SECTION 01 01 00
CONTRACTOR'S SITE OPERATIONS
4/07; Rev 3/11
PART 1 GENERAL
1.1 PERMITS AND RESPONSIBILITIES
The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, County, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor's fault or negligence, and shall take proper safety and health precautions to protect the work, workers, public, and property of others. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.
1.2 WORK AREAS AND ACCESS
The Contractor shall take steps reasonably necessary to ascertain the nature and location of the work, and investigate the general and local conditions that can affect the work or its cost. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expenses to the Government. The Government assumes no responsibility for any conclusions or interpretations made by the Contractor based on the information made available by the Government. Nor does the Government assume responsibility for any understanding reached or representation made concerning conditions that can affect the work by any of its officers or agents before the execution of this contract, unless the understanding or representation is expressly stated in this contract. Site conditions that should be investigated include, but are not limited to:
(1) Conditions bearing upon transportation, disposal, handling, and storage of materials.
(2) The availability of labor, water, electrical power, and roads.
(3) Uncertainties of weather, river stages, tides, or similar physical conditions at the site.
(4) The conformation and conditions of the ground and equipment and facilities to be replaced and/or rehabilitated.
(5) The character of equipment and facilities needed preliminary to and during work performance.
(6) Amount of work space, accessibility, lighting, etc.

1.2.1 Road Restrictions
No new access roads are required for this work. Any damage to existing roadways that are used for access purposes shall be repaired and the surface shall be restored to its "as found" condition. The Contractor shall comply with any special requirements of the State, County, Local authorities and Corps of Engineers for use of existing roadways. These special requirements include, but are not limited to, traffic regulations and load limits. The Contractor is responsible for investigating and understanding these restrictions. No time extensions or cost claims will be allowed due to road restrictions.
1.2.2 Access by Government Personnel
Clear access shall be maintained for Government personnel and equipment through all work areas.
1.2.3 Contractor's Staging Area and Employee Access
The Contractor's staging area shall be restricted to the area designated by the Government. The contractor's job-site office may be in the staging area, as approved. The project areas off-limits to Contractor shall be all areas other than direct work areas. All buildings and facilities constructed or brought on site by the Contractor shall be maintained in a satisfactory condition with strict observance of the rules of sanitation, safety and order as may be established by the Contracting Officer. Prior to final payment under the contract, all buildings and facilities constructed by the Contractor for his own use shall be removed from the site by the Contractor.
1.3 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following shall be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:
SD-01 Preconstruction Submittals
To be submitted in accordance with the GENERAL CONDITIONS (CONTRACT CLAUSES) clause entitled "Schedules for Construction Contracts", see paragraph 1.26
A daily log shall be made of the accomplished work, and shall be submitted at the completion of the contract, see paragraph 1.25.1

Site Supervisor(s);

Project Reporting;
Daily reports shall be completed and submitted to the Contracting Officer or Representative within 24 hours of work, see paragraph 1.28
1.4 STORAGE OF EQUIPMENT AND MATERIALS
Indoor and outdoor storage of equipment and materials will be permitted only at designated storage areas in the vicinity of the Visitor Center which will be coordinated with the Government Representative during the pre-work conference. Due to high winds at the site, everything in the outside storage area(s) shall be securely tied down so it will not be blown away.
1.5 PROJECT SECURITY, HOLIDAYS AND WORKING HOURS
1.5.1 General
A procedure shall be prepared and submitted for approval for the identification and control of employees entering or leaving the project during the hours of closure. The security of the Contractor's property and items furnished under this contract are the Contractors responsibility, until accepted, whether stored inside or outside the Visitor Center.
1.5.2 Federal Holidays
The following Federal legal holidays are observed by this installation:

1.5.3 Working Hours
The contractor will have access to the Visitor Center for work during normal business hours from 0800 to 1730 hrs Monday through Friday excluding any federally recognized holiday that it is observed on and the contractor shall plan all work accordingly to this work schedule. These hours will be strictly adhered to unless government determines work outside this time is beneficial to the government.
In addition to the work business hours listed previously all clearance (Lock Out - Tag Out) operations needed to be performed by the government shall take place during Visitor Center maintenance personnel work schedule

