2. QUESTIONS & ANSWERS
The following are responses to questions received from bidders (FOR INFORMATIONAL
PURPOSES ONLY):
Question No. 1: Proposal Items 0002 and 0003 are for the relocation of the water and gas mains respectively, with maximum allowable bid amounts. The contract specification section 009001 pages 7 and 8 states that the water and gas mains will be relocated by the utility owners at no cost to the Contractor. Please clarify if we are to figure the cost to bid these items using our own forces, or will these items be removed from the proposal due to their being performed by their respective utility companies? Please clarify the intent of these bid items?
Response: See revised Bid Schedule and Section 00 90 01 included in this Amendment.
Question No. 2. Proposal Item 0004 is for the duct replacement for the Verizon conduits. The contract specification section 009001 page 8 and drawing C-107 does not indicate any placement or relocation of this utility. Please clarify the intent and scope of work to be bid under this item.
Response: See response to Question No. 1 above.
Question No. 3 How can I arrange to schedule a walk-through or site inspection of the interior of the portion of the Public Works building to be removed?
Response: The optional work for the demolition of a one story addition to an existing brick industrial building has been deleted from this contract. See revised Bid Schedule, Section 00 08 00, Section 000901 and Sheet C-106 included in this Amendment.
Question No. 4 Are we to assume that there is fuel remaining in the storage tanks to be removed behind the building to be demolished? Are we to include the removal and disposal of any fuel?
Could you provide the capacity of these tanks?
Response: See revised Sheet C-106 included in this Amendment.
Question No. 5 Will all costs associated with the sampling, testing, site monitoring, removal and offsite disposal of any asbestos, contaminated or hazardous substances or soils encountered during the construction of this project, be considered an extra to the contract bid price? If not, would you please consider adding an allowance item for these issues?
Response: See response to Question No. 3 above for all issues related to the building demolition.
Permitting and Soil testing for the underground storage tank shall be done in accordance with the regulations noted in Note E Storage Tank Systems on Sheet C-106. Any such costs beyond that for the removal and disposal of the suspected UST as detailed in the plans and specifications would be negotiated under the Changes Clause of the contract. No allowance will be provided for other hazardous contaminants.
Question No. 6 Pertaining to the railroads, are we to include the costs for safety training, permits, inspections and flagmen in our bids? If so, would you please consider adding an allowance item for these issues?
Response: Permits for working on and adjacent to the railroad will be obtained by the U.S.
Army Corp of Engineers. Other costs shall be included in accordance with Section 00 90 01, Section 105.90.F.1 and Section 00 09 03. The cost of safety training, inspections and flagmen shall be included in the price for Base Bid Item 001. No allowance will be made for any items associated with the railroad.
Question No. 7: On C-202 and C-108 there is an existing Inlet -1 type A with new 15" RCP to be constructed but on the storm sewer profile it calls for replacing this inlet at sta. 0+00. Is this a new Inlet type A?
Response: Yes.
Question No. 8: Notes in the specifications and on the plans refer to providing and maintaining traffic barriers, flagmen and warning devices. However, there are no quantities or specific locations for any traffic control devices or traffic directors, (flagmen). This item, maintenance and protection of traffic needs further clarification. Also are police traffic directors, when dealing with the municipality, to be included as an allowance item and not part of the bid item?
Response: Barriers and other traffic control measures were considered for single lane closures along South Main Street at Rail Road Avenue. Since most of the work within the roadway for the closure gate and associated utility work will be done at night with the road closed, traffic barriers, flagmen and warning devices shall be used only as needed. Minimal Police presence is anticipated throughout the project but some time should be anticipated for setting up initial detours, initially directing traffic until detour pattern is established and for key deliveries such as the roller gate. The cost of Police traffic direction shall be included in the price for Base Bid Item 0001. No allowance will be made for Police traffic direction.
Question No. 9: On Plan Sheet 30 – Phase B #17 it references installing a temporary pedestrian bridge. However going through both the plans and specifications this is the only sheet that references a temporary pedestrian bridge. Please provide all necessary information including load conditions, soil test data & location of the bridge.
