This item should not include the work specifically called for in Bid Option 1 and 2, but must be installed in an manner that allows the installation of Bid Options 1 and 2 whether those options are selected or not. The electric substation and substation building work consists of coordination with El Paso Electric Company (EPE) for connection to the existing 115 kv EPE system; coordination with the EPE for power and controls to their new EPE Control House, and other items as defined in the contract documents. This work includes, but is not limited to the Substation Building and Building Systems, substation transformer, building transformers, medium voltage buss and 115 kv buss structures, feeders, controls and control wiring, battery backup system, interior switchgear, medium and low voltage feeders, lightning protection, exterior lighting, grounding grid, rock, fence, structures, equipment piers, footings and pads. This work also includes anything within the Substation fence that is not included in the Electrical Substation Building and Building System Bid Schedule Item or anything specifically included in other bid items. The work does not include the installation of ground grid, rock, 115kV bus, 115kV circuit breakers, EPE control house and associated foundations inside the 115kV substation yard fence.
Contractor is responsible for installation of the medium voltage feeders to the EPE control house service transformers, control wiring interface to the EPE control house, rough grading inside the 115kV substation yard fence and for installing the 115kV yard fencing as detailed on the documents. 1 LS *** $__________

NOTES:
1. ARITHMETIC DISCREPANCIES (EFARS 14.407-2)
(a) For the purpose of initial evaluation of bids, the following will be utilized in resolving arithmetic discrepancies found on the face of the bidding schedule as submitted by bidders:
(1) Obviously misplaced decimal points will be corrected;
(2) In case of discrepancy between unit price and extended price, the unit price will govern;
(3) Apparent errors in extension of unit prices will be corrected;
and
(4) Apparent errors in addition of lump-sum and extended prices will be corrected.
(b) For the purpose of bid evaluation, the Government will proceed on the assumption that the bidder intends his bid to be evaluated on the basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above and the bid will be so reflected on the abstract of bids.
(c) These correction procedures shall not be used to resolve any ambiguity concerning which bid is low.
2. If a modification to a bid based on unit prices is submitted, which provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to each unit price in the bid schedule must be stated. If it is not stated, the bidder agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the bid schedule.
3. Bidders must bid on all items.
4. Costs attributable to Division 01 - General Requirements are assumed to be prorated among bid items listed.
5. Responders are advised that this requirement may be delayed, cancelled or revised at any time during the solicitation, selection, evaluation, negotiation and/or final award process based on decisions related to DOD changes in force structure and disposition of the Armed Forces.

6. 52.217-5 EVALUATION OF OPTIONS (JUL 1990)
(a) Except when it is determined in ac cordance with FAR 1 7.206(b) not to b e in the Government's best interests, the Government will evaluate offers for award purposes by a dding the total pri ce for all options to the total pric e for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
(b) The Government may reject an offer as non-responsive if it is materially unbalanced as to prices for the basic requirement and the option quantities.
An offer is unbalanced when it is bas ed on prices significantly less than cost for some work and prices which ar e significantly overstated for other work.
7. EXERCISE OF OPTIONS (SWDR 715-1-1 (16 January 1996))
The Government reserves the right to exercise the option(s) by written notice to the Contractor either singularly or in any combinati on for up to 120 calendar days after award of the Ba se Bid without an increase in the Offeror's Bid Price. Completion of add ed items shall cont inue at the same schedule as the Base Bid unless otherwise noted in Section 01000 CONSTRUCTION SCHEDULE, paragraph 1 entitled SCHEDULE.

NOTE: All work on this project shall be completed within the number of calender days stated in Item of Work (1) above, inclusive of all review periods and Government phasing requirements specified. If the Government accepts a proposal for a completion period of lesser duration, and such proposal alters the time periods for review and phasing, the Contract shall be read to include the original periods for review and phasing. If a completion period of lesser duration is proposed and accepted by the Government, the accepted completion period will replace the original construction schedule listed above in the Schedule. If an alternate completion period is proposed, the Bid Schedule must reflect pricing information for the alternate proposed

*Landscaping
The planting of trees, shrubs, and vines shall be accomplished during the first planting season prior to substantial completion of building construction. Maintenance and replacement of trees, shrubs, and vines shall commence immediately after each plant is planted, mulched, and staked and shall continue for a period of 120 calendar days after all plants are planted, mulched, and staked.