Monday through Thursday 0630 to 1600.
1.6 VEHICLES
1.6.1 Use of Private Vehicles
Private vehicles of the Contractor and Contractor's employees shall use the Visitor Center parking lot. The Contractor shall follow all Contracting officer requirements regarding vehicle access to the project. Parking of private vehicles shall be restricted to the areas designated by the Contracting Officer. Additional parking will be designated upon request, but may be located up to ½ mile from the Visitor Center. The Contractor shall maintain the designated parking areas.
1.7 UTILITIES
1.7.1 Government Furnished Utilities
All utilities that are required for use in performance of the work under this contract shall be Contractor-furnished except as noted below:
1.7.1.1 Water
All reasonable amounts of non-potable water will be made available from existing outlets. The Contractor will be responsible for freeze proofing all accessed water sources. Full responsibility for care of water shall be borne by the Contractor until completion of work under this contract. The Contractor shall provide the materials and equipment and perform all work necessary to facilitate construction and to protect the work from damage by water. The Contractor shall make his own investigations and determinations of conditions, both existing and anticipated concerning care of water.
Plans for care of water are subject to approval by the Contracting Officer prior to construction. Facilities shall be removed upon completion of the work.
1.7.1.2 Electricity
Electric power may be obtained from existing sources located at various locations near the work areas unless otherwise approved
1.7.1.3 Compressed Air
Compressed air will not be available to the Contractor.
1.7.2 Temporary Utility Connections
All utilities provided by the Government shall be at no cost. Care shall be exercised in conserving all utilities. The contractor shall at his own expense and in a workman like manner satisfactory to the CONTRACTING OFFICER provide all necessary hoses, cords, couplings, plugs, GFI's and other appurtenances as required to connect to the system(s). All temporary connections shall be subject to approval. The location of all power lines and all temporary connections for electricity shall be coordinated with the

CONTRACTING OFFICER. All temporary circuits and devices shall be provided, connected, and maintained and removed prior to final acceptance. Ground fault protection shall be provided for all circuits used, inside and outside, and shall be Contractor-furnished. The temporary panel shall conform to current NEC standards in EM 385-1-1.
1.7.3 Use of Sanitation Facilities
The Contractor will be allowed to use the Visitor Center sanitation facilities only when the Visitor Center is open for public use (0800-1730 Memorial Day through Labor Day).
1.8 COOPERATION WITH OTHERS
The Contractor shall cooperate and coordinate his work with that of others as required for orderly completion of all work. In the event of disagreement between the Contractor and others, the decision of the Contracting Officer shall be final.
1.9 COORDINATION AND OUTAGES
The Government shall approve outages after coordination with power marketing agency. The Government will limit interference with the Contractor's work to the extent possible. The Government and Contractor shall coordinate work activities as necessary. The Contractor's employees shall not open, close or tamper with switches, valves or control devices for existing installed equipment. Only Government operating personnel will be authorized to open or close existing switches, valves and control devices to enable the Contractor to make connections or modifications to existing equipment. Work shall be coordinated and scheduled to reduce the "Outage" time of operating equipment or systems to a minimum. Work in the proximity of exposed energized equipment or work involving connections to existing energized or operating equipment or systems shall perform only under the Safe Clearance Procedures. The Contractor will be instructed by the Contracting Officer in the proper procedure for requesting clearances.
Only qualified supervisory personnel will be permitted to request clearances. Request for "Outage" shall be made by the Contractor to the Contracting Officer in each instance and in sufficient time to permit adjusting power plant operations, and to coordinate outages with the dispatching agency. Scheduling of "Outage" will be subject to the approval of the Contracting Officer.
1.10 SAFE CLEARANCE PROCEDURES
A Hazardous Energy Control (HEC) procedures are implemented for all the maintenance and construction activities on Corps property. These procedures are in accordance with OSHA regulation 29 CFR 1910.147, 1910.333, 1910.269 and USACE ER 385-1-31, The Control of Hazardous Energy (safe clearance). Any work performed at the Ft. Randall project will be performed under safe clearance. The contractor shall request clearance on a piece of equipment or system before any work may begin. The Corps will establish the limits of the clearance, tag and lock the equipment or systems. The Contractor will be required to institute their own safe clearance procedures in accordance with OSHA and USACE regulations, within the perimeter or the Corps clearance. The Contractor's clearance shall not inhibit or interfere with the Corps operation of the plant. The clearances shall not be violated. Any violation of Hazardous Energy Control procedure

