About this file
This is a Standard Form 30 Amendment to Solicitation/Modification of Contract issued by the U.S. Army National Guard for HVAC services at Estate Nazareth. The amendment is numbered 0001, effective September 8, 2026, for solicitation W9127P26QA028 originally dated August 29, 2026. The amendment is not extending the receipt deadline, and offerors must acknowledge receipt by completing items 8 and 15, acknowledging receipt on each copy of the offer submitted, or via separate letter/email referencing the solicitation and amendment numbers prior to the specified deadline. Quotes are due no later than 3:00 PM AST on September 15, 2026, submitted via email to MAJ Guy J. Maily (guy.j.maily.mil@army.mil) and LTC Jennifer Easterling (jennifer.d.easterling4.mil@army.mil). A mandatory Government-led site visit will occur at 10:00 AM AST on September 10, 2026.
The amendment adds FAR Clause 52.222-90 (Addressing DEI Discrimination by Federal Contractors, Deviation 2026-O0040, Revision 1, effective April 2026) and deletes FAR Clause 52.222-43 (Fair Labor Standards Act and Service Contract Labor Standards-Price Adjustment, Deviation 2026-O0038, effective February 2026). Attachment documents were updated: the prior PWS was deleted and replaced with Attachment 0002 - PWS (06 September 2026, 15 pages), and Attachment 00003 - Government Responses to Industry Questions (2 pages) was added. Proposals must include Technical Approach (maximum 10 pages, excluding cover page), Past Performance documentation, and Price using the provided Price Table with supporting assumptions. Award will be based on Best Value using a tradeoff methodology, with Technical Approach rated more important than Past Performance, and both combined non-price factors significantly more important than Price. Any Offeror with Marginal or below CPARS ratings in the past five years for similar services will be deemed unacceptable for past performance.

4.0 National Guard (NG) Agency Protest Program:
NG Agency Protest Program is intended to encourage interested parties to seek resolution of their concerns with the National Guard (NG) as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods as if filed at the GAO. The NG protest decision goal is to resolve protests within 35 calendar days from filing. An agency protest may be filed with either the Contracting Officer or the NG Agency's Protest Decision Authority, but not both, in accordance with NG protest procedures.
To be timely, the protests must be filed with the periods specified in FAR 33.103. To file a protest under the NG Agency Protest program, the protest must request resolution under that program and be sent to the address below:
National Guard Bureau Office of the Director of Acquisitions/ Head of Contracting Activity
ATTN: NGB-AQ-O
111 S. George Mason Dr.
Arlington, VA 22204
Email: ng.ncr.ngb-arng.mbx.ngb-task-order-ombudsman@mail.mil

Evaluation Factors for Award
The following clauses were modified:
52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation 2026-O0038) (Tailored) Feb 2026 hereby reads as follows:
Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Technical Approach - The Government will evaluate the technical approach to ensure a concise, organized approach to completing all required HVAC services within the specified timeframes is clearly demonstrated. The Government will also evaluate the Offeror's approach to managerial oversight and maintaining appropriate staffing levels of qualified personnel.
W9127P26QA0280001
mailto:byron.a.todman.civ@army.mil mailto:andrea.a.bryan-mcintosh.civ@army.mil
2. Past Performance - The Government shall obtain recent (last 5 years prior to the solicitation release date) and relevant CPARS for each Offeror. Any recent or relevant CPARS for any Offeror found with Marginal or below ratings in any rated area for the past five years for similar services shall render the Offeror's past performance unacceptable. If any Offeror does not have recent and relevant CPARS, they may submit past performance of up to 5 previous similar contracts or projects for the Government's consideration.
Performance that is more current will have a greater impact than older performance periods.
3. Price - Adequate price is anticipated and may exist if, in part, two or more offers are received that satisfy the Government's requirements. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the base year. Offerors' total evaluated prices (TEP) will be evaluated for price reasonableness. The TEP will be the only discriminator amongst Offerors for the Price factor. Evaluation of options shall not obligate the Government to exercise the option(s).
Technical is more important than Past Performance. All non-priced factors, when combined, are significantly more important than Price.
(b) The Government will evaluate offers for award purposes by adding the total price for Options.
all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) . A written notice of award or acceptance of an offer furnished to the successful Notice of award Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Award will be based on a determination of best value to the Government, price Basis for award.
and other factors considered. "Best Value" means the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit in response to the requirement.
Because this is a Best Value procurement using a Tradeoff, the Government may award to other than the lowest priced Offeror. However, the Government will not make an award at a significantly higher price to achieve only slightly superior performance capability. To that end, as non-Price factors approach equality from a qualitative perspective, Price will become a more determinative factor.
