The following have been added by full text:

AMENDMENT 0002

Green Brook Flood Risk Management Project- Segment R2 Levee Extension, Segment T Raising, and East Main Street Storm Sewer Improvements, Borough of Bound Brook, NJ Amendment #0002

IFB# W912DS-14-B-0002

Bid Opening hour and date are changed to 9 January 2014 at 2:00PM local time.

1. The following specification change is made with this amendment:

Section 0 08 00, para 29. VEHICULAR AND OTHER TRAFFIC CONTROL, replace with the following:

The Contractor shall be required to provide and maintain barriers, flagmen and warning devices during construction and hauling operations, which may interfere with vehicular and other traffic.

The Contractor shall also be required to effect necessary traffic control as required by the appropriate agencies, including coordination with the Borough of Bound Brook Police. All safety precautions shall be subject to the approval of the Contracting Officer.

2. The following are responses to questions received from bidders (FOR

INFORMATIONAL PURPOSES ONLY):

Question No. 1: Please advise why Item 0002 Railroad Coordination Fieldwork & Inspection and Item 0004 Railroad Insurance are part of the Base Bid when railroad work is for Item 0005, Option 1 Segment R2 Levee Extension?

RESPONSE: The allotment for all Railroad work is part of the base bid but is only paid out based on actual costs. If option work is never exercised several of these items will not be needed and actual costs would reflect the reduction in effort.

Question No. 2: Segment R2, Dwg. 302 (sheet 24) Legend No. 2. Please provide locations of Inspection Trenches on the plans.

RESPONSE: Inspection trench is clearly identified on the Sections as Item 2.

Question No. 3: Segment T, Drawing C-107: Referenced Drawing C-402 for Pedestrian Bridge does not exist.

RESPONSE: Drawing C-402 is Sheet 67 and is part of the Bid Set.

Question No. 4: Please advise if the contractor is required to hire a local police officer for traffic control, or not, especially while performing East Main Street Storm Sewer work.

RESPONSE: For Construction of Segment T Raising (Base Bid) and Segment R-2 Extension (Option 1) the need for Police for Traffic Control is not anticipated. For Options 3-7 for the Storm Sewer work, the contractor is required to coordinate the work with appropriate agencies including the Borough of Bound Brook Police and to implement necessary traffic controls. See revised Specifications Section 00 80 00, paragraph 29, included in this amendment.

Question No. 5: Bid Items 0010 NJ American Water Main: Please advise if NJ American will perform the work or not. If not, what is the procedure to establish the actual cost?

RESPONSE: The utility, or a subcontractor authorized by them, will perform the work.

Question No. 6: Bid Items 0011thru 0016 PES&G Gas and Electric Lines: Please advise if PSE&G will perform the work or not. If not, what is the procedure to establish the actual cost?

RESPONSE: The utility, or authorized subcontractor, will perform the work.

Question No. 7: Duration of 150 calendar days seems too short for the specified work, especially for work to be performed by others (NJ Transit, Zayo, PSG&E, NJ American Water), those we have no control over their work schedules. This also includes unknown submittal review period by the same entities. Please extend the duration accordingly.

RESPONSE: No change has been made to the duration since it is considered a reasonable timeframe to accomplish the work including required utility coordination.

Question No. 8: Section 00 80 00 Special Conditions para. 27 limits track closures up to 2 Saturdays, 12 hours each. Is it possible to have more time to perform all work related with sheet piles, monoliths, steel work, stop log installation, including NJ Transit removal & replacement of the tracks?

RESPONSE: No additional time shall be allotted. Based on previous work for similar services two weekend days should be adequate for the work.

Question No.9: Section 00 80 00, para. 35 Insurance, page 80 of 72, para. (b) Worker's Compensation calls for a waiver of subrogation in favor of Conrail. Our insurance firm informed us that this is not available in the State of NJ. Please check & advise.

RESPONSE: The Corps is aware of at least one project in New Jersey where the insurance company has issued a waiver of subrogation.

Question No. 10: In addition to NJ Flagmen provided in Base Bid Item 0002, does the contractor need to provide additional NJ Transit Flagmen for other work , i.e. Bid Item 0001, 0005 and 0008?

RESPONSE: All work to be performed by railroads is covered under the allotment in bid Item 0002.

Question No.11: Appendix A. Does the contractor have to perform additional borings/soil investigation as required by NJ Transit EP-2 Pipeline Occupancy document, para. 9, for Item 0008 trenchless railroad crossing?

