Addendum to FAR Provision 52.212-1 Instructions to Offerors-Commercial Items Solicitation Request for Proposal Requirements– Instructions, Conditions, and Notices to Offerors
A. Request for Proposal Submittal and Inquiries:
A.1. The Offeror must provide the following information:
A.2. As stated in 52.212-1(b) & (j) this Request for Proposal (RFP) is for as a commercial acquisition using combination of Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, and FAR Part 15, Contracting by Negotiation. This solicitation is a 100% 8(a) Set-Aside. In accordance with FAR 15.101-2, this acquisition will utilize the Lowest Price Technically Acceptable (LPTA) source selection procedures. The government anticipates award of a firm fixed priced contract from this solicitation.
A.3. The Mission and Installation Contracting Command (MICC) – Fort Knox primary point of contact responsible for providing information and responding to inquiries is Rodrique O. King, Contract Specialist (CS) at rodrique.o.king.civ@army.mil and Marsha S. Barnett, Contracting Officer (KO) at marsha.s.barnett.civ@army.mil.
A.4. As stated in 52.212-1(j), all offerors wishing to do business with the government must possess a valid Unique Entity ID number and must be registered in the System for Award Management (SAM).
Offerors must register online at www.sam.gov. Offeror's SAM registration must be active in order to be eligible for award. Offers containing a name and address (Block 17a of SF1449) different from that registered in SAM may be deemed ineligible for award.
A.5. In Accordance With (IAW) FAR 52.212-1(g) Offerors are encouraged to present their best prices in their initial proposal submission. (KO) at marsha.s.barnett.civ@army.mil. Offeror’s proposal must remain valid for a period of 90 days after the closing date and time identified on SF 1449 block eight (8). Electronic submissions via facsimile will not be accepted.
A.6. Offerors must complete blocks 17a, 17b, 30a, 30b and 30c on page 1, SF Form 1449. Offerors are reminded to complete and return all required certifications contained in this solicitation.
A.7. Offerors must completely fill out pricing in each Contract Line Item Number (CLIN) and total CLIN pricing. Offerors must submit all unit prices to the whole dollar.
A.8. Offerors must submit any questions regarding this solicitation in writing to the CS no later than 1:00 PM Eastern Time (ET) on 7 October 2022. No remarks or written responses to questions by government personnel will change the terms or conditions of this RFP. The RFP will only be changed by a formal written amendment issued by a MICC – Fort Knox KO.
A.9. As stated in 52.212-1(g), it is the Government’s intention to award without negotiations. Offerors are encouraged to present their best prices in their initial proposal submission. However, should negotiations become necessary, the Government reserves the right to negotiate.
A.10. As Stated in 52.212-1(b)(9), all amendments will be posted to sam.gov. It is the offerors responsibility to acknowledge all amendment within their proposal.
A.11. As stated in 52.212-1(f), proposals and amendments that are late will not be accepted.
B. General Instructions:
B.1. IAW FAR 15.101-2, Lowest price technically acceptable source selection process, the award will be made to a single offeror with the lowest evaluated price that satisfies the minimum requirements for the non-cost factors and is deemed responsible IAW FAR 9.104-1. Proposals will be evaluated using the criteria in FAR Clause 52.212-2, Evaluation – Commercial Items.
B.2. Noncompliance with the RFP requirements may hamper the Government's ability to properly evaluate the offer and may result in elimination of the offer from further consideration for contract award.
B.3. The submission of the documentation specified will constitute the Offeror's acceptance of the terms and conditions of the RFP and contract type.
B.4. Instructions outlined in paragraph C below, prescribe the format for the proposal, and describe the approach for the development and presentation of the proposal data. These instructions are designed to ensure the submission of necessary information to provide for the understanding and comprehensive evaluation of Proposal.
B.5. If an offeror believes that the requirement in these instructions contains an error, ambiguity, omission, or are otherwise deemed unsound, the offeror must immediately notify the KO in writing with supporting rationale. The offeror is reminded that the Government intends to award this effort based on
4 | P a g e the initial proposal, as received.
B.6. The government is not liable for any costs incurred by offerors in submitting Proposal in response to this solicitation. Proposal submitted from unsuccessful offerors shall not be returned to the offeror. In accordance with FAR Subpart 4.8, the Government will retain one copy of all offers and remaining copies will be destroyed by the government. The government will not issue any certification of destruction.

