when Schedule 40 PVC is typically used in these types of applications.
Response: Electrical conduit embedded in floodwall has been changed to Schedule 40 PVC. See revised Plan Sheet E-100 included in this amendment.
Question No. 40: The seventh bullet point from the top of the fifth page of the JCP&L Scope of Work in Section 00 90 55 is titled Manhole Construction if required, but this item proceeds to identify four precast concrete 6’ x 16’ x 7’ JCP&L Manholes along with cable racks and grounding grids that appear to be needed for this project. With regard to these Four Electrical Manholes, please clarify the following.
a. Why does the JCP&L document refer to the Manholes as “If Required”, yet the document appears to indicate that four of the manholes are required. Please clarify.
Response: Reference to “Manholes” has been deleted. See revised Section 00 90 05 included in the amendment.
b. The ES-Series of drawings do not show these four manholes and associated underground ductbanks. If these Manholes and associated underground ductbanks are required, then please revise and re-issue the ES drawings as soon as possible to show the locations and construction details for these manholes and ductbanks.
Response: Electrical manholes and associated ductbanks are not required.
c. Please clarify whether or not the costs of these manholes, along with any associated underground conduit work, are to be included in the Lump Sum CLIN #0016- Electric Utility Installation, or some other CLIN.
Response: Electrical manholes and associated ductbanks are not required.
Question No. 41: Detail 5 / S-507 Shows a section view of the top of wall “bump out” for the electrical access boxes and refers to the Electrical Plans for details. Detail 1-A / E-100 appears to show the same wall top access boxes but the lid is very different and the detail refers to the Civil Drawings for details. The Civil Drawings have no details for this wall top access box. Please provide a detail including the length of the bump out and clarify which is the correct detail for the lid and include lid thickness.
Response: Refer to the revised Electrical Access Point detail on Sheet S-507 included in this amendment.
Question No. 42: Please provide additional clarification for Optional items 4 thru 7, is this to address potential increases in qty’s due to field variations? Are the different options needed to address potential increases in specific areas; if so, please provide some guidance as to what areas each item is applicable to?
Response: Optional bid items 4 through 7 are included to address potential increases in quantities that may result after the final job piles lengths are determined based on the test pile program. The options are not geared to any specific area of the contract.
Question No. 43: Specification section 31 62 16.16 paragraph 3.1.2 requires that all battered piles be driven using fixed-extended leads. If contractor is required to perform work identified in RFP within the limits identified as “contractor working limits” on drawings this method is not optimal. This requirement in addition to the ability to drive up to 100’ piles will increase the surface area needed for temporary access. Based on the above we have the following questions:
a. Can contractor extend work area beyond limits shown on drawings?
b. Will hanging leads be considered as it may reduce overall project cost?
Question No. 44: The requirements stated for pile load testing identified in section 31 61
16.16 paragraph 3.3.4.2 will require a significant amount of time to execute. With lags of 21 days between tests we are looking at potentially a 4 month test pile program or 16% of the contract time available. During this time the work available to us would be very limited. Can the 21 day cycles be re-evaluated and reduced to allow for a more favorable and cost effective schedule?
Response: The 21 day requirement will not be changed for the test piles.
Question No. 45: Specification section 31 61 16.16 paragraph 3.3.4.2.5 states that all test piles will be removed and depressions grouted, in order to reduce costs and improve schedule can tension/ static load tests be performed on permanent piles? All piles would be restricken upon test completions to verify required capacities.
Response: Test pile are to be separate piles from the production piles. Pulled test piles, that are undamaged and meet production pile specifications, may be reused as production piles.
Question No. 46: Please clarify Specification 31 62 16.16 paragraph 3.3.4.3, is it the owners intent to have all 5% of piles installed tested and then restricken 21 days after initial installation? If so, how will the contractor account for this additional time in the schedule as it would impact all the remaining work due to the logistical constraints of the work area provided?
Response: It is the Government’s intent to have 5% of the production piles tested and re-striked. It is the Contractor’s responsibility to determine how it impacts the Contractor’s schedule.
Question No. 47: Please clarify how many Campbell and Broadway closure gates there are in project?
Response: There is one (1) Campbell Ave road closure gate and one (1) Broadway road closure gate, for a total of two road closure gates in this contract. .
Question No. 48: We have reached out to the JCP&L contacts under the bid specifications, Andrew Gillespie and Harvey Lockley, in regards to the price associated with the required work under Specification section 00 90 05 “JCP&L Requirements.”
Under the bid items there is a set price of $290,000 for item No. 15 Electric Utility Materials and Inspection, however, we need to set a price for Line Item No. 16 for Electric Utility Installation. Mr. Gillespie informed us that the price of this work was given to the USACE and did not have the authority to disclose pricing details. Please provide the pricing given by JCP&L regarding the Utility Installation.
Response: Bidders must make their own estimate for Bid Item 0016 since the cost could vary based on which JCP&L-approved contractor the Prime Contractor chooses as a subcontractor.
Question No. 49: In specification section 00 90 05, it states US Army Corps of Engineers is to hire an approved JPC&L Electrical contractor to remove and install all equipment noted. Is this to be completed by us (the bidder)? If so please provide a list of approved JCP&L electrical contractors for us to contact for pricing.
Response: Yes, the bidder is required to perform the work on JCP&L facilities using a JCP&L approved contractor. List of JCP&L-approved contractors is included in revised Section 00 90 05 in this amendment.
Question No. 50: The wage determinations included in the RFP are not consistent with prevailing rates for heavy highway construction in Monmouth County NJ. Please provide correct wage rates to use in response.
Response: See revised wage rates included in this amendment.
Question No. 51: Although we recognize that steel sheet pile has been specified in the design we would like the opportunity to present an alternative solution. As I am sure you are aware, FRP Composite sheet piling is gaining traction as a viable option in shore line protection. A feasibility study commissioned by USACE in 2016 proves the Value Engineering case.
Response: Bids should reflect performing work in accordance with the contract plans and specifications.
THIS AMENDMENT SHALL BE ATTACHED TO THE SPECIFICATIONS
AND PLANS, AND SHALL BE A PART THEREOF.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis‐Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health‐related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health‐related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey.
Example:
PLUM0198‐005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non‐union rates. Example: SULA2012‐007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG‐OH‐ 0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