(Safe Clearance Procedures) will be grounds for removal of the offender(s).
1.11 SCAFFOLDING
Any scaffolding, platform, ladder, stairway, or other access schemes proposed to be used shall be submitted for approval, including type, layout, and connections. Approved anti-slip surface material shall be installed on scaffolding platforms. Scaffolding shall comply in every respect with EM 385-1-1.
1.12 CONTRACTOR'S AREA LIGHTING
The Contractor shall provide all lighting necessary to perform his work and to provide a safe work environment.
1.13 GOVERNMENT FURNISHED TOOLS AND EQUIPMENT
Government tools and equipment at the project, i.e., lathes, drill presses, hand tools, etc., are not available for use.
1.14 DAMAGED EQUIPMENT OR ABNORMAL CONDITIONS
The Government shall be informed immediately upon finding any damaged equipment or other abnormal conditions involving additional work. The failure or abnormality shall not be disturbed until witnessed by the CONTRACTING OFFICER. Prior to proceeding further with work, the Contractor and the Government shall agree in writing as to the responsibility for the damage or abnormality.
1.15 PROTECTION AND RESTORATION OF EXISTING FACILITIES
The Contractor shall be responsible for the protection of the work area from damage. All existing grounds, property and facilities shall be protected whether or not shown on the drawings. Upon completion of the work, all the existing grounds, property and facilities, not included as a portion of the work, shall be left in a condition equal to the original condition prior to the contract. Costs for repair and restoration of any facilities shall be considered to be incidental to and included in the contract price. All work, storage of materials, and construction plant shall be kept within the limits of the areas assigned. Prior to construction operations, the Contractor shall confer with the Contracting Officer's representative to determine the proximity of any possible obstructions, pipe or equipment which could be damaged as a result of construction operations. Existing utility lines shall be protected from damage, and if damaged, shall be repaired by the Contractor at no additional expense to the Government. In the event that the Contractor damages any existing utility lines report thereof shall be made immediately to the Contracting Officer. The Contractor will be responsible for the protection of structures from any structural damage during the construction operations. At all times the plant and work areas shall be kept in a condition conducive to safety of workmen and the public and neat in appearance. Waste or surplus materials shall not be allowed to accumulate in the construction areas.

1.16 DAILY CLEANUP AND DISPOSAL
All debris resulting from the work, such as waste metalwork, packing cases, scrap lumber, oil and grease, and other debris shall be collected, removed, and disposed of off site at least once per shift. Disposal shall be in accordance with Federal, State and Local regulations. The location of the Contractor's off-site disposal area and a plan for safe disposal of material shall be approved. The Government's trash cans, dumpsters, etc.
shall not be used. Liquid waste shall not be disposed of in Visitor Center drains. All costs of removing debris shall be incidental to the work, and no separate payment will be made therefore. All temporary structures used by the Contractor in the course of the work shall leave the area looking "broom clean".
1.17 DISPOSAL OF MATERIALS
Title to all materials and equipment to be disposed of, except salvage items and hazardous waste, is vested in the Contractor upon receipt of signed contract and such materials and equipment are designated scrap only as directed. The Government will not be responsible for the condition, loss or damage to such property after notice to proceed. The Contractor may retain these items in usable form and take possession of them providing that there is no subsequent cost or inconvenience to the Government. The Government does not guarantee that these items are complete or in working order, and the Contractor shall assume responsibility for any damages caused by their use immediately upon taking possession of them. Scrap materials shall be removed from the Government's property within 14 days.
Scrap shall not be sold on the site.
1.18 CARE OF DRAINS
Existing Visitor Center drains shall not be used for disposal of any solid material or any liquids other than clear water. Drains obstructed by the Contractor shall be cleaned by the Contractor. All costs incurred in the cleaning and clearing of plugged drains, shall be borne by the Contractor.
1.19 DUST CONTROL AND REMOVAL
Special measures shall be taken to minimize air-borne dust in work areas.
Dust shall not be allowed to accumulate about the Visitor Center in general. Return air ducts for heating, ventilating and air conditioning shall be blocked, where practicable, or equipped with filters in areas where dust is being produced or agitated. Removal of dust shall be by sweeping with dust wetted down or overlain with sweeping compound, or by vacuum cleaner as approved. Where air-borne dust in objectionable amount is unavoidable, equipment containing commutators, contactors, bearing, etc., shall be covered. Adequate air filters shall be provided in covers over equipment which requires circulation of air while operating. Dust shall be removed daily on a continuing basis during the life of this contract. Dust shall be removed as directed from the interior of equipment housed in cabinets by method approved by the Contracting Officer.
1.20 NOISE CONTROL
Noise control and noise levels shall conform to requirements set forth in the appropriate regulations, including EM 385-1-1, Section 05.C, 29 CFR 1910.95, 29 CFR 1926.52 and 29 CFR 1926.101. The most stringent requirement shall govern.