Response: See revised sheet CT-102 included in this amendment. The intent is to allow access to the sidewalk located on either side of South Main Street. The bridge will be shifted away from the side of the road that the contractor is actively working on. The Contractor can use borings for the gate to evaluate soil conditions at the site and maintain a safe crossing over all excavations.
Question No. 10: In reference to the “Bolmer” building and the “option” for the demolition of the building including the UST removal there are several RFI’s listed. They are as follows:
a. Please provide access to the building for inspection of the existing conditions.
b. Please provide any existing as builts and /or plans showing the existing conditions of the building including footings, floor conditions (i.e. concrete slab).
c. Provide information on the portion of the building that is going to remain -footings and/or any other existing conditions.
d. Is the building portion that is going to be demolished an addition to the main building? What if any conditions do they share – footings etc?
e. The Building demolition is listed as an “option” on the bid solicitation. If not selected as an “option” what is the alternative? – It appears that the building must be demolished in order to construct the gate.
f. Please provide dimensions, type of UST, access to the area or any other information in order to obtain / provide a removal price.
Response: See response to Question No. 3 above for items a through e. Assumptions on the Tank Size and remaining Product Level have been added to Sheet C-106 included in this amendment.
Question No. 11: Regarding the demolition of the one story masonry addition on drawing page 25, is there asbestos or lead in the building to be demolished? If so, please provide asbestos and lead abatement report with quantities to be disposed of.
Response: See response to Question No. 3 above.
Question No. 12: On drawing page 25, an underground storage tank is to be removed. What is the size of the underground storage tank and is the tank full or empty?
Response: See response to Question No. 4 above.
Question No. 13: Bid items 0002, 0003 and 0004 all have maximum bid amounts stated in the item descriptions. Please clarify if the maximum bid amount is a set allowance that all bidders must enter as their bid amount, or if the bidders should obtain subcontractor quotes and enter individual bid amounts, which may be any amount up to the maximum amounts stated.
Response: See revised Bid Schedule and Section 00 90 01 included in this Amendment.
Question No. 14: Will South Main Street be reconstructed with new asphalt and stone base, and if so, what are the limits?
Response: South Main Street will be reconstructed with either asphalt (see revised detail Sheet C-501) or in-kind concrete where applicable. See revised sheet C-108 included in this amendment. Paving limits are shown on revised drawing C-108.
Question No. 15: Please provide plans, design, details of pedestrian bridge indicated by sheet 30, phase b, #17
Response: See response to Question No. 9 above.
Question No. 16: Please provide formliner make and model for rustification.
Response: There is no formliner make and model specified for the rustication. To achieve rustication use High Density Poly Ethylene strips of size and length as indicated on the design drawings. Please refer to Section 03 11 14.00 10, paragraph 2.1.1.6 of the specifications.
Question No. 17: In reference to the utility relocation for this project it has been interpreted by the contract documents that the sanitary sewer and the storm drainage systems will be able to be constructed by the successful contractor of the project. With respect to the gas, telephone and water construction on the project will this work be performed by the utility itself or will this work be performed by the GC on the project with an approved subcontractor of the respective utility? If so please provide a list of approved subcontractors for each utility in question. For the steel casings that are to be installed under the gate structure on South Main Street is this to be installed by the GC or the respective utility? Who is responsible for removing or plugging the existing water and gas mains abandoned in place? Bid Items 0002, 0003 and 0004 make reference to maximum allowable amounts for the work by the NJAW, Verizon and PSE&G. Are these amounts to be considered allowances that all bidders put in their bids for each respective line?
Response: See revised Section 00 90 01 and Bid Schedule included in this Amendment.
Concur, with regard to storm and sanitary. Section 00 90 01, Section 105, has been revised to identify who is responsible for installing each utility. Steel casings shall be purchased by the contractor as part of Base Bid Item 0001 and installed by the group (contractor, subcontractor or utility) responsible for installation of the new system. Plugging and removal associated with the installation should also be handled by the responsible party. Yes, the amounts are to be considered allowances that each bidder shall use.
Question No. 18: For the work on South Main Street that involves the construction of the gate building and all the utility work in the roads what are the limits for any milling and overlay or full depth reconstruction?