C.2. Proposal Format:
C.2.a. All text must be single spaced. Times New Roman or Arial font required. Text must be a minimum font size11. All text pages must be oriented in portrait. Landscape orientation is acceptable for tables and/or charts if required to properly present the information. Margins must be at least 1 inch on the top and bottom and ¾ inch on the sides. The Offeror must number each page. In the event the Offeror creates an ambiguity in their numbering, the Government may exercise its own discretion on counting pages.
C.2.b. Proposal Limitation:
A page shall be an 8 ½ X 11” sheet of paper. When both sides of a sheet display printed material, it shall be counted as two pages. Foldouts will be counted as the appropriate number of pages based on an 8 ½ X 11” sheet of paper. The contractor shall number each page in order to eliminate any confusion. In the event the contractor creates an ambiguity in numbering of pages, the government may exercise discretion in counting pages.

D. Proposal Content:
D.1. Factor 1: Technical Capability – The technical capability portion must be clear, concise and include sufficient detail for effective evaluation and for substantiating the validity of stated claims in the Offeror’s offer. Legibility, clarity and coherence are very important. The proposal will be evaluated against the technical factors defined in FAR Clause 52.212-2, “Evaluation – Commercial Item”. The proposal should not simply rephrase or restate the Government’s requirements, but rather provide convincing rationale to address how the Offeror intends to meet these requirements. Statements that the Offeror understands, can, or will comply with
5 | P a g e the Performance Work Statement (including referenced publications, technical data, etc.), statements paraphrasing the PWS or parts thereof (including applicable publications, technical data, etc.), and phrases such as “standard procedures will be employed” or “well known techniques will be used” must be considered unacceptable. Offerors must assume that the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the Offeror’s offer. The Offeror must address as specifically as possible the actual methodology used for accomplishing the PWS tasks. The technical capability portion must be organized according to the following general outline:
D.1.a. Subfactor 1 – Technical Experience - Submit offeror’s experience in providing services of similar scope and size as defined in the PWS paragraph 2.1, 2.9.1. and size with an annual value of $1 million or greater. The offeror shall provide no more than three citations of contracts and/or subcontracts, dated three (3) years from the date of receipt of proposals, that clearly demonstrate its technical expertise. Non-Government contracts may be used if Government contracts are not available.
The documentation shall be submitted in the following format:
Contract Number, award date, performance period, and contract type. Denote whether public or private sector project (if public sector, what agency/department).
Project involvement (did company act in capacity as prime or subcontractor).
Price/Cost – original and final (or to date).
Project title with brief description of work performed (to include number of personnel managed by the company and place(s) of performance).
D.1.b. Subfactor 2 - Key Personnel - Offers must demonstrate clearly, and in detail, how each of the key personnel proposed meet the qualifications/experience listed in PWS para. 7.2 and 7.3. Key Personnel shall include the Program Manager, Alternate Project Manager and Crew Leaders (2). The offeror’s proposal shall address its ability to provide key personnel with the appropriate qualifications and experience outlined in PWS para. 7.2 and 7.3. The offeror’s proposal must include: A narrative description of experience/expertise for all key personnel’s qualifications which addresses, at a minimum: education, professional experience, specific experience as it relates to the requirements in the RFP, professional awards and other relevant activities and achievements. For each key person proposed, the offeror shall provide the individual letter of commitment/intent to accept the position if the offeror is awarded the contract.