1.1.1 Testing of Heating and Air-Conditioning Systems
The times stated for completion of this project includes all required testing specified in appropriate specification sections of heating, air conditioning and ventilation systems including HVAC Commissioning.
Exception: boiler combustion efficiency test, boiler full load tests, cooling tower performance tests, and refrigeration equipment full load tests, when specified in the applicable specifications, shall be preformed in the appropriate heating/cooling season as determined by the Contracting Officer.
1.2 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (OCT 1989)
(ER 415-1-15)(52.0001-4038 1/96)
a. This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the contract clause FAR 52.249-10 entitled "DEFAULT: (FIXED PRICE CONSTRUCTION)." In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
(1) The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
(2) The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the contractor.
b. The following schedule of monthly anticipated adverse weather delays due to precipitation and temperature is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations.
The contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities. Wind is not considered in the Monthly Anticipated Adverse Weather Calendar Day Schedule.

c. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the contractor's scheduled work day.
d. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph "b", above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the contract clause entitled "Default (Fixed Price Construction)."
1.3 WORK RESTRICTIONS
1.3.1 Working Hours
Normal working hours are Monday through Friday, 0630 to 1700 hours, unless otherwise indicated at the preconstruction conference. Requests to work at times other than the stated working hours, including scheduled utility outages discussed below, shall be submitted to the Contracting Officer for approval. Contractor shall not work outside of the above stated working hours without prior written approval of the Contracting Officer.
1.3.2 Security Requirements
1.3.2.1 Installation Entrance Requirements
In addition to the requirements specified in Section 01 35 11.00 44 SPECIAL PROJECT PROCEDURES FOR FORT BLISS and for the duration of this Contract, access to Fort Bliss will be delayed between 5 minutes to 30 minutes or more due to increased security precautions, including the checking of vehicle occupants' IDs, vehicle manifests, and the searching of all vehicles. Any general or specific threat to the safety of those working or living at the Installation could result in longer waiting times at the access points to the Installation.
The following are requirements for contractor employees entering Fort Bliss:
a. One form of picture ID.
b. A memo from the construction company on their letterhead stating the reason for entry, contract number, and the location at Fort Bliss where the jobsite is located.
c. All delivery trucks must have a bill of lading and delivery truck drivers must have a picture ID.
1.3.3 Identification of Employees
The Contractor shall be responsible for furnishing to each employee, and

Prescribed identification shall immediately be delivered to the Contracting Officer for cancellation upon release of any employee. When required, the Contractor shall obtain and provide fingerprints of persons employed on the project. Contractor and subcontractor personnel shall wear identifying markings on hard hats clearly identifying the company for whom the employee works.
Contractor personnel shall wear visible Contractor-furnished employee identification badges while physically on the Installation. Each badge shall include, as a minimum, the company name, employee name, photograph, Contract Title, Contract Number, and the expiration date of the badge.
1.4 UTILITIES
1.4.1 Payment for Utility Services
Utilitiy availability and Payment For Utility Services are specified in Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES AND CONTROL.
1.4.2 Coordination
For Contractor Telephone And Internet Service, the Contractor shall coordinate with ITBC and the local phone company for contractor telephone and internet service during construction.
1.4.3 Outages
The Contractor shall coordinate all requests for utility outages with the Contracting Officer in writing 14 days prior to date of requested outage:

1.5 STREET CLOSINGS
The Contractor shall coordinate all requests for street closings with the Contracting Officer in writing 14 days prior to date of requested outage:
a. One lane traffic shall be maintained at all times (except that a total closing may be allowed for specific 8-hour periods).
b. The final street repair shall be completed within 14 days after the start of any street crossing. Any part of the street returned to service prior to final repair shall be maintained smooth with hot-mix cold-lay surface course.
c. Open cuts across paved roads and streets for utility crossings will not be allowed. Utility crossings will be accomplished by boring

