Please provide a detail for the aluminum terminal post installation in Seaside Heights. See Amendment No. 0003.
What pay item should the terminal post installation be included in?
Bidding Schedule has been revised. See Amendment No.
0003.
It is only stated that beachfill operations shall begin in the Borough of Mantoloking and the provision of not constructing two adjacent beachfill areas concurrently. Are there any other restrictions regarding beachfill sequencing? What are the restrictions/requirements if two or more dredges are utilized on the project? See Amendment No. 0003.
Will the Govt. consider removing the provision requiring that the Dune Crossover must be completed prior to progress payments? No. Please Bid as specified.
Please confirm that the requirement for the completion of the Dune Crossover prior to progress payment is only applicable to the actual progress payment and not to the acceptance of beachfill at the time of surveying?
Yes, applies to the progress payment, not acceptance of beachfill placement. The KTR can complete beachfill stations and continue to move down beach regardless of how crossover work is progressing, but payment for those completed stations will be affected by timeliness of crossover work to provide a useable and accessible beach area.
Can the Govt. clarify the surveying requirements? It is noted that there are 10 Survey Areas for the base bid and 6 Survey Areas for the Options. a. Is there a specific linear footage per survey area (500’ or 1,000’) that will be considered an acceptance section or is it on a station by station basis? b.
With regards to the 24-hour minimum waiting period for after-beachfill survey, if the survey for a particular station is accepted, is that final and complete? c. Or please clarify the before beachfill surveys, daily progress surveys and afterbeachfill surveys and how they relate to payment and acceptance?
a. See section 01 71 23 3.6.1 each town is listed with its stationing. b. The 24 hour minimum waiting period is need prior to the AD survey and is not related to accepted per section 01 71 23 3.7.1. c. The pre placement surveys are to verify site conditions that may differ greatly from design surveys. BD/AD are for payment per section 3.2. The postplacement survey is for tracking and future use. Please Bid as shown and specified.
The days to exercise the options limit the contractor’s ability to properly estimate and manage the borrow areas. Will the Govt. consider reducing the instances of 300 days, 180 days and 90 days, to something more manageable?
The Government will not reduce the number of days within which it can exercise any of the options included in the IFB.
The amount of time associated with the exercise of each option is necessary to either acquire and certify the real estate needed to construct that portion of the Project, review and approve the pre-condition survey information for a portion of the project, or receive Non-federal funding associated with particular options.
Section 32 92 00
Specs Section 32 92 00 Sand Fence and Dune Grass: Part
3.3.1 states that all dunes shall be fertilized and planted after finish grading of all dune crossovers and sand fence, and part
3.3.3.1 and 3.3.3.2 restricts the time dune grass can be planted. Can the Govt clarify the required sequencing?
That is the correct sequencing. Please Bid as shown and specified.
On the Bidding Schedule, Line Item #138 is omitted. Please confirm there is no line item #138.
Bidding Schedule has been revised. See Amendment No.
0002.

9) The specifications indicate that the Contractor should monitor for beach nesting birds (in addition to piping plover), including least tern, American oystercatcher, black skimmer, common tern, and royal tern. Royal tern is not listed as rare (State Special Concern), or federally or State endangered or threatened. In the past, we have been required to monitor for roseate tern (Sterna dougallii, Federal and State Endangered). Are the specifications intended to read “roseate tern” in lieu of “royal tern”? Section 01 57 20 revised. See Amendment No. 0003
Section 01 32 33 Construction Photography, Part 3 Execution, subpart d. “Submit a reference plan sheet or map with the weekly construction photos, showing locations of the photographs.” Are the progress photographs to be conducted monthly or weekly? Or, does the weekly requirement refer to the survey photographs only? This has been clarified. See Amendment No. 0003.
Section 01 32 33 Construction Photography, 1.5.1 Prints. Are 2 copies of 8”x10” prints required for all pictures taken, or just the aerial photographs? Provide 2 sets of prints of all approved pictures taken.
Please provide the sieve curves associated with vibracores NJV-342, NJV-316 and NJV-315 that were omitted from the original specification. See Amendment No. 0002.
I see there are specific Female and Minority “Participation Goals” under section (b) 52.222-23 but are there ACTUAL requirements to use small businesses such as certified Service Disabled Veteran Owned Small Businesses (SDVOSB) somewhere in this massive contract?
See Section 00 45 05, Small Business Subcontracting Plan for the small business goals. The plan must be submitted with the bid.
If there are no specific “requirements” per say can you explain how Prime Contractors can included in their proposal their subcontracting intentions and how stating their intentions with actual certified company names will provide them a more positive rating or stronger bid package. In other words what benefit does a Prime contractor receive by utilizing minority and female if it is just suggested not required.
