About this file

This is a Government Responses to Industry Questions document for a Request for Quotation (RFQ) for HVAC maintenance services at the Estate Bethlehem Military Compound in St. Croix, USVI.

The Virgin Islands National Guard is seeking a small business contractor to provide monthly preventative maintenance and corrective repairs for approximately 68 HVAC systems across eleven facilities at Estate Bethlehem. The contract consists of a 12-month base year plus two 12-month option years, with performance beginning September 29, 2026. Services include routine maintenance tasks such as filter replacement, coil cleaning, refrigerant leak detection, and system inspections conducted Monday through Friday, 8:00 AM to 5:00 PM. The RFQ includes fixed-price CLINs (0001, 0002, 1001, 1002, 2001, 2002) for monthly maintenance services organized into Group 1 and Group 2 facilities based on federal ownership designations, and cost-reimbursable CLINs (0003, 1003, 2003) for corrective repairs not to exceed $10,000 annually per year, with a $5,000 limit for a 6-month extension. Corrective repairs are limited to minor repairs only; major equipment replacements are excluded. The contractor must be EPA Section 608-certified and Virgin Islands-licensed, comply with prevailing wage requirements under the Service Contract Act, and submit monthly maintenance reports and invoices within specified timeframes. Critical clarifications addressed in the Q&A include confirmation that refrigerant recharge and leak repair constitute corrective repairs under the NTE, that the $10,000 annual corrective repair limit may be modified if insufficient, that freight and expedited shipping are allowable costs, and that warranty callbacks due to defective parts will not affect contractor performance ratings. The Government does not provide OEM software licenses or subscriptions and does not maintain a current equipment condition record; the contractor's initial site survey serves as the baseline condition document.

Question
No.Document TypeSection No.Page No.Contractor QuestionGovernment ResponsePWS or RFQ Changes
1General QuestionN/AN/AIs this a new requirement or a recompete? If an incumbent contractor currently maintains these systems, please identify the incumbent contract number and value. This is a new requirement. As such, there is no current contract number or incumbent. No
2General QuestionN/AN/AIf the systems are currently maintained in-house or are unmaintained, please state the date of the last preventive maintenance performed on each system. Most of the systems have not had any regular/routine maintenance in more than a year.No
3RFQCLINs 0003/1003/20034-7CLINs 0003/1003/2003 are designated 'Cost No Fee.' Please confirm (a) allowable cost on these CLINs includes direct labor at actual paid rates, fringe, payroll taxes, overhead and G&A in accordance with FAR Part 31 and DFARS 252.231-7000, plus material at invoice cost including freight to St. Croix and material handling; (b) no fee or profit may be earned on corrective repairs; and (c) whether the Government will consider restructuring these CLINs as Time-and-Materials with fixed loaded labor rates and a parts allowance, which is the customary arrangement for HVAC corrective repair services and avoids a cost-reimbursement accounting burden that is disproportionate to a $10,000 line item.As the repairs conducted under the Corrective Repairs CLIN are to only be minor in nature, the labor, fringe, payroll taxes, overhead, and G&A for the repair work should be included in the FFP CLINs. These repairs should occur during normal business hours while the technicians are on site performing the monthly maintenance. No
4RFQOption CLINs4-7FAR 52.222-43 permits price adjustment for Wage Determination revisions in option periods. Please confirm (a) FFP CLINs 1001, 1002, 2001 and 2002 and the 6-month extension will be adjusted upon each new WD revision, and (b) there is no other escalation mechanism for material, refrigerant, or freight cost increases over the 42-month term. If none, offerors must price escalation risk into the option years.(a) Reviewing the WD annually is standard practice prior to exercising an option. If the WD has been updated since the contract was awarded, or since the last option was exercised, the updated WD will be included in the exercised option.
(b) Correct, there is no escalation mechanism for material, refrigerant, or freight cost increases over the term of the contract. Offerors should inlcude anticipated cost escalation in their FFP price. No
5RFQCLINs 0003/1003/20034-7For corrective repairs performed outside the 08:00-17:00 Monday-Friday hours in PWS 1.4.1 at the Government's request, please confirm that overtime and premium labor required under the Wage Determination and the Fair Labor Standards Act is an allowable cost under CLIN 0003.Corrective repairs are not to be performed outside normal duty hours. At the contractor's request and expense, the government may authorize work outside of the normal business hours. No
6RFQSec. E9-12Section E requires PWS compliance to be verified before invoice acceptance, and Section G requires an Invoice 2in1 for the FFP CLINs. Please confirm the monthly maintenance report (Deliverable #8, due 20 days after completion of service) is the acceptance document for the monthly FFP invoice, and that the invoice may be submitted upon completion of the month's service rather than after the 20-day report window. The note in section E is for the customer (CFMO), not the contractor. It is incumbent on the CFMO to verify that services were performed in accordance with the PWS prior to accepting an invoice. The CFMO should discuss with the awardee what that verification process looks like.No
7RFQFAR 52.219-14(f)(1)28FAR 52.219-14(f)(1) contains two Contracting Officer check boxes designating the period for measuring compliance with the limitations on subcontracting; neither box is checked. Please indicate which applies.Fill-ins completed.Yes

