SECTION M - EVALUATION FACTORS FOR AWARD
The following were previously included by reference and are now included by full text:
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation and Lowest Price Technically Acceptable (LPTA). The following factors shall be used to evaluate offers:
1. Adjectival Ratings
1. The adjectival ratings to be utilized for proposal evaluations are consistent with the DoD Source Selection Procedures and the Army Source Selection Supplement (AS3). A single rating system will be used to evaluate the Technical Acceptability (to include Subfactor 2 as indicated below). Price will be evaluated for reasonableness, balance, and price realism if necessary, and will not receive an adjectival rating.
Technical Acceptable/Unacceptable Ratings Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
2. Evaluation Criteria
1. Evaluation criteria consist of two (2) factors and two (2) subfactor. The proposals will be evaluated under the following evaluation factors:
Factor 1: Technical Capability
SubFactor 1: Resources
SubFactor 2: Relevant work
Factor 2: Price
Evaluation Factors.
(1) Factor 1 – Technical Capability. The Technical Capability Factor evaluation provides an assessment of the offeror‘s capability to satisfy the Government‘s minimum requirements. The Government will evaluate the contractor‘s technical proposal to ensure that it reflects a sound understanding of this requirement.
(a) Subfactor 1: Resources: The Contractor shall demonstrate that they have the necessary resources to support the magnitude of work identified in the PWS. Specifically, does the contractor have the quantity of portable toilets, personnel and vehicles in-house or outsourced that are required to successfully execute performance of the contract.
(b) Subfactor 2: Relevant work: Has the contractor performed this type of work at another DoD installation or at another location that has a similar volume of pots/units needed to be maintained.
(2) Factor 2 – Price. The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 13.106-3(a) will be the primary means of assessing price for commercial items to determine price reasonableness. To be viable for award, an Offeror’s price must be determined fair and reasonable. The Offeror’s total proposed price will be utilized to evaluate if the proposal represents a fair and reasonable price. The total evaluated price includes the price of the base period, and all option periods (to include the option to extend services in accordance with FAR 52.217-8). The Government may conduct a price realism analysis if the Contracting Officer determines it necessary to determine a fair and reasonable price or a competitive range.
a) Professional Compensation: As part of the evaluation of price, the Government will evaluate professional compensation, to include salary and benefits, in accordance with FAR 52.222-46, Evaluation of Compensation for Professional Employees. The Government is concerned with the quality and stability of the work force under this contract. As such, professional compensation that is unrealistically low may be viewed as evidence of failure to comprehend the complexity of the contract requirements; thus the price proposal may be deemed Not fair and reasonable and no longer considered for award.
b) Options: The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, and 1/2 of the 2nd option. Offerors are not required to enter a price for the six-month period.
c) Total Evaluated Price (TEP): The TEP to be used for the determination of price reasonableness will be calculated as follows: The sum of all CLINs (to include the travel plug figure), the base period, first option period, second option period, and ½ of the second option period price as an evaluation of potential pricing under FAR Clause 52.217-8.
d) Unbalanced Pricing: Unbalanced pricing will be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