1.21 FIRE CONTROL
All fire fighting equipment, supplies, and personnel shall be supplied in accordance with EM-385-1-1. Delays due to fire will not be acceptable as the basis of a claim for additional compensation.
1.22 CONTRACTOR'S AGENT, WORK SUPERVISOR, AND PERSONNEL
1.22.1 Contractor's Agent(s)
The Contractor shall give personal attention to the faithful execution and completion of this work and shall be present either in person or by duly authorized representative(s) on the site of the work continually during its progress. The agent shall be fluent in the spoken and written English language. The agent's qualifications and identification shall be provided. The agent shall be fully authorized to act for the Contractor and to receive such orders as may be given for the proper continuance of the work. Written notice to do any work, to alter any work, or to cease work which the Contractor is obligated to do, or concerning any imperfections in work or any material furnished, when given to the agent shall be considered as notice to the Contractor. A daily log shall be made of the accomplished work, and shall be submitted at the completion of the contract. The agent shall have been engaged in similar work at a minimum of two different Visitor Centers. A verifying contact, with name and phone number, shall be provided for at least two such facilities.
1.22.2 Site Supervisor(s)
At least one full-time employee of the Contractor shall be available at the work site anytime other Contractor personnel are working on the site to supervise and direct the work specified herein. The Contractor's Agent and Site Supervisor can be the same person, provided that all qualifications are met. The supervisor(s) shall be fluent in the spoken and written English language. The supervisor shall be technically qualified to supervise the site work and commissioning and all other aspects related to completing this work. The supervisor shall report immediately in writing to the Government any work not in accordance with the manufacturer's recommendations, or any special conditions which may result in an unsatisfactory job. A daily log shall be made of the accomplished work, and shall be submitted at the completion of the contract.
1.23 PROJECT REPORTING
Weekly reports shall be submitted by the Contractor giving project status and activities information. An updated CPM should be included in this report, if appropriate. This report shall include a written summary, accompanied with detailed information relating to current status of procurement, construction, and delivery activities compared to both the current project schedules and the schedule submitted at the time of the Request for Technical Proposal.

SUMMARY OF WORK

PART 1 GENERAL
1.1 Summary Of Work
The work includes removal of the existing air conditioning system, installation of a new heat pump system, installtion of all electrical connections, install and programming of new thermostats, charging of the system and incidental related work as described throughout the specifications.
1.2 WORK COVERED BY CONTRACT DOCUMENTS
1.2.1 Project Description
The work includes installtion of a new heat pump system and incidental related work.
1.2.2 Location
The work shall be located at the Ft. Randall Dam Visitor Center, approximately as indicated. The exact location will be shown by the Contracting Officer.
1.3 OCCUPANCY OF PREMISES
Building(s) will be occupied during performance of work under this Contract.
Before work is started, the Contractor shall arrange with the Contracting Officer a sequence of procedure, means of access, space for storage of materials and equipment, and use of approaches, corridors, and stairways.
1.4 EXISTING WORK
In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":
a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.
b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.
1.5 SALVAGE MATERIAL AND EQUIPMENT
Items designated by the Contracting Officer to be salvaged shall remain the property of the Government.
The salvaged property shall be segregated, itemized, delivered, and off-loaded at the Government designated storage area located within 3 miles

SUBMITTAL PROCEDURES

PART 1 GENERAL

1.1 SUMMARY
The Contractor is responsible for total management of his work including approval, scheduling, control, certification of all submittals and compliance with all applicable Buy-American Act and Trade Agreement Act clauses. Compliance with all applicable Buy American Act and Trade Agreement Clauses is to be included in this review. The Contractor must provide the country of origin on ENG Form 4025 for each item submitted.
The Submittal Register (ENG Form 4288) will be utilized to log and monitor all submittal activities. No construction or installation activities are to be performed until required approvals of applicable submittals have been made. Check to assure that all materials and/or equipment have been tested, submitted and approved during the preparatory phase of quality control inspections.
The Contracting Officer may request submittals in addition to those specified when deemed necessary to adequately describe the work covered in the respective sections.
Units of weights and measures used on all submittals are to be the same as those used in the contract drawings.
Each submittal is to be complete and in sufficient detail to allow ready determination of compliance with contract requirements.
Contractor's Quality Control (CQC) System Manager shall check and approve all items prior to submittal; and stamp, sign, and date indicating action taken. Proposed deviations from the contract requirements are to be clearly identified. Include within submittals items such as:
Contractor's, manufacturer's, or fabricator's drawings; descriptive literature including (but not limited to) catalog cuts, diagrams, operating charts or curves; test reports; test cylinders; samples; O&M manuals (including parts list); certifications; warranties; and other such required submittals.
Submittals requiring Government approval are to be scheduled and made prior to the acquisition of the material or equipment covered thereby. Pick up and dispose of samples not incorporated into the work in accordance with manufacturer's Material Safety Data Sheets (MSDS) and in compliance with existing laws and regulations.
1.2 DEFINITIONS