RFQ clause 52.219-14 8 RFQ FAR 52.222-42 Statement of Equivalent Rates for Federal Hires 29 FAR 52.222-42 is included in full text, but the Employee Class / Monetary Wage-Fringe Benefits table is blank. Please complete the table or confirm the occupation classes the Government anticipates for this contract (e.g., 23410 HVAC Mechanic; 23370 General Maintenance Worker; 23580 Maintenance Trades Helper). Fill-ins completed. Yes RFQ clause 52.222-42

9RFQSec. L 3.2; Sec. M (a)(2)p. 46; p. 50Sections L and M state that any CPARS rated Marginal or below 'for similar services' in the last five years renders past performance unacceptable. Please define 'similar services' - is the evaluation limited to HVAC or mechanical maintenance CPARS, or does it include construction contract CPARS? Please also confirm that offerors without HVAC service CPARS may submit up to five past performance references, including commercial contracts, for consideration.Similar services would be any HVAC related service. If an offeror does not have any HVAC related CPARS, they may submit PP references for similar services whether they be local, State, or commercial services as long as they are HVAC related. No
10Price TableNotes to Offerors 2; RFQ Sec. B CLINs 0003/1003/2003Price Table; RFQ pp. 4-7The Price Table locks the Corrective Repairs Not-to-Exceed (NTE) at $10,000 per contract year (CLINs 0003, 1003, 2003) and $5,000 for the 6-month extension - $35,000 total over 42 months - and directs offerors not to propose any other value. Technical Exhibit 3 lists 64 HVAC systems totaling approximately 605 tons, including three 40-ton York units (RTI), 40-ton and 35-ton York units and a 30-ton Trane unit (JFHQ), three 20-ton Trane units (LTC LAJ Readiness Center), and six 15-ton units, all operating in a marine salt-air environment. A single compressor replacement on one 20-40 ton commercial unit - parts, refrigerant, freight to St. Croix, and SCA-rate labor - can readily exceed $10,000 by itself. Material alone will consume the annual NTE almost immediately. What is the Government's basis of estimate for the $10,000 annual NTE? Please provide the actual corrective repair expenditure on these systems for the last three fiscal years. The Corrective Repairs CLIN is not intended for major repairs or replacements. Updates have been made to the PWS to clarifiy what the Corrective Repairs CLIN is to be utilized for. Major repairs or full replacement of units will not occur under this contract. Also, the Government does not provide the basis of estimate for requirements as this is considered sensitive information and is not released to Offerors.Yes

