SUMMARY OF CHANGES

This amendment list questions asked by potential offerors and Government responses, which the Government feels may have an impact on proposals, and revises 52.228-13:

1. Is the contractor responsible for the permits on the Horse Feed barn task? This project is on US Navy property.

If a permit is required, the contractor will be required to coordinate its approval. The Government will pay the cost for any required permit. The performance period includes a reasonable amount of time for coordinating permits.

2. Where is the existing power source? Who will be responsible for utility connections and/or coordination and contracts with the utility provider?

The contractor shall provide electrical inside the building, the panel and connection point for existing utility tie-in on the exterior. The Government will be responsible for coordinating with the utility provider and arranging the connection from the existing power source to the building.

3. Are Shop Drawings required as part of the Technical Proposal?

Shop drawings are not required unless the contractor proposes to self-perform fabrication and erection of the metal building. Applicable manufacturer's data and drawings are required for a pre-fab metal building.

4. Do past performance questionnaires count as part of the Technical Proposal?

The Government expects Past Performance Questionnaires to be submitted by other organizations, not the offeror. Past Performance Questionnaires received from prior contract points of contact, not included in Volume II of the proposal submission, will not count against the page limitations for the documents included in Volume II of the proposal submission.

5. What is the minimum and maximum number of performance questionnaires required for this proposal?

There is no minimum or maximum number of performance questionnaires required, however, offerors are highly encouraged to solicit responses from prior contract points of contact for all contracts identified the proposal submission.

6. Can you clarify the term "self-performing"?

The term "self-performing" means "without subcontracting any of the work"

7. Are all Work Plan Submittal items identified in the SATOC SOW to be included with the technical proposal?

The Work Plan is a living document designed to develop throughout the life of a project. Some items will be submitted with the initial proposal, and aid the Government in determining the proposal is adequate. Other items will be submitted at other stages of the project. The Government expectation for the Work Plan Submittal for the initial proposal of this task order is:

1. Table of Contents

2. Work Plan Narrative

3. Schedule

W9126G-08-R-0246

4. Task Order specific Organizational structure

5. Site Specific QC Plan

6. Site Specific Safety Plan

7. Specifications if contractor proposes to self-perform fabrication and erection of metal building.

8. Manufacturer's data and applicable information for pre-fab metal building

7. Will the contractor be responsible for any soils testing and/or sub grade restoration etc.?

No.

SECTION 00 72 00 - CONTRACT CLAUSES

52.228-13 ALTERNATIVE PAYMENT PROTECTIONS (JULY 2000)

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.
