(AM-0003)

For each Relevant Contract submitted as defined under Para 2.5.1 above, a Contract Data Sheet shall be completed. This sheet is included as Attachment 1 to this section. All requested information must be provided. Failure to provide any of the requested data may be cause to eliminate a contract from consideration in the evaluation. Only the form provided as Attachment 1 will be accepted. Data submitted in any other format will be eliminated from consideration.

The Offeror shall provide a narrative description of each relevant contract included in its proposal the Contract Data Sheet. The narrative shall clearly explain how the contract fulfills the experience for which it is being submitted. No more than five (5) pages shall be submitted for each contract, including the Contract Data Sheet and any continuation pages. Pages exceeding this 5-page limit will not be considered. The Offeror must demonstrate the ability to obtain a minimum of bonding amount of $500,000 per single contract and $2M aggregate for all contracts.

Offerors experience will be evaluated based on recent relevant experience in contracts. The Government will evaluate the extent of recent, related experience, degree of relationship of such experience to the varied types of work that can be anticipated under this contract, and demonstrated familiarity with applicable codes and local conditions. The Government will place greater value on projects performed as a prime contractor than as a subcontractor, depending upon overall role and relevancy considerations. Some examples of relevancy may include, but are not limited to:

(1) type of work (e.g., office building, barracks, warehouses, housing, hangars, road work, site improvement, etc.)

(2) type of specification (design-build or design-bid-build)

(3) complexity of work and diversity of construction experience (more complex levels and greater diversity may be rated as lower risk)

(4) size of previous contracts (higher dollar values may be rated as lower risk)

(5) Dates (completed or substantially complete on or after 1 July 2004)

(6) Offerors role (prime contractor or subcontractor) and extent of work self-performed

The bonding capability will be evaluated to determine risk of performance.

2.5.2.1 Evaluation Standards

Excellent The Offeror provided relevant projects which included design bid build and design build projects. Projects identified shows the Offeror has strengths that will significantly benefit the Government. The proposal contains no significant weaknesses or deficiencies and presents overall very low risk that it will not be successful.

Good The Offeror provided relevant projects which included design bid build and design build project. Projects identified shows the Offeror has strengths that will benefit the Government. Any weaknesses noted in the proposal are minor and should not seriously affect the Offeror’s overall performance and presents low risk that it will not be

SECTION 00900

RESPONSES TO QUESTIONS

SUBMITTED BY PLANHOLDERS

FOR

RFP NO. W9128A-09-R-0015

Q6. We will be submitting under a Mentor/Protégé Agreement rather than as a Joint Venture.

The 8a Protégé will submit maximum of 3 relevant contracts. Will the Non-8a Mentor be allowed to submit a maximum of 3 relevant contracts as is allowed for joint venture submissions under the above?

A6. See Section 000120, page 00120-5, para 2.5.1, 2nd sentence "For a contract to be considered relevant, the contract must have been awarded to the Offeror and have been declared substantially complete between 01 Jul 2004 and the closing date of this solicitation."

Q7. Can a company with headquarters in CA and no permanent office set up in Hawaii compete for this MATOC?

A7. See Section 00010, page 00010-4, Note 2.

Q8. If a proposer plans to submit a former USACE project on the included Performance Evaluation Questionnaire (Attachment 2), who will the evaluation team accept as an appropriate evaluator to complete the questionnaire on behalf of the client (e.g., the Contracting Officer for the project, the Project Manager, or the project's end user (USACE's customer))?

A8. See Section 00120, page 00120-9, para 2.5.3.

Q9. Is the "Received" signature line under Part B of the Performance Evaluation Questionnaire (Attachment 2) in the RFP for signature from this solicitation's Contracting Officer (ie. Kent Tamai) or from the Contracting Officer on the specific project being evaluated?

A9. The Respondent of the questionnaire.

Q10. Would you kindly clarify as to what would happen if a firm is currently in the 8a program and is awarded the project, but will be graduated at any given time after contract award?

A10. See AM-0003, Section 00010, page 00010-4, Note 4.

Q11. On the proposal schedule, page 00010-3, we are required to provide rates per manday for the position of Project Engineer, QC Representative and Site and Safety Health Officer. Shall the rates include burden such as taxes (e.g. FICA, medicare, FUTA, SUTA, etc) , work compensation insurance and health insurance? Should un-mandated benefits such as vacation, sick and holiday pays also be included? Should the rate also include tools needed for the position such as trucks, cell phones & other miscellaneous items directly attributed to the position.

A11. See AM-0003, Section 00010, page 00010-4, Note 5.

W9128A-09-R-0015 00900-3

Q12. On page 00010-3, shall we include bond premiums and GE taxes on the Home Office Overhead Rate?

A12. See AM-0003, Section 00010, page 00010-4, Note 5.

Q13. We are inquiring if there are any limitations of submitting as a Teaming, Joint Ventures or Mentor Protégé for solicitation W9128A09R0015?

A13. Yes. See Section 00120, page 00120-5, para 2.5.

Q14. Is the Form DD2846 (Contractor Performance Assessment Report) acceptable for Performance Acceptance on a project? This is a form issued by the Air Force.

A14. See Section 00120, page 00120-9, para 2.5.3.

Q15. I respectfully request consideration be given to include in the Solicitation text provision DFAR 252.226-7001 Utilization of Indian Organizations, Indian-Owned Economic Enterprises, and Native Hawaiian Small Business Concerns.

A15. See Section 00700, page 00700-155.

Q16. 2nd paragraph on page 00120-6 states to provide a narrative description of each relevant contract in addition to the Contract Data Sheet. And this narrative shall clearly explain how the contract fulfills the experience for which it is being submitted. This appears to be the same thing that’s being asked for on the 2nd page/3rd part of the Contract Data Sheet. Are we providing something different than what’s already asked for in the Contract Data Sheet, or merely continuing the information in the Contract Data Sheet if more space/sheet is needed?

A16. See AM-0003, Section 00120, page 00120-6, 2nd paragraph, 1st sentence, "in addition to" has been deleted.

Q17. For the technical proposal, it states to include evaluations under tab 2 for past experience.

However, on the contract data sheet it states to include any evaluations in the same tab which would be tab 1 for experience. Does the government want 2 copies of the evaluations?

A17. See AM-0003, Section 00120, page 12 of 16.