D.1.c. Subfactor 3 – Management Approach - The offeror shall identify structure and procedures to successfully manage a project of this scope and complexity. The offeror shall demonstrate how it shall address Government concerns/issues with contractor’s performance. The offeror's demonstration shall include reporting timelines, escalation process, lines of communications and the resolution process. The offeror shall propose management control procedures sufficient to ensure minimal interruption of services and management of the contractual functions. Provide equipment list and catalog cut sheets, as required in PWS paragraph 2.8.4., to include year, make and model.
D.2.d. Factor 2: Price – Price will not be rated. Price will be evaluated for reasonableness.
Price shall contain the following: a) Supplies or Services and Price SF1449, Continuation Section shall be submitted fully completed and error free. It shall contain the offeror’s prices for the established Contract Line Item Numbers (CLINs). (b) Failure to propose a price for all CLINs will render the proposal unacceptable and the proposal will be rejected. (c) Offerors should note that the contract is not subject to a Collective Bargaining Agreement and the Wage Determination is included in the solicitation. The offeror shall submit a unit price and estimated net amount for each line item. The offeror shall also provide a unit price and estimated net amount and an estimated total for each period in the SF1449 CLIN schedule. (d) Unit prices shall be represented in two decimal positions only. Example: $0.27, not $0.27458 formulas or external links and be writeable.
D.2.d.i. The offeror must submit a price offer for a fourteen (14) day phase-in, 11-month base period and four

(4) 12 month option periods. All final monetary extensions must be in whole dollars only.
D.3.e. Factor 3: Past Performance – Part IV shall be named “Part IV– PAST PERFORMANCE, RFP W9124D22R0051". This part must contain past performance information regarding similar contracts. Part IV must not exceed 25 pages plus five pages for each major subcontractor. Offerors must submit Government and/or commercial contracts for the prime offeror and each major subcontractor in performance or awarded during the past three years, from the issue date of this RFP, which are relevant to the efforts required by this solicitation. Relevant efforts are defined as services/efforts that are the same as or similar to the effort (as compared to NAICS code 561730 and PSC Code S208) required by the RFP. Data concerning the offeror must be provided first, followed by each proposed major subcontractor, in alphabetical order. The offeror must also submit the written consent of its major subcontractors to allow the disclosure of its subcontractor’s past performance information to the offeror. In addition, letters of commitment must be included for all major subcontractors for their past performance to be considered. Part IV must be organized into the following sections:
(a) Contractor/Subcontractor place of performance, CAGE Code and UNIQUE ENTITY ID Number. If the work was performed as a subcontractor, also provide the name of the prime contractor and POC within the prime contractor organization (name, and current address, e-mail address, and telephone and fax numbers).
(b) Contract Number and, in the case of Indefinite Delivery type contracts, GSA contracts, and Blanket Purchase Agreements, include Delivery Order Numbers.
(c) Awarded price/cost.
(d) Final or projected final price/cost.
(e) Final or projected final, delivery schedule, including dates of start and completion of work.