1.1 INCORPORATED CONTRACT PROVISIONS
1.2 PROJECT TITLE AND LOCATION
Industrial Complex Infrastructure Project; Ft. Bliss, Texas
1.3 DESCRIPTION OF WORK
The work consists of providing material, equipment and labor for the construction of the Industrial Complex Infrastructure, which includes prepare/implement / maintain a Master SWPPP for the overall project area, installation/maintenance of erosion control devices; retention pond excavation; existing pavement, sidewalk, curb and gutter demolition;
existing utility demolition and or relocation; sign relocation; grading for roadways, substation yard, substation access drive and POV lots;
installation of proposed utility systems (water, gas, sanitary sewer, storm drainage, electric and communication concrete duct banks); paving for roadways, organizational and POV lots; street lighting and site lighting for Organizational and POV lots; striping; signage; permanent fencing;
temporary construction fencing; temporary traffic control; aggregate;
landscape; irrigation; coordination of work and schedules with multiple ongoing separate contracts and other items defined in the contract documents.
The scope of work includes providing materials, equipment, and labor for the construction of the Electrical Substation for the Industrial Complex Infrastructure Base Bid; coordination with El Paso Electric Company (EPE) for connection to the existing 115 kv EPE system; coordination with the EPE for power and controls to their new UP Control House, and other items as defined in the contract documents. This work includes, but is not limited to the construction of the Substation Building and Building Systems, as part of the substation transformer, building transformers, medium voltage buss and 115 kv buss structures, feeders, controls and control wiring, battery backup system, interior switchgear, medium and low voltage feeders, lightning protection, exterior lighting, grounding grid, rock, fence, structures, equipment piers, footings and pads. This work also includes anything within the Substation fence that is not included in the Electrical Substation Building and Building System Bid Schedule Item or anything specifically included in other bid items. The work does not include the installation of ground grid, rock, 115kV bus, 115kV circuit breakers, EPE control house and associated foundations inside the 115kV substation yard fence. Contractor is responsible for installation of the medium voltage feeders to the EPE control house service transformers, control wiring interface to the EPE control house, rough grading inside the 115kV substation yard fence and for installing the 115kV yard fencing as detailed

This scope of work includes providing and maintaining the overall Storm Water Pollution Prevention Plan for the entire project area impacted by construction operations under this contract, including base bid and all awarded options. At a minimum, the Contractor shall maintain the overall SWPPP for the entire contract duration listed below unless specific areas are released from the Contractor's responsibility by the Contracting Officer's Representative prior to the listed duration.
There are Nine Bid Options associated with this project. Refer to the Project Bid Schedule for complete break down of work associated with the Base Bid and each Bid Option.
1.4 PERIOD OF PERFORMANCE
All performance periods listed are in calendar days from the date of Notice to Proceed (NTP) for the project. The performance period to complete all work associated with this solicitation for each phase or listed work item as shown on the drawings shall be as follows:
A. All material, equipment and labor required for the commencement of clearing and grubbing activities must begin by February 15, 2012.
B. All material, equipment and labor required for the construction of the Substation Access Road; Substation grading; and a (7) foot TEMPORARY construction fence or the PERMANENT fence (as per the plans) around the Substation High Voltage Yard Security Fence - 60 days from
NTP.
C. All material, equipment and labor required for the construction of the VMF Building sites (5 total); the EMF building sites (4 total); and vehicular access to both sites - 90 days from NTP.
D. All material, equipment and labor required for the construction of the PERMANENT Substation High Voltage Yard Security Fence (if not constructed under Item B above) - 120 days from NTP.
E. All material, equipment and labor required for the construction of the water service, fire service, sanitary sewer service, gas service and communication service to the VMF Building sites (5 total) and the EMF building sites (4 total) - 120 days from NTP.
F. All material, equipment and labor required for the construction and energizing of the electric substation - 300 days from NTP.
G. All material, equipment and labor required to provide electrical power from the substation to the VMF Building sites (5 total) and the EMF building sites (4 total) - 330 days from NTP.
H. All material, equipment and labor required to for the construction of all remaining work in the contract not specifically stated above - 365 days from NTP.
I. Performance and Payment Bonds shall be provided not later that five
(5) calendar days after Notice To Proceed.

