W912BV‐12‐R‐0032, DRAFT RFIs 1‐9
Department of the Army Tulsa District, Corps of Engineers
USACE Tulsa District HUBZone IDIQ MATOCs for MRR Services
SEED TO: Tenkiller Ferry Lake – Weir & Foundation Access Road
Solicitation (RFI) #: W912BV-12-R-0032
Answers to RFIs Set 1
RFI 1: In previous solicitations, a bid bond was not required for projects under a certain amount (generally $30K). Is a bid bond required for the Seed Task Order?
ANSWER: The FAR at 28.101-1(a) states that a bid guarantee (i.e. bid bond) shall not be required unless a performance and payment bond is also required. The FAR at 28.102-1(a) states that performance and payment bonds are required for any construction contract exceeding $150K. Therefore, since the range of magnitude for the Seed Task Order IAW FAR 36.204 is less than $25K, a bid bond will not be required as part of the Price Proposal for this solicitation. However, please note that the Government expects most follow-on task orders will be over $30K and therefore will require bid bonds.
RFI 2: Pg 19, Paragraph 2.3.12 does not exclude Lists of Figures, Tables and Acronyms from the page count. Please clarify that you want these and they will not be in the page count.
ANSWER: Paragraph 2.3.12 of Section 00 22 11 is revised as follows (added text is underlined):
2.3.12. For submissions with page limitations, the pages will be counted as follows: One side of the paper is one page; information on both the back and front of one sheet of paper will be counted as two pages. Where authorized, fold-out pages (11" x 14" or 11" x 17") will count as one page. Tables of content, proposal cover letters, lists of figures, tables and acronyms and tabs between proposal information do not count toward any page limitations in the proposal.
RFI 3: Pg 20, Paragraph 3, Table for Volume 1 – Under the “Relative Importance” column for Factor 2, which states: “Equally important to Factor 1 – combined Factors 1 & 2 are the Most Important Factors”. Factor 3 states that it is less important than Combined Factors 1 & 2. We know you do not use points for scoring, but to make our point we will use a basis of ten points for Factor 1, which implies Factor 2 equals ten points. Does the RFP imply that Factor 3 is less than twenty points? Or less than ten? You can interpret the intent two different ways. Please clarify the intent.
ANSWER: The intention is that Factors 1 and 2 are more important than Factors 3 and 4, but that Factor 2 is not more important than Factor 1 (i.e. they are equal to each other).
The goal is to have a pool of MATOCs that have all the capabilities and experience they need to perform any projects that will be awarded through the MATOCs. An offeror will not be awarded a MATOC just because they received an Outstanding rating for Factor 3 if their Ratings for Factors 1 and 2 are lower than other offeors. The reason a Seed Task Order is included in the Technical Proposal is so the offeror can demonstrate their ability to understand and evaluate a Government requirement and then prepare a technical approach that meets those requirements. It is anticipated that there may be times that there is a “short turnaround” for proposals due to funding (i.e. end of FY) or urgency, etc.
The MATOC contractors must be able to respond quickly in order to compete for the task orders.
RFI 4: Pg 21, Paragraph 5.1.1.2 – An electronic copy of the Experience Information Form is to be provided in MS Word. Please advise when this will be available.
ANSWER: It is posted on FBO with these RFIs.
RFI 5: Pg 23, Paragraph 5.2.1.7 The Offeror shall in a narrative format provide a disclosure statement which concisely describes all the relevant facts concerning any past or present organizational conflicts of interest that relates to the type of projects described in 1.5. If applicable, the Offeror shall provide information to assure the Government that the conflicts of interest have been mitigated and/or neutralized to the maximum extent possible. If a conflict of interest is discovered after award of the MATOCs, the Contracting Office will make a decision whether to terminate the contract. Please explain what you are looking for? Would another Tulsa Corps contract be considered a conflict?
ANSWER: The organizational conflict of interest means a situation in which the organization has a financial interest, personal activity or relationship that could impair their ability to act impartially and in the best interest of the Government when performing the contract. Some examples are investments, patents, copyrights, intellectual property interests, etc. This is an unusual situation, but we are required to address it just in case.
Having another Tulsa Corps contract would not be this kind of conflict of interest.
RFI 6: Pg 27 and 28, Paragraphs 7.2.1.3 – There appears to be two paragraphs numbered the same. Are both to be included?
ANSWER: You are correct, there are two paragraphs numbered 7.2.1.3. Both are required so the 2nd one should be 7.2.1.4. Then, after the remaining paragraphs are renumbered the last paragraph will be 7.2.1.8 instead of 7.2.1.7.
RFI 7: Pg 30, Paragraphs 8.3.2.3 – There appears to be two paragraphs numbered the same. Are both to be included?
ANSWER: You are correct, there are two paragraphs numbered 8.3.2.3. Both are required so the 2nd one should be 8.3.2.4 and the last one should be 8.3.2.5.
RFI 8: Amendment 1 – Added “The number of offeror copies required 3 has been added.” Page 20, Paragraph 2.5.1 – Requires only an original for Volume 2 and one CD. Please clarify if Volume 2 is to be just the original or if you want 3 copies.
ANSWER: Volume 2 should be just one (1) original binder and one CD. No copies are necessary.
RFI 9: Section 01 44 00 of the Specifications state the following: “The CQC System Manager has be a college graduate engineer or a college graduate of construction management curriculum with a minimum of 7 years documented experience on road construction.” Since the variety of work includes more than just road construction, could this paragraph be modified to remove the word “road”? This would allow a broader range of experience to match the different types of construction.
ANSWER: The specs will be changed as follows:
"The CQC System Manager shall be a college graduate engineer or a college graduate of construction management curriculum with a minimum of 7 years documented experience on road, earthwork, and heavy equipment construction projects."