AMENDMENT 3
a. Industry questions with answers have been incorporated into solicitation.
b. The quarters count are 60 Myer and 27 McNair. CLINs 0002; 1001; 2001; 3001; and 4001 have been corrected and provided herein.
c. “TE” B - Grounds Maintenance” and “TE” C - Snow Removal” for Fort McNair and Fort Myers have been submitted as external documents in conjunction with amendment 0003 submission in SAM.Gov.
d. The PWS has been revised to remove Playground Equipment clean and exchange from 3.0 Work Capability Levels. The revised PWS is provided herein and with revised date 24 Oct 2022.
e. The PWS Attachment 2 Deliverables Schedule: Key Personnel, Quality Control Plan, and Safety Plan has been revised from Paper copies and Hard Copy to Electronic file by e-mail as an MS Word attachment. SEE A.3, on page 3 of the solicitation for electronic submission of documentation to the KO.
Information on the COR will be provided after contract award.
f. Paragraph D.1.a. Subfactor 1- Technical Experience, on page 5 of the solicitation has been revised to read “offeror’s experience in providing services of similar scope and size as defined in the PWS paragraph 2.1, 2.9.1. and size with an annual value of $1 million or greater.”
g. PWS 2.2.14 has been revised as follows:
From: Special Services. The Contractor shall provide additional services as necessary due to unforeseen circumstances, including but not limited to, Very Important Person (VIP) visits, retreats, ribbon cutting ceremonies, and open houses. The Contractor shall provide extra labor and equipment to service pre-identified locations within the High Visibility and Common Areas beyond the normal grounds maintenance. The COR/ACOR will notify the Contractor of unscheduled special service requirements NLT forty-eight (48) hours prior to the event. The COR will provide a list of scheduled events to the contractor a minimum of one week prior to the event. The Contractor shall coordinate special service requirements with the existing grounds maintenance schedule. If the Contractor is required to deviate from their schedule to meet special event requirements, the Contractor shall do so at no additional cost to the government. Upon direction of the COR, the Contractor shall be authorized one duty day or 8 hours to resume their normal operations. Furthermore, the Contractor will not be held accountable for any
7 | P a g e unsatisfactory performance results, on a quality assurance inspection or complaint, due to COR/ACOR-directed schedule change(s), until such point when the Contractor resumes normal operations.
Upon receiving direction from the COR/ACOR, the Contractor shall complete work prior to the event. In the event the Contractor must deviate from their schedule to meet special event requirements, the Contractor shall do so at no additional cost to the Government. The Contractor shall be authorized/entitled one (1) additional duty day to return to their normal operations. Furthermore, the Contractor will not be held accountable for any unsatisfactory performance results, on a quality assurance inspection or complaint, due to KO-directed schedule change(s), until such point when the Contractor resumes normal operations.
TO: Special Services. The Contractor shall ensure all materials used follow local procedures and is acceptable to the COR. The allowable amount of material passing a No. 200 sieve as determined by the American Association of State Highway and Transportation Officials (AASHTO) -T11, Standard Method of Test for Materials Finer Than 75-μm (No.200) in Mineral Aggregates by Washing, shall not exceed 10% by weight. The maximum particle size for sand borrow shall be M1.04.0 Type A, one fourth inch (¼”). No other materials shall be used without the COR/ACOR authorization. The Contractor shall maintain and stockpile enough pet friendly ice melt to last through the winter season.

From: Ice Control Abrasives. The Contractor shall apply abrasives for ice control as directed by the COR.
Abrasives shall consist of salt which shall be treated with an Environmentally Preferred Product (EPP). The application shall be a complete coverage of the designated roads, parking area and sidewalks
To: Ice Control Abrasives (salt/sand). The government will provide salt for contractor’s use under this contract. The Contractor shall apply abrasives for ice control as directed by the COR. The application shall be a complete coverage of the designated roads, parking area and sidewalks. Sand shall not be utilized, unless authorized by the government.
j. All other Terms and Conditions remain unchanged.

Q.5. Please define what is expected with “additional services”.
A. Per PWS 2.2.14, Out of cycle grounds maintenance is defined as additional services (e.g., area beautification for special ceremonies).
Q.6. Pavement Clearance Services shall commence during the winter season in accordance with (IAW) the installation’s Snow and Ice Removal Plan Technical Exhibit (TE B).” Where is the location of the “TE B” in the document? If not provided, please provide attachment.
A. “TE B - Grounds Maintenance” and “TE C - Snow Removal” for Fort McNair and Fort Myers have been submitted as external documents in conjunction with amendment 0003 submission in SAM.Gov.
Q.7. “The Contractor shall apply commercial, N-P-K granular fertilizer and pulverized agricultural lime to High Visibility Areas.” Can you define “High Visibility Areas”?
A. See PWS definition para 15.8 High Visibility Areas.
Q.8. Is there a map and inventory of the current dead and/or dying trees? If not, is the contractor responsible for existing conditions?

