11.1 VOLUME 1, TAB B – FACTOR 1 – Past Performance (Confidence Assessment)

There are three (3) aspects to the past performance evaluation: recency, relevancy (including context of data), and quality (including general trends in contractor performance and source of information). In accordance with FAR 15.305(a)(2), the currency and relevance of the information, source of the information, context of the data, and general trends in contractor's performance shall be considered. Relevance and quality of performance will be combined to establish one performance confidence assessment rating for each Offeror.

11.1.1 Submission Requirements

The prime contractor and designer of record design firms shall each demonstrate recent, relevant experience on similar projects.

A “contract” is defined as a single stand-alone contract or a single task order performed under a MATOC (Multiple Award Task Order Contract)/SATOC (Single Award Task Order Contract)/IDIQ (Indefinite Delivery Indefinite Quantity Contract). MATOCs/SATOCs or any other type of task-order contracts that provide for the issuance of orders for the performance of tasks will not be considered projects for the purposes of this evaluation; only individual task orders issued under such contracts or stand-alone contracts will be evaluated as projects.

All references herein to “the Offeror” includes all proposed joint venture partners as one Offeror. If the Offeror is a Joint Venture (JV) and the JV does not have experience working as a JV, one of the JV partners may submit experience on behalf of “the Offeror”. Submitted contracts by members of a joint-venture or from the joint-venture itself will be considered and evaluated.

Only relevant construction projects will be considered for evaluation. For purposes of this evaluation, to be considered a relevant construction project, the project must possess the following features:

1) It must be a new, repair, or renovation construction project. The types of construction may include, but are not limited to, civil, architectural, mechanical, electrical, security, correction of safety concerns, asbestos and lead abatement, and structural.

2) The contract amount (after any modifications) is $25M or greater.

3) It must be a recent contract. A recent contract is defined as at least 80% complete or turned over within the past eight (8) years preceding the issuance date of this RFP. Evidence of substantial completion from the contracting agency, or a CPARS rating must be included in the proposal in order for a contract to be considered relevant.

4) It must be awarded to the Offeror as the prime contractor.

11.1.1.1 Construction Past Performance Requirements

The Offeror shall use Attachment A, Construction Project Information Sheet to submit a minimum of three (3) but no more than five (5) relevant Construction projects for the prime contractor (whether single entity or joint venture). At least one (1) of the relevant projects must be design-build. If more than five (5) projects for Construction are submitted, only the first five (5) projects will be considered for Construction Past Performance evaluation. Any additional projects will not be considered for evaluation regardless of whether or not the first five projects are classified as “relevant” or “not relevant” by Government evaluators. Offerors should describe each project with enough detail to ensure that the Government can meaningfully assess the projects against the evaluation criteria described in this solicitation. The offeror shall identify the design firm(s). If projects were design-build, identify them as such. The information in Attachment A includes, but is not limited to, the following contract information:

a. Contract title, contract number, and location.

b. Contract type (for example, Indefinite-Delivery, Indefinite-Quantity task order; Design/Build; Design- Bid-Build; Firm Fixed-Price; Cost Plus, etc.)

c. Total dollar award amount, and the total dollar amount at completion of the contract.

d. Start and completion dates (month/year) or percentage until complete to include actual completion date (month/year).

e. Role of Offeror, provide a detailed description (address type of work self-performed, to include design, and percentage and type of self-performed work, as applicable for each team member, and type of work sub-contracted out)

f. Brief description of contract and how it relates to this solicitation. (For example: involved structural assessments and retrofit construction; located in remote area with logistical challenges; required temporary workforce camp, etc.)

g. Customer primary Point of Contact (POC) and alternate POC (name, relationship to the contract [Administering Contracting Officer / Contracting Officer Representative, etc.], agency/firm affiliation, city, state, current phone number, and e-mail address).

h. Awards or recognition received, where applicable.

Limit proposals to a maximum of 10 pages (2 pages per project) for Construction Past Performance. Any pages over this limit will not be considered for evaluation.