Submittals are identified by Submittal Description (SD) numbers and titles as follows:
SD-01 Preconstruction Submittals
Submittals which are required prior to or the start of construction, includes schedules, tabular list of data, or tabular list including location, features, or other pertinent information regarding products, materials, equipment, or components to be used in the work.Unless otherwise designated, the submittals listed below will be handled as Administrative Submittals.

SD-02 Shop Drawings
Drawings, diagrams and schedules specifically prepared to illustrate some portion of the work.
Diagrams and instructions from a manufacturer or fabricator for use in producing the product and as aids to the Contractor for integrating the product or system into the project.
Drawings prepared by or for the Contractor to show how multiple systems and interdisciplinary work will be coordinated.
SD-03 Product Data
Catalog cuts, illustrations, schedules, diagrams, performance charts, instructions and brochures illustrating size, physical appearance and other characteristics of materials, systems or equipment for some portion of the work.
Samples of warranty language when the contract requires extended product warranties.

SD-06 Test Reports
Report signed by authorized official of testing laboratory that a material, product or system identical to the material, product or system to be provided has been tested in accord with specified requirements. (Testing must have been within three years of date of contract award for the project.)
Report which includes findings of a test required to be performed by the Contractor on an actual portion of the work or prototype prepared for the project before shipment to job site.
Report which includes finding of a test made at the job site or on sample taken from the job site, on portion of work during or after installation.
Investigation reports.
Daily logs and checklists.
Final acceptance test and operational test procedure.
SD-07 Certificates
Statements printed on the manufacturer's letterhead and signed by responsible officials of manufacturer of product, system or material attesting that product, system or material meets specification requirements. Must be dated after award of project contract and clearly name the project.
Document required of Contractor, or of a manufacturer, supplier, installer or Subcontractor through Contractor, the purpose of which is to further quality of orderly progression of a portion of the work by documenting procedures, acceptability of methods or personnel qualifications.
Confined space entry permits.
Text of posted operating instructions.
SD-08 Manufacturer's Instructions
Preprinted material describing installation of a product, system or material, including special notices and (MSDS)concerning impedances, hazards and safety precautions.
SD-10 Operation and Maintenance Data
Data that is furnished by the manufacturer, or the system provider, to the equipment operating and maintenance personnel, including manufacturer's help and product line documentation necessary to maintain and install equipment. This data is needed by operating and maintenance personnel for the safe and efficient operation, maintenance and repair of the item.
This data is intended to be incorporated in an operations and maintenance manual or control system.

SD-11 Closeout Submittals
Documentation to record compliance with technical or administrative requirements or to establish an administrative mechanism.
Special requirements necessary to properly close out a construction contract. For example, Record Drawings, special warranties, posted operating instructions, training plan and as-built drawings. Also, submittal requirements necessary to properly close out a major phase of construction on a multi-phase contract.
Interim "DD Form 1354" with cost breakout for all assets 30 days prior to facility turnover.
1.2.2 Approving Authority
Office or designated person authorized to approve submittal.
1.2.3 Work
As used in this section, on- and off-site construction required by contract documents, including labor necessary to produce submittals, except those SD-01 Pre-Construction Submittals noted above, construction, materials, products, equipment, and systems incorporated or to be incorporated in such construction.
1.2.4 Administrative Submittals
The submittal items listed below are not to be included on the Submittal Register (as discussed below). Unless directed otherwise by the Contracting Officer, the following administrative submittals are submitted to the Resident Office, for acceptance, via a Serial Letter: Submittal Register (this section), Quality Control Plans, Accident Prevention Plans (Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS, Revisions to Environmental Protection Plans and other submittals as directed by the Contracting Officer. Format for the Serial Letter is as directed by the Resident Office. Submit copies of administrative submittal items electronicly, unless directed otherwise.
1.3 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with this section.

1.4 ELECTRONIC SUBMITTALS
Electronic format will be utilized for submission of construction submittal items required by the specifications, including ENG Form 4025 Transmittal Form, with exceptions noted below.