A. There is no map or inventory of dead and/or dying trees. These services will be performed in accordance with the PWS, paragraphs 2.2.9.5 and 2.2.10.3.
Q.9. Can you define the exact type of maintenance required? This would include grass cutting, rake baseball fields, adding clay to infield, and marking (IE Painting lines on baseball fields).
A. Required maintenance for this action is reflected in the PWS paragraph 3.0 Work Capability Levels Table, JBMHH and AFH Capabilities identified in the column heading. Painting of baseball fields is not required.
Q.10. Please define added details to the service? IE: Weed Control on Turf A. PWS Para 2.2.7 specifies the application of herbicides to High Visibility Areas in order to control weeds. Refer to PWS paragraph 3.0 Work Capability Levels for additional details.
Q.11. Will a map be provided as per “TE” C?
A. “TE” C – snow removal has been submitted with Amendment 0003.
Q.12. Will the snow removal be based per pass to perform the service required, or a price for the whole storm?

Q.13. Work capabilities, under hedges, there is no frequency for AFH. Can the frequency be provided under hedges?
A. See PWS paragraph 3.0 Work Capabilities Level, frequency has been provided.
Q.14. Playground Equipment, Clean / Exchange: Can you clarify more of the requirements?
A. The PWS has been revised to remove Playground Equipment clean and exchange from 3.0 Work Capability Levels. The revised PWS is provided herein and with revised date 31 Oct 2022.
Q.15. Attachment 2 table lists these as hard copy deliverables. Please confirm that these to need to be submitted as paper copies. If so, to what address should these be sent to via mail? What is the deadline for receipt? Should we also include in our electronic submission? If so, please specify location where we should include them.

The PWS Attachment 2 Deliverables Schedule: Key Personnel, Quality Control Plan, and Safety Plan has been revised from Paper copies and Hard Copy to Electronic file by e-mail as an MS Word attachment. Q.16. a. The $4 million is that an aggregate of all contracts or is this to mean that each contract’s annual value is $4 million or greater? Please note that this solicitation is set-aside for small businesses with a maximum average sale of $8,500,000.00. We do not know of any Government individual grounds maintenance contracts that have an annual value in excess of $2,500,000.00.
b. Will the Government consider contracts that have only grounds maintenance (PWS paragraph 2.1) if the contractor has other contracts that have both grounds maintenance (PWS paragraph 2.1) and snow removal (PWS paragraph 2.9.1) and in aggregate exceed the $4 million threshold?

A. Place of performance is identified in PWS paragraph 6.0, JBMHH consists of Fort Myer, Fort McNair and Henderson Hall. Army family Housing Quarters on JBMHH are to be included in JBMHH services.

A. Yes, in accordance with Army Regulations and any applicable installation regulations in operating a motor vehicle.
Q.44. RTV Kubota Operators required to have valid driver’s licenses?
A. Refer PWS para 7.5. Yes, a Valid Driver’s License is required.
Q.45. Can we store Sand and Salt on both installations?
A. The government will provide the salt necessary for this requirement. Contractor shall provide a pe-friendly ice melt for sidewalk areas. Refer to PWS paragraphs 2.9.14 and 2.9.15. The pet-friendly ice melt may be stored on both installations.
Q.46. Are we required to wear uniforms on the installation?
A. Refer to PWS para 7.3 and 7.4
Q.47. Parade field mowing. On the site visit, it was mentioned that if we mow on Tuesday and the Command may request a second mowing just prior to a ceremony we should comply. How do we invoice for this additional work since this is a height requirement contract?
A. PWS para 2.2.14 stipulates that additional services may be required for some ceremonies. This will be invoiced under the CLINs titled Special Services.
Q.48. Parking is obviously a premium on these installations. What is our parking protocol? Can we park on the grass? Can we double park? We’ll have trucks and trailers to park.
A. No parking on grass and no double parking. Refer to Q.18 for the lay down areas.
Q.49. Is the contractor required to haul snow off the post? Or are we required to push into a pile on the location being cleared?