11.1.1.2 Design Past Performance Requirements

The Offeror shall use Attachment B, Design Project Information Sheet to submit a minimum of three (3) but no more than five (5) relevant Design projects for the design firms and consultant, if applicable. At least one (1) of the relevant projects must be design-build. If more than five (5) projects for Design are submitted, only the first five (5) projects will be considered for Design Past Performance evaluation. This is regardless of whether or not the first five projects are classified as “relevant” or “not relevant” by Government evaluators.

Offeror shall limit proposals to a maximum of 10 pages (2 pages per project) for Design Past Performance. Any pages over the limit will not be considered for evaluation.

Only relevant design projects will be considered for evaluation. For purposes of this evaluation, to be considered a relevant design project, the project must possess the following features:

1) It must be for design of a construction project, in which the construction cost was estimated to be $25 million or greater.

2) It must be for design in support of renovation and/or new construction to rehabilitate existing facilities and/or new construction of buildings or facilities;

4) The proposed designer shall have been the lead designer for the project submitted.

If the Offeror accomplished both design and construction for a Design-Build project which meets both the relevancy criteria for Construction Past Performance and Design Past Performance, the offeror may submit both Attachment A and B for the same project.

11.1.2 Performance Assessment

For each of the projects submitted for Design and Construction, the Offeror shall provide a copy of the Contractor Performance Assessment Reporting System (CPARS) report. If CPARS does not exist please provide a Past Performance Questionnaire (Attachment C, Form PPQ-0) to a representative of the owner who can provide the owner’s opinion of the offeror’s past performance for the project. The Past Performance Questionnaire included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 1, Past Performance. Completed PPQ-0 forms should be submitted with your proposal. A copy of a previously completed PPQ can be submitted if it reflects a substantially complete evaluation of the project. The PPQ-0 does not have to be sent directly from the client. If the offeror is unable to obtain a completed PPQ-0 from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ-0, which will provide contract and client information for the respective project(s).

Ensure correct phone numbers and email addresses are provided for the client point of contact. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Merbby Nicolas, Contract Specialist, via email at Merbbyjoyce.n.nicolas@usace.army.mil prior to proposal closing date. The offeror is responsible for ensuring that the completed questionnaires are submitted by the closing date. If you have questions regarding the attached questionnaire, or require assistance, please contact the Contract Specialist at (808)835-4378.

The Government will evaluate the responses from the customers from which Past Performance Questionnaires have been received. The Government may contact and interview the owner’s representative on the PPQ-0 and reserves the right to interview other individuals acting for the owner’s representative if the owner’s representative is not available.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Past performance information may be obtained from any other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Contractor Performance

Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency. The information obtained from these sources will be evaluated supplementary to the past performance questionnaires. In reference to the contracts pulled from these sources, the relevancy of the projects, completion dates, ratings and comments in the individual categories and overall ratings will be considered in making the overall confidence assessment.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

An Offeror will not receive credit for relevant and recent past performance of a parent, affiliate or separate division.

An Offeror may receive credit for relevant past performance under a previous business arrangement (joint venture or teaming agreement for example) if the Offeror demonstrates that its role or the parent, affiliate or separate division role on the submitted project is relevant to the role it proposes to perform on this project.

At no time during this process, nor during the debriefing, nor after award, will the names of the individuals providing reference information about an offeror’s past performance be revealed to the offerors or to any other party. If discussions are held, offerors may be afforded the opportunity to respond to adverse comments made by references in accordance with guidelines identified in FAR Part 15.3. In this case, comments will be extracted and provided to the offeror. Copies of the questionnaires will not be furnished to the offeror and will remain confidential.

11.1.3 Evaluation Method

The past performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying design, construction, and/or design-build services that meet the contract’s requirements.

The evaluation method that the Government will use with respect to Factor 1 – Past Performance is detailed below.

11.1.3.1 The first aspect is to evaluate the recency of the offeror’s past performance. For this solicitation, recent projects are those completed or substantially completed as defined in Para. 11.1.1 above.