The Small Business Subcontracting Plan states the percentage goals for each SB category. The plan is monitored throughout the life of the contract between the prime contractor, Contracting Officer and the Small Business Specialist. The prime contractor's final evaluation includes a rating on how well they managed their Small Business Subcontracting Plan.
Section 35 31 00 Beachfill, 3.5.2.1 Progress Payments states, “For the purposes of payment for beachfill, the Government will not consider the progress of beachfill satisfactory until the satisfactory completion of the work specified in Section 32 15 00 DUNE CROSSOVERS in areas of beachfill for which progress payment are to be made.” Will the USACE withhold progress payments for completed Beachfill due to incomplete dune crossovers? If so could the USACE remove this restriction on progress payments as the cost for Beachfill is substantially more than that of the crossover installation and is also a separate scope of work. Please see RFI# 4 and RFI# 5 above.

Has the Govt. received the Real Estate Interest necessary to perform the work? If not, what is the expected timeframe the Govt. expects to resolve the outstanding issues? If the issues are not resolved prior to the bid date, will the Govt. consider extending the bid date until the issues are resolved and bid submission results in an awardable contract?
The scheduled bid opening date is based on the current real estate certification timeline. At this time, the anticipated certification is progressing as anticipated.
If issues arise prior to final real estate certification, notification will be made. Bids will not be opened without obtaining final certified real estate interests to allow contract award at that time.
Will the Govt. consider adding the following language into the Commencement, Prosecution, and Completion of Work section of the contract noting that time extensions may be granted for severe weather, equipment breakdowns, or repair periods with proper justification?
“The contractor shall prosecute the work diligently, using one or more dredges and appurtenant equipment of which one dredge will be dedicated to work on this contract until completion (with the exception for weather delays or equipment breakdown). The time stated for completion shall include the final cleanup of the premises.” No. Please bid per the plans and specifications.
Is there a survey in xyz format available for the project (beachfill and borrow sites) or a link where it could be found on the website? No. Please bid per the plans and specifications.
Will the existing force main that is to be extended if option 5 is awarded be turned off while work is progressing or should the contractor expect to be working next to the force main while it is discharging.
See Section 33 41 13, paragraph 1.1, " Contractor to note that the pump station discharges intermittently each day." The contractor will have to ensure positive drainage during the course of construction. Please bid per the plans and specifications.

Amendment No. 0003
Section 01 33 00 Page 25 stockpiling or staging will be allowed in this area. Take any additional action, as directed by the Contracting Officer, to insure adequate protection of the seabeach amaranth. A picture of seabeach amaranth has been attached at the end of this section for detail.
3.7.2 Piping Plover Protection
Take all necessary actions to ensure protection of the piping plover bird, which is a Federally threatened species, and beach nesting birds consisting of one or more of the following state rare species: least tern, American oystercatcher, common tern, other tern species present, and black skimmer.
The nesting season begins approximately on 15 March and ends approximately on 15 August. Ensure that all employees are aware of the potential presence of these species, and provide sufficient information describing them. Immediately notify the COR if any piping plovers and/or beach nesting birds are sighted in the vicinity of the project area. If construction activities occur during the nesting season, the Contractor is responsible for ensuring that a piping plover monitor is on site to monitor construction activities. During the nesting season, the Contractor shall also be responsible for establishing a buffer zone of up to 1,000 meters between all construction activities and piping plover nests. If necessary, the buffer zone may be expanded if the 1,000-meter buffer zone is found to be inadequate. For species other than piping plovers (i.e. least terns, American oystercatcher, black skimmer, etc.), the Contractor shall be responsible for establishing, at a minimum, a 100 meter buffer zone during the nesting season. This buffer area may increase once chicks have hatched and become mobile. The New Jersey Department of Environmental Protection, Division of Fish and Wildlife, Endangered and Nongame Species Program (ENSP) and the plover monitor will evaluate nesting situations to determine if the 100 meter buffer is sufficient or needs to be increased.
Construction activities are defined as, but not limited to, the movement of equipment and vehicles, dredging operations, surveys, and the placement/storage of materials. The Contractor shall delineate the buffer zones by erecting orange plastic fencing. All Contractor personnel, vehicles and equipment shall remain outside the buffer zones. Absolutely no access is permitted within these zones. The Contractor shall be responsible for taking any additional action, as directed by the COR, to ensure adequate protection of the nests and chicks. Piping plovers and other beach nesting birds have the potential to nest anywhere within the contract limits. The Contractor shall be prepared to take all necessary action to ensure protection of these species, regardless of the nesting location within the contract limits or overlapping buffer zone if outside of contract limits, in accordance with the specifications herein. While there are currently no active nesting areas within the project area, highly suitable potential nesting habitat does exist that could be utilized by plovers during the 2017 and 2018 nesting seasons. Prior to the nesting season(s), ENSP will delineate the portions of the project area that contain highly suitable nesting habitat. These are the areas that require monitoring during the nesting season. Monitoring of these areas shall begin a minimum of 2 weeks prior to construction activities within the suitable nesting habitat.
