About this file

This document contains Questions and Answers related to a Request for Proposal (RFP) for a Water Injection Dredging Demonstration project at Tuttle Creek Lake, Kansas.

The RFP is being competed on an unrestricted basis under NAICS code 237990 with an estimated magnitude between $5,000,000 and $10,000,000. Key details include: the requirement for the dredge to have an operational depth range of 90-feet, the target pool elevations for the lake, the need for the contractor to determine maneuverability requirements, and the elimination of the requirement for USCG inspection and approval of the dredge. The government has clarified that the 25-page limit for the technical proposal includes the table of contents, project schedule, and small business participation, but excludes past performance information and pricing. Offerors are expected to determine appropriate line item placements on the bid schedule.

Comment Classification: Controlled Unclassified Information (CUI)

It is hard to determine if this solicitation is Small Business Set-Aside or not. There is conflicting info:

1. It is a SB set-aside, as stated, under NAICS code 237990 (exempt) where footnote 2 applies "NAICS code 237990 – Dredging: To be considered small for purposes of Government procurement, a firm or its similarly situated subcontractors must perform at least 40 percent of the volume dredged with their own equipment or equipment owned by another small dredging concern."

2. It is not SB set-aside, as stated in the SF1413, "This requirement is being competed on an unrestricted basis (i.e., full and open competition)."

Please clarify.

On: Jun 24 2024.

Government Response. . As stated in the solicitation (see SF 1442 at page 1, box 10), this requirement is being competed on an unrestricted basis (i.e., full and open competition). We do not see a footnote in the solicitation making any reference to a small business set aside. There is reference to the Small Business Administration's size standard for NAICS code 237990 (in SF 1442 at page 1, box 10) that is used for determining a contractor a small or large business. During the visit no navigational buoys or aids were seen to depict this navigable channel. If this survey is not available, could you extend the bid date so that we are able to provide the contractors with this?

On: Jul 01 2024.

Government Response. . The due date for proposals will not be extended. There is no defined navigation channel in the lake. The submerged channel to be included in the dredging is depicted in Figure D.1 in Appendix D and is shown in Figure 1 at Appendix F-5. On: Jul 15 2024

The Mill Creek cove, (Stockdale Park Rd.) just North of the proposed staging/dock area gives a much preferable access to the water's edge(hence less cost). Could you provide a survey from inside the cove and right in front of the boat ramp?

On: Jul 01 2024.

Government Response. . A detailed Mill Creek Cove survey has not been conducted. Partial surveys of the area indicate depths near the north shore and boat ramp range from 1 to 3 ft at multipurpose pool (1075). Mud deposition is pronounced at the boat ramp; at the winter/early spring target pool elevation of 1072 (3 ft below multipurpose pool) prior to April 1st the mud would be exposed and the ramp unusable. Actual water levels could be higher or lower based on actual inflows and outflows. On: Jul 15 2024

The contract states that the contractor must collectively demonstrate the following "Experience performing Water Injection Dredging, especially in cohesive sediments." To our knowledge, the USACE has never made a WID a required dredging method on any of its publicly advertised contracts, would therefor the personal experience of our key personnel in this dredging method suffice for this requirement?

On: Jul 01 2024.

Government Response. . Personal experience of key personnel cannot be used as a substitute for the project information required under Volume I, Factor 1. Project experience can be submitted as part of the project information if it pertains to projects that otherwise qualify for consideration under Volume I, Factor 1 for the prime / joint venture partner / major subcontractor. Note that the projects submitted under Volume I, Factor 1 are not required to be U.S. Army Corps of Engineers (USACE) projects.

Also note that the requirement to demonstrate dredging experience as described in the first bullet point on page 17 of the solicitation is not restricted to WID experience.