11.1.3.2 The second aspect is to determine how relevant a recent effort accomplished by the offeror is to the work required by this solicitation. The projects will include those submitted as well as from other sources described above.

This relevancy rating is not a separate proposal rating but is only used in developing overall past performance confidence assessment rating assigned to the Past Performance Factor. With respect to relevancy, past performance on projects with more relevance will typically be a stronger predictor of future success and have more influence on the past performance confidence assessment rating than past performance on projects of lesser relevance. There are four (4) levels of relevancy as shown in the Table below. Each submitted project will be assigned one of the levels of relevancy shown in Table 1 below.

Table 1. Past Performance Relevancy Rating Method

In determining the relevancy of each submitted project, the Government will consider the requirements listed in Para. 11.1.1.1 and Para. 11.1.1.2 above.

Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

11.1.3.3 The third aspect of the past performance evaluation is to establish the overall quality of the offeror's past performance (see FAR 15.304(c)(2)). The past performance evaluation conducted in support of a current source selection does not establish, create, or change the existing record and history of the offeror's past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts. The Government will review all collected past performance information and determine the quality of the offeror's performance, general trends, and usefulness of the information and incorporate these into the performance confidence assessment.

11.1.3.4 A final Performance Confidence Assessment rating will be given for this factor based on the assessment of recent and relevant past performance information and the assessment of the quality of past performance on prior contract efforts. The Government will review the past performance information and determine the quality and usefulness as it applies to the Performance Confidence Assessment. The rating for this factor will be expressed as a degree of confidence in the offeror’s ability to successfully accomplish the contract requirements. In conducting a performance confidence assessment, each offeror shall be assigned one (1) of the ratings using the Table 2 below.

Table 2. Performance Confidence Assessments

Rating Definition Substantial Confidence

Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence

Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Unknown Confidence (Neutral)

No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

11.1.3.5 In the case of an offeror without a record of relevant past performance or for which information on past performance is not available, the offeror may receive a “Neutral Confidence” rating which is neither favorable nor unfavorable; it is considered neutral (see FAR 15.305(a)(2)(iv). The SSAC (if applicable) may recommend and the SSA may determine, that a “Substantial Confidence” or “Satisfactory Confidence” past performance rating is worth more than a “Neutral Confidence” past performance rating in a best value tradeoff as long as the determination is consistent with stated solicitation criteria.

11.2 Volume 1, TAB B – Factor 2 – Management Plan

11.2.1 Submission Requirements

The Offeror shall submit a Management Plan describing the Offeror’s approach to performing this task order contract.

The Plan shall clearly, but concisely detail the organizational approach to program management and execution and explain how the firm expects to handle multiple major projects at multiple locations under the contract. The plan shall include an organizational chart outlining the entities responsible for program execution. The plan shall describe the proposed management structure for the Offeror, describing how the design and construction process will be managed and the authorities and the delegations of authority within the Offeror’s organization. It shall describe how communications within the organization and with the Corps of Engineers will be conducted. Limit the Factor 2 Management Plan to twelve (12) pages or less (using a font size of no smaller than 10 pt.). Of the 12 pages, one (1) single-sided no larger than 11”x17’, folded to 8-1/2”x11”. Any pages over the prescribed limit will not be considered for evaluation. A page is defined as text or information on one side of the paper. If it is printed double-sided, each face will be counted as a page.

11.2.2 Evaluation Criteria

The evaluation will consider the content of each offerors' Management Plan and will assign strengths, weaknesses, and/or deficiencies based on how well each offeror's Management Plan demonstrates the following:

1. Organizational chart graphically represents the offeror’s organization in regard to other partnering firms/subcontractors/internal personnel and clearly indicates the name of the management team member (partnering firm/subcontractor/internal personnel).

2. Organizational Chart shows clears lines of authority among team members.

3. Organizational chart demonstrates the following information about all firms in the

Offeror’s team, including partnering firms and subcontractors: the role/responsibility for Design Build projects AND any contractual arrangements that have been established (Project Manager, AE Design Manager,…
