About this file
This is a Questions and Answers (Q&A) document addressing clarifications to a Performance Work Statement (PWS) for a federal contract opportunity in Peru.
The document addresses three key clarifications requested by prospective contractors. First, regarding employment eligibility in PWS Section 1.6.7.7, the contracting officer confirmed that employment requirements should reflect Peruvian local nationals and legally permitted Third Country Nationals, not Antigua and Barbuda nationals as originally stated. Second, concerning applicable publications referenced in PWS Sections 6.1.15-6.1.17, the contracting officer clarified that operational compliance should focus on Peru's Environmental Protection and Management Act (Law No. 28611 and 1278) as outlined in PWS Section 5.1.1.1, rather than Antigua's Public Health Act, Litter Control and Prevention Act, and National Solid Waste Management Authority Act. Third, regarding Defense Base Act (DBA) insurance requirements in CLIN 0009, the contracting officer clarified that Defense Base Act insurance requirements applicable to performance in Peru have been updated in the PWS, replacing references to Barbados DBA waiver considerations. All three answers direct contractors to review the updated PWS for specific implementation details.

At all, See below the questions we received along with the answers to the best of our understanding.
1. Employment Eligibility (PWS Section 1.6.7.7): The PWS states that all contractor employees must be "Antigua and Barbuda nationals." Could you please confirm if this should instead reflect Peruvian local nationals and/or legally permitted Third Country Nationals?
Yes. See updates in PWS
1. Applicable Publications (PWS Sections 6.1.15 - 6.1.17): These sections reference the Public Health Act, Litter Control and Prevention Act, and National Solid Waste Management Authority Act of Antigua. Could you confirm that our operational compliance should focus strictly on the Peru Environmental Protection and Management Act (Law No. 28611 and 1278), as correctly outlined in PWS Section 5.1.1.1?
Yes. See updates on PWS
2. DBA Insurance (Solicitation Document, Page 4): The instructions note that "The country of Barbados does not have a waiver for DBA insurance." We will absolutely include DBA insurance in our quote (CLIN 0009), but we just wanted to verify if there are any specific waiver considerations for Peru that we should be aware of, or if standard DBA requirements apply.
DBA Insurance: Clarified the Defense Base Act (DBA) insurance requirements applicable to performance in Peru. See updates in PWS
