SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
INSTRUCTION TO OFFERORS
1. Overview: This Request for Proposal (RFP) solicits for the Ship Repair, Maintenance and Overhaul for the
U.S. Army Corps of Engineers (USACE) Hopper Dredge YAQUINA. This will be a Firm-Fixed Price (FFP) job order.
For the purpose of this RFP, the Government will use the Lowest Price Technically Acceptable (LPTA) source selection process in accordance with Federal Acquisition Regulation (FAR) subpart 15.101-2, using technical (non-price) and price factors specific to the tasks in the job order. Interested offerors are required to submit technical proposals in conjunction with a pricing schedule for review and consideration by the Government. The Government will evaluate each proposal in accordance with FAR subpart 15.305 Proposal Evaluation and in accordance with the criteria described in Section M.
2. Who May Submit a Proposal: Any organization holding a Master Ship Agreement for Repair and Alteration of Vessels (MSRA) for overhaul of the YAQUINA with USACE, Portland District, may submit a proposal.
If a prospective offeror wants to submit a proposal for this job order and does not hold a MSRA for overhaul of the YAQUINA with Portland District, then the following procedures shall be followed:
A. The prospective offeror shall submit a capabilities package in accordance with the sources sought notice titled “2019 Dredge YAQUINA Overhaul,” number W9127N18R0052, posted on Federal Business Opportunities and can be accessed via www.fbo.gov. The capabilities package shall be received by Portland District no later than 2:00 P.M. Pacific Time ten (10) calendar days prior to the proposal due date.
Offerors submitting a capabilities package for a MSRA will be notified of their eligibility or non- eligibility within seven (7) calendar days of receipt of the capability package.
B. If there are any questions regarding the MSRA for overhaul of the YAQUINA or the procedures to submit a capabilities package for consideration for the award of a MSRA, please contact Mr. David Dvorak at David.L.Dvorak@usace.army.mil.
All Offeror’s interested in submitting a capabilities package for consideration of an MSRA shall be registered in System for Award Management at www.sam.gov.
3. Mandatory Site Visit: A mandatory pre-proposal site visit will be required as part of the RFP. The dates for the site visits are 03 July 2018 10 July 2018, 17 July 2018, 24 July 2018, and 31 July 2018. Site visits will begin promptly at 9:00 AM Pacific Time. All offerors will be required to wear Personal Protective and Safety Equipment (PPE) that meet the requirements of EM 385-1-1. PPE WILL NOT be provided by USACE, so offerors will be expected to bring their own PPE to the site visit.
To attend a site visit all offerors need to confirm atendence by emailing David Dvorak (David.l.dvorak@usace.army.mil) and Brandon Lasich (Brandon.m.lasich@usace.army.mil) no later than 1200 the Friday Monday prior to the scheduled site visit.

SECTION M - EVALUATION FACTORS FOR AWARD
EVALUATION FACTORS FOR AWARD
A. BASIS FOR AWARD
Every prospective offeror wanting to be considered for the award of the job order under this RFP must hold a MSRA for overhaul of the YAQUINA with USACE, Portland District. If a prospective offeror wants to submit a proposal for this job order and has not entered into a MSRA for overhaul of the YAQUINA with Portland District, that prospective offeror shall follow the instructions in Sections L and M to be considered for the award of the job order under this RFP.
The job order contemplated by this RFP will be awarded on the basis of the Lowest Price Technically Acceptable (LPTA) source selection process using technical (non-price) and price factors specific to the tasks in the job order.
The LPTA source selection process shall be used in accordance with FAR Part 15.101-2. There are three (3) non-price evaluation factors consisting of Factor 1 – Preliminary Production Schedule, Factor 2 – Site Visit Attendance, and Factor 3 – Past Performance; price shall be evaluated separately. To receive consideration for award of the job order under this RFP, a rating of no less than ‘Acceptable’ must be achieved for all non-price evaluation factors.
The Government intends to evaluate proposals and award a contract without discussions with Offerors, except clarifications as described in FAR 15.306(a); therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
For evaluation purposes, the Government will calculate the overall price of each proposal by adding the total price proposed for CLIN 0001 (Category A) Price Schedule, the total price proposed for the Anticipated Items (Category B) Pricing Schedule, and the location adjustment described below. Additional details are explained below under Factor 4 – Price.
FACTORS AND SUB-FACTORS TO BE EVALUATED
The following evaluation factors will be used to evaluate each proposal:
VOLUME I: Technical Proposal
Factor 1 – Preliminary Production Schedule;
Factor 2 – Site Visit Attendance;
Factor 3 – Past Performance; and
VOLUME II: Price
Factor 4 – Price.
EVALUATION APPROACH
FACTOR 1 – PRELIMINARY PRODUCTION SCHEDULE
To receive a rating of “Acceptable” under Factor 1 – Preliminary Production Schedule, an Offeror shall submit a schedule that includes all Preliminary Production Schedule Items identified in Section C – Technical Provisions and shows their completion within the period of performance (POP) of the job order. A proposal that fails to include all required items or fails to identify their performance and completion within the POP specified in the RFP, shall receive a rating of “Unacceptable” under Factor 1 – Preliminary Production Schedule.
FACTOR 1
PRELIMINARY PRODUCTION SCHEDULE
Rating Description Acceptable Proposal meets the requirements of the RFP.
Unacceptable Proposal does not meet the requirements of the RFP.