PWS para. 5.5.3

11Price TableNotes to Offerors 2; PWS 5.5Price Table; PWS p. 10Once the $10,000 annual NTE is exhausted - which could occur on the first major failure - what is the contractual mechanism to continue corrective repairs? Please confirm: (a) whether the $10,000 is funded at award or is only an evaluation figure; (b) that the Contracting Officer will issue a modification adding funds before further repairs are required; and (c) that the contractor has no obligation to respond to or perform corrective repairs, and will not be assessed against the PRS (TE 1, item 5.5.1), once the available NTE is exhausted. As this is a new requirement that is not currently under contract, the Government used the $10,000 figure as our best estimate of minor repairs needed for this requirement. If, in the course of the base year of performance, this figure proves to be too low, the Government may increase funding to this line item and re-assess the amount of funding for the option years as well. Increased funding or a change in the amount for option year CLINs will be executed via contract modification. No
12Wage DeterminationOccupation 23410; Fringe Benefits5 and 8The mandated Wage Determination sets the HVAC Mechanic (23410) rate at $21.48/hr plus $5.92/hr Health & Welfare, plus paid vacation and eleven paid holidays - a fully burdened minimum of approximately $27.40/hr before payroll taxes, insurance, overhead and profit. Market wages for the EPA Section 608-certified, Virgin Islands-licensed technicians required by PWS 1.4.7 exceed the WD minimum. At mandated labor rates plus material and freight, the $10,000 NTE covers only a small number of labor hours per year across 64 systems. Did the Government's estimate for the corrective repair NTE account for SCA-mandated labor cost at these rates? Please confirm the Government will re-evaluate the NTE in light of the mandated wage rates.See answer to question 3 above. No
13Wage DeterminationHealth & Welfare8The Wage Determination lists two Health & Welfare rates: $5.92/hr, and $5.42/hr for contracts subject to EO 13706 (Paid Sick Leave). FAR 52.222-62 is incorporated in Section I. Please confirm the $5.42/hr rate applies, with paid sick leave accrued separately under EO 13706, so that all offerors price fringe on the same basis.FAR 52.222-62 and EO 13706 apply to this contract. No
14PWS1.2; 5.01 / 8-10PWS 1.2 states the systems include building automation systems (BAS), but PWS 5.0 contains no BAS requirements. Please identify the BAS platform(s) installed and confirm whether BAS/controls calibration, programming, software licensing, or troubleshooting is within scope, and if so under which CLIN.There is a BAS at the RTI building and the JFHQ building. The contractor is not required to work on the BAS. The contractor must ensure its work does not disrupt the connection to the system. No
15PWS1.4.5.13PWS 1.4.5.1 requires DD369 police record checks with a stated validation time of one to four weeks, plus AT Level 1, iWATCH and OPSEC training. The period of performance begins 29 September 2026 - four days after quotes are due - and PWS 5.1 requires the site survey within five days of award. How will the Government handle the gap between award and installation access? Please confirm the period of performance start date will be adjusted, or that the contractor will be excused from performance and PRS measurement until access clearances are granted. The contractor will submit the DD 369, as required. The contractor will submit a list of personnel and coordinate with CFMO for escorted access to conduct the site survey. Should the contractor require further access prior to completion of security requirements, coordination will be made with CFMO.No
16PWS1.4.3; 1.4.43PWS 1.4.4 references the Government's Quality Assurance Surveillance Plan (QASP). Please provide the QASP with the solicitation or confirm it will be furnished at award, since the contractor's Quality Control Plan (Deliverable #1) is due 10 days after award and must align with the QASP.The Government's QASP is an internal document not meant for distribution to Offerors, however, Technical Exhibit 1 (PRS table) is the standard used in the QASP for surveillance. No
17PWS5.18If the initial site survey and inspection under PWS 5.1 identifies units in failed or deficient condition, please confirm (a) the Government will fund those repairs separately from, or in addition to, the $10,000 NTE, and (b) the contractor will not be held responsible under the PRS for pre-existing deficiencies documented in the site survey report (Deliverable #7).The site survey is to establish a baseline for the maintenance of the units. The government will make a determination on funding after the site survey report has been received and reviewed. No
18PWS5.2.1 and 5.2.59PWS 5.2.5 requires all materials and parts for maintenance to be included in the FFP monthly price, and PWS 5.2.1 requires replacement of filters and belts on a monthly basis. Across 64 systems that is a minimum of 768 filter change-outs per year, many on 15-40 ton air handlers with multiple filter banks. Please provide filter sizes, quantities per unit, and the required MERV rating, and belt sizes for all belt-drive units. Alternatively, please confirm 'replace filters and belts' means inspect monthly and replace at the OEM-recommended interval rather than mandatory replacement every month. The government is aware that not every filter and belt will need to be replaced every month. The government is also aware that the OEM recommended interval is not always applicable in this environment. The monthly requirement is a guide and a common basis for all contractors to develop their pricing. The government has provided a separate document with the size, make and model of the units and common sizes of filters that are used.No
19PWS5.2.1 (refrigerant leaks)9PWS 5.2.1 lists 'check and repair refrigerant leaks' as a monthly preventive maintenance task included in the FFP price. Leak repair, refrigerant recovery and recharge are corrective repairs, and a full charge on a 30-40 ton unit can cost several thousand dollars. Please confirm that leak repair and refrigerant replacement are corrective repairs chargeable to CLIN 0003 upon COR authorization and are not included in the FFP monthly price, and that the FFP price covers leak detection only. The government concurs that refrigerant recovery and full recharge of any system are not contemplated as part of the routine maintenance. They would be covered as part of CLIN 0003.No
20PWS5.2.49PWS 5.2.4 requires washing coils, fan blades and condenser casings monthly to prevent salt and rust build-up. Please confirm the Government will provide water access at each facility for coil cleaning, and that chemical coil cleaners, rust inhibitors and coil coatings (if required) are considered maintenance materials under the FFP price and not corrective repair items.Water access will be provided via hose bibs at each facility. The contractor is responsible for providing its own hoses. Coil cleaners, rust inhibitors, etc. are incidental to the monthly maintenance service and are not considered corrective repairs. No
21PWS5.5.110PWS 1.4.1 limits performance to 08:00-17:00 Monday through Friday, while PWS 5.5.1 requires response to routine service calls within 24 hours of notification. Please confirm (a) '24 hours' means by the next business day for calls received after hours or before a weekend or holiday, and (b) whether the Government expects after-hours or weekend emergency response for mission-critical spaces (USPFO Server Room, JISCC, JOC) and, if so, how that response is defined in the PRS and compensated.Normal business hours are 8:00 a.m. - 5:00 p.m. Monday through Friday except Federal holidays. The 24-hour requirement refers to the next business day. The government does not require the contractor to work after normal business hours, on Federal holidays or on weekends.Yes