Response: See revised Sheets C-501 and C-108 included in this amendment. South Main Street will be reconstructed with either asphalt (see detail revised Sheet C-501) or in-kind concrete where applicable (see revised sheet C-108). For concrete sections the contractor shall assume a 9-12 inch thick concrete slab with 8 inches of dense graded aggregate below. Paving limits are shown on revised drawing C-108.
Question No. 19: The brick paver detail on sheet C-501 shows a 4” header curb. At what locations is the header curb applicable (ex: adjacent to grass areas only, in the roadway, along the gate structure walls, etc.)?
Response: This detail is applicable in areas where the proposed curb needs to be removed and replaced to install new utilities such as the water main.
Question No. 20: What are the limits of milling on South Main Street as detailed on sheet CT- 102, Phase I, Note 7? Furthermore, is the milling even required since there are so many utilities in the roadway; creating a full depth reconstruction scenario on South Main Street? Again, the limits are not clearly defined on the plan documents.
Response: See response to Question No. 18 above.
Question No. 21: Under the railroad bridge there is a concrete slab where several proposed utilities are located. What is the depth of this existing slab and should it be replaced with a new concrete slab or a full depth asphalt pavement section?
Response: See response to Question No. 18 above
Question No. 22: Bid items 2-4 have “maximum allowed” values indicated in the proposal.
Please clarify the intent for these items:
a. Either they are allowance type items whereby they are essentially placeholders and the contractor gets paid whatever the costs are from the utility company plus overhead & profit – or…
b. Is the ACOE actually trying to set a lump sum price the contractor must bid whatever the costs are. If this is the intent, which seems unlawful, how does a contractor recover the monies if costs are in excess of this preset bid amount?
Response: The wording “maximum allowed” values has been revised in the Bid Schedule.
These items are meant to be an allowance for reimbursement of the utility installer through the contract. The contractor shall pay the provider upon receipt of payment from the Contracting Officer. Any of the bidder’s overhead and profit associated with the utility bid items may be included in Base Bid Item 0001.
Question No. 23: Steel sleeves for water and gas thru monolith – provided by whom? If the answer to our question 5.a in RFI #2 is affirmative, then disregard.
Response: The contractor shall provide steel sleeves for installation by the gas and water utility installers.
Question No. 24 limits of slope stabilization (coir matting) at south main st – please provide
Response: Limits of slope stabilization are shown on Railroad Avenue Drawing Sheet C-101 and Cross Section Sheet C-301.
Question No. 25: Please verify that asbestos removal at the building is not part of item #1 or #8, i.e. if encountered will be change order
Response: See response to Question No. 3 above.
Question No. 26: Section 00800-special contract requirements (section 39):
a. does not detail the NJDEP insurance – please provide
b. does not detail the train traffic required to properly price the insurance policies –
FOR ALL THREE RAILROADS
Response: See Section 00 08 00, paragraph 39.a for NJDEP insurance requirements. If necessary, train traffic information can be obtained from individual railroads. CSX railroad insurance requirement has been eliminated from this contract.
Question No. 27. Please provide limits of milling and paving on south main street per sheet 30, phase I, #7
Response: Paving and milling limits for South Main Street are shown on revised sheet C-108.
Question No. 28: 1. Sheet 30 indicates a temporary water and gas line to be installed and removed although the plans show only the permanent. Please provide plans, details, specs, etc for these temporary pipe items.
Response: A temporary 8” bypass may be required. NJAW will perform a system analysis to determine whether a bypass line is needed. This potential was accounted for in the allowance shown for water main relocation. The location of the temporary gas line has been added to revised sheet C-107 included in this amendment. Layout shall be coordinated with PSE&G.
Question No. 29: If the ACOE’s response to our RFI#2, item 5.a is affirmative – verify this work is covered under this item.
Response: RFI #2 item 5a, refers to Question #22. The Base Bid allowance for Items 2 (water) & 3 (gas) covers temporary utility relocation work.
Question No. 30: If the ACOE’s response to our RFI#2, item 5.a is affirmative: a. Verify the utility companies will work at night and provide their own light
Response: : RFI #2 item 5a, refers to Question #22. Gas and water are aware that night time is required. The allowance includes cost for night labor. Also lighting will be provided by the installer.
