W9124R20Q0017 - Refuse Collection at Yuma Proving Ground, AZ

Solicitation Document

1. The Period of Performance for the 14 day Phase in Period is 1 August 202 to 15 August 2020 and refuse collection starts on 16 August 2020, the incumbent’s contract expires on 31 July 2020. Who will be responsible for refuse collection services during the Phase in Period?

Response: The incumbent will be responsible for full performance during the resultant follow-on contract phase in period.

2. Pg 24 of 51 Technical Acceptable/Unacceptable Ratings states “In order to receive an acceptable rating, the technical factor submissions must submit sufficient information to determine acceptability when compared to the technical requirements”. a) Please confirm that the technical information required for evaluation is the completion of Technical Exhibit 9 Equipment List? And b) If any other technical information is required for evaluation purposes please provide clarification as to what is needed.

Response: a.) Yes, all offerors are required to provide a completed Technical Exhibit 9 Equipment List for technical evaluation. b.) In accordance with Performance Work Statement section 2.1.11.1.4 Qualification Standards, the offeror shall provide objective evidence of key personnel qualifications and years of experience. The offeror is responsible for meeting all requirements within the combined synopsis/solicitation, attachments, technical exhibits, provision and clauses.

3. Pg 24 of 51 Technical Acceptable/Unacceptable Ratings states “To be deemed technical acceptable offerors will need to provide Federal and State certification in refuse collection services.” There is no Federal certification for refuse collection services and a review of the Arizona Department of Environmental Quality (ADEQ) website https://azdeq.gov/solidwaste indicates that no such permit or certification is required for non-hazardous waste hauling in Arizona. (copy of the description of activities that do require licenses and permits is attached), accordingly we respectfully request that this requirement for Technical Acceptability be removed.

Response: This requirement is removed.

PWS

4. PWS Introduction “The Contractor shall provide permanent five (5) cubic yard dumpsters placed at locations as indicated on Exhibit 3 (Schedule A).” Exhibit 3 to the Solicitation is Special Services & Events, please correct reference to correct exhibit.

Response: The PWS Introduction should read Technical Exhibit 1 (Schedule A).

5. PWS 1.2 Objectives. States The Contractor shall provide 90-gallon containers for residential housing units and Unaccompanied Personnel Housing Containers shall be delivered one to each residential unit located at USAYPG.” Technical Exhibit 2 Identifies 4 Housing Units, please confirm that the 90-gallon container service is limited to the 4 housing units.

Response: Confirmed. The 90-gallon container service is limited to the 4 housing units.

6. PWS 2.5.1.5 states “Government is not liable for any damage to Contractor owned equipment.” Please confirm that this exclusion only applies to equipment at the wash rack, and that the government would be liable for damage caused by their negligence elsewhere on the base.

Response: The Government is not liable for any damage to Contractor owned equipment that was not caused by the Government.

TE10 CLS403

7. Technical Exhibit 10 (TE 10), Refuse/Solid Waste Management Requirements CLS 403. Will the Government please clarify the relevance of this Exhibit to the work contemplated in this contract as stated in PWS, 2.1.3.11, “The work to be performed under this contract will be performed at the locations listed in Technical Exhibit (TE) 2 – Schedule-A.” As many of the requirements listed in TE 10 are not accounted for in TE 2 or as line items on Attachment 2 – Bid Schedule. These include such things as yard waste collection and grinding and brass deforming.

Response: The PWS section is 2.1.3.1 place of performance and the PWS should read Technical Exhibit 1 – Schedule A. Technical Exhibit (TE) 10 – CLS 403 Refuse-Solid Waste Management Requirements is a description of in-depth technical refuse requirements. This requirement is for Refuse Services only and does not include solid waste management requirements. TE 10 sections 2.3.1.6 through 2.3.1.8 are not required.

8. Please identify the order of precedence for conflicting requirements of the various contract attachments; such as PWS, TE10 and defined and priced work in Attachment 2.

Response: Enough information is not provided in this question for the government to provide a thorough response. The Technical Exhibits are listed in the PWS section 7.2 and are properly named.

