Acceptable: Proposal clearly meets the minimum requirements of the solicitation. The proposal clearly demonstrates a logical or proven method for performing the fabrication, assembly, painting, and shipping of the miter gates and a clear understanding of the Contract Requirements.
Unacceptable: Proposal does not clearly meet the minimum requirements of the solicitation. The proposal does not clearly demonstrate a logical or proven method for performing the fabrication, assembly, painting, and/or shipping of the miter gates or a clear understanding of the Contract Requirements
3.1.2. FACTOR 2 - CONTRACTOR PAST PERFORMANCE
Offerors’ and major subcontractors’ past performance is a measure of the degree to which an offeror was successful on projects of similar scope, size, and complexity, as measured by the level of past customer satisfaction. The offeror will provide past performance information using the past performance questionnaires included in the solicitation. It is also a measure of the degree to which an offeror has complied with Federal, State, and local laws and regulations. Major subcontractors are defined as members of an offeror’s overall team who are expected to cost ten (10) percent or more of the total project cost. The Government’s assessment of past performance will be based mainly on offeror reputations with customers and other sources. The Government will evaluate the information/performance data provided by offerors, as well as information from other sources, such as Government databases. In the event an offeror and major subcontractor(s) submit fewer than three past performance references, the offeror must certify that additional past performance information is not available for the offeror and provide an acceptable explanation as to why.
The offeror and major subcontractor(s) shall each submit a list of at least three but no more than five performance references for work performed since 2006 by the offeror and/or major subcontractor(s) using the past performance questionnaires included in the solicitation. If more than five past performance references are submitted, only the five most recent projects will be considered. If fewer than three past performance references are submitted, they will be evaluated, and the lack of the requested number of projects will not be evaluated favorably or unfavorably for this factor, provided the offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why additional past performance information is not available.
The past performance reference must have been a client, or client representative, with whom the offeror/subcontractor had a contract, or subcontract (if applicable) for one or more projects.
The past performance reference must hold, or have held at the time, a senior position in the client organization with responsibilities for either contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the offeror or subcontractor’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the performance.
The past performance reference must have a current, valid phone number at which they can be reached at during normal business hours, a fax number, and must be able to speak, read, and write in the English language. If available, include an e-mail address.
Offerors may include information on problems encountered on the identified projects and the corrective actions taken by the offeror or sub-contractor to resolve the problems.
The Government may contact any or all of the past performance references provided by the offerors to collect and evaluate past performance information, as well as information obtained from any other sources, when evaluating an offeror’s past performance. The evaluation will take into account past performance information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirements when such information is available and relevant to the instant acquisition.
EVALUATION CRITERIA:
The Government will evaluate the Offeror’s record of past performance information in accordance with the table below. The Government will review the past performance information provided for the relevant project submitted under Factor 1.
Based on the Offeror’s recent relevant performance record, the Government will make a determination as to the expectation that the Offeror will successfully perform the required effort. A past performance evaluation rating will be assigned in accordance with the table shown below. Where no recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the Offeror will receive an Unknown Confidence (neutral) rating. This rating is neither favorable nor unfavorable.
Rating Guidelines for Factor 2
PAST PERFORMANCE EVALUATION RATINGS
Rating Description
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
*NOTE In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
The Government will review the relative risk of the contractors ratings but normally not award to an Offeror that receives unacceptable rating in this factor:

4.0 EVALUATION PROCEDURES
4.1. SOURCE SELECTION EVALUATION BOARD (SSEB)
4.1.1. The SSEB will be established to conduct the evaluation of proposals received in response to this solicitation. The evaluation will be based on the content of the proposal and any subsequent discussions required, as well as information obtained from other sources, e.g. past performance information. The SSEB will not consider any information incorporated by reference.
4.2. EVALUATION
4.2.1. The SSEB will evaluate the proposals and assign a consensus rating for each evaluation factor, except that performance risk ratings are assigned to past performance (see below).
4.2.3. If discussions are held, the Government may engage in meaningful discussions with each technically acceptable Offeror in accordance with FAR 15.306 (d). The Contracting Officer/PCO will tailor the discussions to each Offeror’s proposal relative to the solicitation requirements and evaluation factors. To be meaningful, at a minimum, discussions must include identification of all evaluated deficiencies, significant weaknesses, weaknesses, and any adverse past performance information to which the Offeror has not yet had an opportunity to respond. The Contracting Officer/PCO also is encouraged to discuss other aspects of the Offeror’s proposal that could, in the opinion of the Contracting Officer/PCO, be altered or explained to enhance materially the proposal’s potential for award. However, the Contracting Officer/PCO will not discuss with individual offerors how their proposal compares to other offerors proposals (technical leveling and/or technical transfusion is not allowed). The Government will provide the Offeror an advance agenda for the discussions. During discussions, the Government may ask the Offeror to further explain its proposal and to answer questions about it.
4.2.4. Upon conclusion of discussions Offerors will be afforded an opportunity to submit their proposal revisions for final evaluation and selection.
4.3. DEFINITIONS

A material failure of a proposal to meet a Government requirement, where correction of this error is not possible without major revisions to the proposal, or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level or when a failure to meet the RFP requirements is a life/safety issue.
4.3.2. Weakness
A flaw in the proposal that increases the risk of unsuccessful contract performance but is easily correctable. Successful contract performance is defined by customer satisfaction.
4.3.3. Significant Weakness
A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.
Successful contract performance is defined by customer satisfaction.
4.3.4 Uncertainty

4.4. EVALUATION RATING SYSTEM -
4.4.1. General: The Government will review the proposals and rate the quality of each evaluation factor. The SSEB will rate each proposal against the specified evaluation criteria in the Solicitation requirements. They will not compare proposals.
4.4.2. Review Write-up: The Government will support each rating with a narrative, separately listing all strengths or advantages, weaknesses or disadvantages, deficiencies, and required clarifications.
5.0 BASIS OF AWARD
5.1. The Government will award a firm fixed price contract to the responsible Offeror whose technically acceptable proposal represents the lowest price technically acceptable.
5.2. The basis of award will be the Government’s assessment as to which proposal is determined to be technically acceptable and is the lowest price determined fair and reasonable through the use price analysis.
Offerors that do not receive an acceptable rating (technically acceptable); will not be selected, regardless of their price (lowest Offeror may not be selected).
5.3. Offerors have been reminded to include their best technical and price terms in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of an acceptable proposal without discussions, if deemed to be in the best interests of the Government.
5.4. A successful large business Offeror will be required to submit and negotiate a Small Business Subcontracting Plan acceptable to the Contracting Officer/PCO. The dollar threshold for the subcontracting plan will be $36,500,000 for NAICS code 237990.