PWS para. 1.4.1

22PWS5.510Does the Government intend a priority or emergency response tier faster than 24 hours for mission-critical spaces such as the USPFO Server Room and JISCC? If so, please define the required response time, add it to the PRS, and confirm the associated labor is compensated under CLIN 0003.The government does not have an emergency response requirement faster than 24 hours. No
23PWS5.5.210Parts for the commercial York, Trane, Rheem and Lennox units in Technical Exhibit 3 must be shipped to St. Croix, with lead times commonly two to six weeks. Please confirm (a) freight, including expedited air freight when authorized by the COR, is an allowable cost under CLIN 0003, and (b) repair completion timelines are measured from receipt of parts, not from COR authorization.Shipping, handling and freight are to be included in the cost estimate for any repair part. Refer to PWS paragraph 5.5.3.No
24PWS5.6.311PWS 5.6.3 makes the contractor responsible for all waste disposal. Please confirm refrigerant recovery, recovery-cylinder handling, and EPA Section 608-compliant disposal of recovered refrigerant, compressor oil and replaced components are allowable costs under CLIN 0003, and identify any Government-approved disposal facility on St. Croix, as disposal options on-island are limited. The contractor is responsible for waste disposal in accordance with the regulations of the Virgin Islands Waste Management Authority and the Department of Planning and Natural Resources Division of Environmental Protection. The government does not have any facility for the storage or disposal of refrigerant, used oil or similar materials.Yes

PWS para. 5.6.3 25 PWS 5.6.2 11 PWS 5.6.2 requires a limited warranty on repair work per manufacturer specifications. Please confirm (a) the expected labor warranty period on corrective repairs; (b) parts warranty is the OEM warranty passed through to the Government; and (c) warranty callbacks caused by parts failure are not assessed against the contractor's PRS performance. The labor warranty shall be valid for 90 days on any repair work. The parts warranty shall be the OEM warranty passed through to the government. Warranty callbacks as a result of defective parts will not be assessed against the contractor's PRS performance. Yes PWS para. 5.6.2

26PWS1.2; 5.1; Technical Exhibit 31 / 8 / 14-15Neither the PWS nor Technical Exhibit 3 identifies the existing condition of any equipment. Please state whether any of the 64 systems is currently inoperable, operating with known deficiencies, supplemented by temporary or portable cooling, or carrying open or deferred repairs, and identify each such unit, the nature of the problem, and any repair estimates the Government has received. Please also identify any unit that has been condemned or is scheduled for replacement. If the Government holds no current condition record, please state so, and confirm that the contractor's initial site survey report (Deliverable #7) will be accepted as the baseline condition of record for purposes of the PRS and the corrective repair NTE.The initial site survey report is to be used as the baseline for the maintenance service. The government notes that two (2) of the 15-ton units and two (2) of the 3-ton units at the USPFO building as well as two (2) of the 40-ton units at the RTI building are currently under contract for replacement. Additionally, the government is working on a contract to replace some of the condensing units at the LTC LAJ Readiness Center. No
27PWSTechnical Exhibit 314-15Please provide the refrigerant type for each unit listed in Technical Exhibit 3 (R-22, R-410A, R-32, R-454B, etc.). Older York, Trane and Rheem units may be R-22, which is no longer produced and carries significantly higher cost and availability risk. This directly affects both the corrective repair NTE and the FFP materials allowance. The units are using R-22, R-32 or R-410A refrigerant. No
28PWSTechnical Exhibit 314-15Please provide for each unit in Technical Exhibit 3: model number, serial number, installation date or age, current operational status (including any unit presently inoperable or with known deficiencies), and available maintenance and repair history. Equipment age and condition drive both the materials allowance in the FFP price and the corrective repair risk offerors must assume. Please see Technical Exhibit 4 for additional information. The age range of the units is two (2) months to 10 years.Yes