9. TE10 2.1 & 2.8.1 indicate that the Contractor is required to track all container weights. We have no scales on our trucks and the YPG landfill has no scale. Is this intention to require the contractor to have scales on their collection vehicles? There is a substantial cost associated with on board scales and the ongoing collection of the data they collect. Their accuracy is also unreliable.

Response: Tracking container weights is not required.

10. 2.3.1.1 “Cardboard. The Contractor shall collect cardboard from troop barracks and other building residents receiving furniture and other items, including cardboard left by Contractors.” This is a new requirement to the contract, which will require additional personnel and equipment, please confirm that this service will be required under this contract. Further we would recommend that contractors be responsible to dispose of their refuse and cardboard as is the case on other basses.

Response: All cardboard will be placed in the 5 yard containers by the customer.

11. “2.3.1.2 Bulk Items. The Contractor shall collect and dispose of bulky items (e.g., shipping cartons, scrap lumber, discarded furniture, appliances, toys, wood pallets) placed at collection stations, curb side or outside a refuse container” please confirm that curbside collection of bulk items will only be from the residential units and not Basewide.

Response: Contractor is not required to pick up bulk items base wide. On rare occasion there may be bulk items from the residential units.

12. “2.3.1.3 Hazardous Items. Items such as refrigerators, freezers, and window air conditioner units may contain chlorofluorocarbon (CFC). Items containing CFCs shall be picked up and properly disposed.” Is this intended to be a new requirement for this contract? And Can these items be taken to the base landfill for disposal?

Response: The contractor is not required to pick up hazardous items.

13. “2.3.1.5 Toner Cartridge Items. The Contractor shall palletize and shrink wrap all cartridges and electronics for shipment if collected by the Government for selling” Section 2-1 indicates that toner cartridges are refuse and are to be disposed at the landfill. Please clarify this conflict. If palletizing and shrink wrapping of toner cartridges is being added as a new requirement, please add a price line item for same to Attachment 2 Bid Schedule.

Response: This is not required.

14. 2.3.1.6 & 2.3.1.7 & 2.3.1.8 Yard Waste collection and grinding – this is a new requirement for this contract. Is this intended to be included in this contract?

Response: This is not required.

15. 2.3.1.7 “Yard Waste Areas. Wood shall be collected and chipped” Please provide an estimate of volumes to be collected and chipped so that we may accurately price this new requirement?

Response: This is not required

16. 2.3.1.7 “Yard Waste Areas. Wood shall be collected and chipped” Please identify the location and size of the facility to be provided to the contractor for chipping.

Response: This is not required.

17. “2.3.1.8 Brass Deformer. The Contractor shall deform all expended brass ammunition casings (.50 caliber and below) and containerize the deformed casings into boxes.” This is a specialized service that is not usually provided by waste hauling contractors; accordingly we respectfully request that this requirement be removed form the scope of work. If it is to remain please provide a separate line item for this work in Attachment 2 bid schedule.

Response: This is not required.

18. 2.4.1.1 states: The container shall be painted on all interior and exterior surfaces including the bottom.” We respectfully request that the requirement to paint the interior and bottoms of the containers be deleted, this is not a standard industry best practice, further supported by the fact that manufacturers do not paint the interior and bottoms of new containers.

Response: The Government agrees, this is not required.

19. 2.4.7 requires metal lids and locking latches on all containers. The current containers do not have metal lids or locking latches, please confirm that these would be unacceptable?

Response: Metal lids and locking latches on containers are not required.

20. 2.4.7 requires metal lids and locking latches on all containers. Metal lids are very heavy and pose a safety hazard from both their weight and the unprotected pinch points they create. Manufacturers will no longer supply metal lids on new 5 yard containers due to liability concerns. We respectfully request the government remove this requirement, for safety reasons.

Response: Metal lids and locking latches on containers are not required.

21. 2.5.3 Appears to be mislabeled as SCALES, as the requirement relates to the proper maintenance of collection equipment.

Response: This section appears to be mislabeled.

22. 2.6.2 please confirm that Service Orders will be issued for all Special Events and services paid for utilizing the pre-priced line items.

Response: Service Orders will be issued for special events and services.

23. 2.7.4 please confirm that Service Orders will be issued for all Scheduled and Unscheduled Cleanups and services paid for utilizing the pre-priced line items?