1.5 CONTRACTOR REQUIREMENTS
See Section 01 00 50.00 44, GENERAL REQUIREMENTS for additional requirements applicable to this Project.
1.6 PHASING REQUIREMENTS AND WORK RESTRICTIONS
a. Access to project site is subject to base closures for security and military mission execution. Contract time extension without addition cost shall be granted on a day for day basis for periods when the contractor is denied access to the project site due to base closures. See Section 01 32
01.00 10 PROJECT SCHEDULE and Section 01 50 00 TEMPORARY CONSTRUCTION FACILITIES AND CONTROLS for additional requirements.
The Contractor can access the construction site from the North ACP from Loop 375 into the IBCT Complex; then access the project area from the North ACP via Liberty Avenue.
b. Working hours for this project shall be between 0700 and 1700, Monday through Friday. Requests to work at times other than the stated working hours, including scheduled utility outages discussed below, shall be submitted to the Contracting Officer for approval. Contractor shall not work outside of the above stated working hours without prior written approval of the Contracting Officer. See Section 01 32 01.00 10 PROJECT SCHEDULE for additional requirements.
c. . The Contractor shall coordinate any required utility outages with the Contracting Officer. See Section 01 32 01.00 10 PROJECT SCHEDULE.
d. In accordance with this Task Order work the standard work week is 5 days, 8 hours a day. If the Contractor wants to work double shifts on a 5, 6, or 7 day work week; then notify the Government 48 hours in advance. If proper security and oversight can be arranged and no other unforeseen problems prohibit approval, the Government may grant request. Approval is discretionary and not guaranteed.
1.7 REQUIRED COORDINATION
Contractor is advised that coordination with other Contractors and construction projects is required on this project. These other projects may include El Paso Electric's work on the Substation, VMF TEMF Building, EMF TEMF Building, SSA Warehouses and DRMO facility. Coordination is also required with building tenants and Fort Bliss Fire Department. Contractor must maintain Fire Department access to all building 24 hours/7 days a week. The Contractor under this Task Order shall plan all operations so that all other contractors working in the area have continuous access to their project sites at all times. Contractor is also responsible for maintaining access to these other work areas and for providing and maintaining temporary access when construction activities require interruption of the other contractor's primary access. Contractor shall notify all site contractors and affected tenants 14 days prior to any modification of their primary access route to their project site.
1.8 LIQUIDATED DAMAGES
The schedule duration/completion dates are stated in Paragraph 1.4 above.
The Liquidated Damages for each of them are stated below.

PART 1 GENERAL
1.1 REFERENCES

1.2 PAYMENT
Separate payment will not be made for providing and maintaining an effective Quality Control program, and all associated costs will be included in the applicable Bid Schedule unit or lump-sum prices.
1.3 COMMISSIONING
Commissioning (Cx) is a systematic process of ensuring that all building systems meet the requirements and perform interactively according to the Contract. The QC Program is a key to this process by coordinating, verifying and documenting measures to achieve the following objectives:
a. Verify and document that the applicable equipment and systems are installed in accordance with the design intent as expressed through the Contract and according to the manufacturer's recommendations and industry accepted minimum standards.
b. Verify and document that equipment and systems receive complete operational checkout by the installing contractors.
c. Verify and document proper performance of equipment and systems.
d. Verify that Operation and Maintenance (O&M) documentation is complete.
e. Verify and document that the Government's operating personnel are adequately trained.
1.3.1 Acceptance of the Construction Quality Control (QC) Plan
Acceptance of the QC Plan is required prior to the start of construction.
The Contracting Officer reserves the right to require changes in the QC Plan and operations as necessary, including removal of personnel, to ensure