PWS TE 4

29 PWS 1.2(c); Technical Exhibit 3 1 / 15 PWS 1.2(c) lists the Access Control Point (ACP) among the eleven facilities, but Technical Exhibit 3 contains no ACP entry; it lists a 'Guard Booth' (Midea 3-ton, Group 2) that does not appear in PWS 1.2. Please confirm the Guard Booth and the ACP are the same facility, and confirm the total equipment inventory is 64 systems as listed in Technical Exhibit 3. The ACP and the Guard Booth are the same facility. The units are as listed in Technical Exhibit 3 and Technical Exhibit 4. Yes

PWS TE 4

30PWSTechnical Exhibit 314-15Technical Exhibit 3 lists some equipment as separate condensing unit and air handler entries (e.g., AAOF York CU-1 and AHU-1; Sprat Hall Rheem CU and AHU) and elsewhere as combined 'CU and AHU' entries. Please confirm the exhibit represents 64 complete systems (condensing unit plus matched air handler) rather than additional standalone air handlers. For the LTC LAJ Readiness Center, the 14 entries are condensing units only - please confirm the matching air handlers or fan coil units are in scope and state their quantity. There are no stand alone air handlers. Each condensing unit is matched with a corresponding air handler. No
31PWSTechnical Exhibit 314-15PWS 5.2 refers to 'all HVAC systems.' Please confirm the contractor's FFP obligation is limited to the equipment listed in Technical Exhibit 3, and that any equipment added, replaced, or discovered during the initial site survey will be added by bilateral modification with an equitable adjustment to the monthly price. The government has identified all units covered by this PWS. New units that are being installed under separate contract are substituted into this contract for the unit that they are replacing. The size of the units listed in Technical Exhibit 3 and Technical Exhibit 4 will not change.Yes

PWS TE 4

32PWSTechnical Exhibit 3 (Group designations)14-15Please state the basis for the Group 1 / Group 2 designations (e.g., funding source or building ownership). JFHQ main-building units are Group 1 while the JFHQ JOC and JISCC units are Group 2. Please confirm both groups are on the same compound and are serviced on the same monthly schedule, and that the grouping affects invoicing only. The Group 1 and Group 2 designations are an internal nomenclature. (Refer to the Government's response to Question #8 on the Post Site Visit Questions tab of this spreadsheet). All buildings are on the Estate Bethlehem site except AAOF which is at the airport and Sprat Hall which is in Frederiksted. All units are on the same monthly maintenance schedule. The cost of service for each building is to be identified. No
33PWS1.2; 5.2.6; Technical Exhibit 31 / 9 / 14-15Many of the systems in Technical Exhibit 3 (York/Johnson Controls, Trane, Daikin, Mitsubishi, Gree, Midea, Lennox) use proprietary controllers, building automation platforms, and cloud or mobile applications whose firmware updates, diagnostic tools, software licenses, and remote-monitoring portals require OEM subscriptions or service agreements. Please state whether the Government currently holds any OEM software license, controls/BAS subscription, firmware-update or remote-monitoring agreement for this equipment, and identify the platform, licensee, and expiration date of each. If none exist, please confirm whether the Government expects the contractor to obtain them, under which CLIN they will be paid, and that they are excluded from the FFP monthly price. These subscriptions can cost many thousands of dollars per year, and PWS 5.2.6 requires maintenance to OEM checklists that for several of these systems cannot be completed without OEM software access.Only the RTI building and the JFHQ building have a BAS. The contractor is not responsible for the BAS. The contractor is responsible for ensuring that any work done on the systems does not disconnect the system from the BAS.No
34PWS5.6.2; Technical Exhibit 311 / 14-15Please identify any unit in Technical Exhibit 3 that remains under manufacturer warranty or an existing OEM service agreement, with the expiration date and any requirement that service be performed by an OEM-authorized dealer to preserve the warranty. Please confirm that warranty repairs on those units will be pursued through the OEM at no charge to the corrective repair NTE, and that the contractor will not be held responsible for warranty conditions voided by prior servicing. There is no OEM service agreement in place. The contractor/subcontractor is required to be licensed and certified to service and maintain air conditioning systems. No
35PWSTechnical Exhibit 3 (ERV and PTAC units)15Technical Exhibit 3 includes energy recovery ventilators (JFHQ ERV-1, ERV-3, ERV-4) and a PTAC unit. Please confirm whether ERV core/media cleaning or replacement is within the monthly PM scope, and state the OEM interval the Government expects. The ERVs are to be serviced in the same manner as the other air conditioning systems. No