Addendum to FAR Provision 52.212-2, Evaluation-Commercial Items
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award must be made to a single Offeror who is deemed responsible in accordance with the FAR, whose proposal is evaluated by an overall assessment of the evaluation criteria, other considerations specified in this solicitation and represents the Lowest Price Technically Acceptable (LPTA) offer. To be considered technically acceptable and eligible for award of the resulting contract, all factors and subfactors must receive an acceptable rating. The following factors must be used to evaluate proposals:
Factor 1 will receive one of the adjectival ratings defined below. The subfactor will not be rated separately but they will be considered in the rating for Factor 1. A rating of “Acceptable” in all factors must be achieved for
15 | P a g e an Offeror to be considered for award. Offers/Offerors receiving a rating of “Unacceptable” for any factors will not be considered for award.
Factor 1: Technical Capability – The Government will evaluate the management and technical approach to assess the staffing mix and resource allocation (including any subcontractors). The proposed management and technical approach that meets the capability to achieve each performance objective and standard that reflects the best industry and/or commercial practices, standards, and procedures for all specific tasks identified in the PWS will be rated acceptable.
Subfactor 1. Technical Experience: The Government will evaluate the offer to assess the offeror’s demonstrated experience on projects similar in scope as defined in the PWS paragraph 2.1 and 2.9.1.
Offerors may demonstrate specific individual experience in Key Personnel categories outside the three (3) listed in this section provided that they are relevant to the scope and complexity of the JBMHH requirement.
Subfactor 2. Key Personnel: The Government will evaluate that the offeror has met the qualifications/experience listed in paragraph 7.1, 7.2, and 7.3.
Project Manager – Minimum two years of college-level training in horticulture or agronomy or a minimum of 5 years equivalent technical training and experience with large commercial type facilities may be substituted for college - level training. The Project Manager must be an agent of the Contractor; must have expressed authority to obligate the contractor to perform various tasks as specified in this performance work statement (PWS). The Project Manager must be able to read, write, speak, and understand English.
Alternate Project Manager - Minimum two years of college-level training in horticulture or agronomy or a minimum of 5 years equivalent technical training and experience with large commercial type facilities may be substituted for college- level training. The Alternate Project Manager must be an agent of the Contractor; must have expressed authority to obligate the contractor to perform various tasks as specified in this performance work statement (PWS). The Alternate Project Manager must be able to read, write, speak, and understand English.
Crew Leaders - Minimum two years’ experience in horticulture or agronomy or a minimum of 3 years equivalent technical training and experience with large commercial type facilities may be substituted for college- level training. The contractor must provide to the KO written certification that the onsite Crew Leaders have this experience notated in the technical proposal and utilizing the equipment requirements listed IAW PWS 2.8. The Crew Leaders must be able to read, write, speak, and understand English.
Subfactor 3. Management Approach: The Government will evaluate that the offeror has identified the structure and procedures to successfully manage a project of this scope and complexity. In addition, has equipment necessary to perform a project of this size.
Factor 2: Price – Price will not be rated. Price will be evaluated to determine if the offeror’s proposed price is fair, reasonable, and balanced utilizing price analysis techniques in accordance with the guidelines in FAR 15.404, Proposal Analysis. Reasonableness is defined as, a price is reasonable if, in its nature and amount it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.
Unbalanced is defined as, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by application of cost or price analysis techniques.
Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Factor 3: Past Performance – The government will evaluate the offeror’s Part IV Report to ensure they have satisfactory performance in the Contract Performance Assessment Reporting System (CPARS) on the contracts that they have identified. Should no past performance exist in CPARS, the offeror will be rated as neutral and considered acceptable.
Factor 3 will receive one of the ratings defined below.
Rating Description
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options must not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The purpose of this site-visit is to improve potential offerors’ understanding of Government requirements, thereby allowing potential offerors to judge whether or how they can satisfy the Government’s requirement. This site-visit also enhances the Government’s ability to obtain quality services at reasonable prices and increase efficiency in proposal preparation, proposal evaluation, negotiation, and contract award.

Instructions: Attendees will have a sign in sheet to fill out prior to the commencement of the site-visit. Any contractors not at the designated site at the designated time (10:00am promptly) will not be allowed to attend the site visit. The site visit will be a tour of the grounds at multiple locations as identified in the solicitation.
Absolutely no questions will be allowed during the site visit. All questions shall be submitted in writing via email to the Ft Knox POC.