The Contracting Officer reserves the right to interview any member of the QC organization at any time in order to verify the submitted qualifications. All QC organization personnel are subject to acceptance by the Contracting Officer. The Contracting Officer may require the removal of any individual for non-compliance with quality requirements specified in the Contract.
1.3.2 Preliminary Construction Work Authorized Prior to Acceptance
The only construction work that is authorized to proceed prior to the acceptance of the QC Plan is mobilization of storage and office trailers, temporary utilities, and surveying.
1.3.3 Notification of Changes
Notify the Contracting Officer, in writing, of any proposed changes in the QC Plan or changes to the QC organization personnel, a minimum of 10 work days prior to a proposed change. Proposed changes are subject to acceptance by the Contracting Officer.

PART 3 EXECUTION
3.1 GENERAL REQUIREMENTS
Establish and maintain an effective quality control (QC) system in compliance with the Contract Clause titled "Inspection of Construction."
QC consist of plans, procedures, and organization necessary to produce an end product which complies with the contract requirements. Cover all construction operations, both onsite and offsite, and be keyed to the proposed construction sequence. The project superintendent will be held responsible for the quality of work and is subject to removal by the Contracting Officer for non-compliance with the quality requirements specified in the contract. In this context the highest level manager responsible for the overall construction activities at the site, including quality and production is the project superintendent. The project superintendent must maintain a physical presence at the site at all times and is responsible for all construction and related activities at the site, except as otherwise acceptable to the Contracting Officer.
3.2 QUALITY CONTROL PLAN
Submit no later than 14 days after receipt of notice to proceed, the Contractor Quality Control (CQC) Plan proposed to implement the requirements of the Contract Clause titled "Inspection of Construction."
The Government will consider an interim plan for the first 30 days of operation. Construction will be permitted to begin only after acceptance of the CQC Plan or acceptance of an interim plan applicable to the particular feature of work to be started. Work outside of the accepted interim plan will not be permitted to begin until acceptance of a CQC Plan or another interim plan containing the additional work.
3.2.1 Content of the CQC Plan
Include, as a minimum, the following to cover all construction,construction operations, both onsite and offsite, including work by subcontractors, SECTION 01 45 00.00 10 Page 2 fabricators, suppliers, and purchasing agentssubcontractors, designers of record, consultants, architect/engineers (AE), fabricators, suppliers, and purchasing agents:
a. A description of the quality control organization, including a chart showing lines of authority and acknowledgment that the CQC staff will implement the three phase control system for all aspects of the work specified. Include a CQC System Manager who reports to the project superintendent.
b. The name, qualifications (in resume format), duties, responsibilities, and authorities of each person assigned a CQC function.
c. A copy of the letter to the CQC System Manager signed by an authorized official of the firm which describes the responsibilities and delegates sufficient authorities to adequately perform the functions of the CQC System Manager, including authority to stop work which is not in compliance with the contract. Letters of direction to all other various quality control representatives outlining duties, authorities, and responsibilities will be issued by the CQC System Manager. Copies of these letters must be furnished to the Government.
d. Procedures for scheduling, reviewing, certifying, and managing submittals, including those of subcontractors, offsite fabricators, suppliers, and purchasing agentssubcontractors, designers of record, consultants, architect engineers (AE), offsite fabricators, suppliers, and purchasing agents. These procedures must be in accordance with Section 01 33 00 SUBMITTAL
PROCEDURES.
e. Control, verification, and acceptance testing procedures for each specific test to include the test name, specification paragraph requiring test, feature of work to be tested, test frequency, and person responsible for each test. (Laboratory facilities approved by the Contracting Officer must be used.)
f. Procedures for tracking preparatory, initial, and follow-up control phases and control, verification, and acceptance tests including documentation.
g. Procedures for tracking construction design and construction deficiencies from identification through acceptable corrective action. Establish verification procedures that identified deficiencies have been corrected.
h. Reporting procedures, including proposed reporting formats.
i. A list of the definable features of work. A definable feature of work is a task which is separate and distinct from other tasks, has separate control requirements, and may be identified by different trades or disciplines, or it may be work by the same trade in a different environment. Although each section of the specifications may generally be considered as a definable feature of work, there are frequently more than one definable features under a particular section. This list will be agreed upon during the coordination meeting.