RESPONSE: No additional borings are anticipated to be needed to meet the permit requirements. This does not prohibit the Contractor with permission from NJT doing additional borings at no additional cost to the government if they feel it’s needed to better define their means and methods for doing the work.

Question No. 12: Can NJ Transit Contractor's Safety Training be provided on site?

RESPONSE: No.

Question No. 13: Is there any cost related with NJ Transit review of Sheeting/Dewatering/Trenchless RR Crossing, etc?

RESPONSE: Yes, there is a cost that will be applied to the allowance contained in Bid Item 0002.

Question No. 14: Besides Item 0002, is there any additional cost related with NJ Transit and Conrail providing railroad engineer and/or inspector during the construction of the project?

RESPONSE: No, all costs are to be applied against item 0002.

Question No. 15: Section 01 35 45.00 10 Chemical Data Quality Control. Does the contractor have to retain a Chemical Quality Control Officer and an Environmental Sampler during the construction? If so, what is being tested and what is sampling frequency?

RESPONSE: Yes, Contractor must have Chemical Quality Control Officer and Environmental Sampler. They do not need to be on site full time and they can have multiple roles provided they meet the standards called for in the specification though the

Environmental Sampler cannot be the Chemical Quality Control Officer nor the other way around. For testing see response to Question 16 below.

Question No. 16: Please confirm that this project does not include hazardous material testing, remediation, removal, or disposal.

RESPONSE: Testing is to be required per the specifications and in accordance with the notes “Segment R-2 Soil Disposal” drawing G1005 Amendment 1. It is not anticipated that soils will be above RCRA thresholds for Hazardous waste.

Question No. 17: Section 01 57 19.00 18 Archeological Excavations, para. 5.2: Please specify/provide excavation locations and size, as none shown on the plans.

RESPONSE: See Section 01 57 19.00 18, paragraph 1, which specifies that trenches with the potential to encounter archeological resources are those to be constructed in the New Jersey Transit parking lot as part of the East Main Street Storm Sewer Improvements and the Segment R-2 Levee tie-off work. The locations and sizes of these elements of work are shown on the contract plans.

Question No. 18: Section 01 57 20.00 10, para. 3.9: Please advise if contaminated soil/water remediation is in the scope of this project.

RESPONSE: Remediation is not within the scope of this contract. See note “Segment R-2 Soil Disposal” on drawing G1005 Amendment 1. It is not anticipated that soils will be above RCRA thresholds for Hazardous waste.

Question No. 19: Segment T Levee: There are 2 types of excavation shown, 1' deep stripping & 1' deep common. Are both types of excavation available for re-use, or just the stripping?

RESPONSE: Topsoil removed from the existing levee is available for reuse. Stripping and common excavation can only be reused if it meets the specifications for Embankment Material.

Question No. 20: We request the bid due date to be extended after receipt of above clarifications to allow us to submit a responsive proposal.

RESPONSE: Bid opening date has been extended as per this amendment.

Question No. 21: Firm would like to ask for a bid extension of 3 weeks, It has been difficult obtaining competitive quotes from suppliers and subcontractors due to the holidays, shop closings and weather related days. It would be most appreciative for the bid extension so we may prepare a competitive bid proposal for this important project.

RESPONSE: Bid opening date has been extended as per this amendment.

Question No. 22: There is a note on drawing GI005 sheet 6 of 124 "Segment R-2 Soil Disposal" it is noted that the regulatory levels exceed the state and federal disposal levels. The disposal facilities will require test in order to classify the excavated materials.

Are there or has there been any soil testing or classification of the material to be disposed. There are numerous classification that cost of disposal are associated with.

For example ID-27 classification can range from non-hazardous to hazardous based on its classification can be at a range from $10/cy to $60/cy.

Can you provide and test results?

RESPONSE: No tests have been taken. Contractor should make estimate based on information provided considering the site is a rail road area. Tests to be conducted by the contractor are identified in the specifications and Drawing G1005, Amendment 1.

Question No. 23: (Related to Question No. 22.) For bidding purposes, can you set an allowance or classification we can use in the bid to make it fair to the bidders.

RESPONSE: An allowance is not warranted as there is sufficient information in the contract plans and specifications to estimate this work. See Drawing G1005, "Segment R-2 Soil Disposal", included in Amendment 1 which now spells out the testing. If found to be classified as Hazardous per RECRA standards, a contract modification would be required.

3. This amendment shall be attached to the specifications and plans and shall be a part thereof.