Refer to the full wording of the bullet point, which mentions experience performing water injection dredging OR experience performing other type(s) of dredging. On: Jul 15 2024

In the minimum requirements for the dredge, it states: "USCG inspected and approved for its weight class", could you elaborate on this, we do not think that the USCG inspects modular barges with or without propulsion unless they are on a navigable waterway. Could you provide us with the contact information which USCG station has jurisdiction over Tuttle Creek Lake and or can we have the contact to get clarification regarding the build process of this modular barge?

Can you please provide a 60 day extension to gather the required, necessary information in order to provide a competitive and effective proposal for this solicitation?

The complexity of this contract, dredging to 90 feet deep (deeper than any other USACE contract), the design, the sourcing of equipment (mostly overseas) and the discussions between the contractor, designers ,suppliers and constructors will take more time than allotted at this moment

On: Jul 01 2024.

Government Response. . We are unable to grant the requested extension. On: Jul 15 2024

Could you please provide your navigational survey that shows the width and depth from leaving your proposed dock/staging area to the "navigable" testing area? We would need this so that we can define the requirements needed for the propulsion and available propulsion gear depth. At this moment there are no navigation charts available (this is a non-navigable waterway) that could show the contractor the width, depth and obstacles in the proposed sailing route in the contract.

Will the WID need to have an operational depth range of 90-feet for each of the CLIN or Bid Item options? Or will only one of line items require the 90 foot dredging depth?

On: Jul 03 2024.

Government Response. . The 90 ft operational depth range is needed during each CLIN to allow dredging to occur near the gates (elevation 1003) in the case of a high pool. The actual dredging depth for most of the lake is considerably less. See Figure A.2. for sediment depth below the multipurpose pool (1075).

Here is a brief description of pool elevations: Target pool elevations over the winter are 1072 ft (3 ft below multipurpose pool) but could be higher or lower based on actual inflows and outflows.

Target pool after April 1st will be 1082.2 ft. From May to October the pool elevation with 50% exceedance probability ranges from 1080.71 to 1082.20. The pool elevation with 10% exceedance probability ranges from 1088.28 to 1101.89. The pool elevation ranges with 90% exceedance probability ranges from 1069.95 to 1072.77. Actual pool elevations could be more or less depending on actual inflows and releases. On: Jul 15 2024

The solicitation states, "The technical proposal (Volume I) must not contain reference to price." However, the solicitation also requires Attachment C, Small Business Participation Commitment Document (SBPCD), to be included in the technical proposal and the SBPCD requires offerors to reference price by percentage and value planned for large and small businesses. Can the USACE please clarify how the offeror should proceed in this regard?

On: Jul 03 2024.

Government Response. . A revised version of the Small Business Participation Commitment Document has been uploaded to the solicitation in lieu of the original version. It does not require offerors to provide the dollar values mentioned in the question. On: Jul 15 2024

The solicitation states, "Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other procurements." Can PPQs or CPARS previously submitted for other procurements be incorporated in their entirety into the offeror's proposal?

On: Jul 03 2024.

Government Response. . As stated in the solicitation under the Submission Requirements section for Volume I, Factor I, if a completed CPARS evaluation is available for any of the projects submitted, the offeror shall submit it with the proposal. If there is not a completed CPARS evaluation for a given project, the offeror shall submit a Past Performance Questionnaire (PPQ) for that project. If submitting a PPQ due to the lack of a CPARS evaluation as described in the preceding sentence, it is acceptable to submit a PPQ that was previously submitted for another procurement. Should we assume if Bid Item No 0005 is selected that all equipment that is used for options CLINs 0002 & 0003 need to be demobilized and removed from the site at the end of option 3 and paid for under Item 1? Item 5 would be a whole additional remobilization of equipment and demobilization in 2026? Or will the contractor be allowed to store equipment at the site over the winter?

On: Jul 03 2024.

Government Response. . No, the contractor will not have to fully demobilize. Dredge and equipment can be stored, but must be done in a way that allows recreational access and use of the parking lot and boat ramp as described in section 3.1.3 on page 35 20 23-6.