FACTOR 2 – SITE VISIT ATTENDANCE
A mandatory site visit is required for this RFP. There are no submission requirements for this factor. The Contracting Officer and/or Contract Specialist will be present at each organized site visit and will have a sign in sheet for all attendees to fill out as record of attendance. As long as the Offeror is represented, signs the attendance sheet, and is present throughout one of the organized site visits, the Offeror will received a rating of ‘Acceptable’ under this factor. If an Offeror is not represented, does not sign the attendance sheet, or is not present throughout one of the organized site visits, the offeror will be assigned an ‘Unacceptable’ rating for this factor.
FACTOR 2
SITE VISIT ATTENDANCE
Rating Description Acceptable Proposal meets the requirements of the RFP.
Unacceptable Proposal does not meet the requirements of the RFP.
FACTOR 3 – PAST PERFORMANCE
The Government will pull past performance evaluations on projects for the last 24 months, which are similar in size and scope to the requirements of this RFP. This information will be used to evaluate past performance for this Job Order. The Government reserves the right to pull past performance information from all available sources to include, but are not limited to: past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), Wide Area Workflow (WAWF), and any other known sources not provided by the offeror. No further submissions are required.
Past Performance will be evaluated on an Acceptable/Unacceptable basis as follows:
FACTOR 3
PAST PERFORMANCE
Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below)
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)).
Therefore the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
FACTOR 4 – PRICE
Offeror’s price for tasks shall represent the best price in response to the RFP. For evaluation purposes, the Government will calculate the overall evaluated price of proposals by adding the total price proposed for CLIN 0001 (Category A) Price Schedule, the total price proposed for the Anticipated Items (Category B) Pricing Schedule, and the location adjustment described below. This overall price will be evaluated in accordance with FAR 15.404, Proposal Analysis, to determine the lowest-price, technically-acceptable proposal. Unit prices shall be evaluated to determine fairness, reasonableness and if unbalanced pricing exists. Per FAR 15.404-1(g), unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated. If cost or price analysis techniques indicate that a proposal is unbalanced, the Contracting Officer shall consider the risks to the Government associated with the unbalanced pricing. NOTE:
A proposal may be rejected if the Contracting Officer, determines that the unbalanced pricing poses an unacceptable risk to the Government.
LOCATION ADJUSTMENT
The Dredge YAQUINA's current FY18 operating schedule directs dredging in the Columbia River near Portland/Vancouver prior to entry into and upon departure from the shipyard. The Columbia River is the largest, most dynamic navigation channel and dredging is required throughout the year to maintain adequate depth. The YAQUINA will be the only dredge available in February 2019. The YAQUINA will be required to dredge the Columbia River immediately before and after the shipyard availability. Portland is the homeport for the vessel and the home duty station for crews per union agreement. Therefore, Portland will be used as the reference point for round-trip travel for the purpose of comparing proposals. Due to the unknown location of the overhaul and the cost impact associated with the logistical concerns identified below, a location adjustment will be added to every proposal to obtain a total evaluated price. The rate will be calculated based on the offeror’s location where services will be rendered:
1. If the offeror’s location where services will be rendered is within 300 nautical miles of Portland, OR:
Location adjustments will not be required.
2. If the offeror’s location where services will be rendered is beyond 300 nautical miles of Portland, OR. The location adjustment will contain the following multiple factors.
a. Dredge Vessel Transportation: For the purpose of comparing proposals only, the Government’s cost to transport dredge from the homeport, to and from the offeror’s facilities. Costs include roundtrip travel.
i. FY19 YAQUINA cost is $2.36 per Gallon.
Consumption 3000 Gallons Per Day 3000 glns x $2.36 = $7,080 per day
11.5 nautical mile/hour = 276 nautical miles/day Cost per nautical mile = $7,080/276 = $25.65/nautical mile Total Cost = distance between excess of 300 NM from YAQUINA homeport and offeror's facilities x
2 x $25.65 (cost per Nautical Mile).
b. Crew members: For the purpose of comparing proposals only, the Government’s cost for forty-four (44) Government employee crew members from Portland to the offeror’s facilities. Costs include roundtrip travel but not per diem (assume liveaboard ship). Crew change every 2 weeks = 5 trips x 44 crew members = 220 individual air-fare; 5 trips x 2 vans per trip = 10 van trips.
c. Non-Crew member: For the purpose of comparing proposals only, the Government’s cost for on-site non-crew personnel and tools/equipment from Portland to the offeror’s facilities. Costs include roundtrip travel and daily per diem.
Periodic meetings for two (2) management personnel (2 days every 2 weeks) = 2 x 2 x 6 trips = 24 days per diem. One contract specialist and one COR on site (75 days, travel every 2 weeks) = 2 x 75 = 150 days per diem. Four (4) port engineers (75 days, travel every 2 weeks) = 4 x 75 = 300 days per diem. Three (3) moorings shop personnel including supervisor (75 days, travel every 2 weeks) = 3 x 75 = 225 days per diem. Total per diem = 24 + 150 + 300 + 225 = 669 days. Total trips = 75/14 (roundup to whole) = 6; 6 trips x 10 personnel = 60 individual air-fare; 6 trips x 7 cars per trip = 42 car trips. Total transportation of tools and equipment = one roundtrip freight fee = ~$2.50 per mile (on road). For shipyards not accessable by road from Portland OR, a $10,000.00 freight fee will be added in replacement of $2.50 per mile.
d. The rates will be pulled from published standard DOD rates, such as GSA airfare rates and location per diem charts. Nautical mileage will be pulled from the U.S. Department of Commerce’s publication entitled ‘Distance between United States Ports – 2012 (12th Edition).’