1.4.1 Exceptions
Submit all SD-04 (Samples) submittals and other submittals, where noted in the specifications to be in physical, hard-copy form. Other known exceptions include: Operation and Maintenance Data/Manuals
1.4.2 File Format
Electronic submittals may be submitted by any means readily accessible to the Government including, but not limited to, the following:
a. E-mails with text and all attachments less than or equal to 14MB in size. The Government IT system does not currently support e-mail transmissions of greater than 14MB. Should this e-mail transmission size limitation change during the course of the Contract, larger e-mail transmissions may become acceptable, but no time extensions will be granted for transmission errors resulting from oversized email attachments.
b. Internet Secure File Transfer Protocol (FTP) systems compatible with Government IT systems.
c. Mailed CD-ROM or DVD-ROM media.
d. Contractor-funded file sharing website compatible with Government IT systems.
e. Any other secure, Government-approved means of transmitting digital media.
Means of transfer must provide documents freely accessible to the Government. If the means of transfer is by e-mail, FTP repository, or similar, files shall be capable of being downloaded without errors or disruption. Regardless of the method of transfer, the files shall be able to be archived on Government IT systems without error or restriction.
Once provided, all submittal documents shall become Government property.
ZIP-file or similar archives requiring a password for access to the archive are permissible provided the password for the archive is static, permanent, not use-limited, and provided to the Government at the time of transmission. Any individual files provided electronically to the Government in 'SECURED' format, password-protected, or utilizing any other such method of file restriction shall be deemed defective and returned to the Contractor for correction. Regardless of errors encountered during the electronic submittal process the Contractor shall be responsible for delays resulting from the inadequacy of media delivery method, file-formatting, or file restriction issues. No time extensions will be granted for delays resulting from improper file formatting, file restrictions, or inadequate file transfer methods.
Discussion and decisions on a consistent Means of transfer throughout the duration of the project will be made at the pre-construction conference.
The format of electronic submittals is Adobe Acrobat Portable Document Format (PDF), compatible with Adobe X, unless agreed to and directed otherwise by the Contacting Officer's Representative. For As-built drawings, see Section 01 78 39.00 24 AS-BUILT DRAWINGS.
1.4.3 Digital File Naming
Label and name electronic files delivered to the Government in a manner that is logical and consistent throughout the duration of the project. A file naming convention that clearly indicates the transmittal number, component of submittal, and revision number associated with the submittal
SECTION 01 33 00 Page 5 will be discussed and confirmed at the pre-construction kickoff conference.
1.4.4 Content
Submit one (1) set of readily copied and legible electronic documents and associated matching ENG Form 4025 Transmittal Form. Duplicate copies of electronic submittals are not desired. Content and format of the electronic submittal shall conform to all requirements listed herein. Delivery methods of both electronic and hard-copy submittals shall remain consistent throughout the duration of the Contract, in compliance with Contract specifications.
1.4.5 Delivery
Delivery of submittals will be similar to those described in the "SUBMITTAL ITEM PROCEDURES" paragraph below. Notifications of file transfers will be sent to the Government recipients listed below. The means of contact and notification by mail or email will be coordinated and confirmed at the pre-construction conference.
1.5 SUBMITTAL CLASSIFICATION
Submittals are classified as follows:
Unless directed otherwise, the words "Government Approval" associated with "G" designated submittals are interpreted in the context of the below defined submittal types. Submittal Reviewers include the following:
DO - District Office AE - Architect Engineer CR - Government Conformance Review DA - Designer of Record AO - Area Office or other designated Government Office RO - Resident Office
1.5.1 Government Approved [G]
Within the terms of the Contract Clause entitled, "Specifications and Drawings for Construction," they are considered to be "shop drawings."
1.5.2 Information Only
They are not considered to be "shop drawings" within the terms of the Contract Clause referred to above.
1.6 PREPARATION
1.6.1 Transmittal Form
Use the attached sample transmittal form (ENG Form 4025) for submitting submittals in accordance with the instructions on the reverse side of the form. These forms will be furnished to the Contractor. Properly complete this form by filling out all the heading blank spaces and identifying each item submitted. Exercise special care to ensure proper listing of the specification paragraph and sheet number of the contract drawings pertinent to the data submitted for each item.