Response: Service Orders will be issued for scheduled and unscheduled cleanups and services paid for utilizing the pre-priced line items.

24. 3.3 this is a new requirement, currently there are no government owned containers in service on YPG, accordingly it is impossible to price for the repair and maintenance of unknown items, we respectfully request this requirement be removed and addressed if and when government equipment is added.

Response: Contractor is not required to maintain Government owned equipment.

25. 3.7 Hazardous Material, the contaminated soil materials hauled under the current contract are non-hazardous waste that requires profiling and manifesting before it can be transported. EPA regulated hazardous waste is not covered under the current contract and reference to hazardous waste should be deleted from this requirement and replaced with non-hazardous petroleum contaminated soils.

Response: The Government agrees.

1) Under Instructions to Offerors - how many past performance is required?

Response: The offerors are not required to submit past performance information. The Government will evaluate past performance from the information obtained from established systems such as the Contractor Performance Assessment Reposting System (CPARS) and/or Federal Awardee Performance and Integrity Information System (FAPIIS). The past performance information will be reviewed to determine the quality and usefulness as it applies to performance confidence assessment.

2) Under Evaluation - Technical Ratings. Government is requesting offerors to provide Federal and State certification in refuse collection services. There are no certification required to operate this service except for DOT license. What is government looking for from offerors to meet this technical requirement. Please be specific.

Response: ADOT certification is all that is required for the transportation of Refuse. All offerors are required to provide a completed Technical Exhibit 9 Equipment List for technical evaluation. In accordance with Performance Work Statement section 2.1.11.1.4 Qualification Standards, the offeror shall provide objective evidence of key personnel qualifications and years of experience. The offeror is responsible for meeting all requirements within the combined synopsis/solicitation, attachments, technical exhibits, provision and clauses.

3) Can the government provide the current contract information for this requirement? Contract Number, Contractor, total value of the contract by each performance period.

Response: The current contractor is Dorado Services, Incorporated. The contract total value at award was $1,234,266.91. The other specifics of the contract cannot be released.

4) Are there any changes to the PWS from the existing contract to this follow-on requirement? If so, please indicate.

Response: Completely new PWS in accordance with IMCOM standards and the CLS

5) Government is requesting 5 CY containers. Can the contractor provide 6 CY containers instead? Is there a reason behind this container size request? Such as size of the location where these containers will be placed?

Response: 5 yard containers fit into the container encasements. 6 yard containers can be used where no encasements are present, size and space permitting.

6) GFE - Can the government provide a picture of the GFE's on this contract. Especially vertical compactor?

Response: The Yuma Proving Ground (YPG) does not provide GFE for this contract. Technical Exhibit 9 is for the contractor to identify to YPG an equipment list stating major pieces of equipment to be used in performance of this contract by vehicle make, model and year; type of equipment; number of pieces of equipment; and whether the equipment is owned, leased or rented. The list shall include other support and maintenance items such as small tools, cleaning and painting equipment and any other such items required to demonstrate that the bidder is adequately prepared to perform under this contract.

7) Operating hours noted under the PWS states all work to be performed Monday through Thursday. Will contractor employees have access to the base on Friday in case of emergency or any additional work the contractor wants to perform under this contract?

Response: Yes, access to the base is available on Fridays. The prices are FFP and the Government will not pay for overtime. Some areas of the installation have limited access outside of the hours of operation identified in PWS section 2.1.3.1.

8) Section 2.1.4.1 - It is not usual to see that the government outlines the requirement that the contractor personnel shall not work overtime in the PWS. What is the reason government has emphasized about not working overtime?

Response: Site access may be limited or restricted outside of the hours of operation (PWS 2.1.3.1), the Government will not pay for overtime as this is a firm fixed price contract, and the Government will not be able surveillance the contractor’s performance outside of the hours of operation.

9) Section 2.3.1.2 - How many access/copies of this software will be provided to the contractor?

Response: Software will not be provided. The education center has computers available for the completion of annual training.

10) The PWS states that all dumpster maintenance shall be performed at an off-site location by the contractor. Can the government provide us with the historical knowledge on how currently it's been performed? On the base or off-site location?

Response There is a dumping location adjacent to Martinez Lake Road which is owned by the Govt.