Question No. 31: Verify the utility companies will provide their own traffic control
Response: With regard to traffic control South Main Street needs to be closed at night in order to complete this work. The contractor shall set up an approved detour plan for all work to be done at South Main Street. Utility companies assumed that the contractor will provide and coordinate all traffic control devices including but not limited to barriers, cones, arrow boards, message boards detour plan, signs, and police officers if required.
Question No. 32: Verify the utility companies will perform all required sawcutting and repair trench.
Response: Sawcutting and trench repair shall be performed by the utility installer.
Question No. 33: Verify the utility companies will dispose of all spoils
Response: Disposal shall be completed by the utility installer.
Question No. 34: If the utility companies do not provide a-d above, verify these costs are part of the “allowance” item.
Response: Items a, c & d (see Questions 30, 32, and 33) will be provided by the utility installer.
The cost of traffic control should be included in the Base Bid Item 0001.
Question No. 35: Paver hatching is not indicated adjacent to the removable sidewalk plates although some sheets call out pavers. Please clarify sidewalk at these areas.
Response: Existing paver locations are not called out with hatching. For the extent of the existing pavers the contractor should review topographic survey plan sheet V-102. Hatching is only shown for new paver locations.
Question No. 36: Sheet c-501, detail 52 indicates 14” dga under the sidewalk which appears to be a typo. Please clarify.
Response: See revised Sheet C-501 included in this amendment.
Question No. 37: Please verify that spec section 617.10 - Emergency Towing Service (Section 00 90 01 page 25) is needed.
Response: No. Section 617.10 has been eliminated.
Question No. 38: Please confirm that there is no field office required for the Contracting Agency per section 105 - Control of Work.
Response: Concur. Field Office is not required.

7. RECORD DRAWINGS (6-01 Version)
See Section 01 12 00.00 18 RECORD DRAWING REQUIREMENTS for more details.
a. General: The Contractor will maintain as-built drawings during the construction period and will submit final record drawings at the completion of individual facilities. The Government will provide to the Contractor the CAD (Computer-Aided Drafting) files consisting of compact (computer) disks or magnetic media of the drawing files in the appropriate CAD format (i.e.
"Microstation", etc.) for the project. The Contractor is required to make prints or mylars from the CAD files and continuously maintain drawings to show current as-built conditions for the duration of the construction.
Except for updates as indicated below, the Contractor may maintain as-built drawings by marking up drawings by hand or by CAD methods. Scanned drawings will not be acceptable. If the Government cannot provide CAD files for the project drawings, mylar (reproducible) drawings will be provided. The Contractor will then be required to comply with all requirements indicated herein by the use of hand drafting.
b. Progress As-built Prints: During construction the Contractor is responsible for maintaining up to date one set of paper prints to show as-built construction conditions. These prints shall be kept current and available on the job site at all times. All changes from the contract drawings, which are made in the work, or additional information, which might be uncovered in the course of construction, shall be accordingly and neatly recorded as they occur by means of details and notes. The as-built prints will be jointly inspected for accuracy and completeness by the Contracting Officer's Representative and a responsible representative of the Contractor prior to submission of each monthly pay estimate. Partial payment will be withheld (amount to be determined) if the monthly review of as-built drawings reveals inaccuracies or incompleteness of as-built conditions. Progress as-builts shall show the following information, but not limited thereto:
(1) The location and description of any utility lines, valves, or other installations of any kind within the construction area. The location includes dimensions to permanent features. Average depth below surface shall also be indicated. The location of all under-ground utility lines, valve boxes or other items shall be located using a minimum of two tie-point dimensions. All dimensions must be taken from permanent structures or points that will remain after the construction work is completed.
(2) The location and dimensions of any changes with the building and structure.
(3) Correct grade or alignment of roads, structures or utilities if any changes were made from the contract drawings.
(4) Correct elevations if changes were made in site grading.
(5) Changes in details of design or additional information obtained from working drawings specified to be prepared and/or furnished by the Contractor including but not limited to fabricated, erection, installation plans and placing details, pipe sizes, insulation material, dimensions of equipment foundations, etc.
