Section 00610 – Page 1
SECTION 00610
PRE-AWARD SURVEY SUBMITTAL REQUIREMENTS
Award of the contract will be made as a whole to the lowest responsive and responsible bidder whose bid conforms to all requirements of the specifications. Subsequent to the bid opening, the apparent low bidder will be required to submit pre-award survey information relating to Specialized Experience, Past Performance Evaluations, Key Personnel information and the Proposed Contract Summary Schedule.
A) Specialized Experience on Similar Type Work and Project Experience
To demonstrate specialized experience, the apparent low bidder shall provide the following as part of the pre-award survey information package:
(1) Examples of three (3) relevant projects during the last seven (7) years for all of the Experience items listed below. Furthermore, for an example project to be considered relevant the bidder must document that current personnel proposed to work on this project were substantially involved with each of the past projects. (See Paragraph “Key Personnel”.)
Experience may be as the Prime Contractor, or that of a Subcontractor under this contract, except the requirements for the manufacturing of the prestressed girders shall be from the Manufacturer.
Experience 1: Experience with prestressed girder manufacturing, shipping, handling and installation for spans greater than 100 ft.
Experience 2: Experience with Soil Nail Wall Construction.
Experience 3: Experience with Mechanically Stabilized Earth (MSE) wall construction.
B) Past Performance
The form “PRIME CONTRACTOR EXPERIENCE,” provided as Attachment 1 at the end of this section may be used to list relevant projects. Please submit one forms package for each relevant project. Use of this form is not mandatory provided the information listed in Sub-Paragraph B (1) through (8) below, is provided.
The bidder shall provide the performance evaluations on the same projects submitted under Paragraph A) above as well as any in-progress projects.
Submission of correspondence from project owners will suffice if performance evaluation forms are not available. For government agency projects, the bidder shall submit that agency’s performance evaluation forms. The Government may contact the individuals identified by the bidder to confirm performance capabilities. The bidder must take whatever steps are necessary to ensure that the named individuals can be reached at the number indicated for a reference. The Government may use other information that is readily available to determine a bidder’s past performance, such as CCASS ratings.
Past performance submittal shall include at least the following:
(1) Project Name and Location
(2) Scope and Relevance
Section 00610 – Page 2
(3) Award Amount and Completion Amount
(4) Original and Final Contract Durations and Completion Dates, (Where applicable, explain facts, with an assessment of liquidated damages, for failure in meeting completion dates)
(5) Final Performance Rating
(6) Project Owner and Point of Contact Information
(7) Role of Bidder in Project (prime, subcontractor, or as joint venture, identifying the bidder's role in the joint venture)
(8) Amount and Extent of Subcontracting
If a bid represents the combination of two or more companies (Joint Venture) for the purpose of this IFB, the experience may be from the individual companies, and is not necessary as collaborative examples. The Government reserves the right to verify performance evaluations by reviewing the Corps of Engineers (CCASS) or to interview owners.
C) Key Personnel
Key Personnel - Identify key personnel to be assigned to the project on an organization chart that includes names, resumes and responsibilities. Include as a minimum the Construction Project Manager, Construction Field Superintendent, Contractor Quality Control (CQC) System Manager, and Safety Officer. Indicate whether each individual has had a significant part in any of the relevant project examples cited. The Construction Project Manager and Construction Field Superintendent, assigned to this contract, shall be employees of the prime Contractor and shall each possess a minimum of 10 years current experience in construction similar to this contract work in type and scope. If reassignment of personnel is considered possible, provide the names and resumes of the alternative professional in each assignment.
Any proposed alternates for the Construction Project Manager and Construction Field Superintendent shall be identified to serve in the event of their absence. The requirements for the alternates shall be the same as for the assigned Construction Project Manager and Construction Field Superintendent.
This is in addition to the CQC System Manager, who also requires a minimum of 10 years current experience in construction similar to this contract work in type and scope. See Section Section 01451 Contractor Quality Control for CQC System Manager requirements.
D) Proposed Contract Summary Schedule
Provide a schedule for contract performance, including key milestone events and major scope item durations, that is within the maximum allowable contract performance period identified in the solicitation specifications.
Note: Any Bid that is materially unbalanced as to prices may be rejected. An unbalanced bid is one which is based on prices significantly less than the cost for some work and prices which are significantly overstated for other work and can also exist where only overpricing or under pricing exists. A bid may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government. Failure to insert prices for each item, including any options, in the bid schedule can cause the proposal to be rejected.
After evaluation of the pre-award information award of the contract will be made as a whole to the lowest responsive and responsible bidder whose bid conforms to all requirements of the specifications.

WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
Section 00815 - 22
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