3.2.2 Acceptance of Plan
Acceptance of the Contractor's plan is required prior to the start of construction. Acceptance is conditional and will be predicated on satisfactory performance during construction. The Government reserves the right to require the Contractor to make changes in his CQC Plan and operations including removal of personnel, as necessary, to obtain the quality specified.
3.2.3 Notification of Changes
After acceptance of the CQC Plan, notify the Contracting Officer in writing of any proposed change. Proposed changes are subject to acceptance by the Contracting Officer.
3.3 COORDINATION MEETING
After the Preconstruction Conference, before start of construction, Postaward Conference, before start of construction, and prior to acceptance by the Government of the CQC Plan, meet with the Contracting Officer or Authorized Representative and discuss the Contractor's quality control system. Submit the CQC Plan a minimum of 14 calendar days prior to the Coordination Meeting. During the meeting, a mutual understanding of the system details must be developed, including the forms for recording the CQC operations operations, design activities, control activities, testing, administration of the system for both onsite and offsite work, and the interrelationship of Contractor's Management and control with the Government's Quality Assurance. Minutes of the meeting will be prepared by the Government, signed by both the Contractor and the Contracting Officer and will become a part of the contract file. There may be occasions when subsequent conferences will be called by either party to reconfirm mutual understandings and/or address deficiencies in the CQC system or procedures which may require corrective action by the Contractor.
3.4 QUALITY CONTROL ORGANIZATION
3.4.1 Personnel Requirements
The requirements for the CQC organization are a CQC System Manager and sufficient number of additional qualified personnel to ensure safety and contract compliance. The Safety and Health Manager must receive direction and authority from the CQC System Manager and serve as a member of the CQC staff. Personnel identified in the technical provisions as requiring specialized skills to assure the required work is being performed properly will also be included as part of the CQC organization. The Contractor's CQC staff must maintain a presence at the site at all times during progress of the work and have complete authority and responsibility to take any action necessary to ensure contract compliance. The CQC staff will be subject to acceptance by the Contracting Officer. Provide adequate office space, filing systems and other resources as necessary to maintain an effective and fully functional CQC organization. Promptly complete and furnish all letters, material submittals, shop drawing submittals, schedules and all other project documentation to the CQC organization. The CQC organization shall be responsible to maintain these documents and records at the site at all times, except as otherwise acceptable to the Contracting Officer.

3.4.2 CQC System Manager
Identify as CQC System Manager an individual within the onsite work organization who is responsible for overall management of CQC and have the authority to act in all CQC matters for the Contractor. The CQC System Manager must be a construction person with a minimum of 15 years in related work. This CQC System Manager must be on the site at all times during construction and be employed by the prime Contractor. The CQC System Manager must be assigned no other duties. Identify in the plan an alternate to serve in the event of the CQC System Manager's absence. The requirements for the alternate are the same as the CQC System Manager.
3.4.3 Additional Requirement
In addition to the above experience and/or education requirements the CQC System Manager must have completed the course entitled "Construction Quality Management For Contractors"..
3.4.4 Organizational Changes
Maintain the CQC staff at full strength at all times. When it is necessary to make changes to the CQC staff, revise the CQC Plan to reflect the changes and submit the changes to the Contracting Officer for acceptance.
3.5 SUBMITTALS AND DELIVERABLES
Submittals, if needed, must comply with the requirements in Section 01 33 00 SUBMITTAL PROCEDURES. The CQC organization is responsible for certifying that all submittals and deliverables are in compliance with the contract requirements.