(6) The topography and grades of all drainage installed or affected as part of the project construction.
(7) All changes, which result from contract modifications.
(8) Where contract drawings or specifications allow options, only the option selected for construction shall be shown on the as-built prints.
(9) Systems designed or enhanced by the Contractor, such as HVAC controls, fire alarm, fire sprinkler and irrigation systems.
(10) All amendments to the contract drawings issued during the solicitation period shall be posted on the as-built drawings.
c. Hand Drafting: If mylars only are provided to the Contractor, they shall be updated using hand drafting. Only personnel proficient in the preparation of engineering drawings to standards satisfactory and acceptable to the Government shall be employed to modify the mylar reproduction drawings or prepare additional new drawings. All additions and corrections to the contract drawings shall be neat, clean and legible, and shall match the adjacent line work and/or lettering being annotated in type, density, size and style. All drafting work shall be done using the same medium (pencil, plastic lead or ink) that was employed on the original contract drawings and with graphic lead on paper base material. The title block to be used for any new as-built drawings shall be similar to that used on the original contract drawings.
d. Protection of Records: The Contractor shall be responsible for the protection and safety of mylars and CAD record until returned to the Contracting Officer. Any drawings damaged or lost by the Contractor shall be satisfactorily replaced by the Contractor at his expense.
e. 50% As-Built Update: At the 50% point in construction of this project (as determined by progress payments) the Contractor will update the CAD files of the project drawings in the appropriate CAD program to show as-built conditions as above, and submit an updated computer disk and one set of prints to the Contracting Officer for approval. If mylars only are provided to the Contractor, they shall be updated at this stage using hand drafting as specified herein, and the Contractor shall submit one set of prints to the Contracting Officer for approval. Any required corrections will be made by the Contractor before payment will be approved for this item. The Contractor must use the updated CAD record or mylar drawings to produce required prints.
f. Preliminary Record Drawing Submittal: At least thirty (30) calendar days before the anticipated date of final acceptance inspection the Contractor shall deliver two copies of progress prints showing final as-built conditions to the Contracting Officer for review and approval. These prints shall correctly show all the features of the project as it has been constructed, adding such additional drawings as may be necessary. They shall be printed from the CAD files updated in the appropriate CAD program, or from updated mylars if mylars only were provided to the Contractor. Within ten days, the Government will provide the Contractor one set of prints indicating required corrections to the preliminary submittal. Contractor will correct and resubmit within five (5) days. Any required subsequent review and resubmission periods will each be accomplished within five (5) days. Upon Government approval of the preliminary submittal, the Contractor will prepare final record drawings.
g. Record Drawing Submission: In the appropriate CAD program each drawing shall be marked with the words "RECORD DRAWING AS-BUILT" followed by the name of the Contractor in font, which will print at least 3/16" high. All revisions to the original contract drawings will be dated in the revision block. All prints must be reproduced from the updated CAD files. A minimum of 5 calendar days before the anticipated date of final acceptance inspection of the project the Contractor shall deliver to the Contracting Officer:
Three (3) CD's of CAD files and (3) CD's of PDF’s of the Record Drawings and Three (3) hard copies Of the Record Drawings
Failure to make an acceptable submission of Record Drawings will delay the Final Acceptance Inspection for the project and shall be cause for withholding any payment due the Contractor under this Contract.
h. Property: All paper prints, reproducible drawings and CAD files will become property of the Government upon final approval. Approval and acceptance of the final record drawings shall be accomplished before final payment is made to the Contractor.
i. Payment: No separate payment will be made for the as-built and record drawings or updating of CAD files required under this Contract, and all costs in connection therewith shall be considered a subsidiary obligation of the Contractor.
8. PHYSICAL DATA
Information and data furnished or referred to below are not intended representations or warranties but are furnished for information only. It is expressly understood that the Government will not be responsible for any deduction, interpretation, or conclusion drawn therefrom by the Contractor.
a. Weather Conditions: Climatological data determined from records of the U.S. Weather Bureau station, Elizabeth, New Jersey
