About this file
This document contains questions and answers regarding technical specifications for a federal contract solicitation to supply high resistance grounding equipment for Fort Peck Dam in Montana. The solicitation will be posted on www.fbo.gov and seeks to replace aging low impedance reactors and breakers with a modern high resistance grounding system for five generator units. The high resistance grounding system will reduce damage from single line to ground faults which are the most common type of fault. The purchase is for the high resistance grounding equipment only, as installation will be completed by federal employees at the dam. Offerors must register in the System for Award Management database and ensure annual representations and certifications are up to date. The contracting agency is the Department of the Army Corps of Engineers Engineering District Omaha.

Question: Specification 01 33 00; 1.1.1, what exactly does “all applicable Buy-American and Trade Agreement clauses” mean?
Answer: In accordance with FAR 25.101(a), the Buy American statute uses a two-part test to define a domestic end product. (1) The article must be manufactured in the United States; and (2) The cost of domestic components must exceed 50 percent of the cost of all the components. In accordance with 41 U.S.C. 1907, this component test of the Buy American statute has been waived for acquisitions of COTS items (see 12.505(a)).
Question: Specification 01 33 00; 1.2.1 SD-09, since USACE is doing the contracting, the company has no intention of sending a representative to the job site for field reports. Typically, this type of product does not require start-up assistance from factory personnel. Is this acceptable?
Answer: The requirement for manufacturer representative for field testing was removed from the technical specs (26 11 15.00 26) and it should be removed from this section also.

Answer: There are no federal, military publications applicable for this job.
Question: Specification 01 33 00; 1.5.2.4 SD-11, since this is a very large assembly with very large components, the contractor will not provide samples.
Answer: The requirement for samples is not applicable.