1.7 INFORMATION ONLY SUBMITTALS
Normally submittals for information only will not be returned. Approval of the Contracting Officer is not required on information only submittals.
The Government reserves the right to require the Contractor to resubmit any item found not to comply with the contract. This does not relieve the Contractor from the obligation to furnish material conforming to the plans and specifications; will not prevent the Contracting Officer from requiring removal and replacement of nonconforming material incorporated in the work;
and does not relieve the Contractor of the requirement to furnish samples for testing by the Government laboratory or for check testing by the Government in those instances where the technical specifications so prescribe.
1.8 VARIATIONS
Variations from contract requirements require both Designer of Record (DOR) and Government approval pursuant to contract Clause FAR 52.236-21 and will be considered where advantageous to Government.
1.8.1 Considering Variations
Discussion with Contracting Officer prior to submission, after consulting with the DOR, will help ensure functional and quality requirements are met and minimize rejections and re-submittals. When contemplating a variation which results in lower cost, consider submission of the variation as a Value Engineering Change Proposal (VECP).
Specifically point out variations from contract requirements in transmittal letters. Failure to point out deviations may result in the Government requiring rejection and removal of such work at no additional cost to the Government.
1.8.2 Proposing Variations
When proposing variation, deliver written request to the Contracting Officer, with documentation of the nature and features of the variation and why the variation is desirable and beneficial to Government, including the DOR's written analysis and approval. If lower cost is a benefit, also include an estimate of the cost savings. In addition to documentation required for variation, include the submittals required for the item.
Clearly mark the proposed variation in all documentation.
Check the column "variation" of ENG Form 4025 for submittals which include proposed deviations requested by the Contractor. Set forth in writing the reason for any deviations and annotate such deviations on the submittal.
The Government reserves the right to rescind inadvertent approval of submittals containing unnoted deviations.
1.8.3 Warranting That Variations Are Compatible
When delivering a variation for approval, Contractor, including its Designer(s) of Record, warrants that this contract has been reviewed to establish that the variation, if incorporated, will be compatible with other elements of work.

1.8.4 Review Schedule Is Modified
In addition to normal submittal review period, a period of 20 working days will be allowed for consideration by the Government of submittals with variations.
1.9 SUBMITTAL REGISTER
Prepare and maintain submittal register, as the work progresses. Do not change data which is output in columns (c), (d), (e), and (f) as delivered by Government; retain data which is output in columns (a), (g), (h), and
(i) as approved. A submittal register showing items of equipment and materials for which submittals are required by the specifications is provided as an attachment. This list may not be all inclusive and additional submittals may be required. Maintain a submittal register for the project. The Government will provide the initial submittal register [in electronic format] with the following fields completed, to the extent that will be required by the Government during subsequent usage.
Column (c): Lists specification section in which submittal is required.
Column (d): Lists each submittal description (SD No. and type, e.g. SD-02 Shop Drawings) required in each specification section.
Column (e): Lists one principal paragraph in specification section where a material or product is specified. This listing is only to facilitate locating submitted requirements. Do not consider entries in column (e) as limiting project requirements.
Thereafter, the Contractor is to track all submittals by maintaining a complete list, including completion of all data columns, including dates on which submittals are received and returned by the Government.
1.9.1 Use of Submittal Register
Submit submittal register. Submit with QC plan and project schedule.
Verify that all submittals required for project are listed and add missing submittals. Coordinate and complete the following fields on the register submitted with the QC plan and the project schedule:

1.9.4 Contractor Action Code and Action Code
Entries for columns (j) and (o), are to be used are as follows (others may be prescribed by Transmittal Form):