3.7.2.1 Monitoring Requirements
The primary role of the piping plover monitor shall be to ensure that no previously undetected piping plover nest or broods are located within the construction area and to monitor movements of unfledged chicks from adjacent known nesting areas that may disperse into the construction area.
Section 01 57 20 Page 11
The plover monitor shall also detect any territorial or breeding behavior exhibited by any plovers discovered outside of historic nesting areas. A secondary role of the piping plover monitor shall be to ensure that appropriate protective buffer areas are established and maintained surrounding historical nesting (which includes courting and territorial) and chick foraging areas. The plover monitor shall coordinate with New Jersey Department of Environmental Protection, Division of Fish and Wildlife, Endangered and Nongame Species Program (ENSP) to become familiar with the locations of highly suitable nesting habitat, known or suspected territorial pairs, nest sites, and chick foraging areas. The plover monitor shall notify the ENSP immediately if any territorial or breeding activity is observed or any new nests found and the ENSP shall assist in fencing off nesting or foraging areas and erecting predator exclosures.
There shall be no entrance of these fenced areas by the piping plover monitor or any other contractor personnel unless authorized by the ENSP or the U.S. Fish and Wildlife Service (USFWS). Piping Plover monitoring shall begin on 15 March and continue until all chicks from adjacent nesting sites have fledged or construction related activities have terminated. With written concurrence from USFWS and the ENSP, work greater than 1,000 meters from a known nesting area may proceed in non-nesting portions of the project area after 1 July, provided no piping plover activity has been observed within the remaining construction area after 8 alternate days of monitoring over the previous 2-week period. If these conditions are met, no further monitoring will be required.
3.7.2.2 Qualifications
Provide qualified piping plover monitors and support staff that have been approved by the U.S. Fish and Wildlife Service for construction monitoring. All monitors used shall be biologists with a minimum of 2 years experience in the type of work being performed on this project or person(s) with a minimum of 5 years related experience that have the necessary education and/or experience in accordance with the requirements listed herein.
3.7.2.3 Monitoring Schedule
The monitor shall be present on the beach, in the area of active construction, a minimum of every other day, to include weekends, weather permitting, for a minimum of 2 hours per day in order to determine the arrival and use of the area by piping plovers. Monitoring times shall vary in order to cover the full tidal cycle. If plovers are (or become) present in the area, behavioral observations with regard to establishing territories and initiating nesting shall be observed and documented. In the event that plovers establish active nests in the construction areas, further coordination between the Corps, USFWS, and ENSP shall be required to document nests and establish buffer areas. Monitoring frequency shall be increased from every other day initially to several times daily in the event that breeding and/or nesting activity is observed within the monitored activity area in order to determine if impacts from construction activities are occurring.
Monitoring activities shall take place in and around the immediate construction disturbance area (vehicle staging, sand placement, sand stockpiling, grading, nearshore dredging operations, etc.), the area to where the construction will be progressing, and the buffer areas around the historical nesting area.
Section 01 57 20 Page 12
3.7.2.4 Establishing Buffer Areas
If a piping plover is observed during the nesting season, in a previously unoccupied area within the contract limits, the plover monitor shall immediately notify the project biologist, ENSP and USFWS, through the COR, to determine necessary protective actions, and a temporary buffer shall be established. These contact numbers will be provided after contract award.
Prior to 15 May, a temporary buffer of 300 meters shall be established around areas newly occupied by foraging adult plovers and plovers displaying territorial behavior. From 15 May to 15 August, the temporary buffer shall be 1,000 meters. If nesting behavior (i.e. active scrapes, courtship or copulation) is confirmed, or if nests or chicks are found, a buffer sufficient in size to prevent disturbance to nesting birds and/or to protect unfledged broods shall be established based on site-specific conditions and shall remain in effect until the conclusion of breeding activity. If birds are not displaying any signs of nesting behavior (i.e., are likely to be non-nesting birds or spring migrants) or are no longer sighted after observations are conducted over one week, the temporary buffers shall be removed. Once piping plover nests have hatched and chicks are mobile (possibly as early as approximately 15 May), no construction shall take place within 1,000 meters of chick foraging areas until after the chicks have fledged. The same procedures shall be used to establish the 100 meter buffer area required for other beach nesting birds (least tern, black skimmer, American oystercatcher, and other tern species present).