1.9.5 Copies Delivered to the Government
Deliver one copy of submittal register updated by Contractor to Government with each invoice request.
1.10 SUBMITTAL ITEM PROCEDURES
1.10.1 Submittals
Except as noted below, all submittals are to be submitted electronicly.
Electronic Submittals and e-mail notifications of Electronic Submittals posted to AMRDEC SAFE or other FTP repositories should be sent to the contracting officer
Items not to be submitted in multiples, such as samples and test cylinders, are to be submitted to the Area or Resident Engineer (as directed), accompanied by three (3) copies of the transmittal form.
Hard Copy Drawings: Submit each required submittal, which is in the form of
SECTION 01 33 00 Page 9 a drawing, as three (3) prints of the drawing. Drawing prints are to be either blue or black line permanent-type prints on a white background or blueprint and shall be sufficiently clear and suitable for making legible copies.
Catalog cuts and other descriptive data which have more than one model, size, or type or which shows optional equipment must be clearly marked to show the model, size, or type and all optional equipment which is provided. Submittals on component items forming a system or that are interrelated are to be submitted at one time as a single submittal in order to demonstrate that the items have been properly coordinated and will function as a unit.
1.10.2 Government Approved (G-AO/G-RO) and FIO Submittals
Except as noted below, data for all Government Approved submittal items are to be submitted electronicly to the contracting officer or Area Enginner (as Directed). All copies are to be submitted using the transmittal form 4025. Items not to be submitted in multiples, such as samples and test cylinders, are to be submitted to the contracting officer or Resident Engineer (as directed)accompanied by three (3) copies of the transmittal form.
Except as noted below, data for all items listed as "FIO" Submittals in the various sections are to be submitted electronicly to the contracting officer. Items not to be submitted in multiples, such as samples and test cylinders, are to be submitted to the Contracting Officer or Resident Engineer (as directed) accompanied by three (3) copies of the transmittal form.
All submittals must be reviewed and approved by the Contractor's Quality Control Representative prior to submittal to the Government.
The Government has the option to review any For Information Only submittals.
1.10.3 Certificates of Compliance
Each certificate must be signed by an official authorized to certify in behalf of the manufacturing company and contain the name and address of the Contractor, the project name and location, and the quantity and date or dates of shipment or delivery to which the certificates apply. Copies of laboratory test reports submitted with certificates must contain the name and address of the testing laboratory and the date or dates of the tests to which the report applies. Certification is not to be construed as relieving the Contractor from furnishing satisfactory material, if, after tests are performed on selected samples, the material is found not to meet the specific requirements.
1.10.4 Purchase Orders
Copies of purchase orders are to be furnished to the Contracting Officer when the Contractor requests assistance for expediting deliveries of equipment or materials, or when requested by the Contracting Officer for the purpose of quality assurance review. Each purchase order issued by the Contractor or his subcontractors for materials and equipment to be incorporated into the project are to (1) be clearly identified with the applicable DA contract number, (2) carry an identifying number, (3) be in
SECTION 01 33 00 Page 10 sufficient detail to identify the material being purchased, (4) indicate a definite delivery date, and (5) display the DMS priority rating, if applicable.
1.10.5 Operation and Maintenance Data/Manuals
Where required by various technical sections, operations and maintenance data/manuals are to be provided by the Contractor in three (3) hard copy and one (1) separate electronic copy submitted electronicly, unless directed otherwise. Provide legible hard copies of the operations and maintenance data that are assembled in three-ring binders with index and tabbed section dividers and having a cover indicating the contents by equipment or system name and and include the project title and location.
The legible electronic copies of the operation and maintenance data are to be in a Adobe Acrobat .PDF format (Version 9.0) and be organized using bookmarks that define the contents by equipment or system name and includes Project Name and Location, unless directed otherwise by the Contracting Officer. Operation and maintenance data for mechanical and electrical systems are to be submitted for approval to the Contracting Officer 10 days prior to final tests of these systems, unless otherwise specified. Each operation and maintenance manual must contain a copy of all warranties and a list of local service representatives required by Section 01 78 36.00 24 WARRANTY OF CONSTRUCTION. If field testing requires these copies to be revised, they are to be updated and resubmitted for approval within 10 calendar days after completion of tests. In addition, all wiring and control diagrams and approved system layout drawings must be submitted and included with the O&M Data.
1.11 SCHEDULING
Schedule and submit concurrently submittals covering component items forming a system or items that are interrelated. Allow a minimum of 20 calendar days exclusive of mailing for any Government reviews and approvals, unless directed otherwise. Include certifications to be submitted with the pertinent drawings at the same time. No delay damages or time extensions will be allowed for time lost in late submittals.
a. Coordinate scheduling, sequencing, preparing and processing of submittals with performance of work so that work will not be delayed by submittal processing. Allow for potential resubmittal of requirements.
b. Submittals called for by the contract documents will be listed on the register. If a submittal is called for but does not pertain to the contract work, the Contractor is to include the submittal in the register and annotate it "N/A" with a brief explanation. Approval by the Contracting Officer does not relieve the Contractor of supplying submittals required by the contract documents but which have been omitted from the register or marked "N/A."
c. Re-submit register and annotate monthly by the Contractor with actual submission and approval dates. When all items on the register have been fully approved, no further re-submittal is required.

d. Carefully control procurement operations to ensure that each individual submittal is made on or before the Contractor scheduled submittal date shown on the approved "Submittal Register."
1.12 GOVERNMENT APPROVING AUTHORITY
When approving authority is Contracting Officer, the Government will:
a. Note date on which submittal was received.
b. Review submittals for approval within scheduling period specified and only for conformance with project design concepts and compliance with contract documents.
